Abstract

This research aims to analyze the implementation of Minister of Agrarian Regulation No. 1589/SK-HK.02.01/XII/2021 on protected rice fields in Tegal Regency and the impact of the implementation of Minister of Agrarian Regulation No. 1589/SK-HK.02.01/XII/2021 on protected lands in Tegal Regency. The urgency of this research is so that the community can obtain legal certainty regarding the status of the land they own after the stipulation of Minister of Agrarian Regulation Number 1589, so that business actors can continue their business again. This type of research is sociological. Sociological jurisprudence is research that aims to obtain legal knowledge empirically by going directly into the object or experimenting with analysis. The results of this research show that the implementation of Minister of Agrarian Regulation No. 1589/SK-HK.02.01/XII/2021 on rice fields in Lindugi in Tegal Regency has complied with the applicable regulations from the central government, but in its implementation obstacles were encountered, namely the differences in land zone maps between the central and regional governments. Minister of Agrarian Affairs Regulation No. 1589/SK-HK.02.01/XII/2021 regarding rice fields in Lindugi is the legal umbrella for implementing control over the conversion of rice fields in Tegal Regency.

Abstract

The positive fictitious principle in the Law No. 11 of 2020 concerning Job Creation (CK Law) exists to facilitate investment and simplify licensing. However, the provisions in the CK Law, which exclude the role of the Administrative Court in fictitious applications have the potential to cause injustice and legal uncertainty in society. That research focuses on examining the positive fictitious principle's existence after the CK Law's enactment in the paradigm of prophetic law. The paradigm of prophetic regulation was chosen in this study as an effort to explore the theological (divine) and human dimensions in positive fictitious formulations as in CK Law. This research is a normative legal type of research with a concept and statutory approach. The results of the study confirm that in terms of the three aspects of prophetic law, namely transcendence, liberation, and humanization, the provisions of the CK Law, which no longer involve the role of the Administrative Court and have not issued Presidential Regulations regarding positive fiction can cause uncertainty and injustice in society. That makes the substance of the prophetic law in the positive fictitious provisions in the CK Law not be realized optimally. Orientation based on the prophetic legal paradigm in regulating the positive fictitious principle after regulation in the CK Law, according to the author, can be done by revising the positive fictitious provisions in the CK Law by returning the competence of the State Administrative Court.

Abstract

The aim of this research is to analyze the mechanism of the open proportional system in the General Election of the People's Representative Council in Indonesia by referring to Law Number 7 of 2017 concerning General Elections which regulates the open list Proportional Election System, where this system can give rise to a polemic in the struggle for seats. in a very competitive parliament that has the effect of giving birth to an unhealthy model of competition between candidates that only aims to gain as many votes as possible from voters by relying solely on money and popularity. This research method uses normative juridical in answering the problems in this paper. Meanwhile, the results of the research obtained are that an open Proportional System makes it possible for anyone to nominate themselves as members of the legislature. In this system, a person who gets the most votes can take a seat as a member of the People's Representative Council even though the person concerned is at the bottom of the ballot paper.

