Abstract

Indonesia as a State of Law, has some rules about marriage that is Law Number 1 Year 1974. Marriage is legitimate if it is  according to the laws  of their  each  religion  and  belief. Furthermore, there is also an obligation to register their marriage. Pasti is the name of a banjar that located in Pandak Gede Village, Kediri District, Tabanan Regency, Province of Bali. To prove that the marriage existed, Pasti’s citizens must have a Marriage Act. This  research  aims to  determine the level  of community legal  awareness in Banjar Pasti on marriage certificate ownership, and to know and examine the factors that affect it. This research uses empirical juridical approach method, that is using the existing factual approach by way of observation and research in the field, then studied and reviewed based on relevant legislation as a reference to solve the problem. Based on the research, it is found that the level of community legal awareness in Banjar Pasti on marriage certificate ownership based on Law Number 1 Year 1974 regarding Marriage is relatively high. This can be proved by the following indicators : (a). The high level of community law knowledge in Banjar Pasti on marriage certificate ownership. (b). The high level of community law  understanding in Banjar Pasti  on marriage certificate ownership.  (c). The  high level of community legal attitude in Banjar Pasti on marriage certificate ownership. (d). The high level of community legal behavior patterns in Banjar Pasti on marriage certificate ownership. The Factors influencing the  community legal  awareness in Banjar Pasti  on marriage  certificate ownership under Law Number 1 Year 1974 regarding Marriage, that is : Level of education, Age and Sex.

Abstract

Keanekaragaman Hayati Indonesia merupakan kekayaan alam Negara Indonesia sekaligus menjadi identitas nasional bangsa Indonesia. Sumber daya hayati meliputi sumber daya satwa maupun tumbuhan, yang secara fakta terhadap beberapa jenis spesies telah menunjukan kondisi terancam punah. Sehingga pemerintah Indonesia mengatur perlindungan serta pelestarian satwa maupun tumbuhan tersebut. Melalui peraturan perundang-undangan. Bahkan dilakukan  pula upaya preventif maupun represif sebagaimana tertuang dalam Undang-Undang Nomor 5 Tahun 1990 tentang Konservasi Sumber Daya Alam Hayati danEkosistemnya. Upaya represif salah satunya melalui penerapan sanksi pidana terhadap pelaku pelanggar ketentuan hukum dalam Undang-Undang aquo. Penerapan upaya represif berupa sanksi pidana tentunya tidak melepaskan peran hakim dan pengadilan dalam memutus perkara. Kajian terhadap putusan pengadilan Nomor 799/Pid.Sus/LH/2019/PN Dps ini diharapkan menjadi bahasan komperhensif terhadap pertimbangan hakim dalam memutus perkara pidana khusus di bidang lingkungan hidup. Penegakan hukum berorientasi pada keadilan tentu menjadi salah satu upaya represif yang baik dalam perlindungan dan pengelolaan lingkungan hidup, dalam konteks ini adalah satwa liar yang termasuk daftar hewan yang dilindungi oleh negara.

Abstract

One group that is vulnerable to being carried away by the flow of narcotics abuse is teenagers, this is because teenagers are at the stage of seeking identity, adolescence is a transition to adulthood. The family environment has a very important role in the formation of adolescent personality. Narcotics abuse among adolescents has become a national threat that needs to get serious attention by all elements of the nation. Lack of communication and openness in the family is one of the factors that participate in narcotics abuse among adolescents. This type of research is empirical juridical research, which is a type of research that uses facts that occur in reality in society, the nature of research in this study is descriptive. Abstract

Society in social life always there is a means in the form of control or control to regulate the various behavior or behavior anngota social group, It means that human behavior should be limited by the rules so that humans can know what to do and actions that should not be done. Behavior that is governed means a limit of values ??and norms deviant and antisocial. Con- versely, the behaviors that are ordered mean that they contain values ??and norms that are komformis. Prevention or handling efforts for the community not to violate the rules, then within the community group must have a set of values ??and norms is none other than to prevent or reduce the violation of the rules. This is called the form of social control. When looking at the function of social control that applies to the life of the community, is to develop a fear that someone not to do acts that are not in accordance with the values ??and norms that apply, and provide compensation for people who comply with the values ??and norms -the prevailing norms so as to reinforce a sense of confidence in society that the value is supposed to be adhered to for the life of society towards the better. And able to create a legal system (the rules are formally formulated with the sanctions contained in it). From these limitations, it can be interpreted that social control is a designed or not designed and controlled means and process aimed at engag- ing, educating, and even forcing citizens to comply with prevailing social norms and values.

