The notion of Japan as a homogeneous society has been challenged by many recent studies. In fact, Japan is a home to different minority groups, ethnic and non-ethnic. Although the percentage of resident foreigners is relatively low comparing to other countries, acts of racial discrimination against them occur in everyday life in Japan. Thus, this study discusses how the foreigners are treated in Japan, and therefore tends to answer the question whether the legislation exists in order to protect their rights and penalize discriminatory activities committed by citizens or organizations. The study reveals that although Japan signed the UN Convention on the Elimination of Racial Discrimination (CERD), the problem of racial discrimination against foreign nationals still remains considerable. There are many reported incidents of human rights violation and discrimination practice against foreigners among individuals due to differences in language, religion, custom and appearance as well. Some of the cases handled by the human rights organs of the Ministry of Justice include the refusals of apartment rental or entrance to a public swimming pool on the grounds of being a foreigner. The study suggests that Japan should introduce new legislation to combat discrimination. === Pendapat yang menyatakan bahwa Jepang adalah masyarakat homogen telah dibantah oleh banyak penelitian. Kenyataannya, Jepang adalah rumah bagi berbagai kelompok minoritas, etnis dan non etnis yang berbeda-beda. Meskipun persentase orang asing relatif rendah dibandingkan dengan negara lainnya, tindakan diskriminasi rasial terjadi dalam kehidupan sehari-hari di Jepang. Oleh karena itu, studi ini membahas bagaimana perlakuan terhadap orang asing di Jepang dan menjawab pertanyaan apakah peraturan perundang-undangan yang ada mampu memberikan perlindungan hak dan menindak kegiatan diskriminasi yang dilakukan oleh warga masyarakat dan organisasi. Studi ini mengungkapkan bahwa meskipun Jepang telah menandatangani Konvensi PBB tentang Penghapusan Diskriminasi Rasial, permasalahan diskriminasi rasial terhadap warga negara asing masih sering terjadi. Berbagai peristiwa telah dilaporkan terkait pelanggaran hak asasi manusia dan praktek diskriminasi terhadap orang asing yang disebabkan karena perbedaan bahasa, agama, kebiasaan dan juga penampilan. Beberapa dari kasus tersebut ditangani oleh badan hak asasi manusia dari Kementerian Kehakiman termasuk penolakan penyewaan apartemen atau larangan masuk ke tempat permandian umum bagi orang asing. Studi ini menyarankan agar Jepang menerbitkan hukum yang baru yang menentang diskriminasi.

In accordance with Law No. 12 of 1995 concerning correctional facilities, that prisoners have the right to get a reduction in criminal time (remission), get the opportunity to assimilate, get leave before free. However, after the amendment to regulations regarding the conditions for granting prisoners rights contained in Government Regulation No. 99 of 2012, there was a tightening of the conditions for granting rights to prisoners, one of which was a narcotics case. The main problem in this research is why Narcotics Criminal Prisoners in Batam Class IIA Detention Center have difficulty obtaining their rights contained in Article 14 Paragraph 1 of Law No.12 of 1995 concerning Corrections, and what are the factors and constraints for narcotics inmates in Batam Class IIA Detention Center to get their rights.

This Study examines whether the Multi-year Development has been implemented effectively and efficiently on the Development Multi-year Activities between the Government of Riau Islands Province with PT. Nindya Karya. It also analyzes and finds the best solution for the effective implementation of Local Regulation. Data was collected through interviews. Research method used in this study was a socio-legal method. It found that there is a dualism or disharmony in the implementation of the multi-year activities arising from the Regulation No.14 of 2007 and the Work Agreement. This causes the Regional Regulation No. 14 of 2007 invalid and inefficient. It is suggested that the preparation of legal products should be harmonized with other laws. === Penelitian ini bertujuan untuk menganalisis apakah Pembangunan Tahun Jamak telah diterapkan secara efektif dan efisien pada Kegiatan Pembangunan Tahun Jamak antara Pemerintah Provinsi Kepulauan Riau dengan PT. Nindya Karya. Penelitian ini juga menganalisis dan menemukan solusi terbaik agar Peraturan Daerah dapat berlaku efektif dalam penerapannya, Pengumpulan data dilakukan dengan wawancara. Metode yang digunakan dalam penelitian ini yaitu metode Yuridis Sosiologis. Penelitian ini mengungkapkan bahwa terjadi dualisme atau disharmonisasi dalam pelaksanaan pekerjaan tahun jamak yang disebabkan oleh Perda No. 14 Tahun 2007 dan Perjanjian Pelaksana Pekerjaan. Hal ini menyebabkan Perda No. 14 tahun 2007 menjadi tidak valid dan tidak efisien. Oleh karena itu dalam penyusunan produk hukum harus dilakukan harmonisasi dengan produk-produk hukum lainnya.

