Abstract

Banyak kasus malpraktik yang terjadi dari tahun 2006 sampai 2012, tercatat ada 182 kasus kelalaian medik dan malpraktik yang terbukti dilakukan oleh dokter di Indonesia, hal ini menyebabkan perlindungan hukum terhadap pasien sebagai konsumen pelayan medik sangat penting untuk didiskusikan. Kurangnya pemahaman terhadap hak tentang pasien menyebabkan pasien memiliki posisi yang lemah sebagai konsumen pelayan publik. Dalam jurnal ini, akan dibahas tentang hubungan antara pasien dan dokter, hak pasien dan penyelesaian sengketa malpraktik. Melalui penelitian ini diharapkan dapat memberikan informasi singkat untuk dapat memahami lebih baik tentang hak-hak pasien dan tindakan apa yang dapat diambil jika mengalami malpraktik dalam pelayanan kesehatan.

Abstract

                Basiclly that the rules that apply to franchise agreements (franchisting) in Indonesia is the norm of a special presence to set the franchise stipulated in Government Regulation No. 42 Year 2007 on Franchise and Minister of Trade Regulation No.68 / M - DAG / PER / 10 / year 2012 on franchise Business Type modern Store as well as other regulations related adjusted by the Regional Regulation modern stores where the franchise was founded.               Existence of traditional markets in the city of Denpasar is still maintained and not altered by the presence of modern shop franchise and it does not bias is inevitable given the people of Bali itself, which is predominantly Hindu, where many needs that require a person to shop at traditional markets, automatically it becomes value more for the traditional market .

Abstract

Ilicit Traffic in Narcotic Drugs is carried out by international networks operating in several countries. Ilicit traffic in narcotic drugs results in huge financial and wealth gains that enable transnational crime organizations to penetrate, pollute and undermine the structure of government, legitimate commercial and financial business, and society at all levels. In dealing with this situation, Indonesia harmonizes the law through mutual legal assistance arrangements. In this study two issues will be discussed namely legal reform through mutual legal assistance and mutual legal assistance in narcotics crimes.Legal reform is a policy carried out by a country to deal with the situation that occurs in the country. The development of transnational crime was responded by the state through a policy of mutual legal assistance as outlined in the Law of the Republic of Indonesia Number 1 of 2006 concerning Reciprocal Assistance in Criminal Matters. Cooperation between countries in the process of law enforcement needs to be done to tackle the crime of trafficking in narcotics. Ilicit traffic in narcotic drugs is carried out by involving several countries. Reciprocal legal assistance in narcotics crimes can be implemented in three ways, namely diplomatic channels, through central authorities and through direct cooperation between law enforcement agencies.Keywords: Mutual legal assistance, Ilicit Traffic, Narcotic Drugs

Abstract

The purpose of this study was conducted to determine the legal effects that arise in pledging the land of common property rights as collateral in the Bank in terms of Law No. 4 of 1996 on Encumbrance Right Over Land And Land Related Objects. This research method using normative research method by reviewing the Law No. 4 of 1996. Data analysis is done to solve the problems contained in the problem formulation by using descriptive qualitative data analysis. From this study obtained the result that the land of common property rights may be assumed that the land is owned by more than one person whose names are listed in the land title certificate as the land owner. the land is owned by more than one person and there is no clear division, then the authorities to take legal action on the land are all three together. Therefore,the legal effect is the existence of the consent of the other party by giving a special power of attorney to such person to act for and on their behalf to pledge the land.

Abstract

The equality of men and women in the inheritance system is a concern in the development of Balinese customary law. Basically, Balinese indigenous people adhere to a patrilineal kinship system. As a consequence, the line is drawn from the father and the heirs are only boys, while girls can only enjoy the assets of their parents as long as they are not married. This condition certainly reduces women's access to economic rights. Whereas, the economic control is very important in life. In this research, two issues are discussed, namely the inheritance system according to Balinese customary law and the struggle for gender equality through the position of women as heirs. Decree of the Pesamuhan Agung Majelis Utama Desa Pakraman Bali Number 01 / KEP / PSM-3 / MDP Bali / X / 2010, dated October 15, 2010 provides opportunities for girls to become heirs with limited provisions. Even so, the position of women as heirs in Balinese customary law is still difficult to be implemented. This is due to a very strong patriarchal culture that places men in higher power relations.