Abstract

The court is obliged to uphold justice regardless of one’s social status. Resolving criminal cases is carried out through the courts with various types of examination processes. The examination process is referred to as a normal examination, a short examination, a quick examination in accordance with the Criminal Code. Therefore, it is necessary to know whether the implementation of the rapid inspection program has been carried out in accordance with theapplicable rules both in the Criminal Code and other legal rules. The implementation of the quick inspection program at the Bangli District Court can be carried out effectively and efficiently so that the achievement of legal objectives, namely justice and legal certainty for the entire community. It is inseparable from the factors that influence its implementation. So that in thisstudy the author discussed what are the factors that influence the implementation of the rapid inspection program in Bangli District Court and whether there are any factors that become obstacles in the implementation of the rapid examination program at Bangli District Court. The results of the study are as follows: Factors that influence the implementation of the rapid inspectionprogram at Bangli District Court namely; law enforcement, community, facilities and facilities as well as cultural factors.

Abstract

The establishment of the Satgas Gotong Royong Pencegahan Covid-19 or Covid-19 Mutual Assistance Officer Unit is a policy taken by the Governor of Bali Province in responding to the rate of spread of COVID-19 in the Bali Province area. This strategic step is a form of harmonization between the Government and its people in preventing the spread of COVID-19. Prevention through this Task Force is an Indigenous Village-based prevention which is seen as effective in preventing the spread of COVID-19 in the Bali Province area and there is a pararem that strengthens the Task Force in carrying out its duties. Using normative research and qualitative descriptive analysis, it can be concluded that the Task Force for Covid-19 Prevention is an implementation of the harmonization of the Bali Provincial Government with the Balinese customary law community in this case the Traditional Village to jointly prevent and break the chain of the spread of COVID-19.Keywords: Covid-19, Desa Adat, Harmonization, Pararem, Government, Task Force.

Abstract

Perkembangan teknologi yang sangat pesat pada saat ini dan tingkat pertumbuhan penduduk yang terus bertambah pula populasinya, mengakibatkan semakin meningkatnya aktivitas dan kepadatan di jalan raya. Lalu lintas kendaraan yang beraneka ragam dan pertambahan jumlah kendaraan yanglebih cepat dibandingkan dengan pertambahan prasarana jalan yang mengakibatkan berbagai masalah lalu lintas seperti pelanggaran, kemacetan dan kecelakaan lalu lintas. Berdasarkan data Satlantas Polres Badung, tingkat pelanggaran lalu lintas para pelajar atau anak di bawah umur 16 tahun di kabupaten Badung relatif tinggi sepanjang tahun 2015. Dari total 8.720 pelanggaran, sebanyak 1.612 kasus dilakukan oleh para pelajar. Sesuai dengan Undang Undang Nomor 22 Tahun 2009, maka pelanggaran tersebutdikenakan sanksi sesuai dengan bentuk pelanggaran yang dilakukan. Penegakan hukum terhadap anak pengguna sepeda motor yang dilakukan oleh aparat kepolisian dengan memberi sanksi berupa sanksi tilang masih kurang optimal diterapkan, karana masih tingginya tingkat pelanggaran lalu lintas yangdilakukan oleh anak pengguna sepeda motor setiap tahunnya. kurangnya sarana atau fasilitas membuat anak menggunakan sepeda motor kesekolah, seperti tidak adanya angkutan umum yang di gunakan anak untuk menumpang kesekolah, sehinga anak menggunakan sepeda motor sendiri untuk pergi kesekolah.

