Abstract

The study aims to examine attempts to counter-terrorism from a criminological perspective. This research is important given that terrorist crime is a global threat that affects countries and communities, with potentially negative effects, both physically and psychologically. The novelty of this research is in an attempt to counteract terrorist crime with a criminological perspective that uses local "jogo tonggo" wisdom. This research is a sociological jurisprudence.  The results of the research showed efforts to combat terrorist crime from a criminological perspective: character identification and funding, national preparedness, counter-radicalization, deradicalization, and radical anticipation of terrorism in Lapas. Control the fight against terrorism in Java Among other things, there is still a radical Napiter, the rise of gotong royong values, society tolerant of terrorists, legal sanctions of educational institutions, and charity of weak terrorist groups. Overcome the obstacles in combating terrorist crime requires a structured and adaptive strategy to strengthen intelligence networks by improving surveillance technology and enhancing cross-country cooperation for the exchange of information, training, and monitoring of former Napiter through a religious building, tolerance, national insight involving Islamic religious figures, implementation of jogo tonggo programs, acceleration of regional action plans for prevention and combating extremism leading to violence, and economic empowerment..Penelitian ini bertujuan untuk mengkaji upaya penanggulangan tindak pidana terorisme perspektif kriminologi.  Penelitian ini penting mengingat tindak pidana terorisme merupakan ancaman global yang merambah berbagai negara dan masyarakat, dengan potensi dampak yang sangat merugikan, baik secara fisik maupun psikologis. Penelitian ini penting mengingat tindak pidana terorisme merupakan ancaman global yang merambah berbagai negara dan masyarakat, dengan potensi dampak yang sangat merugikan, baik secara fisik maupun psikologis. Kebaruan penelitian ini adalah dalam upaya penanggulangan tindak pidana terorisme dengan perspektif kriminologi yang menggunakan kearifan lokal "jogo tonggo". Penelitian ini merupakan penelitian yuridis sosiologis. Hasil penelitian menunjukkan upaya penanggulangan tindak pidana terorisme perspektif kriminologi: identifikasi karakter dan pendanaan, kesiapsiagaan nasional, kontra radikalisasi, deradikalisasi, antisipasi radikal terorisme di Lapas. Kendalah penanggulangan terorisme di Jawa Tengan antara lain masih adanya Napiter yang radikal, lunturnya nilai gotong royong, masyarakat permisif kepada teroris, sanksi hukum lembaga pendidikan dan amal kelompok teroris lemah. Dalam mengatasi kendala dalam penanggulangan tindak pidana terorisme membutuhkan strategi yang terstruktur dan adaptif memperkuat jaringan intelijen dengan memperbaiki teknologi pengawasan dan meningkatkan kerjasama lintas negara untuk pertukaran informasi, pembinaan dan monitoring mantan Napiter melalui pembinaan agama, toleransi, wawasan kebangsaan melibatkan tokoh agama Islam, implementasi program jogo tonggo, percepatan rencana aksi daerah pencegahan dan penanggulangan ekstremisme yang mengarah pada kekerasan, dan pemberdayaan ekonomi.

Abstract

This study explores Indonesia's legal approach to narcotics rehabilitation under Law Number 35 of 2009, focusing on a shift from punitive measures to a public health framework. Article 54 mandates both medical and narcotics rehabilitation for addicts, emphasizing a commitment to breaking the cycle of dependency. Through analyzing legal provisions, Supreme Court circulars, and joint regulations, this research highlights a three-stage rehabilitation process: medical, non-medical, and aftercare phases. Emphasizing rehabilitation over punishment, insights align with the ultimum remedium principle, advocating for alternative policies. Results reveal a progressive legal landscape recognizing narcotics users as individuals in need of treatment. Supreme Court circulars and joint regulations aim to address challenges, emphasizing the importance of collaboration between legal, health, and social entities for an effective narcotics rehabilitation system in Indonesia. This legal mandate signifies a pivotal shift towards a holistic, public health-oriented response to narcotics offenses, reflecting an acknowledgment of addiction's multifaceted nature. Ongoing collaboration is crucial for successfully integrating rehabilitation into the legal framework, ensuring a compassionate and effective response to narcotics-related issues.