Abstract

Bali sebagai industri pariwisata tingkat internasional yang membawa warga masyarakat Bali menuju kepada masyarakat modern / masyarakat global yang serba komplek dan serba cepat( instan ) yang disertai dengan perkembangan ilmu pengetahuan dan teknologi, tranfortasi, komunikasi, ekonomi dan berbagai masalah hidup bagi warganya. Bali pada tahun 1960an secara pelan-pelan telah mengubah watak penghuninya dari budaya agraris yang membawa masyarakat Bali lebih humanis, sedangkan budaya pariwisata, waktu diubah menjadi nilai uang semata, warga masyarakat Bali makin individualis dari sisi lain budaya pariwisata membawa masyarakat Bali ke arah masyarakat global dengan pola kehidupan yang serba modern yang dengan sendirinya juga membawa berbagai masalah hidup seperti masalah kesehatan, masalah ekonomi, masalah pendidikan, masalah lapangan kerja, masalah pengaruh budaya negatif dari luar, gangguan kesehatan jiwa/mental dan sebagainya. Bagi warga masyarakat Bali yang menghadapi berbagai permasalahan hidup tersebut diatas diantaranya meresfon negatif berupa melakukan tindakan bunuh diri dengan menganggap permasalahan yang mereka alami sudah selesai dan mendapat solusi yang paling baik dan tepat. Bunuh diri merupakan perbuatan perilaku yang menyimpang atau disorganisasi sosial, penyimpangan ajaran agama-agama yang ada di Indonesia. Sehingga melalui penelitian ini dapat diharapkan mendapat jawaban tentang implementasi hukum pidana terhadap responsif negatif masyarakat global dalam melakukan tindakan bunuh diri di wilayah hukum Provinsi Bali, yang melatar belakangi perbuatan bunuh diri, modus operandinya dan upaya pencegahannya, selanjutnya dapat bermanfaat bagi masyarakat luas, pendidik, orang tua, aparat pemerintah eksekutif dan legislatif dalam rencana mengisi kekosongan hukum dan juga aparat penegak hukum, yang sekaligus juga merupakan salah satu wujud pengabdian kepada masyarakat serta melaksanakan proses kegiatan pendidikan.

Abstract

To carry out a more flexible market expansion, usually a company will open a branch office. This branch office is a representation of the head office in a certain area. The branch office is an extension of the head office, so that if a dispute arises in business relations and the resolution of the problem reaches the court, the branch office is often positioned as a party to the case, even though according to the provisions in the Law on PT which represents the company in dispute is the head office. The purpose of this paper is to find out whether the lawsuit filed by the plaintiff to the branch office does not violate the court's relative competence, and to determine the relevance of simple, fast and lowcost judicial principles in resolving the case. In this study, this type of research uses normative research by examining Court Decisions, the approach method is by intensively studying material facts (ratio decidendi) in the application of the basis for a lawsuit against the law in Civil Lawsuit No: 466/Pdt.G/2018/PN.DPS. In Denpasar, the results showed that the filing of a lawsuit at the branch office of a company in the form of a Limited Liability Company did not violate the Court's Relative Competence, because the branch office is an extension of the Board of Directors in the head office and carries out duties for the benefit of the head office. The principle of a simple, fast and low-cost trial is very relevant to be applied in this case because the implementation of the case can be more effective and efficient, because the case is handled by the Denpasar District Court so that it can save time, energy and costs.

Abstract

The active contribution of a mother/woman in activities to prevent the spread of the Covid-19 pandemic is very necessary because mothers have a natural role as the primary and first educators for children from the time the fetus is in the womb to growing and developing into the younger generation. To carry out the prevention of Covid-19 persuasively and educationally, it is necessary to have two-way communication between mothers and children, between mothers and husbands, between mothers and other family members. Besides communication through the family line, communication is also carried out through the school and community channels. Groups of women/mothers based on different professions, cultures, customs, languages ​​, and ancestral (ethnic) ties also have a role in preventing the spread of the Covid-19 pandemic to all generations of the nation. The program carried out is to socialize health protocols: wear masks, wash hands, cover mouth when sneezing and coughing, social distancing and adequate rest and nutritious eating. The juridical foundation for mothers/women to actively contribute to the younger generation in preventing the spread of the Covid-19 pandemic is based on the ideological foundation of the Republic of Indonesia, namely Pancasila and the 1945 Constitution of the Republic of Indonesia and Human Rights and laws and regulations relating to legal protection and equality of gender roles in state life. This study used a normative legal research methodology with an applied normative. The data were analyzed qualitatively on the natural roles of mothers/women in the family, the gender roles of mothers/women in school, and the gender roles of mothers/women in society. This study found that mothers/women have a natural role to actively participate in preventing the spread of Covid-19.