Abstract

This research aims to analyze the use of the right of inquiry by the Regional People's Representative Council (DPRD) in Indonesia's state governance, particularly in overseeing infrastructure development in Sleman Regency. The urgency of this research lies in the need to strengthen the supervisory function of the Regional House of Representatives (DPRD) to ensure the effectiveness and transparency of regional development. The novelty of this research focuses on optimizing the role of the DPRD through a normative juridical approach and an in-depth analysis of the implementation of oversight functions involving the right of inquiry. This research uses a normative juridical method by examining legislation, literature, and empirical data related to the implementation of the DPRD's supervisory function. The research results show that the DPRD's oversight of infrastructure development in Sleman Regency has been effective, supported by adequate regulations, the commitment of DPRD members, as well as budgetary support, and the enhancement of human resource capacity through training. In addition, the harmonious relationship between the DPRD and the executive, as well as community participation, also strengthens the oversight. This research concludes that the optimization of the DPRD's supervisory function can be achieved through preventive and repressive oversight, both directly and indirectly, as well as across sectors. With effective oversight, it is hoped that development in Sleman Regency can proceed more transparently, accountably, and in accordance with the needs of the community without deviations that harm the state. Penelitian ini bertujuan untuk menganalisis penggunaan hak angket Dewan Perwakilan Rakyat Daerah (DPRD) dalam tata kelola negara Indonesia, khususnya dalam pengawasan pembangunan infrastruktur di Kabupaten Sleman. Urgensi penelitian ini terletak pada perlunya memperkuat fungsi pengawasan DPRD untuk memastikan efektivitas dan transparansi pembangunan daerah. Kebaruan penelitian ini terfokus pada optimalisasi peran DPRD melalui pendekatan yuridis normatif dan analisis mendalam terhadap implementasi fungsi pengawasan yang melibatkan hak angket. Penelitian ini menggunakan metode yuridis normatif dengan menelaah peraturan perundang-undangan, literatur, dan data empiris terkait pelaksanaan fungsi pengawasan DPRD. Hasil penelitian menunjukkan bahwa pengawasan DPRD terhadap pembangunan infrastruktur di Kabupaten Sleman telah berjalan baik, didukung oleh regulasi yang memadai, komitmen anggota DPRD, serta dukungan anggaran dan peningkatan kapasitas sumber daya manusia melalui pelatihan. Selain itu, hubungan harmonis antara DPRD dan eksekutif serta partisipasi masyarakat turut memperkuat pengawasan.Penelitian ini menyimpulkan bahwa optimalisasi fungsi pengawasan DPRD dapat dicapai melalui pengawasan preventif dan represif, baik secara langsung maupun tidak langsung, serta lintas sektor. Dengan pengawasan yang efektif, diharapkan pembangunan di Kabupaten Sleman dapat berjalan lebih transparan, akuntabel, dan sesuai dengan kebutuhan masyarakat tanpa penyimpangan yang merugikan negara.

Abstract

This study aims to evaluate the effectiveness of legal assistance in the investigation process for economically disadvantaged suspects at the Semarang Police Department, with a focus on the challenges and solutions encountered. The criminal justice system in Indonesia regulates the rights of suspects, including the right to legal assistance. Although this right is governed by various laws and regulations, practices in the field reveal a gap between the expected norms and the reality. This research uses an empirical legal method with an empirical juridical approach, integrating the analysis of legal norms with their implementation in practice. The findings show that although the regulations related to legal assistance are generally applied, there are still significant obstacles related to public legal awareness and the lack of effective socialization. While law enforcement officers and legal aid institutions play an active role, there is still a need for improvements in facilities and legal education for the public to ensure that legal assistance is accessible to all levels of society. This study recommends improvements in the legal assistance system and an increase in public understanding of the importance of legal aid. Penelitian ini bertujuan untuk mengevaluasi efektivitas bantuan hukum dalam proses penyidikan terhadap tersangka yang tidak mampu secara ekonomi di Polres Semarang, dengan fokus pada kendala dan solusi yang dihadapi. Sistem peradilan pidana di Indonesia mengatur hak-hak tersangka, salah satunya hak untuk mendapatkan bantuan hukum. Meskipun diatur dalam berbagai peraturan perundang-undangan, praktik di lapangan menunjukkan adanya ketimpangan antara norma yang diharapkan dan kenyataan yang ada. Penelitian ini menggunakan metode hukum empiris dengan pendekatan yuridis empiris, yang mengintegrasikan analisis terhadap norma hukum dengan penerapannya di lapangan. Hasil penelitian menunjukkan bahwa meskipun secara umum peraturan terkait bantuan hukum sudah diterapkan, masih terdapat kendala utama terkait kesadaran hukum masyarakat dan kurangnya sosialisasi yang efektif. Meskipun aparat penegak hukum dan lembaga bantuan hukum berperan aktif, peningkatan sarana dan pendidikan hukum bagi masyarakat masih diperlukan untuk memastikan bantuan hukum dapat diakses dengan optimal oleh semua lapisan masyarakat. Penelitian ini menyarankan perlunya perbaikan dalam sistem pendampingan hukum serta peningkatan pemahaman masyarakat mengenai pentingnya bantuan hukum.