Abstract

This research aims to understand how essential the establishment of a special land court is in the current era in order to facilitate government policies regarding agrarian reform by looking at current cases, country comparisons, how the special court is structured, and the formulation of its judges. Soil is one type of earth's wealth that is fundamental for life. In implementing the agrarian reform policy, it is basically targeting land legalization of assets that are the object of ownership disputes between the community, companies, and government agencies, as well as land owned by the community that has not received legal certainty as the owner of the land rights of the agrarian reform object (TORA). However, in reality, regulating land ownership is not easy, so land disputes often arise that take time to resolve and ultimately hamper policies, one of which is regarding agrarian reform. This is the urgency of the need to establish a special land court. The method used in this research is normative juridical, with statutory, case, and conceptual approaches. The results of this research are that the formation of this court will be under the Supreme Court court chambers, in this case the general court, with a composition of three judges consisting of one career judge and two ad hoc judges, which of course cannot be separated from land certification, the basis of which will be regulated in law.  Penelitian ini bermaksud untuk  mengerti betapa esensialnya pembentukan pengadilan khusus pertanahan dalam era saat ini dalam rangka memperlancar kebijakan pemerintah terkait reforma agraria dengan melihat kasus terkini, komparasi negara dan bagaimana struktur pengadilan khusus tersebut beserta formulasi hakimnya. Tanah adalah salah satu jenis kekayaan bumi yang bersifat fundamental bagi kehidupan. Dalam menerapkan kebijakan reforma agraria, pada dasarnya menyasar kepada tanah-tanah legalisasi aset yang menjadi objek sekaligus peselisihan kepemilikan antara masyarakat dengan pihak perusahaan dan instansi pemerintah begitu pula dengan tanah-tanah yang dimiliki masyarakat yang belum mendapatkan kepastian hukum sebagai pemilik hak Tanah Objek Reforma Agraria (TORA). Namun, pada kenyataannya mengatur kepemilikan tanah tidaklah mudah, sehingga seringkali terjadi permasalahan sengketa tanah yang penyelesaiannya memerlukan waktu dan pada akhirnya menghambat kebijakan salah satunya mengenai reforma agraria. Hal inilah yang menjadi urgensi perlunya dibentuk pengadilan khusus pertanahan. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan pendekatan peraturan perundang-undangan, kasus, dan konseptual. Hasil penelitian ini yaitu pembentukan pengadilan ini nantinya dibentuk di bawah kamar pengadilan Mahkamah Agung dalam hal ini pada pengadilan umum dengan susunan tiga orang hakim terdiri dari satu hakim karir dan dua hakim ad hoc yang tentunya tidak terlepas dari sertifikasi bidang pertanahan yang dasarnya akan diatur dalam undang-undang.

Abstract

The aims of this research are to determine legal protection for neglected children based on the regional regulations of Bali Province. The problem in this study is how legal protection for neglected children in the province of Bali is based on the Regional Regulations of Bali Province Number 6 of 2014. This research uses a normative legal method by taking a statutory approach. The sources of legal materials used are primary and secondary, which are reviewed using literature study techniques and analyzed descriptively and qualitatively. The result can be seen that legal protection for neglected children based on Article 2 of Regulation Number 6 of 2014 of Bali Province concerning child protection states that every child has the right to be able to live, grow, develop, and participate appropriately following human dignity. Preventive protection is also emphasized, where the state, government, local government, community, family, and parents or guardians are obliged and entirely responsible for child protection. This protection is based on the principles of child protection, namely the principle of non-discrimination, the principle of the child's best interests, the right to live, grow, and develop, and the principle of children's participation.

