Abstract

The purpose of this paper is to examine the publication of Perma No. 2 of 2015 concerning Procedures for Settling a Simple Lawsuit. Perma can be seen as one solution to meet the needs of the community for dispute resolution procedures quickly and simply. The substance contained in Perma is to uphold the principle of justice which is simple, fast, and low cost. Therefore, the requirements in a simple lawsuit are limited in nature, where if one of the conditions is not fulfilled, the case cannot be resolved through the Simple Lawsuit Procedure in accordance with Perma No. 2 of 2015. The results of the author's research, the Perma substance is needed to be improved, because the limitation of jurisdiction is only one legal domicile and the use of legal counsel in a simple claim is something that needs to be regulated in more detail, in the future to further encourage the use of a simple claim mechanism as a instrument of applying the principle of justice that is simple, fast, and low cost in Indonesia. The Supreme Court needs to regulate in more detail the role of the attorney in simple lawsuits, such as regulating the right to speak a legal representative and the problem of the absence of the principal in the event that the party is a legal entity; Electronic calling via Sms, whasapp and email can be an alternative used in the calling process, so Perma should regulate in more detail the terms and conditions of the validity of the information technology-based calling. Tujuan penulisan ini adalah  untuk menelaah penerbitan Perma No. 2 Tahun 2015 tentang Tata Cara Penyelesaian Gugatan Sederhana. Perma itu dapat dipandang sebagai salah satu solusi untuk memenuhi kebutuhan masyarakat terhadap prosedur penyelesaian sengketa dengan cepat dan sederhana. Substansi yang terkandung di dalam Perma yaitu menjunjung asas peradilan yang sederhana, cepat, dan berbiaya ringan. Oleh karena ini persyaratan dalam gugatan sederhana bersifat limitatif, di mana bila salah satu syarat tidak dipenuhi, maka perkara tersebut tidak dapat diselesaikan  melalui Prosedur Gugatan Sederhana sesuai PERMA No. 2 Tahun 2015. Hasil penelitian penulis, substansi Perma diperlukan pernyempurnaan, karena pembatasan yurisdiksi hanya pada satu domisili hukum dan penggunaan kuasa hukum dalam gugatan sederhana merupakan hal yang perlu diatur secara lebih rinci, di masa yang akan datang untuk lebih mendorong penggunaan mekanisme gugatan sederhana sebagai instrumen penerapan asas peradilan yang sederhana, cepat, dan berbiaya ringan di Indonesia. Mahkamah Agung perlu mengatur lebih rinci peran kuasa hukum dalam gugatan sederhana, seperti mengatur hak bicara kuasa hukum dan masalah ketidakhadiran prinsipal dalam hal pihak adalah badan hukum; Pemanggilan secara elektronik melalui SMS, WA dan email dapat menjadi alternatif yang digunakan dalam proses pemanggilan, maka PERMA sebaiknya mengatur secara lebih rinci syarat dan ketentuan keabsahan pemanggilan berbasis teknologi informasi tersebut.

