Abstract

The presence of vagrants and beggars in Batam City is one of the problems of community welfare that is not easy to solve. Therefore, it is necessary to have a clear protection of the law against Vagrants and beggars in Batam City, not only to make efforts to combat vagrants and beggars but also to fulfill the rights of vagabonds and beggars that must be put forward by the Batam City Government. In this case, tackling the problems of vagabonds and beggars is the responsibility of the state. If you look at the contents of the 1945 Constitution of the Republic of Indonesia in Article 27 paragraph (2) which states that "Every citizen has the right to work and a decent living for humanity". In this case, the government is obliged to improve the condition of the community having problems with social welfare and ensure that every citizen has the right to a decent income. Whereas by providing legal protection, it is hoped that the squatters residing in Batam City can achieve a decent life and existence as citizens of the Republic of Indonesia. The research design that researchers used in this study was empirical legal research. The data analysis method used in this research is quantitative and qualitative research. Data were obtained by conducting interviews and observations with the Batam City Social and Community Empowerment Service Vagrants and Beggars in Batam City as a form of approach to vagabonds and beggars in their activities.From the results of research conducted by researchers, it shows that over the last four years (2016 - 2019) the number of vagrants and beggars in Batam City has tended to increase from year to year. Until 2019, the number of vagrants and beggars in Batam City has reached 588 people. The Batam City Social and Community Empowerment Service has carried out a non-physical prevention as a preventive legal protection, namely through print media, radio, videotron, provision of information through billboards in public places, which can be used to disseminate information and education to the public not to provide money to beggars on the streets, unless the money is given in its place, social counseling in places where vagrants and beggars are, so that vagrants and beggars do not wander and beg on the streets so that social order can be created. Furthermore, repressively carrying out control, outreach, data collection on vagrants and beggars to be followed up on the rehabilitation process. In this case, an analysis based on the Legal Protection Theory by Philipus M Hadjon, shows that the Batam City Social and Community Empowerment Service has not been effective in providing legal protection for vagrants and beggars in Batam City, because there are still many factors that become obstacles in providing legal protection. against vagrants and beggars in Batam City which is analyzed based on Soerjono Soekanto's Legal Theory of Legal Effectiveness

Abstract

One consequence of technological and communication advancement is the business activity that is usually done conventionally has started to shift into the electronic-based system by using a computer network. However, the phenomenon also generates a new problem that is related to the safety standard of products being sold, because many suspected of having no proper approval or license from authorized agency namely the National Agency for Drug and Food Control (NA-DFC). The cosmetic product is one of the examples. The objective of this research to analyze and elaborate legal protection through preventive and repressive means to consumers in the online business system from unregistered items or products in NA-DFC. The research used juridical normative approach, a method legal research where the analysis itself does not include data or social factors into account. Performing analysis on legal protection for consumers against unregistered products certainly cannot be separated from the Law of Consumer Protection.Result of the research shows preventive legal protection does exist and proven by the existence of Law of the Republic of Indonesia No. 8 of 1999 on Consumer Protection which explicitly states its information that consumers have appropriate protection against the act of deceit, harmful or even any action that may lead to dangerous consequences. The repressive legal protection comes in the form of a maximum of five years imprisonment or a maximum fine of Rp. 2.000.000.000,- for businesses or producers that produce and/or trade items and/or service that does not fulfill or incompatible with pre-determined standards.

Abstract

Multi Level Marketing (MLM) is basically a very good legal business practice that may lead people who run it earnestly into success. MLM has provides employment and income for the communities. MLM practice can be considered valid and legal if it meets the requirements set by the Government in Law No. 7 of 2014 on Trade, Regulation No.32/M-DAG/PER/8/2008, Regulation No. 47/M-DAG/PER/9/2009, and Regulation No. 55/M-DAG/PER/10/2009. The purpose of this research is to find a legal basis for both local and Multi National Company (MNC) that practice MLM, and how a company can meet the operational requirements to practice MLM as well as the responsibilities to which the products has been market on using MLM. Data in this research is collected during interviews and field observations with samples of Top Leaders from both local and MNC that practice MLM in Batam. The results of this research is Company which runs MLM are declared valid and legal if they have met some of the requirements as stated in Law No. 7 of 2014 on Trade, and Regulation of the Minister of Trade of the Republic of Indonesia No. 32/M-DAG/PER/8/2008 on the Implementation of Business Activities Trading With Direct Sales system. Furthermore, the legal basis for the protection of local and MNC that practise MLM in Batam have been pretty good, but the implementation is yet to be filled. Pemasaran berjenjang (MLM) pada dasarnya adalah usaha legal yang baik, tidak sedikit orang yang sukses menjalankan bisnis network marketing ini. Bahkan bisnis ini menyediakan lapangan pekerjaan dan pendapatan bagi masyarakat. Perusahaan Pemasaran berjenjang (MLM) dinyatakan sah dan legal apabila memenuhi persyaratan yang ditetapkan Pemerintah dalam Undang-Undang Nomor 7 Tahun 2014 tentang Perdagangan, Permendag RI Nomor 32/M-DAG/PER/8/2008, Permendag RI Nomor 47/M-DAG/PER/9/2009, Permendag RI Nomor 32/M-DAG/PER/8/2008 dan Permendag RI Nomor 55/M-DAG/PER/10/2009. Tujuan penelitian adalah menemukan landasan hukum bagi perusahaan yang bergerak dalam Pemasaran berjenjang baik lokal dan asing di Kota Batam, mengenai sebuah perusahaan dapat memenuhi syarat operasional untuk menjalankan sistem Pemasaran berjenjang serta mengenai tanggung jawab pelaku usaha terhadap Produk yang di jual dengan system Pemasaran berjenjang. Pengumpulan data dilakukan secara wawancara dan observasi lapangan dengan sampel para Pimpinan Perusahaan Pemasaran berjenjang lokal dan asing di Kota Batam. Berdasarkan hasil penelitian Perusahaan Pemasaran berjenjang (MLM) dinyatakan sah dan legal apabila memiliki beberapa persyaratan yang diwajibkan dalam Undang-Undang Nomor 7 Tahun 2014 tentang Perdagangan dan Peraturan Menteri Perdagangan Republik Indonesia Nomor : 32/M-DAG/PER/8/2008 Tentang Penyelenggaraan Kegiatan Usaha Perdagangan Dengan Sistem Penjualan Langsung. Selanjutnya Landasan hukum mengenai perlindungan Pemasaran berjenjang (MLM) lokal dan asing di Kota Batam telah cukup baik, namun pelaksanaannya belum berjalan secara penuh.

