Abstract

Perkembangan teknologi internet yang terus meningkat tentunya mengakibatkan peredaran karya digital semakin pesat pula dan permasalahan mengenai hak cipta karya digital menjadi semakin ramai diperdebatkan. Tujuan penelitian ini adalah untuk menganalisis perbedaan perlindungan hukum terhadap karya cipta digital di Indonesia dan Amerika Serikat dan mengkaji penerapan ketentuan pasal 52 UndangUndang Hak Cipta tahun 2014 dalam kasus yang terjadi di Indonesia. Dalam penelitian ini digunakan pendekatan perundang-undangan dan perbandingan hukum. Hasil penelitian ini menunjukkan bahwa baik dalam UU No 28 tahun 2014 tentang Hak Cipta dan Digital Millennium Copyright Act 1998, kedua ketentuan tersebut telah mengatur perlindungan ciptaan terkait penggunaan Sarana Kontrol teknologi. Namun demikian, terdapat perbedaan dalam hal pelarangan importasi, produksi dan pemasaran alat (device) yang digunakan untuk merusak Sarana Kontrol Teknologi, dimana di dalam Undang-Undang Hak Cipta tahun 2014 tidak diatur. Perbedaan kedua, Undang-Undang Hak Cipta tidak mengatur secara lengkap klasifikasi pengecualian dari pelanggaran terkait Sarana Kontrol Teknologi; seperti penggunaan oleh perpustakaan, penelitian dan hal lain seperti dalam DMCA. Undang-Undang Hak Cipta hanya mengatur dengan frase “selama tidak menyalahi ketentuan perundang-undangan” yang masih mungkin bisa ditafsirkan secara luas Kata kunci: Ciptaan Digital, Hak Cipta, Sarana Kontrol Teknologi

Abstract

One of the agenda of the Reform in Indonesia in 1998 was Constitution Reform resulting in Amendment of Constitution of the Republic of Indonesia Year 1945 (abbreviated 1945 Constitution 1945) four times. In the present era, the idea of limited change of the 1945 Constitution is being widely discoursed to encourage the establishment of a dignified State of Law in accordance with the basic philosophy of the Pancasila state. However, learning from the experiences in the process of amending the 1945 Constitution four times gradually (1999, 2000, 2001, and 2002), realizing the idea of a Dignified Law Country does not necessarily have to go through Constitutional Amendments. Rather it can be done through the interpretation of the constitution, either by the legislature, the executive, or by the judiciary, provided that in the interpretation of the constitution, the institutions are able to capture the moral message of Pancasila and the 1945 Constitution of the Republic of Indonesia. Abstract

The Constitutional Court made a progressive legal breakthrough by asserting the rights of smallholders through the verdict on the testing of Plant Cultivation System Law. The Court stated that small farmers are exempt from licensing in making plant breeding and producing seeds. Criminalization of small farmers should be avoided. In view of this decision, a legislation is required on legal protection of farmers capable of ensuring (a) the right of peasants to the main resources, capital and production factors; (b) the right to technology in the form of seeds, fertilizers and plant protection; (c) the right to post-harvest handling and agricultural products processing and; (d) rights to the distribution and marketing of agricultural products. Abstract

