The fundamental reason for the Insolvency of Penaga Timur (M) SDN.BHD Shipping Companies from Malaysia is because they did not submit Peace Proposals at the Creditor Meeting as stipulated in Law Number 37 of 2004 concerning Bankruptcy and PKPU, and at that time the Bankruptcy Institution was no longer accepting The peace between the creditor and the debtor, as a result, the Curator appointed by the court must immediately issue all the assets of the bankrupt debtor, but is constrained by the location of the bankrupt debtor's assets outside the territory of the Republic of Indonesia, and of course this is very detrimental to PT. WAS and PT UML as Creditors as Justice Seekers. Researchers conducted descriptive-exploratory research with a juridical-normative approach. From the results of the research that has been done, the researcher did not find a situation where the East Penol (M) SDN BHD insolvency was caused by the cash flow test approach method, or the balance sheet test or going concern value concept and also had no relation to the assessment of debtor financial ratios such as liquidity (liqidaty), solvency (solvability), profitability (profitability) and leverage as it applies in the Perspective of Bankruptcy Regime in general, and in this case the lack of regulation regarding the provisions of International Law relating to the Ordering of a Bankruptcy and / or Cross Border Insolvency in general. The curator has not been able to fulfill the rights of creditors for bankruptcy bodies outside the territory of the Republic of Indonesia.

The drama entitled “Kau Yang Berasal Dari Bintang” produced by SinemArt and aired by RCTI TV station on 28 April 2014 was claimed as a plagiarism of the most popular South Korean drama "You Who Came from the Stars". Consequently, the screening of the drama was pending until the negotiation of the Korean and Indonesian production house was settled. This research advanced a question whether the Indonesian Copyright Law provides sufficient protection to the works of cinematography either produced by Indonesian or foreign nationals. To answer this research question, the legal protection theory of Phillipus M. Hadjon was used as a platform. It also analyzed the effective implementation of the Law by adopting the Effectiveness of Law Theory of Satjipto Rahardjo. Furthermore, it reviewed the settlement made by the Indonesian and South Korean production house. In order to obtain concrete findings, this research adopted a normative research method (doctrinal method) by using secondary data as its sources. Data collected were analyzed based on its content (a content analysis) by using the qualitative approach. The research found that cinematographic work is one of the protected works under the Indonesia Copyright Law; therefore the Indonesian drama violated the Law because of the similarities of stories, plot, and roles played with the Korean drama. However, the Law was not effective in its implementation due to its weak enforcement by those responsible and a lack of public awareness. It was also found that the amicable settlement through negotiations were the best solution to resolve the infringement of Copyright Law relating to cinematography.

Parallel import is a concept for importing and reselling original products from distributors that are legally obtained from producers at lower prices rather than buying directly from producers. These products are placed on the market in one country with the approval from owner and imported to another country without the permission of the owner. Parallel imports are built on the principle of exhaustion of rights. Basically, there are three principles of exhaustion of rights, namely;the principle of international exhaustion of rights, domestic/national exhaustion of rights and regional exhaustion of rights. Based on the TRIPS agreement, each country is given the freedom to determine and regulate the principle of exhaustion of rights to be applied. The issue under discussion is how the parallel import regulation in brands according to Indonesia, Indian, and New Zealand laws what can be adopted in Indonesia law regarding parallel imports based on these comparisons. In this study, the writer used a normative research method. This research also uses legal comparison as part of its analysis with data collection techniques through literature study. Data analysis method used is descriptive qualitative method. The results of the study showed that Indonesia has no regulation regarding parallel imports. While in India and New Zealand there are related regulations. Regarding disputes settlement regarding parallel imports in Indonesia, civil law is adopted, in India with a judge's decision in accordance with existing regulations. What can be adopted by Indonesia in this case is to explicitly reinforce regulations regarding parallel imports in brands.

Indonesia's strategic sea location is one of the most demands by local and foreign shipping. Shipping becomes an element of nation's economy and government’s concern. This is proven by the issuance of Law No. 17 of 2008 concerning Shipping which regulates implementation, legal protection of community, especially shipping companies, both debtors and creditors, judges, trustees and related institutions. Yet, it cannot implement effectively because Article 223 of Law No. 17 does not have a Ministerial Regulation governing the procedures for its implementation, consequently it disadvantages and leads to a loss for creditors and debtors. This study uses a normative legal research method which examines the secondary materials which is supported by a primary data. The Progressive Legal Theory is used by this study. It argues that there must be a procedure which links the implementation of shipping claims and the legal actors both creditors - debtors, judges and harbourmaster. They must pay attention to ethics and procedures in making decisions. In this regard, a Ministerial Regulation governing the claim procedures must be established.