Abstract

Perkawinan dapat dikatakan sebagai hal yang sangat wajar dilakukan oleh umat manusia yang ingin membangun rumah tangga atau keluarga yang bersesuaian dengan kepercayaan agama masing-masing, dalam perkawinan Indonesia aturan hukum perkawinan tercatat dalam Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan. Perkawinan hanya dapat dilaksanakan jika usia perkawinan mencukupi sesuai dengan aturan hukum perkawinan, usia yang belum mencukupi usia perkawinan masih termasuk kategori sebagai anak. Dalam Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak, Anak ialah yang tidak melebihi usia 18 tahun. Maraknya perkawinan usia dini di Indonesia meresahkan pemerintahan Negara Indonesia dalam memberantas atau mencegah perkawinan usia dini. pelaksanaan perkawinan usia dini sangat berdampak besar bagi anak yang melakukannya, seperti adanya Kekerasan Dalam Rumah Tangga (KDRT), putusnya pendidikan anak, dampak kesehatan bagi anak wanita, dampak kehamilan atau kandungan dan pengaruh pysikologi dan biologi anak. Dalam hal penelitian skripsi jenis penelitian yang digunakan ialah penelitian normatif, dan data yang digunakan berdasarkan Undang-Undang, Jurnal, Artikel, dan Buku-Buku untuk memperoleh kedataan, serta metode analisa data dalam penelitian ini bersifat Kualitatif yang penjelasannya disusun secara deskriptif. Pencegahan perkawinan usia dini harus dilaksanakan atau dilakukan oleh penegakan hukum yang secara maksimal sesuai dengan Undang-Undang yang berlaku. Pencegahan yang secara maksimal dapat menurunkan angka perkawinan usia dini, bukan hanya secara maksimal akan tetapi harus dilaksanakan juga sosialisasi mengenai bahayanya perkawinan usia dini.

Abstract

Agreements for mortgages and complementary principles are two important legal issues in the Underwriting Rights Law. As a complement to the existence of an agreement on mortgages, it depends on the main agreement. Hence, its existence must be preceded by a principal agreement.This research uses the legal normative approach. It is a research method conducted by analyzing secondary data and utilizing a analytical descriptive. Based on the results of the analysis, it was found that the Underwriting Agreement preceded by the Principal Agreement could not be legally justified. This is Underwriting Rights are esablished or only have power, if the debt guaranteed by Underwriting Rights already exists. Unlike the case with the burden of mortgages that have been granted in the first credit agreement. It can also be charged to the next credit agreement that will exist in the future. Therefore, the Underwriting Law can be justified because it is in accordance with the complementary principle.

Abstract

Harta kekayaan mungkin berasal dari berbagai kejahatan.. Penelitian ini bertujuan untuk memaparkan efektivitas penegakan hukum tindak pidana pencucian uang dalam mencegah dan memberantas tindak pidana korupsi di Indonesia. Adapun efektivitas tersebut akan dikaji dengan teori efektivitas hukum yang dikemukakan oleh Soerjono Soekanto Jenis penelitian yang digunakan adalah penelitian yuridis normatif. Hasil penelitian ini menyimpulkan bahwa penegakan hukum tindak pidana pencucian uang belum cukup efektif untuk mencegah dan memberantas tindak pidana korupsi di Indonesia. Hal tersebut disebabkan karena perbedaan pemahaman hakim dan keyakinan hakim dalam memutus perkara tindak pidana pencucian uang sebagai tindak pidana lanjutan dari tindak pidana korupsi.