Abstract

The purpose of this writing is to review and know the supervisory function of the DPRD, to determine the answer and problem solving to obstacles or obstacles in the supervision of the DPRD, in the implementation of regional regulations and mayoral regulations in the city of Semarang. Functions, duties, authority of the DPRD of Semarang city play less optimally or less maximally carry out the function of supervision on the implementation of local regulations and mayoral regulations. So that the supervisory function carried out by the DPRD has not been or is not felt by the community which raises the assumption that dprd supervision is less effective and not in accordance with the expectations of the community. The results showed that there is still weak supervision by the DPRD, against local regulations or mayoral regulations, indicated there are still local regulations or regulations that conflict with the regulations above, Then the constraints in the supervisory function of the number of members of the Semarang city DPRD have not understood the supervisory function of the implementation of regional regulations and mayoral regulations due to their educational background and still attach importance to political groups or parties. Maximize or improve in carrying out the supervisory function of the Semarang city DPRD against local regulations and mayoral regulations, in accordance with Law number 23 of 2014 concerning local government. Tujuan penulisan ini untuk mengkaji dan mengetahui fungsi pengawasan DPRD, untuk menentukan jawaban dan pemecahan masalah terhadap kendala atau hambatan dalam pengawasan DPRD, dalam pelaksanaan Peraturan Daerah dan Peraturan Walikota di Kota Semarang.Fungsi, tugas, wewenang DPRD kota Semarang kurang berperan secara optimal atau kurang maksimal mengemban fungsi pengawasan terhadap pelaksanaan peraturan daerah dan peraturan walikota. Sehingga fungsi pengawasan yang dijalankan DPRD belum atau tidak dirasakan oleh masyarakat yang menimbulkan anggapan bahwa pengawasan DPRD kurang efektif dan tidak sesuai dengan harapan masyarakat. Hasil penelitian menunjukkan bahwa masih Lemahnya pengawasan oleh DPRD, terhadap peraturan daerah atau peraturan walikota, diindikasi masih ada peraturan daerah atau perwal yang bertentangan dengan peraturan diatasnya, Kemudian kendala dalam fungsi pengawasan banyaknya Anggota DPRD kota Semarang belum memahami fungsi pengawasan terhadap pelaksanaan Peraturan Daerah dan Peraturan Walikota dikarenakan oleh latar belakang Pendidikan dan masih mementingkang kelompok atau partai politik. Maksimalkan atau tingkatkan dalam menjalankan fungsi pengawasan DPRD kota Semarang terhadap peraturan daerah dan peraturan walikota, sesuai dengan Undang-undang nomor 23 Tahun 2014 tentang pemerintah daerah.

Abstract

TThe purpose of this study is to examine how the Ethics Council as a complement to the DPRD in order to maintain dignity and honor in accordance with the DPRD's code of ethics. In fact, the Ethics Council is expected to play a role not only as a guardian of the morale and integrity of DPRD members, but also as an internal mechanism for enforcing the code of ethics and maintaining discipline, ethics and board performance. In this study using the type of empirical research. Because the title raised refers to the Reposition of the Honorary Board of the Regional People's Legislative Assembly of the Temanggung Regency in Maintaining Discipline, Ethics and Council Performance in the Regional DPRD of Temanggung Regency. The renewal of this research has not yet examined the repositioning of the Honorary Board of the Temanggung Regency People's Representative Council in maintaining discipline and performance of the council. The importance of the legal system and subsystem in taking action and maintaining the discipline of DPRD members is an important tool in monitoring and prosecuting violations of the code of ethics. Tujuan penelitian ini untuk mengkaji bagaimana Badan Kehormatan sebagai alat kelengkapan DPRD dalam rangka menjaga martabat dan kehormatan sesuai dengan kode etik DPRD. Padahal, Badan Kehormatan diharapkan berperan tidak hanya sekedar menjadi penjaga moral dan integritas anggota DPRD, melainkan juga menjadi mekanisme internal untuk menegakkan kode etik serta menjaga Kedisiplinan, Etika Dan Kinerja Legislatif. Dalam penelitian ini menggunakan jenis penelitian empiris. Sebab dari judul yang diangkat mengacu kepada Reposisi Badan Kehormatan Dewan Perwakilan Rakyat Daerah Kabupaten Temanggung Dalam Menjaga Kedisiplinan, Etika Dan Kinerja Legislatif di Wilayah DPRD Kabupaten Temanggung. Kebaharuan penelitian ini belum ada yang meneliti tentang Reposisi Badan Kehormatan Dewan Perwakilan Rakyat Kabupaten Temanggung dalam menjaga kedisiplinan dan kinerja legislatif. Pentingnya sistem dan subsistem hukum dalam suatu penindakan serta menjaga kedisiplinan anggota DPRD merupakan suatu perangkat yang penting dalam pengawasan dan penindakan pelanggaran kode etik.