Abstract

Ilicit Traffic in Narcotic Drugs is carried out by international networks operating in several countries. Ilicit traffic in narcotic drugs results in huge financial and wealth gains that enable transnational crime organizations to penetrate, pollute and undermine the structure of government, legitimate commercial and financial business, and society at all levels. In dealing with this situation, Indonesia harmonizes the law through mutual legal assistance arrangements. In this study two issues will be discussed namely legal reform through mutual legal assistance and mutual legal assistance in narcotics crimes.Legal reform is a policy carried out by a country to deal with the situation that occurs in the country. The development of transnational crime was responded by the state through a policy of mutual legal assistance as outlined in the Law of the Republic of Indonesia Number 1 of 2006 concerning Reciprocal Assistance in Criminal Matters. Cooperation between countries in the process of law enforcement needs to be done to tackle the crime of trafficking in narcotics. Ilicit traffic in narcotic drugs is carried out by involving several countries. Reciprocal legal assistance in narcotics crimes can be implemented in three ways, namely diplomatic channels, through central authorities and through direct cooperation between law enforcement agencies.Keywords: Mutual legal assistance, Ilicit Traffic, Narcotic Drugs

Abstract

Law Number 1 Year 1974  on Marriage, embraces the principle of  separate property where except husband and wife determine otherwise by making a marriage agreement before or at the time of marriage is held. In the middle of 2015, Ike Farida, a lawyer who performs a mixed marriage, filed a petition for judicial review to the Constitutional Court because he felt his  constitutional  rights were injured  by the  enactment  of  Law Number  5  of  1960  on Basic Agrarian Law, namely Article 21 paragraph (1), (3), Article 36 paragraph (1); and Article 29 paragraph (1), (3), (4) and Article 35 paragraph (1) of the Marriage Law. The Constitutional Court through Decision Number 69 / PUU-XIII / 2015, in particular on the verdict stating: “At the time or before the marriage takes place or during the marriage bond, the two parties to mutual consent may  submit a written agreement  authorized by the marriage registry officer, after which the contents also apply to the third party caught “. This poses a problem where it will be difficult to know the existence of a third party related to the making of a marriage agreement. The conclusion is that the Constitutional Court Decision does not regulate the legal consequences of marriage agreement after marriage to the status of property but implicitly regulate the legal effect on a third party

Abstract

Bali, which is an international tourist destination, makes tourism as a major commodity so that the impact of the Covid 19 pandemic is enormously felt for the Bali economy and tourism actors involved. For instance, almost about 98% of tourist attractions, hotels, restaurants, spas and tourism facilities are closed to the public. With the intention that it brings a very harsh recession to the economy of the Balinese people themselves, involving the indigenous village in handling the Covid-19 outbreak in Bali is very appropriate. By involving the indigenous communities, in this case the indigenous village, it will directly touches up to the littlest area in Bali, the Banjar environment. With a more massive structure, it is also hoped that it can effectively break the chain of the spread of Covid 19 in Bali province. This writing uses the normative legal research method. The study of legislation and literature is used to formulate the authority of indigenous villages in the new era of Balinese culture tourism which will be faced after the Covid-19 pandemic. Finally, it can be concluded that the position of the indigenous villages in assisting the higher tasks of the government is legally very strong, from the constitution to the legislation below recognizing the existence and role of the indigenous villages. On this basis, it is appropriate for the indigenous village to be given its own portion as an integral part of the structure both legally and administratively. Secondly, the authority of indigenous villages in carrying out their functions in the Covid Task Force for the prevention of Covid 19 in Bali province has been very clear and this can be the basis for further enhancing role of indigenous villages in the new era of cultural tourism in Bali which will be rebuilt after this pandemic. Finally, the optimization of the role of indigenous villages in the acceleration of Covid 19 prevention in Bali has been able to run well and can answer all doubts from various parties who during the pandemic might underestimate the magnificent role of this indigenous village, thus the Provincial Government of Bali should be able to consider an alternative management of indigenous village-based tourism going forward.Keywords: Covid-19, Indigenous Village, Bali Cultural Tourism, New Normal