Indonesia is a country rich in biological natural resources which is spread throughout the region, including the Riau Islands Province. Geographical location surrounded by almost 90% (ninety percent) of the sea area, it indirectly indicates the potential of Geographical Indications that are spread in 7 (seven) districts/ cities in Riau Islands. Directorate General of Intellectual Property through the Regional Office of the Ministry of Law and Human Rights has committed to continue to explore the IG potential in each region determined through the Annual Performance Target. IG legal protection can only be given if an item or product has been registered, for example "Sagu Lingga" which has just been declared as one of the IG products. The registration of “Sagu Lingga” is inseparable from the role of the Regional Office of the Ministry of Law and Human Rights of the Riau Islands in collaboration with the Lingga Regency Government and Indonesian Sagu Empowerment Association of Lingga. From the results of research in the field, in an effort to register potential IG Products in Riau Islands Province, the Role of the Kemenkumham Kepri Regional Office since the enactment of Law Number 20 of 2016 concerning Trademarks and Geographical Indications has not been running optimally, where the form of efforts carried out is still limited to inventory, coordination with local governments and supervision of IG products. This is caused by the existence of several constraints caused by several factors including Legal Factors, Law Enforcement Factors, Means and Infrastructure Factors, Community Factors and also Cultural Factors. Whereas the IG registration effort should aim to establish legal certainty and increase the economic value of a product that has an impact on the welfare of the community. This is what then makes researcher interested in pouring it in the form of research. All information was carried out by unstructured interviews, observations and document studies where sample selection was carried out using the purposive sampling method. The research method used is a sociological juridical research method.

Posisi wilayah Republik Indonesia yang strategis menjadikan Indonesia sebagai titik transit (bahkan terdapat indikasi yang mengarah menjadi tempat tujuan) yang menjanjikan bagi para imigran ilegal untuk menuju negara ketiga (khususnya Australia). Bahwa permasalahan pengungsi bukan sekedar isu, sehingga permasalahan ini perlu ditangani secara serius dan terencana bersama-sama antar instansi terkait. Kantor Wilayah Kementerian hukum dan HAM Kepulauan Riau sebagai salah satu Instansi yang memiliki fungsi utama dalam penanganan pengungsi. Penelitian ini bertujuan untuk mendeskripsikan fungsi Kantor Wilayah Kementerian Hukum dan HAM Kepulaun Riau terhadap penanganan pengungsi berdasarkan perspektif Hukum Keimigrasian. Penelitian ini menggunakan metode penelitian hukum sosiologis untuk memberikan rekomendasi kepada Kantor Wilayah Kementerian Hukum dan HAM Kepulauan Riau terhadap penanganan Pengungsi dalam perspektif Hukum Keimigrasian.

Brand (Trademark) as an Intellectual Property Rights is a sign to identify the origin of goods and services from a company with goods and/or services of other companies. Brand is the spearhead of trade in goods and services. Through brands, entrepreneurs can maintain and guarantee the quality of goods and/or services produced and prevent dishonest acts of competition (consequences) from other entrepreneurs with the intention of aggravating brand image and reputation. Branding as a means of marketing and advertising provide a certain level of information to consumers about the goods and/or services produced by the company. The purpose of this study is to outline the legal protection for Indonesian entrepreneurs, especially in the City of Batam, who often import raw materials products, and the implementation of Law No. 15 of 2001 on Trademarks. The data is gathered through conducting interviews and field observations focusing on the case study of ‘Taman Teh Wangi’, who registered their products with the trademark 'Cha Shen‘. Based on this research, it is concluded that the protection of the Law for imported goods is similar or equivalent to Indonesian company (locally-produced goods). This is in accordance to the theory put forward by Philpus M.Hadjon. Law No. 15 of 2001 on Trademark remains ambiguous on the brands that are allowed to register under the Intellectual Property Rights. === Merek (Trademark) sebagai Hak Atas Kekayaan Intelektual pada dasarnya ialah tanda untuk mengidentifikasi asal barang dan jasa dari suatu perusahaan dengan barang dan/atau jasa perusahaan lain. Merek merupakan ujung tombak perdagangan barang dan jasa. Melalui Merek, pengusaha dapat menjaga dan memberikan jaminan akan kualitas barang dan/atau jasa yang dihasilkan dan mencegah tindakan persaingan (konsekuensi) yang tidak jujur dari pengusaha lain yang beritikad buruk yang bermaksud membonceng reputasinya. Merek sebagai sarana pemasaran dan periklana) memberikan suatu tingkat informasi tertentu kepada konsumen mengenai barang dan/atau jasa-jasa yang dihasilkan pengusaha.Tujuan penelitian ini adalah untuk menguraikan perlindungan hukum bagi pengusaha Indonesia terutama di kota Batam yang mengimpor bahan baku produknya dari Luar negeri.,serta penerapan Undang-Undang Nomor 15 Tahun 2001 Tentang Merek. Pengumpulan data dilakukan secara wawancara dan observasi lapangan dengan studi kasus Toko Taman Teh Wangi yang mendaftar produknya dengan merek cap ‘Cha Shen”. Berdasarkan hasil penelitian, perlindungan Hukum yang didapatkan oleh pegusaha indonesia setara atau sama (Produk berbahan baku lokal dan non-lokal) dan sesuai dengan Teori Pelindungan yang dikemukakan oleh Philpus M. Hadjon. Undang-Undang Nomor 15 Tahun 2001 Tentang Merek belum mengatur terlalu dalam mengenai Merek yang diperbolehkan untuk pendadtaran Hak Merek.