Abstract

The issuance of the Law on Halal Product Assurance in 2014 marked a new era of halal certification in Indonesia. In the past, halal certification was voluntary, but after the JPH Law it became mandatory. The government through the Halal Product Guarantee Agency of the Ministry of Religion of the Republic of Indonesia is tasked with guaranteeing halal products in the community. The fact is that until 2022, there are still many business actors, especially those on the Small, Medium and Micro scale (MSMEs) who have not registered for halal certification. Even though the regulation has existed since 2014. Based on this, this study aims to determine the effectiveness of the Halal Product Guarantee Act on the Awareness of Business Actors in the Registration of Halal Certification in Indonesia. The research method used in this research is qualitative field research, with an empirical juridical research approach. The results of this study indicate that the Halal Product Guarantee Act has not been effective in increasing the awareness of business actors to register for halal certification and increase the availability of halal products in Indonesia. The minimum number of business actors who register for halal certification is influenced by legal awareness, namely: knowledge of legal regulations, knowledge of legal content, legal attitudes, and legal behavior. It is concluded that business actors in Indonesia have a low level of legal awareness in registering for halal certification. Many business actors do not know about the obligation of halal certification. There are also business actors who already know about halal certification, but have not yet arrived at compliance and carrying out the mandate of the Halal Product Guarantee Act. Terbitnya Undang-undang tentang Jaminan Produk Halal (UU JPH) pada tahun 2014 menandai era baru sertifikasi halal di Indonesia. Dahulu, sertifikasi halal bersifat sukarela (voluntary), akan tetapi setelah adanya UU JPH menjadi wajib (mandatory). Pemerintah melalui Badan Penyelenggara Jaminan Produk Halal (BPJPH) Kementrian Agama Republik Indonesia bertugas untuk menjamin produk halal di masyarakat. Faktanya sampai tahun 2022, masih banyak pelaku usaha terutama yang berskala Usaha Kecil, Menengah dan Mikro (UMKM) yang belum melakukan pendaftaran sertifikasi halal. Padahal regulasinya sudah ada sejak tahun 2014. Berdasarkan hal tersebut, maka penelitian ini bertujuan untuk mengetahui efektivitas Undang Undang Jaminan Produk Halal Terhadap Kesadaran Pelaku Usaha dalam Pendaftaran Sertifikasi Halal di Indonesia. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian lapangan (field research) yang bersifat kualitatif, dengan pendekatan penelitian yuridis empiris. Hasil penelitian ini menunjukan bahwa Undang-undang Jaminan Produk Halal (UU JPH) belum efektif dalam meningkatkan kesadaran pelaku usaha untuk pendaftaran sertifikasi halal dan meningkatkan ketersediaan produk halal di Indonesia. Minimnya jumlah pelaku usaha yang mendaftar sertifikasi halal ini dipengaruhi oleh kesadaran hukum, yakni: pengetahuan tentang peraturan hukum, pengetahuan isi hukum, sikap hukum, dan perilaku hukum. Disimpulkan bahwa pelaku usaha di Indonesia memiliki tingat kesadaran hukum yang masih rendah dalam mendaftar sertifikasi halal. Pelaku usaha banyak yang belum tahu tentang kewajiban sertifikasi halal. Ada juga pelaku usaha yang sudah tahu tentang sertifikasi halal, namun belum sampai pada ketaatan dan melaksanakan amanat Undang-undang Jaminan Produk Halal.

