Gagasan modernisasi koperasi bukan hal baru, gagasan ini muncul seiring dengan tuntutan globalisasi ekonomi yang menuntut peran koperasi untuk dapat bersaing dalam pertarungan pasar bebas. Namun nampaknya, hingga saat ini pemerintah belum menemukan formula yang jitu untuk mendongkrak koperasi di Indonesia agar mampu bersaing. Modernisasi koperasi dapat dilakukan dengan mengacu para aspek-aspek dalam koperasi yaitu dalam hal kelembagaan, usaha, dan permodalan koperasi. Modernisasi usaha mutlak harus dibarengi dengan digitalisasi. Modernisasi koperasi tidak akan berhasil hanya dengan mempermudah izin pendirian dan izin usaha koperasi semata, dalam pada itu sinergitas antar element yang tekait dengan koperasi termasuk didalamnya quadruple helix (pemerintah, masyarakat, perguruan tinggi dan dunia usaha) harus turut menumbuhkan usaha usaha koperasi. Tantangan modernisasi koperasi ada pada pola hubungan koperasi dan pemerintah. Dalam era globalisasi bersaingan bebas fase hubungan koperasi dan pemerintah sudah tidak bisa lagi berada pada fase officialisasi tetapi sudah harus pada fase otonom. Kebijakan-kebijakan modernisasi era omnibus law harus didasarkan pada semangat menumbuhkan kesadaran berkoperasi dengan kualitas sember daya manusia yang mumpuni, semangat sinergitas usaha koperasi dengan entitas bisnis lainnya dan semangat otonomi koperasi dengan meminimalisasi unsur-unsur politik - kekuasaan dalam pengembangan koperasi.

Law No.37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations Article 2 paragraph (1) has determined that a debtor who has two or more Creditors and does not pay in full at least one debt that has matured and is collectible, is declared bankrupt by verdict Court, either at the request of one or more creditors. With this provision, it can be understood that bankruptcy is a reasonable choice. However, several opinions of bankruptcy law have not provided sufficient protection to debtors with good intentions. This article intends to find out more about the implementation of the reorganization of debtor companies whether it can be used as an alternative so that the debtor company does not go bankrupt. The method used is normative legal research. Data sources consist of primary legal materials, secondary legal materials, and tertiary legal materials. Based on the results of the research, it is known that the regulations regarding company reorganization have not been clearly and firmly regulated in Law Number 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations, Reorganization is part of the restructuring, bankruptcy can be avoided through a business reorganization in the form of mergers, consolidations. , business acquisitions, and other forms. This bankruptcy law also does not provide sufficient protection to debtors with good intentions, because there has been a tendency to interpret bankruptcy as liquidation. However, it must be understood that bankruptcy should also be a means of reorganizing the company. The legal consequence of company reorganization on the settlement of the company's debt and accounts receivable is that there is an opportunity for creditors and debtors to settle their debts without going through a bankruptcy process which can result in the debtor being declared bankrupt.

The border region is the front territory of the country jurisdiction and posses an important role in the matter of enforcement of national law sovereignty. Sebatik Island owned by two countries, Indonesia and Malaysia. Demarcation of territorial boundaries in Sebatik Island refers to Memorandum of Understanding between the Government of Malaysia and the Government of the Republic of Indonesia regarding Surveys and Demarcation of the Border Line of 1973 which is followed up with the results of a joint Surveys and Demarcation on the island of Borneo poured in the form of an advanced Memorandum of Understanding containing each boundary point which has been agreed upon.From 1973 to 2017 there are 9 (nine) points of Outstanding Boundary Problem (OBP) on Sebatik Island that have not been agreed by both countries. The boundary disputes have led to unclear legal status of Sebatik Island's land border territory within the framework of international treaty law and also led to the uncertainty of the status of the MoU as the legal basis for the determination of state borders between Indonesia and Malaysia on Sebatik Island.This law research questioning two issue. First, what factors make the border region not yet regulated by international agreements on borders. Second, how the legal status of the 1973 Memorandum of Understanding in stipulate the point of demarcation between Indonesia and Malaysia in the perspective of international treaty law. Based on the research, the factor that caused the border area not yet been regulated by a definitive border agreement is the disparity of reference between Indonesia and Malaysia to determining the land boundary in Sebatik Island. Indonesia uses the provisions of 4o 10 'LU degree while Malaysia uses existing pillar references. This dispute involve the overlap of the Sebatik Island border area from both countries. Thus, the legal status of the 1973 Memorandum of Understanding has not been binding as law either in national law or as an agreement in international law.