Praktek gadai tanah ulayat di Minangkabau lazim di kenal dengan pagang gadai yang awalnya sebagai bagian tolong menolong dalam masyarakat namun saat sudah bertranformasi menjadi suatu transaksi ekonomi dan atau kapitalis. Hak dari si penggadai seakan di kebiri karena pelaksanaanya yang tidak merujuk kepada Hukum Nasional. Secara umum gadai tanah merupakan suatu penyerahan tanah untuk menerima pembayaran sejumlah uang secara tunai, dengan ketentuan bahwa si penggadai tetap berhak atas pengembalian tanahnya dengan jalan menebusnya kembali. Dari hasil penelitian diketahui bahwa praktek gadai tanah di masyarakat Minangkabau di Kenagarian Taram Kabupaten Lima Puluh Kota tidak memiliki dasar hukum yang kuat dalam melakukan perikatan artinya terjadi kekosongan hukum dalam pelaksanaannya. Surat perjanjiannya dibuat dengan judul “pinjam meminjam” akan tetapi merupakan praktek dari “gadai” yang terjadi dalam pelaksanaannya. Perlunya aturan yang jelas untuk kembali ‘meluruskan’ atas penyimpangan-penyimpangan yang terjadi selama ini. Kemudian menginisiasi lahirnya suatu lembaga keuangan non-bank yang mampu mengokomodir kepentingan semua pihak yang terlibat.

The purpose of this study is analyzing the setting of Law No. 8 of 1999 on Consumer Protection Against Expired Food Products in Kota Batam.Menganalisis application of the impact of Law No. 8 of 1999 on Consumer Protection Against Expired Food Products in Kota Batam.Menganalisis and find solutions Law No. 8 of 1999 against the negative effects of using products Food Expiration in Batam. This research is classified as qualitative research, and the kind of empirical legal research / sociological, and the object of research is the primary data Interview and observation data coupled with secondary data literature study.The results of this thesis study can be concluded as follows: Implementation of Law No. 8 of 1999 on Consumer Protection against food products expired in Batam practically found that business (shop owners) already have a sense of absolute responsibility (strick lialibility), where when consumers konplein in case the goods expired they had provide compensation in accordance with the agreement. Against the expired goods store owners take action to restore the goods to the seller, gutted and there was also selling goods at bargain prices

The study aims to describe and analyze and identify the reasons behind the Riau Islands Provincial Government not yet applying Government Regulation No. 59 of 2015 to the establishment of regional legal products. This research was conducted using a sociological juridical approach. Lack of knowledge or information on regional equipment in the Riau Islands Provincial Government regarding the need for the participation of legislators in the formation of regional legal products, there is still a sectoral ego from the Riau Islands Province government as a representative of the central government in the regions, no sanctions if not including regulatory designers legislation in the formation of regional legal products.

This research purports to analyse the Batam City’s Government limited authority in Free Trade and Free Port Zone. It is also to analyse the impact of government limited authority and propose solutions that can solve the government limited authority in Free Trade and Free Port Zone. Based on the result of this research, it was revealed that that the Batam City Government has limited experiences in planning, utilization, and controlling layout, providing land services, and public infrastructure. The limitations impact on the services giving by the government that lead to the lack of legal certainty in action. The solutions to overcome the limitations are to rearrage overlapping regulations. === Tujuan penelitian ini adalah untuk menganalisis keterbatasan Pemerintah Kota Batam dalam kewenangannya dalam Kawasan Perdagangan Bebas Pelabuhan Bebas. Penelitian ini juga menganalisis dampak keterbatasan kewenangan Pemerintah Kota Batam dan memberikan solusi yang dapat dilakukan untuk mengatasi keterbatasan kewenangan Pemerintah Kota Batam dalam kawasan Perdagangan Bebas dan Pelabuhan Bebas. Berdasarkan hasil penelitian terungkap bahwa Pemerintah Kota Batam memililiki keterbatasan dalam perencanaan, pemanfaatan dan pengawasan tata ruang, pelayanan Pertanahan, dan Penyediaan sarana dan prasarana umum. Keterbatasan tersebut berdampak pada pelayanan masyarakat yang menyebabkan tidak terwujudnya kepastian hukum. Solusi yang dapat dilakukan untuk mengatasi keterbatasan adalah menata ulang kembali regulasi yang tumpang tindih.