Abstract

Traditional knowledge is a subset of intellectual activity that stems from a country's collective ideas, opinions, or discoveries. This research aims to analyze: (1) The municipal government provides legal protection for intellectual property rights in traditional knowledge to increase the welfare of Ternate City inhabitants and (2) the potential for registering intellectual property rights related to traditional knowledge from 2019 to 2023 in Ternate City. The legislation method and the case approach were used in this empirical study. The most feasible way for the Indonesian government to protect traditional knowledge now is to strengthen the database on traditional knowledge. Special regulations are urgently needed that regulate the implementation of licensing procedures for users of Traditional Knowledge. The urgency of this research because It was found that from 2019 to 2023 in Ternate City, no traditional knowledge database yet existed. On this basis, there needs to be tactical steps from the Ternate City Regional Government in encouraging city branding about the utilization of traditional knowledge. The novelty of this research because Ternate has an abundant amount of traditional knowledge from its hundreds of ethnic groups that need to be legally protected but nearly zero traditional knowledge is processed with property rights. This paper is urgent and it contributes to science as it provides knowledge on how to legally protect this valuable knowledge.

Abstract

This research aims to analyze the form of accountability of the Archipelago Capital Authority after the passing of the Archipelago Capital Law. The relocation of the country's capital will be based on social, economic, political and geographical conditions in the region that create new governance dynamics. The existence of structural changes in the implementation and governance of government in the new national capital has given rise to urgency in research related to the accountability mechanism of the Archipelago Capital Authority, which is something new in Indonesian state affairs. Through literature and theoretical studies as well as a doctrinal research approach, it is stated that the Nusantara Capital City Authority functions as a ministry-level institution that administers the Special Regional Government for the Archipelago Capital City. The position of the Archipelago Capital Authority then became an anomaly because the concept of authority was not appropriate for special regional government units. Then the responsibility of the Archipelago Capital Authority is carried out in two dimensions, namely legal and political responsibility. Apart from that, the authority obtained by the Archipelago Capital Authority through the Archipelago Capital Law is an attribution which causes responsibility to lie with the recipient of the authority (attributeary). Penelitian ini bertujuan untuk menganalisis bentuk pertanggunjawaban Otorita Ibu Kota Nusantara pasca disahkannya Undang-Undang Nomor 3 Tahun 2022 tentang Ibu Kota Negara. Pemindahan ibu kota negara dilatarbelakangi atas kondisi social, ekonomi, politik dan geografi wilayah yang menciptakan dinamika tata pemerintahan yang baru. Adanya perubahan struktur dalam pelaksanaan dan tata kelola pemerintahan di ibu kota negara baru menimbulkan urgensi dalam penelitian terkait dengan mekanisme pertanggungjawaban Otorita Ibu Kota Nusantara yang menjadi hal baru dalam ketetanegaraan Indonesia. Melalui kajian pustaka dan teoretik serta dengan pendekatan penelitian doktriner, dinyatakan bahwa Otorita Ibu Kota Nusantara berfungsi sebagai lembaga setingkat kementerian yang menyelenggarakan Pemerintahan Daerah Khusus. Kedudukan Otorita Ibu Kota Nusantara tersebut kemudian menjadi anomali karena konsep otorita tidak tepat dengan satuan pemerintahan daerah yang bersifat khusus. Kemudian pertanggung jawaban Otorita Ibu Kota Nusantara dilaksanakan dalam dua dimensi yaitu pertangggungjawaban hukum dan politik. Selain itu, kewenangan yang didapatkan oleh Otorita Ibu Kota Nusantara melalui Undang-Undang Ibu Kota Negara merupakan atribusi yang menyebabkan pertanggungjawabannya berada pada penerima wewenang (atributaris), atau dalam hal ini adalah Otorita Ibu Kota Nusantara itu sendiri.