Abstract

The purpose of this research is to understand and analyze Islamic Law the practice of profit sharing agreement for fish catch between skipper fisherman and jurah fisherman in Wedung Village. In Wedung Village, Wedung District, Demak Regency, profit-sharing system for marine catch isnot based on the provisions of the law Number 16 of 1964 concerning Fishery Profit Sharing. In the fishery profit sharing agreement in Wedung fishing community, the average Jurah fisherman gets 25- 30%, whereas the should have received at least 40 for using a motorized boat as stated in Article 3 paragraph (1) of the Law Number 16 of 1964. This research uses empirical juridical research methods. As a result, the practice of sharing agreements for fish catch in the fishermen’s Village Of Wedung Village are still carried out by way Of Verbal agreement without any written evidence. In the implementation of profit sharing fpr catch, 25-30% is for the skipper fisherman and 70-75% is for jurah fisherman. Profis sharing agreement for fishery between skipper fishermen and jurah fishermen are not in accordance with the Islamic Law. Based on the theory of Syirkah Mudharabah, all expenses to go fishing in the sea should be borne by skipper fisherman, but in practice, in addition to the energy and mind thay they have put into, juragan fisherman must also bear the cost of fishing in the sea. Judging from the Islamic Law’s justice theory, profit sharing agreement for fish catch between skipper fishermen and jurah fishermen in Wedung Village is Very detrimental to jurah fishermen because the receive an unfair share and these are far from thr values f juctice Penelitian ini bertujuan untuk memahami dan menganalisis pandangan Hukum Islam terhadap praktik perjanjian bagi hasil tangkapan ikan yang terjadi antara nelayan juragan dengan nelayan jurah di Desa Wedung. Di Desa Wedung Kecamatan Wedung Kabupaten Demak sistem bagi hasil tangkapan laut tidak mendasarkan pada ketentuan Undang-undang Nomor 16 Tahun 1964 Tentang Bagi Hasil Perikanan. Dalam perjanjian bagi hasil perikanan di masyarakat nelayan Wedung rata-rata nelayan Jurah mendapat 25-30 %, yang seharusnya minimal mendapat 40% karena menggunakan kapal motor sebagaimana Pasal 3 ayat (1) Undang-Undang Nomor 16 Tahun 1964. Penelitian ini menggunakan metode penelitian yuridis empiris. Hasilnya, praktik perjanjian bagi hasil tangkapan ikan yang terjadi di Perkampungan Nelayan Desa Wedung masih dilakukan dengan perjanjian secara lisan tanpa ada bukti tertulis. Dalam pelaksanaan bagi hasi tangkapan ikan, 25-30% untuk nelayan juragan dan 70-75% untuk nelayan jurah. Perjanjian bagi hasil perikanan antara nelayan juragan dengan nelayan jurah belum sesuai dengan hukum Islam. Berdasarkan teori Syirkah Mudharabah seharusnya seluruh biaya melaut di tanggung nelayan juragan, namun dalam prakteknya, nelayan jurah selain mengerahkan tenaga, dan pikiran, nelayan jurah juga ikut menanggung biaya melaut. Ditinjau dari teori keadilan Hukum Islam perjanjian bagi hasil tangkapan ikan antara nelayan juragan dengan nelayan jurah di Desa Wedung sangat merugikan nelayan jurah karena mendapatkan bagian yang tidak sebagaimana mestinya dan jauh dari nilai-nilai keadilan.

