Civil Service : Jurnal Kebijakan dan Manajemen PNS
Jurnal kebijakan dan manajemen pegawai negeri adalah jurnal peer-review yang diterbitkan dua kali setahun (Juni dan November). Isi jurnal berisi analisis penelitian yang dilakukan oleh semua lapisan aparatur PNS dengan substansi diskusi terkait isu-isu terkait pengelolaan PNS. Setiap diskusi memberikan perspektif kritis dan analisis yang meyakinkan sehingga dapat menjadi jalan keluar dari berbagai masalah yang telah dan sedang melalui kerja teoretis sebuah penelitian. Jurnal ini didedikasikan dan diterbitkan dalam upaya untuk meningkatkan kualitas pengorganisasian, perencanaan dan pelaksanaan birokrasi, serta kinerja tata kelola Aparatur Sipil Negara.

This article will telling us any alternatives about how Indonesian bureaucracy should be reforming and transforming its structure and values into new paradigm, culture and structure. The key words are how they can change to be a political neutrality institution and competence person, they should have good training to build clear vision as entrepreneur corporate and ascetic spiritual institution when they serving all of citizens and states. The conclusion of this article are the explanation about how any stakeholder in Indonesia should make planning of bureaucracy model of transformation and applicable implementation to achieve good bureaucracy, promoting state capacity and welfares people issues should be managed now and the future.

Classic neutrality principles of bureaucracy which put down bureaucracy as pure administrator of implementor, apolitic and has low accountability have to be changed become new neutrality principles of bureaucracy. New neutrality principles of bureaucracy want bureaucracy can act as critical administrator and implementor, politic (join in accommodating and submitting public aspiration) and has high accountability (by developing open accountability). New neutrality principles of bureaucracy can be applied if there are supporter system, like: political system which is egaliter and responsive; elite of bureaucracy and politic committing to behave egaliter, responsive and supporting the betterness change; and also education of politics that giving position citizen as most sovereign institution. In order to create the quality of public service, so bureucracy neutrality as a principle must be done. Therefore, it is necessary the profesional, responsible, reliable, and fair government officer through construction done based on job performance and carrier system focused on system of job performance. The effort is written in number 43 of Laws in 1999 that regulates about pronciples of officers and number 37 of government regulation in 2004 about prohibition for government officer to be the member of political party.

Undang-Undang No.43 Tahun 1999 Tentang Pokok-pokok Kepegawaian Negara rules how to make bureaucratic independenly. But in fact, the process of democratic showed many problematic situations of bureaucratic reform in Indonesia. Sentralistic power have made of bureaucracy officials are fail to respond of economic and politics crisis because street-level bureaucrats not have authority and creativity to take in hand of economic and social problems. Paternalistic bureucracy and power concentrate on higher officials and social services concentrate on lower officials. Not drive and incentive for efficiency and responsive. Culture and competitive traditions not develop. Contract management is one of element in bureaucracy that regulate of relationship pattern between higher officials and lower officials. Relationship pattern between officials have not openness and rightness so that have potential to make corruption, collution and nepotism. Purposes of contract management models for increase of performances and neutralities of public servan with partnerships equity between higher officials and lower officials. Besides as of personnel admistration models so alternative model to increase of budgeting performance. Basing on theoretical perspective, civil service neutrality which is part of bureaucratic neutrality has three theoretical basis: (1) Hegel’s neutrality, (2) ) Max’s neutrality, and (3) ) Weber’s neutrality. Hegel and Weber with their own argumentation agree that bureaucracy should be neutral, while Max argue thar bureaucracy should not be neutral. This theoretical controversion has impact on the interpretation of policy implementation in many countries, including Indonesia.

This reformation era, bureucracy in Indonesia are not many change, both in central government or local government. Burecracy behavior at reformation era is resemble with New Orde era. Although central government are many policy about burecracy reform, but burecracy behavior are not many change. Bureucracy in Indonesia still is patrimonialism. This article investigates the problem of public service ethics from an institutional optic. This is an alternative way of looking at ethics other than a cultural approach. While acknowleding that ethics roots in culture, this article argues that ethics is institutionally embedded and can therefore be institutionally engineered. Since public service ethics is an integral part of a social contract between a government and its citizens, this article recommends the implementation of a contract-like mechanism to improve ethics in public service delivery. Citizen’s charter is among the alternatives for such purpose as citizens can control their government and hold it accoutable in process of service delivery.Key words: ethics, public service, control, citizen’s charter

This paper pointed out that ethic and moral is a key factor to speed up bureaucratic reform in Indonesia. As a matter of fact, public service in Indonesia is hamper by systemic problems involving all actors in the system from high level officer to the low rank officer. Although regulation regarding ethic and moral of the government official sufficient enough to promote certain high standard code of conduct, the bureaucratic behavior is far from ideal. Indeed, bureaucratic behavior is a mixed of individual characteristic and bureaucratic characteristic. It is impossible to change bureaucratic behaviour without give attention to these two aspects. To solve this problem, leadership in Civil Servant Institution is crucial as a breakthrough to cut the vicious circle of buraucracy.Keywords: Bureaucratic Behaviour, Government Official, Ethic and Moral.