Amendemen konstitusi merupakan suatu keniscayaan untuk dilaksanakan. Wacana amendemen kelima menjadi suatu perhatian khusus untuk dicermati dengan baik. Beragam isu penting menjadi topik yang akan menjadi objek amendemen. Proses amendemen sebelumnya mendapatkan kritik terkait kepentinggan politik yang mempengaruhi hasil amendemen. Hal itu menjadi dasar pelaksanaan amendemen selanjutnya harus melalui prosedur yang baik dan sesuai dengan prinsip negara hukum. Demokrasi deliberatif menjadi konsep yang penting dalam proses amendemen konstitusi. Hal itu dikarenakan demokrasi deliberatif dianggap dapat mengakomodir segala kepentingan elemen masyarakat. Prinsip demokrasi deliberatif memberikan ruang terhadap titik temu antara pengambil keputusan dan masyarakat. Konsep yang lebih terbuka juga menjadi hal penting dalam pelaksanaan teori demokrasi deliberatif. Dengan begitu, konsep amendemen konstitusi dapat dilakukan dengan baik dan sesuai dengan arah tujuan masyarakat bukan golongan tertentu. Demokrasi deliberatif menyatukan berbagai kepentingan yang timbul dalam masyarakat Indonesia yang heterogen. Hal tersebut akan menghasilkan konstitusi dari musyawarah yang baik bukan dipaksakan. Konsep yang mengelaborasi sistem keterwakilan dengan proses yang memberikan ruang publik untuk terlibat dan berpartisipasi ini akan menjadi sebuah ikhtiar dalam mewujudkan konstitusi yang diharapkan semua warga negara.

Tindak pidana pencucian uang terdapat karakteristik khusus yang membedakan dengan tindak pidana. Tindak pidana pencucian uang merupakan follow up crime, sedangkan hasil kejahatan yang diproses pencucian uang disebut sebagai predicate offence. Predicate crime dalam Undang-Undang Nomor 8 Tahun 2010 tentang Pencegahan dan Pemberantasan Tindak Pidana Pencucian Uang menggunakan pendekatan follow the money dan follow the suspect berdasarkan teori hukum guna memastikan adanya tindak pidana pencucian uang. Cara efektif dalam memberantas tindak pidana pencucin uang dengan menyamakan persepsi dan kerjasama aparat penegak hukum dalam menggunakan pendekatan follow the money sebagai pelengkap pendekatan follow the suspect untuk memperoleh hasil yang maksimal dalam pemberantasan tindak pidana pencucian uang.

Penelitian ini bertujuan untuk mengetahui tentang diskresi dari sudut pandang hukum administrasi negara dan hukum pidana serta menganalisa apa penyebab kriminalisasi kebijakan atau diskresi yang dikeluarkan oleh penyelenggara negara. Penelitian ini adalah penelitian normatif dalam penelitian ini yang menjadi alat utama pengumpulan data, berupa studi dokumen atau studi kepustakaan. di dalam penelitian ini pengumpulan data dilakukan dengan metode studi kepustakaan. Hasil penelitian ditemukan bahwa ada perbedaan sudut pandang antara hukum administrasi negara dan hukum pidana mengenai diskresi. Di dalam hukum administrasi negara, diskresi merupakan kebebasan bertindak atau kebebasan mengambil keputusan dari Badan atau Pejabat administrasi pemerintahan menurut pendapatnya sendiri, sedangkan dari sudut pandang hukum pidana, diskresi dianggap sebagai sebuah sudut yang menggoda atau disebut sebagai power seduction, bagi para penguasa dalam menjalankan kekuasaaannya. Kekuasaan yang dimaksud adalah kekuasaan untuk menggunakan kewenangan berdasarkan kreatifitas pejabat tersebut. Kemudian Diskresi dapat menjadi sebuah perbuatan melawan hukum dalam hukum pidana. Hal tersebut dapat terjadi Ketika diskresi tersebut mengakibatkan kerugian negara, sekalipun sebenarnya niat awal dari dilakukannya diskresi tersebut bertujuan untuk mengisi kekosongan aturan dan menyelesaikan permasalahan yang ada Ketika menjabat, bukan untuk keuntungan diri sendiri atau orang lain. Kemudian dari penelitan diketahui bahwa kriminalisasi kebijakan, atau diskresi yang gagal kemudian menjadi tindak pidana korupsi, disebabkan oleh adanya kekeliruan pemahaman dalam memaknai unsur melawan hukum sebagai genuus delict dan menyalahgunakan kewenangan sebagai species delict, Kurang cermatnya para penegak hukum dalam memahami dan membedakan antara ruang lingkup hukum administratif dan hukum pidana inilah yang menurut penulis menyebabkan hal ini terjadi.