Abstract

Prostitution is a form of sexual deviation and disease of society and also against Indonesian morality. Therefore, its existence is a problem for the Indonesian nation. One of the causes is that criminal formulation policies are set within KUHP specifically article 296 jo. article 506 only discussing about criminal responsibility for a pimp. The other parties involved in such prostitution as prostitutes (sex workers) and client of prostitutes are not convicted unless one or both are committed in marriage, so it can be convicted under article 284 which qualifies for a felony in adultery. Based on these issues, this research aims to learn and analyze criminal policy for client of prostitutes in positive laws in Indonesia and criminal policy for client of prostitutes to realize substantial justice. The results of this research show that criminal policy for client of prostitutes in positive laws is not optimal. The arrangement of prostitution in particular article 296 jo. 506 KUHP only disscuss about criminal resonsibility for a pimp, so there is a legal vacuum in Indonesia's penal formulation policy that regulates prostitution. The government's policy to close brothels in Indonesia still raises problems as it is not followed by reformulation of criminal laws that regulate prostitution crimes. Thus, it has been necessary for criminal policy either by penal or non-penal efforts to realize the laws expected by society and to attain substantial justice (the perfect justice). The author's recommendation would be to include new legal norms governing prostitution crimes and encourage governments to legitimize RUU KUHP and RUU PKS.[]Praktik prostitusi ini menjadi problematika tersendiri bagi bangsa Indonesia. Salah satu penyebabnya adalah rumusan pemidanaan yang diatur dalam KUHP khususnya Pasal 296 jo. Pasal 506 hanya berkaitan dengan pertanggungjawaban pidana muncikari. Pihak lain seperti pekerja seks komersial dan pengguna jasa prostitusi tidak dimintai pertangungjawaban, kecuali bila salah satu terikat hubungan perkawinan (Pasal 284 KUHP). Penelitian ini ditujukan untuk mengetahui dan menganalisis mengenai kebijakan kriminal bagi pengguna jasa prostitusi dalam hukum positif di Indonesia dan kebijakan kriminal bagi pengguna jasa prostitusi yang berkeadilan substansial. Hasil penelitian menunjukkan bahwa criminal bagi pengguna jasa prostitusi dalam hukum positif Indonesia belum optimal. Pengaturan mengenai prostitusi khususnya dalam Pasal 296 jo. Pasal 506 KUHP hanya berkaitan dengan pertanggungjawaban pidana bagi muncikari (hal ini didasarkan karena KUHP/WvS masih dipengaruhi budaya hukum Belanda dan Prancis), sehingga menimbulkan adanya kekosongan hukum dalam kebijakan formulasi hukum pidana di Indonesia yang mengatur terkait praktik prostitusi. Upaya non penal melalui penutupan lokalisasi juga masih menyisakan permasalahan karena tidak diikuti dengan reformulasi hukum pidana yang mengatur terkait kejahatan prostitusi. Oleh karenanya, dibutuhkan kebijakan kriminal baik melalui pendekatan penal maupun non penal yang berkeadilan substansial untuk mewujudkan keadilan yang dicita-citakan masyarakat. Adapun rekomendasi penulis adalah dengan memasukkan norma hukum baru yang mengatur mengenai kejahatan prostitusi dan mendorong pengesahan RUU KUHP dan RUU PKS.

Abstract

Many children have a pregnancy out of wedlock. Many factors make the parents marry off their underage children who are pregnant out of wedlock, by applying for matrimonial dispensation to the Religious Courts. Law Number 1 Year 1974 on Marriage has set a minimum age limit for men and women to marry with age and psychological maturity considerations, for the realization of the purpose of the marriage. This study uses a juridical-empirical method, which will see the Religious Courts as the authorized institution, having particular considerations in granting marriage dispensation applications in order to fulfill the rights of the people and to preserve the order of life in the community.[]Banyak terjadi anak-anak mengalami kehamilan di luar nikah akibat dari pergaulan yang terlalu bebas antara laki-laki dan perempuan. Banyak faktor yang membuat orang tua menikahkan anaknya yang masih di bawah umur yang hamil di luar nikah, yakni dengan mengajukan permohonan dispensasi kawin ke Pengadilan Agama. Undang-undang Nomor 1 Tahun 1974 tentang Perkawinan telah menentukan batas usia minimum bagi laki-laki dan perempuan untuk menikah dengan pertimbangan kematangan usia dan psikologis, demi terwujudnya tujuan pernikahan tersebut. Penelitian ini menggunakan metode yuridis-empiris, yang akan melihat Pengadilan Agama sebagai lembaga yang  berwenang, memiliki pertimbangan-pertimbangan tertentu dalam mengabulkan permohonan dispensasi kawin dengan tujuan untuk memenuhi hak-hak masyarakat.

Abstract

Principally, legal development is a sustainable development, its function  as human interest protection, legal aims to reach an order and balance. Order in society guarantees the protection on human interest.  Even though, the development on law is directed to create order in society, meaning law and society are interconnected, there are still plenty of legal products that are not able to meet people needs, and one of them is the judicial review on  the Act no. 19 year 2013 on Protection and Enforcement to Farmers. This  reflects that the Act does not represent social factors. This shows no harmony and benefit connections between the Act no.19 year 2013 as written legal product and society. This phenomenon, then, is analyzed from Theory of John Henry Merryman on Legal Development Strategy (Orthodox and Responsive). The process of making a responsive legal product is a participative one meaning that the process involves greatly the participation of society through social groups and individual in community. Reversely, orthodox legal product is characterized by its centralistic process in which state institutions dominate the process, especially  the authority of executives.