Pemerintah berupaya untuk meningkatkan kesejahteraan rakyat sebagaimana tercantum dalam Perubahan Keempat Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 pada Pasal 34 ayat 2 dan 3. Tujuan tersebut semakin dipertegas melalui UU Nomor 36 tahun 2009 tentang Kesehatan. Untuk mengimplementasikan hal tersebut pemerintah memberlakukan Undang-undang Nomor 40 tahun 2004 tentang Sistem Jaminan Sosial Nasional dan Undang-Undang Nomor 24 Tahun 2011 Tentang Badan Penyelenggara Jaminan Sosial. Penelitian ini mengunakan penelitian hukum sosiologis dimana data dianalisis secara kualitatif dan kuantitatif. Penelitian ini menjelaskan bahwa hak dan kewajiban para pihak dalam Perjanjian Kerjasama antara BPJS Cabang Tanjungpinang dengan RSUD Tanjungpinang telah mengacu pada Peraturan Menteri Kesehatan Nomor 71 Tahun 2013 Tentang Pelayanan Kesehatan pada Jaminan Kesehatan Nasional. Meskipun, akta perjanjian kerjasama yang dibuat antara BPJS Cabang Tanjungpinang dengan Rumah Sakit Umum Daerah Tanjungpinang termasuk jenis perjanjian dibawah tangan, namun berdasarkan Pasal 1874 KUHPerdata bahwa akta di bawah tangan tersebut memperoleh kekuatan pembuktian yang sama dengan suatu Akta Otentik.

Batam City has 70 government institutions, that consists of the regional and central government. The government goods/ service need to be done in order to improve public service. Indonesia implements the Presidential Decree Number 70 of 2012 on the Second Amendment of Presidential Decree Number 54 of 2010 on the Government Goods/ Service Procurement. Article 81 & 82 of Presidential Decree Number 70 of 2012 state that participants who feel aggrieved may submit their complaints and the complaints may be appealed. The word “may” in Article 81 and 82 of Presidential Decree Number 70 of 2012 obscures the obligation to use administrative efforts (complaints) in Article 48 of Law Number 5 of 1986 on Administrative Court. Reviewing the administrative dispute resolution arrangements in the procurement of government goods/ services, examining the implementation of administrative dispute resolution through administrative effort and through the court, and finding the ideal socialization concept and the rule of law in the administrative dispute resolution procurement of governmant goods / services in Batam city were the purposes of this research. Normative legal research used as the research method. The results showed that the word “can” in article 81 and 82 this presidential decree obscures the interpretation of those who seek for justice and it is right for the procurement of government goods/ services to be based upon as the product of law. The application of procurement service is not yet perfect. Therefore, a seriousness from those who seek for justice in filing a lawsuit in court is needed, and stages of litigation in administrative courts should be able to minimize the desicion of which is not acceptable (niet onvankelijkverklaard). A certification for the government goods/ service procurement’s judge. To the violation of this law should later be subject to administrative sanction threat, not criminal sanctions. === Kota Batam memiliki 70 institusi pemerintahan yang terdiri atas pemerintahan pusat dan daerah. Untuk meningkatkan kualitas pelayanan publik, maka pemerintah perlu melaksanakan pengadaan barang/ jasa pemerintah. Indonesia menerapkan Peraturan Presiden Nomor 70 Tahun 2012 tentang Pengadaan Barang/Jasa Pemerintah. Pada Pasal 81 dan 82 peraturan presiden ini menyatakan bahwa penyedia barang/ jasa yang merasa dirugikan dapat mengajukan sanggahan dan dapat mengajukan sanggahan banding. Kata dapat di Pasal 81 dan 82 ini mengaburkan kewajiban upaya administratif pada Pasal 48 Undang-Undang Nomor 5 Tahun 1986 tentang Peradilan Tata Usaha Negara. Menelaah pengaturan penyelesaian sengketa administrasi dalam pengadaan barang/ jasa pemerintah, menelaah pelaksanaan penyelesaian sengketa administrasi melalui upaya administratif dan melalui pengadilan, dan menemukan konsep ideal sosialisasi dan aturan hukum penyelesaian sengketa administrasi dalam pengadaan barang/ jasa pemerintah di Kota Batam merupakan tujuan dari penelitian ini. Metode yang dipakai adalah penelitian yuridis normatif. Hasil penelitian menunjukkan bahwa kata “dapat” pada pasal 81 dan Pasal 82 peraturan presiden ini mengaburkan penafsiran terhadap masyarakat pencari keadilan. Aplikasi Layanan Pengadaan Secara Elektronik belum sepenuhnya sempurna, dituntut keseriusan dari masyarakat pencari keadilan dalam mengajukan gugatan di peradilan, dan tahapan berperkara di peradilan tata usaha negara seharusnya dapat meminimalisir putusan yang tidak diterima (niet onvankelijkverklaard). Perlu sertifikasi bagi hakim pengadaan barang jasa pemerintah, pembentukan produk hukum yang setingkat undang-undang bagi pengadaan barang/ jasa pemerintah, dan terhadap pelanggaran undang-undang ini nantinya dikenakan ancaman sanksi administratif dan bukanlah sanksi pidana.
