Abstract

Expanding understanding of working relationships between labors and employers become involving government as the third parties. In industrial relations, the elements involved should play their roles and functions properly, creating harmonious relationships that can stimulate economic growth. So the aim of this research is to know the interpretation of Law No. 13 Year 2003 concerning Manpower against the wages of workers / laborers under process during termination.In this case the author conducted this study using a normative juridical approach. The judge's decision that provides 6 (six) months of process wages or more is based on the theory of justice law, namely the thought that the decision-making process base on both parties justice consideration. Judges' decisions that provide zero process wages in accordance with theory progressive law which consider the benefit of both parties labors and employers and development of one area specific and national generally.

Abstract

Perseroan sebagai Badan Hukum (rechtspersoon/legal person) merupakan Perseroan Terbatas yang pengaturannya tunduk pada ranah hukum privat yaitu Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas. Sebagai organ penting Perseroan, Direksi sebagai pengurus adalah pilar utama untuk menjamin dan untuk melanjutkan bisnis Perseroan. Itu sebabnya tanggung jawab Direksi sebagai pengurus atau manajemen didasarkan pada itikad baik, loyalitas, kejujuran, penuh tanggung jawab, kepedulian dan kemampuan serta maksud yang terbaik bagi Perseroan, untuk mengurus hingga tercapainya tujuan Perseroan dan yang mewakili Perseroan di dalam pengadilan dan di luar pengadilan. Tanggung jawab Direksi berdasarkan prinsip Fiduciary Duty dalam Perseroan Terbatas harus mampu melaksanakan tugasnya dengan penuh itikad baik, bertanggungjawab, serta menghindari adanya benturan kepentingan. Direksi juga dituntut untuk bertindak dengan penuh kehati-hatian dalam membuat segala keputusan dan kebijakan (duty of care) serta mampu mengutamakan kepentingan Perseroan di atas kepentingan pribadinya (duty of loyalty). Seorang Direksi dikategorikan melakukan Corporate Opportunity dan melakukan pengelolaan Perseroan yang salah, apabila seorang Direksi melakukan pelanggaran Code Of Conduct. Tidak melaksanakan duty of care dan duty of loyalty yang terdapat dalam prinsip perusahaan dan memiliki itikad buruk dengan mengambil kesempatan bagi dirinya pribadi atas nama untuk kepentingan Perseroan.

Abstract

Tanjungpinang local government issued Tanjungpinang Mayor Decree Number 37 Year 2010 about the Official Uniform for Civil Servants and Non Civil Servants at Tanjungpinang Government Circle. That decree stated that Batik Gonggong was one of the official uniforms that must be used. With the decree which caused the economical rights, all the entrepreneurs should get the opportunity to compete without any discrimination. It was concluded that public participation was needed to conduct a study in determining a batik motive as the special characteristic of a place before it was determined as a law of the local government. It could be socialization or an open competition for the society or the related entrepreneurs, because that activity could cause an economical consequence for the public. Tanjungpinang local government should give a transparency guarantee and the same rights of access about business information for every micro, small and middle entrepreneur.

Abstract

To ensure the realization of peace and public order, the Tanjunginang City Government has established the Local Regulation Number 5 of 2015 concerning Public Order. In factual, in the enforcement of Regional Regulations and Regulations of the Head of Regional Units the Civil Service Police can carry out non-judicial operations. But in reality, the results of the study indicate that the application of administrative sanctions or criminal provisions against the Tanjungpinang Regional Regulation No. 5 of 2015 is not running optimally, this is due to several obstacles faced by the Civil Service Police Unit in the field, including its own Legal Factors , Law Enforcement Factors Are Alone, Facilities and Infrastructure Factors and Community Factors. In order for the enforcement of these regional regulations to work properly, the Tanjungpinang City Government should, in this case be carried out by the Civil Service Police Unit, be able to resolve these obstacles, one of which is by using the Legal Effectiveness theory proposed by Soerjono Soekanto in accordance with these 4 (four) factors.