Abstract

The development of cryptocurrency technology is the latest innovation in the financial sector. The purpose of this study is to determine the efforts made by BNPT and to assess the ideal regulations in addressing this issue in the future. Through the use of blockchain technology, users can transact anonymously. This research is considered as a normative juridical research equipped with interviews using a statutory approach. Sources of data obtained from secondary data which includes primary, secondary, and tertiary legal materials.  The novelty of the study shows that the BNPT establish the CTF Task Force which aims to combat terrorism financing through cryptocurrency and based on several previous studies and after looking at the above-mentioned examples of the phenomenon of terrorism financing, it is undeniable that many terrorists are trying to utilise cryptocurrencies to fund criminal acts. This has resulted in the issue of a legal or regulatory vacuum regarding the use of cryptocurrencies, in this case, the Commodity Futures Trading Supervisory Agency Regulation No. 6/2019 on Implementation of Anti-Money Laundering and Terrorism Financing Prevention In its future endeavors, there is a need for specific regulations to ensure that the implementation process of the CTF Task Force with other agencies can be carried out more optimally.

Abstract

The aim of this study is to provide an overview of the latest phenomenon in the development of sources of embryonic stem cells in the world, as a criticism of the Health Act that closed Indonesia's opportunity to undertake health transformation. Now many countries have begun to legalize embryonic stem cells by exploiting the remains of the in vitro fertilization embryos left just by their owners. It responds to earlier debates about the method of embryonic stem cells that originate in a fetus or embryos taken from a mother's womb. Some research sources say that embryonic stem cells have more potential than non-embryonic. On that basis, it is interesting to study how the Indonesian Health Act responds to these developments and the commitment to transform in terms of health. The innovation in this research focuses on responding to existing research that more categorizes embryonic stem cells as violating the ethics of living beings and strictly prohibits the use of embryonal stem cell. This research method is normative, using statutory and comparative approaches. The results of this research are, first, that embryonic stem cells have greater potential than the adult stem cells currently used and countries around the world are starting to legalize the use of embryonic stem cells by utilizing leftover embryos from in vitro fertilization. Second, Indonesia is still unable to carry out health transformation by utilizing legal instruments, such as the preamble to the Health Law and Development Legal Theory.Tujuan penelitian ini ialah memberikan gambaran fenomena terbaru perihal perkembangan sumber dari sel punca embrionik di dunia, sebagai kritik terhadap Undang-Undang Kesehatan yang menutup rapat kesempatan Indonesia untuk melakukan transformasi kesehatan. Saat ini banyak negara-negara mulai melegalkan sel punca embrionik dengan memanfaatkan sisa embrio in vitro fertilazation yang ditinggalkan begitu saja oleh pemiliknya. Hal ini menjawab perdebatan dahulu terkait metode sel punca embrionik yang bersumber pada janin atau embrio yang diambil dari rahim seorang ibu. Beberapa sumber penelitian mengatakan bahwa sel punca embrionik lebih memiliki potensi besar dibanding sel punca non embrionik. Atas dasar itu, menarik untuk dikaji bagaimana Undang-Undang Kesehatan Indonesia menanggapi perkembangan ini dan komitment untuk bertransformasi dalam hal kesehatan. Pembaharuan dalam  penelitian ini berfokus pada menjawab penelitian yang sudah ada yang lebih mengkategorikan sel punca embrionik sebagai hal yang melanggar etika makhluk hidup dan melarang keras penggunaan sel punca embrionik. Metode penelitian ini adalah normatif dengan menggunakan pendekatan perundang- undangan dan komparatif. Adapun hasil dari penelitian ini ialah pertama, sel punca embrionik lebih memiliki potensi besar ketimbang sel punca dewasa yang saat ini digunakan dan Negara-negara di dunia mulai melegalisasi penggunaan sel punca embrionik dengan memanfaatkan sisa embrio in vitro fertilazation. Kedua, Indonesia masih belum mampu melakukan transformasi kesehatan dengan dengan memanfaatkan instrumen hukum, sebagaimana konsideran Undang-Undang Kesehatan dan Teori Hukum Pembangunan.