Abstract

Kota Batam merupakan salah satu kota yang berkembang dengan pesat dengan pertumbuhan ekonomi yang melebihi dari rata-rata pertumbuhan ekonomi secara nasional. Melihat begitu tingginya pertumbuhan ekonomi di Kota Batam, tentunya sangat diperlukan keberadaan Notaris selaku pejabat umum. Dalam Peraturan Menteri Hukum dan Hak Asasi Manusia Republik Indonesia Nomor 27 Tahun 2016 tentang Formasi Jabatan Notaris dan Penentuan Kategori Daerah mengatur tentang penempatan Notaris berdasarkan kuota dan kategori daerah, sehingga Notaris baru maupun yang telah bertugas tidak dapat secara langsung memilih tempat kedudukannya karena berdasarkan kuota yang ditetapkan. Menteri Hukum dan Hak Asasi Manusia Republik Indonesia telah membuat regulasi mengenai formasi jabatan Notaris, dimana di dalam peraturan tersebut, Calon Notaris tidak bisa mengajukan permohonan ke Kategori Daerah A, B dan C. Bagi Calon Notaris, formasi jabatan Notaris yang dapat diusulkan hanya untuk Kategori Daerah D. Setelah melaksanakan tugas kenotariatan di Kategori Daerah D selama minimal tiga tahun, Notaris diberikan hak untuk mengajukan permohonan perpindahan wilayah kerja ke Kategori Daerah C. Calon Notaris harus melaksanakan tugas di wilayah kerja Kategori D terlebih dahulu

Abstract

A statutory regulation starts to apply and has binding power on the date of promulgation. Enactment is intended to fulfill the formal requirements of a law and to fulfill the principle of legal fiction that everyone is considered to know the law. The enactment of the Provincial Regulation is the authority of the Provincial Regional Secretary whose mechanism of enactment is carried out by the Legal Bureau of the Regional Secretariat of the Riau Islands Province. However, the implementation of the promulgation mechanism carried out by the Legal Bureau of the Regional Secretariat of Riau Islands Province is different from the guidelines set out in the Minister of Home Affairs Regulation No. 80 of 2015 in addition to the disharmony between the laws and regulations relating to enactment.The method used in this research is normative juridical method with qualitative juridical data analysis method. The implementation of the enactment mechanism carried out by The Legal Bureau of the Regional Secretariat of the Riau Islands Province is still not in accordance with the Minister of Home Affairs Regulation No. 80 of 2015 in addition to the need for legal rules governing the mechanism of enactment in more detail and clearness.

Abstract

Land is a significant part in providing sources for life for human beings. The problems relating to land dispute settlement remain to be unable togive justice and fairness to disputing parties as it is mandated by Pancasila, the 1945 Constitution, Law No.5 of 1960 concerning the Basic Land Law and the Regulation of Agrarian Minister and Head of National Land Body No.5 of 2015 concerning Location Permit. This study reveals that land dispute settlement between community and developers in Batam City should be conducted by litigation and non litigation because these are the appropriate settlement methods in providing justice, security, comfortability and happiness to both disputing parties. === Tanah sebagai bagian yang sangat penting memberikan sumber penghidupan, seluruh umat manusia. Permasalahan penyelesaian sengketa tanah belum dapat memberikan rasa keadilan bagi pihak-pihak yang bersengketa, sebagaimana diamanatkan dalam Pancasila dan UUD 1945 dan Undang-Undang No. 5 Tahun 1960 tentang Dasar Pokok-Pokok Agraria maupun Peraturan Menteri Agraria Dan Tata Ruang/Kepala BPN No.5 tahun 2015 tentang Izin Lokasi. Studi ini mengungkapkan bahwa bentuk penyelesaian sengketa tanah antara masyarakat dan Developer di Kota Batam sebaiknya dilakukan melalui secara Litigasi maupun Non Litigasi karena cara inilah yang paling tepat dalam memberikan rasa keadilan, keamanan dan kenyamanan serta kebahagian bagi kedua belah pihak yang bersengketa.

Abstract

The purpose of this study is to describe clearly and carefully about the exception of National Treatment principle of the GATT/WTO whether it is justifiable or not. It also aims to analyze the obstacles that hinder Indonesia in implementing international agreements, in particular the National Treatment principle of GATT/WTO completely, and to find out the consequences if Indonesia continues to apply the exceptions of the National Treatment principle of GATT/WTO. Based on the result of this research showed that the exceptions of the National Treatment principle that was imposed by Indonesia was violating the rule of GATT/WTO. Furthermore, the uncertain regulation and the confusion are the obstacles that hinder Indonesia in implementing the National Treatment principle of GATT/WTO completely, thus Indonesia should make a clearly decision whether it is a Monism or a Dualism country to determine which law should be more supreme, International Law or National Law?. The consequences impose on a state when violating a GATT/WTO agreement is very influential and harms the state itself, because it would be excommunicated from the international trade.