Abstract

Legislation in Indonesia continues to experience growth, including regional governance. Previously, laws relating to local government, namely Law No. 22 of 1999 and Law No. 32 of 2004 recognize the Head of Regency/City as a local executive and the Regional Representatives Council (Parliament) as a legislative that have legislative, supervisory and and budgetary functions. Later under Law No. 23 of 2014 on Regional Government, the legislative function is altered by the function of formulating local regulations. This change is significant to be analyzed by using a normative research method to examine the position of local regulation, the function of regional regulation making and working relationships between the Head of Regioncy/City and Regional Parliament in the process of formulating local regulations. === Peraturan perundang-undangan di Indonesia senantiasa mengalami perkembangan termasuk dalam hal penyelenggaraan pemerintahan daerah. Sebelumnya Undang-Undang tentang Pemerintahan Daerah Nomor 22 Tahun 1999 dan Undang-Undang Nomor 32 Tahun 2004 mengenal Kepala Daerah dan perangkat daerah sebagai eksekutif dan Dewan Perwakilan Rakyat Daerah sebagai legislatif yang memiliki fungsi legislasi, fungsi pengawasan dan fungsi anggaran. Dalam perkembangannya, Undang -Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah fungsi legislasi diubah menjadi fungsi pembentukan peraturan daerah. Perubahan tersebut perlu dianalisis secara yuridis dengan menggunakan metodelogi penelitian yuridis normatif yang menganalisis kedudukan peraturan daerah, fungsi pembentukan peraturan daerah dalam penyelenggaraan pemerintahan dan hubungan kerja Kepala Daerah dengan DPRD dalam proses pembentukan peraturan daerah.

Abstract

Dalam era reformasi, pemerintah dituntut untuk dapat mewujudkan pemerintahan yang terbuka dengan cara meningkatkan layanan publik terhadap masyarakat, sehingga pemerintah selaku penyelenggara negara sudah sepatutnya menjalankan tugas secara proporsional dengan maksimal demi tercapainya tata pemerintahan yang baik (Good Governance), guna mewujudkan pemerintah yang bersih (Clean Governance). Salah satu aspeknya adalah dalam hal pengadaan barang dan jasa harus dapat dilakukan secara transparan melalui system eProcurement. Hal ini sudah menjadi sesuatu yang sangat genting di Indonesia untuk saat ini. Berdasarkan data per 31 Maret 2017, total penanganan perkara tindak pidana korupsi oleh KPK dari tahun 2004-2017 adalah Penyelidikan 874 perkara, Penyidikan 594 perkara, Penuntutan 489 perkara, Inkracht 406 perkara, dan Eksekusi 434 perkara. Direktur Pengaduan Masyarakat KPK Eko Marjono mengungkapkan, pengaduan yang masuk ke KPK sebagian besar berasal dari Lembaga Kebijakan Pengadaan Barang dan Jasa Pemerintah (LKPP). Padahal, sejatinya Indonesia sudah mempunya seperangkat regulasi yang mengatur tentang hal tersebut, salah satunya adalah Peraturan Presiden Nomor 70 Tahun 2012 Tentang Perubahan Kedua Peraturan Presiden Nomor 54 Tahun 2010 Tentang Pengadaan Barang/Jasa Pemerintah pada Layanan Pengadaan Secara Elektronik (LPSE) di Pemerintah Kota Batam. Penelitian ini merupakan penelitian yuridis sosiologis yang dilakukan dengan observasi secara langsung di lapangan, dan disertai dengan penelitian kepustakaan. Data yang dipergunakan dalam penelitian ini adalah data primer yang didapatkan langsung dari lapangan melalui observasi dan wawancara pada Pemerintahan Kota Batam (PEMKO). Kemudian data sekunder yang diperoleh dengan cara penelusuran bahan-bahan hukum yang bersifat primer, sekunder dan tersier. Keseluruhan data yang diperoleh kemudian dianalisis secara deskriptif dengan analisis kualitatif. Penelitian ini bertujuan untuk mengetahui bagaimana pelaksanaan e-Procurement dan kendala-kendala apa yang dihadapi, serta solusi terbaik dalam menyelesaikan kendala-kendala yang dihadapi terkait pelaksanaan Layanan Pengadaan Secara Elektronik (LPSE) di Kota Batam.