Abstract

This study aims to explore the transformation of the concept of property ownership in business law as a reflection of adaptation to social, cultural, and economic changes. The complex dynamics in the relationships among individuals, companies, and the state regarding personal ownership rights, collective rights, and legal norms are highlighted. The urgency of this research lies in understanding the evolution of the relationship between law and business history, where property is not only an object of ownership but also a business asset. This research distinguishes itself from previous studies by focusing on the transformation of the concept of property ownership in business law and its historical perspective. The research employs a doctrinal method with a literature review as a secondary data source. The innovative contribution of this research includes a profound understanding of ownership theory perspectives, encompassing concepts of individual ownership rights, collective rights, and moral and ethical dimensions. The transformation of the concept of property ownership in Indonesia is reflected in its history, influenced by colonial law and local values. The impacts of globalization, technology, and social changes have led to a shift in perspectives on property ownership. Business law and property ownership are intertwined, regulating business activities with regulations reflecting Islamic law, civil law, and business law perspectives. The conclusion emphasizes the importance of a deep understanding of the transformation of the concept of property ownership to meet societal demands and ensure the sustainability of legal business relationships.Penelitian ini bertujuan untuk menggali transformasi konsep kepemilikan harta dalam hukum bisnis sebagai refleksi adaptasi terhadap perubahan sosial, budaya, dan ekonomi. Terdapatnya dinamika kompleks dalam hubungan individu, perusahaan, dan negara terkait hak milik pribadi, hak kolektif, dan norma hukumnya. Urgensi penelitian ini terletak pada pemahaman evolusi hubungan antara hukum dan sejarah bisnis, dengan harta bukan hanya sebagai objek kepemilikan tetapi juga sebagai objek bisnis. Metode penelitian yang digunakan adalah metode doktrinal dengan studi kepustakaan sebagai sumber data sekunder. Kontribusi kebaharuan penelitian ini mencakup pemahaman mendalam terhadap pandangan teori kepemilikan, termasuk konsep hak milik individu, hak kolektif, dan dimensi moral dan etika. Transformasi konsep kepemilikan harta di Indonesia tercermin dalam sejarahnya, dipengaruhi oleh hukum kolonial dan nilai-nilai lokal. Dampak globalisasi, teknologi, dan perubahan sosial menciptakan pergeseran dalam cara pandang terhadap kepemilikan harta. Hukum bisnis dan kepemilikan harta saling terkait, mengatur aktivitas bisnis dengan regulasi yang mencerminkan pandangan hukum Islam, hukum perdata, dan hukum bisnis. Kesimpulan menekankan pentingnya pemahaman mendalam terhadap transformasi konsep kepemilikan harta untuk menjawab tuntutan masyarakat dan memastikan keberlanjutan hubungan hukum-bisnis.

Abstract

This paper aims to find out the extent to which Indonesia views the concept of nature as a legal subject. This research can provide comprehensive information and understanding, which focuses on comparative law and how the application of the Theory of Legal Transplantation. Two experiences have occurred, namely in New Zealand and Ecuador, which have answered the view of nature as a legal subject. Based on these two experiences, it becomes urgent in the preparation of this research to describe the concept of nature as a legal subject in Indonesia by comparing Indonesian regulations on environmental protection and examining how Indonesia views the concept of nature as a legal subject through the existing legal system, as well as definitive legal subjects. The method used is normative juridical with a comparative approach and conceptual approach. The writing of this legal Article has the novelty of discussing the application of Articles 66 and 91 of Law Number 32 of 2009, which explicitly discusses the concept of nature as a legal subject in Indonesia and the view of Legal Transplantation Theory. The results of this study indicate that Indonesia's Law on environmental protection still does not need to recognize nature as a legal subject. Still, with the experience of two countries that have accommodated nature as a legal subject, it is not impossible through Legal Transplantation Theory that the influence in the form of legal instruments or concepts can be transplanted to the Indonesian State as a source of environmental protection regulation formation.