KUHP merupakan produk hukum Belanda yang berdasarkan nilai-nilai individualisme dan liberalisme yang bertolak belakang dengan hukum dan budaya bangsa Indonesia. Hal ini terlihat dalam Pasal 284 KUHP tentang zina, perbuatan zina tidak dapat dilakukan penuntutan jika tidak adanya aduan. Tujuan dari penelitian ini ialah untuk menganalisis perlunya perubahan sifattindak pidana perzinaan dalam KUHP Indonesia menjadi tindak pidana biasa, dan membuat formulasi tindak pidana perzinaan dalam KUHP Indonesia yang akan datang agar menjadi tindak pidana biasa. Dalam penelitian ini menghasilkan: Pertama, berdasarkan analisis terhadap putusan-putusan pengadilan, gambaran kondisi dan reaksi masyarakat, kasuskasus zina yang tidak diadukan dan alasan pembenar perlunya perubahan sifat tindak pidana zina, maka perlu dilakukan perubahan sifat tindak pidana zina menjadi tindak pidana biasa. Kedua, agar bersifat tindak pidana biasa perlu dilakukan perubahan dengan mereformulasi Pasal 284 KUHP dengan menggunakan Teori Perubahan dan Pembentukan Undang-Undang. Hal tersebut dapat dilakukan selama Pasal tersebut bertentangan dengan Pancasila. Kata Kunci: Perzinaan, Delik Aduan, Delik Biasa, Reformulasi Kebijakan

Abstract

This legal writing aimed to determine authority of regional goverment to implementation evaluation and clarification about RAPBDesa and to determine implication of implementation evaluation and clarification RAPBDesa by regional goverment. This research used a social legal approach, where it wouldbe tempting between of rule of law with the law enforcement. Primary and secondary data sources was obtained trough observation and interview. And then describe the data that has been collected. Management according to law number 6 of 2014 concerning villages, regional govermnet has authority to do evaluation and clarificstion of APBDesa village regulation. Implementation of authority regional goverment in Jombang city on delegated to subdistrict mayor with estabilished Jombang regent regulation number 2 of 2014 concerning delegation of part of regent’s authority to the subdistrict mayor. Implementation evaluation and clarification RAPBDesa by regional goverment guided the regent regulation of the village financial management. From implementation of evaluation and clarification will issued evaluation report, which shows approved and qualify or rejected and unqualify and must to revision. Need for timeliness in the issuances of evaluation guidelines by the regional goverment and the firmness of subdistrict supervising to villages especially with schedule drafting RAPBDesa. And need for the awareness of the village goverment to do step of budgeting in management according to law.Key words: Evaluation, Clarification, Local Government, APBDesa Village Regulation.

Abstract

Article 10 of the Criminal Code explains that the Basic Punishment types consisting of capital punishment, imprisonment, confinement, fines, and penalty closure. All the types of punishment have been regulated in the KUHP, except regulations related to penalty closure. The penalty closure is regulated under the act number 20 years 1946 about Closing Penalty. The act is created after the event of July 3rd 1946. A closing penalty requirement is an act that is motivated by intentions that deserve respect. Moreover, the maximum sentence of closing penalty only applies 1 (one) time since the promulgation. Based on the explanation above, to regulate criminal proceedings in the future, it is necessary to analyze criminal closure using the Hermeneutic Double Movement by Fazlur Rahman's theory and the legislation methodology approach, case approaches, and historical approaches. Based on the results of this research, it concludes thatin the future, there should be no need for closing penalties because the meaning of the actions that are motivated by intent that deserves respect is to defend the nation. According to the Hermeneutic Double Movement theory conveyed by Fazlur Rahman, that the act of defending the homeland and the nation does not have the same moral ideas as the previous event, causing the blurring of norms and will be difficult in its application.Keywords: penalty closure, moral ideas, Hermeneutics Double Movement

Abstract

The research aims to determine the fulfillment of social costs theory when granting parate execution rights to the holders of the mortgage rights, and to determine the form of legal protection for the creditors of the holders of the mortgage rights. The formulation of the problem tested in the discussion, namely: does the granting of parate execution rights to the holders of the mortgage rights meet the theory of social costs ?, and what is the form of legal protection for the creditors of the mortgage holders ?. The research method used is normative research. This research results: 1) The right of execution parate to the holder of the mortgage rights meets the elements of Social Costs theory, this is because the creditor should have been given a right by the debtor to him for default, the debtor is responsible for a default that he did then the creditor was given the right parate execution of a guarantee, and 2) Legal protection of the debtor giving the right of dependents in the perspective of Law No. 8 of 1999 concerning consumer protection and protection of determining the value of guaranteed mortgage rights limit. The juridical reason for the resistance of the debtor granting the mortgageis based on the explanation in Article 6 of the UUHT, where the right to sell on his own strength is not intended ex lege but on the basis of an agreement first.Key words: Execution Parate, Mortgage Rights, Social Costs