The Indonesian government seeks to boost the Indonesian economy by facilitating foreign investment in Indonesia, which is realized through the enactment of the Omnibus Law on Job Creation Number 11/2020 and the Revision of the Mineral and Coal Mining Law Number 3/2020, both of which aim to legitimate investment in Indonesia in terms of natural resource management and to improve the welfare of the Indonesian people through the creation of jobs from these investments. However, those two legislations also pose several potential threats to indigenous peoples in the form of expropriation of their customary territories. This is further worsened by the absence of a special act on the fulfillment, recognition and protection of indigenous peoples and their rights, which lead to exacerbate the structural agrarian conflicts between the government, corporations/investors and indigenous peoples that would further impose expensive conflict resolution costs and threaten the investment itself. The urgency of the enactment of the Indigenous Peoples Bill is an absolute necessity to provide legal certainty for the protection of indigenous peoples in the midst of high investment aggression, as well as to the investors themselves.

Tanah Tongkonan merupakan bentuk perwujudan tanah milik masyarakat hukum adat yang ikut serta dalam program pendaftaran tanah sistematis lengkap (PTSL) yang diselenggarakan oleh Badan Pertanahan Nasional Kabupaten Toraja Utara berdasarkan Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Nomor 6 Tahun 2018 Tentang Pendaftaran Tanah Sitematis Lengkap (PTSL), hal berikut menunjukan sangatb bertentangan dengan Peraturan Pemerintah Nomor 24 Tahun 1997 yang memiliki isi mengenai Pendaftaran Tanah. Penelitian yang dilaksanakan bertujuan dalam menganalisis bentuk Pendaftaran Tanah Sistematis Lengkap (PTSL) terhadap tanah tongkonan. Penelitian ini menggunakan metode penelitian yang bersifat empiris, dengan menganalisis data yang terkumpul dengan sarana wawancara dan studi kepustakaan. Tinjauan mengenai hasil yang didapat pada penelitian ini memberikan petunjuk bahwa, apabila tanah tongkonan di daftarkan melalui program pendaftaran tanah sistematis lengkap (PTSL) akan menimbulkan berbagai permasalahan terutama yang berwenang sebagai pemegang sertifikat hak atas tanah tongkonan, dan kemudian pemberian hak melalui penerbitan sertifikat bertentangan dengan semangat dari Undang-Undang Nomor 5 Tahun 1960 Tentang Peraturan Dasar Pokok Agraria (UUPA).

Local wisdom becomes the full authority of the Regency/City Government as clearly stated in the Table of Division of Authority for the Sub-Division of Local Wisdom Based on Law no. 23 of 2014 concerning Regional Government. Therefore, it is very necessary to know the urgency of the integration of local wisdom related to environmental conservation in the Bangka Belitung Islands. This study uses a socio-legal approach, namely the object of research remains in the form of law, namely laws and regulations related to local wisdom and the environment with the use of methods and theories of social sciences to assist researchers in conducting analysis. Local Wisdom is very important to be integrated in regional policies related to environmental conservation because there is a reciprocal relationship between humans and nature, where people who pay attention to local wisdom related to the environment always place the balance of nature in environmental management and must be accepted or approved, which means that the regulation gets recognition. legitimacy) from the community because it comes from local wisdom that lives in the community.

Sea sand mining has a significant impact on fishermen who have fishing areas in Spermonde Waters. The purpose of this study is to see the impact of sea sand mining on the rights of fishermen who daily catch fish around the Spermonde Waters which are the location of sand mining. This research method is a qualitative method using data collection techniques in the form of, (1) literature review, to examine related policies; (2) Interview, to get related information; and (3) observation. The result of the research is that there are changes in the marine environment ecosystem due to this mining. The dredging of sea sand causes the sea water to become cloudy, resulting in reduced fish catches in the area. The occurrence of economic degradation of the community, especially fishermen, before and after mining occurs so that it violates the rights of fishermen that have been mandated in the law.