Abstract

Regional Regulation (PERDA) is a political product that is formed by the Regional Government and the Parliament. Regional Government is divided into provincial government that has the authority to establish a Provincial Regulation is the Governor together with the Provincial Parliament. The District Governement that has the authority to establish a District Regulation is the Regency Head or Mayor together with the District Parliament. The regional regulations as Legal Product are a form of written law that contains the rules of behavior that are binding in general. The substance of Regional Regulation must be further elaborated from the higher law by taking into account the specificity of each region. The Regulation must not contradict with higher laws and regulations and as well as public interest. The purpose of this study is to explain the establishment of the villages which is located in Natuna regency. It examines whether it has fulfilled the requirements that are regulated by the Law and to explain its legal implications. The data collection is obtained from study of documents and literature. The method used in this study is a normative legal research method. The results showed that the Establishment of Natuna Regency Regulation No. 15 of 2014 concerning the Establishment of the Village did not follow the procedures / mechanisms that are regulated in the Government Regulation, therefore the Riau Islands Governor has not issued a register code for Village Preparation Establishment, and Registration Number to regulate the village establishment. Consequently, the Minister of the Interior has not issued Village codes. Accordingly, the Regional Regulation may be declared as not aligning with the legal procedures. === Peraturan Daerah atau disingkat Perda merupakan produk politik hukum daerah yang dibentuk oleh Pemerintah Daerah dan DPRD. Dimana Pemerintah Daerah terbagi menjadi pemerintahan Provinsi yang memiliki kewenangan untuk membentuk Perda Provinsi adalah Gubernur bersama-sama dengan DPRD Provinsi. Sedangkan untuk pemerintahan Kabupaten/Kota yang memiliki kewenangan untuk membentuk Perda Kabupaten/Kota adalah Bupati/Walikota bersama-sama dengan DPRD Kabupaten/Kota. Peraturan Daerah sebagai produk hukum daerah merupakan bentuk hukum yang tertulis yang berisi aturan tingkah laku yang bersifat mengikat secara umum. Pengaturan Perda secara substansi haruslah merupakan penjabaran lebih lanjut dari peraturan perundang-undangan yang lebih tinggi tingkatannya, dengan memperhatikan kekhususan masing-masing daerah dan tidak bertentangan dengan peraturan perundang-undangan yang lebih tinggi serta kepentingan umum. Tujuan penelitian ini adalah untuk menjelaskan pembentukan desa-desa yang berada di Kabupaten Natuna apakah telah memenuhi persyaratan sebagaimana yang diatur dalam Peraturan Perundang-undangan dan untuk menjelaskan implikasi hukum. Pengumpulan data dilakukan dengan studi dokumen dan kepustakaan. Metode penelitian yang digunakan dalam penulisan ini adalah metode penelitian hukum Normatif. Hasil penelitian menunjukkan bahwa Penetapan Peraturan Daerah Kabupaten Natuna Nomor 15 Tahun 2014 tentang Pembentukan Desa yang tanpa melalui prosedur/mekanisme sebagaimana diatur di dalam Peraturan Perundang-Undangan sehingga Gubernur Kepulauan Riau tidak mengeluarkan Kode Register untuk Desa Persiapan, Nomor Registrasi untuk Peraturan Daerah dan Kode Desa oleh Menteri Dalam Negeri sehingga Peraturan Daerah tersebut dapat dinyatakan “tidak mengikuti prosedur hukum yang berlaku”.

