Abstract

The existence of law accommodates every interest so that there is no conflict in society. From the statement we see the function of law as a mediator between many interests, one of which is the interests of indigenous peoples. Awareness of the importance of resolving customary law issues encourages the government to form institutions responsible for resolving customary law. The statement of recognition by the state to customary law communities is as long as they are still alive in the provisions of Article 18 paragraph (2) of the 1945 Constitution of the Republic of Indonesia becomes a question whether this article can be interpreted as a form of guarantee of full legal protection for customary law communities. This research discusses the existence of customary law communities in the formation of village customary institutions as alternative dispute resolution institutions. This type of normative legal research is studied through literature studies using legal materials collected through inventory and identification of laws and regulations. The approach used in this research is a statutory approach. The results of this study found that the existence of a customary law community unit and recognition from the local government through a regional regulation is a form of legal certainty for customary law communities in the region. With this recognition, the customary institution formed must come from the community unit which better understands the origin and traditional rights of the community so that the LAD is also a judicial institution at the indigenous community level is expected to be able to provide benefits to the community. Alternative dispute resolution is a concept of a customary law settlement process directed at an opportunity for parties to produce a win-win solution (win for all parties to the dispute) through negotiation, negotiation, mediation, arbitration and through the courts.

Abstract

The study area in Kecamatan Damai, Kabupaten Kutai Barat, East Kalimantan, consists of two coal-bearing formations, namely the Pamaluan Formation (Tomp) and the Warukin Formation (Tmw). The northern region is characterized by moderate to steep hills with slopes ranging from 7% to 30%. The lithology predominantly comprises sandstone with some claystone, and coal is found as intercalations within these layers. Five coal outcrops, named OCPDM, were identified, with three located outside the concession area. These outcrops exhibit varying thicknesses and orientations, primarily following a northeast-southwest direction, representing four coal seams of moderate thickness. The coal samples show low-quality characteristics. An analysis revealed that only Seam 2 and Seam 3 extend throughout the concession area, with an inferred coal resource of up to 18,100 metric tons. However, the preliminary investigation yielded unsatisfactory results, indicating that the coal potential in the area is not economically viable. Furthermore, constructing a hauling road to the nearest designated stockpile location at Mahakam River would pose significant challenges in terms of distance and cost. Considering these factors, it is concluded that the area does not hold sufficient economic potential for coal extraction.

Abstract

In this study, liquid smoke was pyrolyzed in a batch type pyrolysis reactor equipped with a stirrer to accelerate heat transfer during the process. In addition, cooling water that has been cooled by the refrigeration system is used during the smoke condensation process to produce liquid smoke. The research was conducted based on these supporting parameters to determine the effect of size, temperature, and pyrolysis time of palm shells on liquid smoke products. The method uses a pyrolysis process carried out in batches. Observations were made on the parameters of pyrolysis time, volume, pH, specific gravity (BJ), water content, acetic acid content, active compounds, and bacterial inhibition for each pyrolysis temperature interval, namely temperature 23 oC - 100 oC, 100 oC - 200 oC, 200 oC - 300 oC, and 300 oC - 400 oC. The test results stated that the amount and type of chemical produced causes the specific gravity of liquid smoke to increase with increasing pyrolysis temperature