The 1945 Constitution of Republic of Indonesia states that it is mandatory for government to ensure all of citizen life and well-being in any conditions and to protect them. This mandate take its concrete form by constructing the relevant National Development Plan. The government responsibility in disaster management is in the hands of central and local government—it is supposedly in well-planned and integrated manner. However, in reality, there is still a lot of overlapping authority and bureaucracy from both the central and local or regional governments in disaster management. The harmonization is needed between the central and regional governments, with the basis of granting the widest possible autonomy within the framework of a unitary state. The purpose of this research is to identify the central and regional relationship arrangements in disaster management in the prevailing regulations and to identify steps that must be taken to realize the harmonization of regulation arrangement between the central government and the regions in disaster management. This research is a normative juridical research and uses a basic, systematic approach and the law synchronization approach. From this paper, it is found that the legal politics of central and regional relations in the planning document have been designed to always be synchronous and consistent and have a high level of harmonization, but in the implementation stage it still needs to be reviewed because there are still disharmony caused by the lack of involvement of local governments as partners and communication between the central government and the local government.

Abstract The purpose of this research is to analyze and to find the implementation and implication of special systematical principle (lex specialis systematic) in cases of violations of the law committed by telecommunication corporations. This research uses the legal normative approach. It is a research method conducted by analyzing secondary data and utilizing a analytical descriptive. Based on the results of the analysis, it was found that the implementation of Anti-Corruption law in this regard is less precise. This kind of offense should fall under the Telecommunication law because the subject, object, and cause and effect of the violation are governed heavily by Telecommunication law. And the legal implications of the implementation of the Anti-Corruption Law generates legal uncertainty in law enforcement. This research offers a solution by fabricating a technical guideline in the enforcement of lex specialis systematic for the laws that contain the said special characteristic as a handbook when confronted by cases that hold the potential falling under several laws.

The dependency on imports may increase the risk of the spreading of pest and other animal disease and quarantined plants which can destroy Indonesia’s biodeversity. One of the preventive steps which may be taken in order to avoid the worse effect of this trade liberalization attack is by enforcing a stricker sanctions in agriculture and trade to save Indonesia’s food market. This study examines the effect of the implementation quarantine rules towards the produce bussines fosterage between countries in Batam. The research method used empirical jurisdiction. The result shows that the effect of implementation quarntine rules in Batam has been carried out in accordance with the applicable acts and regulations. the effectiveness of implementation quarantine rules were caused by obstacles that raised because of the ignorance of the business, importers, exporters, and society in the things dealing with the rules or administrative provision in document issue or quarantine certification, Efforts taken by the Quarantine Batam in making quarantine rules as well as its rules effective were giving guidance to the officers in the Quarantine to minimalize violation of rules. Dengan ketergantungan akan impor maka semakin besarnya kemungkinan tersebarnya hama dan penyakit hewan dan tumbuhan karantina yang dapat memusnahkan keanekaragaman hayati Indonesia. Salah satu langkah preventif yang dapat dilakukan untuk menghambat serangan dampak liberalisasi perdagangan yang lebih buruk adalah ketegasan penerapan sanksi hukum dalam pertanian dan perdagangan untuk menyelamatkan pasar pangan di dalam negeri. Penelitian mengkaji tentang pengaruh implementasi aturan karantina terhadap perdagangan produk pertanian antar negara di Batam. Metode penelitian menggunakan pendekatan yuridis empiris. Hasil penelitian menunjukkan bahwa Pengaruh implementasi aturan karantina pertanian di Batam telah dilaksanakan berdasarkan Perundang-undangan yang berlaku. Efektifitas Implementasi tentang karantina disebabkan oleh kendala yang timbul dikarenakan ketidak tahuan pengusaha, importir, eksportir, serta masyarakat dalam hal-hal yang berkaitan dengan peraturan atau ketentuan administrasi dalam pembuatan dokumen atau sertifikasi karantina, Upaya - upaya yang ditempuh oleh Balai Karantina Kelas 1 Batam dalam mengefektifkan aturan karantina dengan Proses peningkatan pelayanan publik di Balai Karantina Kelas 1 Batam adalah mengenai kesadaran petugas itu sendiri harus selalu dibina untuk meminimalisir terjadinya pelanggaran

This research was conducted for the purpose of ascertaining law enforcements for Small and Medium Enterprises (SMEs) business actors in Indonesia based on Law Number 55 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition. It also analyzes the role of government in providing enforcements to small and Medium Enterprises. In this study, normative legal research was used. It found that the legal protection of small businesses competition in Indonesia is a manifestation of the implementation of economic democracy that contains the principles of justice and togetherness to encourage creating opportunities for every businessman in a healthy competition environment. It also found that healthy competition aims to avoid a monopoly of certain business actors only, but it could provide business opportunities for Small and Medium Enterprises business actors to enlarge their business.