Abstract

Legal Protection for Persons with Disabilities to Obtain Rights Equations in Government, the existence of Discrimination in Article 65 paragraph (1) letter b of Law Number 5 of 2014 concerning State Civil Apparatus which requires prospective ASN to be physically and mentally healthy. Of course we know that there are humans who are less than perfect or called Disabled Persons. Therefore, with this regulation, people with disabilities feel discrimination because they will not be able to meet the requirements of physical and spiritual health even though in fact they have the same abilities and opportunities (Article 28I paragraph (2) of the 1945 Constitution of the Republic of Indonesia) with normal human beings , only they have differentneeds. Efforts to Improve Legal Protection for Persons with Disabilities, as follows: Ensure and implement the importance of political education (civic education) for persons with disabilities in formal education institutions, Make changes to the contents of article No. 5 of 2014 concerning State Civil Apparatus, the Government immediately forms 15 Implementing Regulations as mandated by the contents of the Final Provisions Article 152 of Law No. 8 of 2016 concerning Disabled Persons, Providing a 10% quota to persons with disabilities to be able to sit in government seats, as a form of affirmative action or positive discrimination. the form of legislation starting from top to bottom for synchronization and harmonization, changing the stigma of people with disabilities into persons with disabilities or disabilities (different abilities), changing the concept of charity based on the concept of rights based.Keywords: Disability, Goverment

Abstract

In this study shows that the Asean Economic Community (AEC) does not protect the economic interests of the Micro Small and Medium Enterprises in the Traditional Medicine Industry in East Java because 1) national law inhibits capital, guidance or has not been able to protect price competition from global markets, 2) business competition policies Asean cannot guarantee legal certainty and protect against unfair competition among member States because it is a reference and not binding on each of its members, 3) There is a dishonorisation between the 1945 Constitution with international provisions on the Asean Economic Community (AEC), and 4) The results of harmonization of the Agreement Traditional medicines are not able to be carried out by the traditional medicine industry because the rules are equated with chemical drugs thatrequire expensive facilities and infrastructure and good buildings. Furthermore, legal construction so that the UMKM of the Traditional Medicine Industry is protected from the impact of the AEC is to extend the preparation period, the government provides capital support, and creates regulations that favor traditional drug business actors by providing clear legal certainty regarding certificates for making good traditional medicines ( CPOTB)

Abstract

Yogyakarta, pinned to the Special Region because it has its own historical factors from other regions, so that Yogyakarta has specificities that are given the law through Law No. 13 of 2012 concerning Yogyakarta Regional Privileges. On his journey there seemed to be a problem, with the Sultan currently not having a son. This study discusses: First, What is the ratio decidendi (judge's consideration) of the Constitutional Court Decision 88 / PUU-XIV / 2016 in interpreting article 18B of the 1945 Constitution? Second, how is the examination of the Constitutional Court Decision 88 / PUU-XIV / 2016, and the reformulation of regulations. This research uses normative legal research, the method of approach used is the statutory regulation, conceptual approach, historical approach and philosophy. The results of the study show that, first, there is no definite benchmark by the Constitutional Court in interpreting Article 18B of the 1945 Law concerning asymenteric decentralization. Thus, this makes the Constitutional Court Decision 88 / PUU-XIV / 2016, in its consideration, inconsistencies occur. Second, the examination of the verdict, more specifically on the legal standing, where the loss is not felt by the applicant. In the future reformulation, the state does not need to intervene in the internal affairs of the palace, either through court rulings or legislative regulations.Key words: Legal Review, MK Decision, Special Region of Yogyakarta, Asimeteris Decentralization