Abstract

Children are vulnerable groups when dealing with the criminal justice system based on various analyzes. Therefore a special mechanism is needed to protect the interests of children facing the law. It is affirmed in the UN Regulations for the Protection of Children Who Lost their Freedom that the child court system must uphold rights and safety and promote the physical and mental well-being of children. Prison sentences must be used as a last resort. Children who are in conflict with the law, will get a label or stigmatization from the community from the moment the case processes at the police level until the court ruling is even possible forever. This article will discuss the implications of inconsistencies in prison sanctions for children and the purpose of criminal prosecution in RKHUP, that children who proceed in criminal justice, the label will be inherent indefinitely, so it is likely that children tend to commit criminal acts again. Prison sentences will bring children to learn more about their environment.

Abstract

The researchers analyzed from sociological and legal perspectives the COVID-19 lockdown and the plights of people remanded in security detention centers in Nigeria. The objective of the study is to identify the loopholes in the Constitution of the Federal Republic 1999 as amended and other relevant legal provisions in Nigeria. The study is an exploratory type of research whose goal is to explore the phenomenon under investigation. This research design is considered appropriate for this paper because the COVID-19 lockdown has explored the weaknesses of the extant legal provisions in Nigeria in a situation like the Lockdown. Data were from secondary sources and were subjected to content analysis. The result revealed that during the COVID-19 lockdown in Nigeria, accused persons, awaiting trial persons and prisoners in different detention centers were detained beyond the legal requirements whereas there is no legal provision that clearly stated remedies.Tulisan ini mengkaji hak-hak orang yang ditahan oleh aparat keamanan atau dijebloskan ke dalam lembaga pemasyarakatan oleh Pengadilan sebelum lockdown COVID-19 dan menjalani masa karantina COVID-19 dalam tahanan. Para peneliti mengidentifikasi ketentuan hukum yang terkandung dalam Konstitusi Republik Federal Nigeria 1999 celah di dalamnya yang gagal membuat ketentuan untuk keadaan darurat seperti penguncian. Konsekuensi yang tidak diinginkan dari tindakan purposive oleh Robert Merton diadopsi sebagai penjelasan teoretis. Makalah ini mengadopsi desain penelitian eksplorasi untuk mengeksplorasi kekosongan dalam Hukum Nigeria di mana data bersumber dari sumber sekunder dalam teks terdokumentasi. Makalah ini menemukan bahwa semua Undang-undang dan Undang-undang di Nigeria tidak memiliki ketentuan tentang bagaimana memberi kompensasi kepada orang-orang yang mengalami masalah emosional, keuangan sosial, dan psikologis sebagai akibat dari waktu yang mereka habiskan di sel tahanan di luar waktu yang diharapkan karena penguncian.

Abstract

This research examines the institutionalization, position and contribution of Islamic law to the national legal system. This study uses a qualitative method with a sociological legal approach. The data source comes from legal materials such as laws and other regulations. The research results show that the institutionalization of Islamic law into the national legal system is carried out procedurally, democratically and in accordance with the needs of the community. This institutionalization is a further process and recognition of the position of Islamic law, not only as a raw material for the making of national laws, but also as a source of law (legal sources) and even a source of values (values sources) for the development of national law. The contribution of Islamic law to the development of the national legal system can be seen in the law on marriage, zakat, waqf, hajj, guarantees of halal products and others which substantively do not contradict Islamic law.[]Riset ini mengkaji tentang pelembagaan, posisi dan kontribusi hukum Islam ke dalam sistem hukum nasional. Kajian ini menggunakan metode kualitatif dengan pendekatan sosiologi hukum. Sumber data berasal dari bahan-bahan hukum seperti UU dan regulasi lainnya. Hasil riset menunjukkan bahwa pelembagaan hukum Islam ke dalam sistem hukum nasional dilakukan secara prosedural, demokratis dan sesuai dengan kebutuhan masyarakat. Pelembagaan ini merupakan proses lanjut dan pengakuan mengenai posisi hukum Islam, bukan saja sebagai bahan mentah (raw material) pembuatan hukum nasional, tapi juga sebagai sumber hukum (legal sources) dan bahkan sumber nilai (values sources) pembangunan hukum nasional. Kontribusi hukum Islam dalam pembangunan sistem hukum nasional dapat dilihat pada UU perkawinan, zakat, wakaf, haji, jaminan produk halal dan lainnya yang secara substantif tidak bertentangan dengan hukum Islam.