Abstract

The purpose of this research was to find out and analyze the implementation of land acquisition for toll road construction and legal protection of agricultural land in relation to the construction of the Semarang-Demak toll road, Dukun Village, Karangtengah District, Demak Regency. This study uses empirical juridical legal research, with descriptive analytical research specifications. The results of the study can be concluded that the implementation of land acquisition for the construction of the Semarang-Demak toll road in Demak Regency in general is in accordance with the Land Acquisition Regulations for the Implementation of Development in the Public Interest and the deliberation stage for determining compensation has not been carried out, so that the implementation of Law Number 41 of 2009 regarding the Protection of Sustainable Food Agricultural Land, the implementation cannot be known. In the initial deliberation process there was no compensation in the form of replacement land for the agricultural land used. The temporary agreed form of compensation is cash. Future implementation should have implemented the law in the deliberation stage. Tujuan dalam penelitian yang dilakukan untuk mengetahui dan menganalisa pelaksanaan pengadaan tanah untuk pembangunan jalan tol dan perlindungan hukum lahan pertanian dalam hubungannya dengan adanya pembangunan jalan tol Semarang-Demak Desa Dukun, Kecamatan Karangtengah, Kabupaten Demak. Penelitian ini menggunakan penelitian hukum yuridis empiris, dengan spesifikasi penelitian deskriptif analitis. Hasil penelitian dapat disimpulkan bahwa pelaksanaan pengadaan tanah untuk pembangunan jalan tol Semarang-Demak di Kabupaten Demak secara umum telah sesuai dengan Peraturan Pengadaan Tanah bagi Pelaksanaan Pembangunan untuk Kepentingan Umum dan tahap musyawarah penentuan ganti rugi belum dilaksanakan, sehingga implementasi Undang-Undang Nomor 41 Tahun 2009 tentang Perlindungan Lahan Pertanian Pangan Berkelanjutan belum bisa diketahui pelaksanaannya. Pada proses musyawarah awal belum ada ganti rugi berupa lahan pengganti bagi lahan pertanian yang digunakan. Bentuk ganti rugi yang disepakati sementara adalah uang tunai. Pelaksanaan yang akan datang seharusnya telah mengimplementasikan undang-undang tersebut dalam tahap musyawarah.

Abstract

Tujuan penelitian ini adalah untuk memahami kedudukan rekomendasi Camat dalam proses pengisian perangkat desa dan reposisi rekomendasi Camat dalam proses pengisian perangkat desa. Pengangkatan perangkat desa merupakan salah satu dari kewenangan kepala desa, akan tetapi, adanya persyaratan rekomendasi yang dikeluarkan oleh camat membuat kewenangan kepala desa seolah dibatasi, selain itu tidak adanya aturan yang jelas terkait rekomendasi tersebut, bisa menimbulkan ketidak pastian hukum . Urgensi dalam artikel ini untuk mengembalikan kedudukan rekmendasi Camat dalam sudut pandang tujuan dari regulasi hukum yang seharusnya.Metode penelitian ini adalah yuridis normatif yaitu pendekatan terhadap kajian permasalahan hukum dari aspek peraturan hukum yang berlaku. Kebaruan penelitian ini terletak pada reposisi rekomendasi camat sebagai pengawasan dan kontrol dalam setiap tahapan pengisian perangkat desa. Hasil penelitian ini adalah Camat sebagai perangkat daerah mempunyai tugas untuk membina dan mengawasi kegiatan desa sebagaimana diatur dalam PP NO 18 Tahun 2016 tentang Perangkat Daerah, yang mempunyai peran penting terkait proses pengangkatan perangkat desa. Berdasarkan aturan yang ada kedudukan rekomendasi camat dalam proses pengangkatan perangkat desa merupakan mutlak harus ada karena merupakan peraturan yang diperintahkan oleh undang-undang dan di bentuk berdasarkan kewenangan. Namun legalitas aturan-aturan tersebut belum ada penjelasan yang pasti terkait rekomendasi Camat tersebut, sehingga aturan-aturan tersebut ada celah untuk menimbulkan ketidak pastian hukum. Maka reposisi kewenangan Camat mengenai rekomendasi tersebut adalah bahwa rekomendasi Camat tersebut adalah bersifat pengawasan dan kontrol maka harus diperjelas kembali jangan sampai mendistorsi kewenangan kepala desa