Abstract

As a border region, Riau Islands Province is very vulnerable to cases of illegal fishing. Such cases can occur in the territorial sea as well as in exclusion economic zones or in the open sea boundary region. The number of cases of illegal fishing in the border region raised the theme of illegal fishing for this research which refers to Law Number 45 of 2009. The purpose of this study is to record which agencies have authority in the case of cases of illegal fishing in the border region of Riau Islands Province, to analyze the actions taken by the authorities in law enforcement against those who commit illegal fishing in the border areas of Riau Islands Province, and to analyze barriers and solutions faced by the authorities in law enforcement related to illegal fishing in the Riau Islands border region by using sociological legal research methods The result of this study is the agencies that manage cases of illegal fishing are including the Directorate of Water Police of Riau Islands Regional Police, Riau Islands Province Marine and Fisheries Service, Fisheries Court at Tanjungpinang State Courts and Indonesian Riau Islands Navy Force. Each of them has their respective authority in accordance with the provisions of the applicable legislation which in carrying out these authorities they face obstacles and try to provide solutions in solving cases of illegal fishing in the border region of Riau Islands Province.

Abstract

The purpose of this research is to analyse the application of Law No. 13 of 2003 on Manpower related to the calculation of overtime wages on a construction service company and analyse the constraints faced by the company due to the calculation of overtime wages based on the Law. It also purports to find solutions that can be implemented in the construction company based on the Law. The result of the research of found that the application of the calculation of overtime wages at Construction Company was still far from what was stated in the Law in terms of both overtime hours and the calculations of the total overtime hours which has exceed of the prescribed number of hours from the rules. The obstacles encountered is that the lack of understanding relating to standard minimum wages in Batam city by the wages councils, union/ worker and labour. The solutions are to implement a calculation system of overtime wages based on the Law and improve the supervision, and check thoroughly the records and calculation of the overtime. Tujuan penelitian ini adalah menganalisis penerapan Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan terkait perhitungan lembur pada perusahaan jasa konstruksi, menganalisis kendala yang dihadapi oleh perusahaan jasa konstruksi dalam perhitungan lembur sebagaimana Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, menemukan solusi yang dapat dilakukan agar penerapan perhitungan lembur pada perusahaan jasa konstruksi sesuai dengan Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Hasil penelitian dari penelitian ini adalah penerapan perhitungan upah lembur pada perusahaan jasa konstruksi masih jauh dari apa yang diatur dalam Undang-Undang baik dari segi jam maupun perhitungan yang dilakukan melebihi dari jumlah jam lembur yang ditentukan peraturan berlaku. Kendala yang dihadapi adanya ketikdaksepahaman dalam menetapkan standar upah minimum Kota yang melibatkan dewan pengupahan, serikat pekerja/buruh dan pekerja. Solusi yang dapat dilakukan adalah menerapkan sistem upah lembur sebagaimana yang telah diatur oleh Undang-Undang berlaku, meningkatkan pengawasan, teliti dalam pencatatan dan perhitungan upah lembur.

Abstract

Batam City is an area located in an area close to other countries. This will certainly trigger rapid growth. However, this also creates a new problem with the emergence of street singers and underage street children crowding the streets of Batam. The presence of street singers and street children in Batam City is a factor that makes the author interested in discussing this research. The conclusion from the case analysis based on the sociological theory of street singers and street children is a form of social inequality that occurs in Batam City. the existence of street singers and street children was found at a red light intersection. By promoting buskers and street children can have a negative impact, one of which can disturb road users. This also has an impact on the economy of the city of Batam and for the people themselves. Singers and street children also have an influence on the orderliness of Batam City. If viewed from the sociological theory of law, cases of street singers and underage street children that occurred in Batam City, there is feedback between social and community morals. In this case the Batam city government has a role in controlling street singers and street children. This is also contained in Mochtar Kusumaatmadja's theory, that the development created by the government can provide protection, education and understanding of religion so that buskers and street children can provide solutions in a better way. Meanwhile, Dumairy's theory explains that there is a concern from the government in eradicating street singers and children.