Abstract

The national land law structure in force in Indonesia does not mention and does not prohibit the sale and purchase of customary land rights. The fact in customary law has conditions that must be met regarding the transfer of the sale of customary land rights. If it does not meet the requirements, then buying and selling rights to customary land is said to be a deviation regarding the objectives contained in the customary order. Formulation of the first problem, why the legality of buying and selling rights over customary land of the Malay tribe in Dharmasraya Regency, West Sumatra Province. Second, what is the form of transfer of customary land rights according to customary law and national land law in Dharmasraya Regency and what kind of government legal policy is capable of providing protection to customary community rights relating to customary land rights? This paper is the result of research using the Socio Legal Research method that uses primary data and secondary data is a source of questions with the collection techniques carried out by observation and interviews equipped with literature studies and analyzed descriptively prescriptive. The results of the study found a deviation regarding the substance of the transfer of title to the Malay customary land. One of the factors is the undeniable development of the age related to economic survival without thinking about the common rights inherent in customary land. The conclusion is that the customary land is a common right of the customary law community. The meaning of collective rights here is not owned by individuals, ‘ninik mamak’ or customary leaders only. Therefore, the sale and purchase of customary land rights must be returned in accordance with customary law norms attached to the customary law community itself. So that the existence of customary land is maintained in the days to come and is not eroded by time. The future legal politics of the government pays attention to the existence of customary land and recognizes the customary community's customary land to be poured in the form of an authentic deed and poured in the form of a Regency / City Regional Regulation in terms of the transfer of customary rights to other parties, especially investors.

Abstract

The rapidly growing information technology-based co-financing service (LPBBTI) in Indonesia requires a forceful legal basis for the parties involved in information technology-based financial services. As a rule-of-law country, Indonesia must make the rule of law the commander in chief and guide behavior. This research seeks to find the legal basis of LPBBTI in the laws and regulations of Indonesia, which is carried out by document study and uses a statute approach. The data obtained were then analyzed qualitatively. This research did not find any legal basis for LPBBTI in the law, but there are several laws related to LPBBTI, such as the Civil Code and Law No. 11 of 2008. The legal basis for LPBBTI specifically only exists in the Financial Services Authority Regulation No. 10/POJK.05/2022 and  No. 13/POJK.02/2018.Layanan Pendanaan Bersama Berbasis Teknologi Informasi (LPBBTI) yang berkembang pesat di Indonesia memerlukan landasan hukum kuat sebagai panduan para pihak yang terlibat dalam layanan keuangan berbasis teknologi informasi tersebut. Indonesia sebagai penganut negara hukum harus menjadikan hukum sebagi panglima dan pedoman dalam bertingkah laku. Penelitian ini berusaha menemukan landasan hukum LPBBTI dalam peraturan perundang-undangan di Indonesia yang dilakukan dengan studi dokumen dan menggunakan pendekatan statute. Data yang diperoleh kemudian dianalisa secara kualitatif. Penelitian ini tidak menemukan landasan hukum LPBBTI dalam undang-undang tetapi ada beberapa undang-undang yang terkait dengan LPBBTI seperti Kitab Undang-Undang Hukum Perdata dan Undang-Undang No. 11 tahun 2008. Dasar Hukum LPBBTI terdapat dalam Peraturan Otoritas Jasa Keuangan No. 10/POJK.05/2022 dan No. 13/POJK.02/2018.
