Abstract

Married Indonesians who have never entered into a marriage contract face conflict over the division of common property during divorce. On the other side, the Religious Courts have difficulties deciding such matter since neither party entered into a marriage contract, and thus lack authentic evidence related to the origin of the husband's and wife's property. The objective of this study is to examine the legal protection of marital property through the use of a marriage contract deed. This paper employed juridical-normative legal research. Subsequently, the object was studied qualitatively. The study's findings indicate that legal protection of assets in a marriage contract can occur only after the wedding take place. Where a marriage contract serves as a law for the parties, this is in accordance with Civil Code Article 1338. Additionally, Article 29 of the Marriage Law requires that the agreement's contents be carried out in good faith, taking into account applicable law, religion, standards of decency, and public order. Unless one of the parties breaches the marriage contract and causes harm to the other party, the court may grant compensation to the aggrieved party, which may include both demands for the agreement's execution as well as compensation.

Abstract

This paper examined various information content to gain an in-depth understanding of the status or law of Binary Options in Indonesia's trading context. In recent years, the development of digital-based businesses has been growing and proliferating, thus requiring an explanation of the legal status in business and trade. Therefore, we have obtained research evidence that provides a comprehensive understanding of the existence of binary options and their legal status. Before concluding, of course, we need a scientific data processing process to account for these findings regarding the validity and reliability of these findings. As for the process, we get the data through a Google search on some sources of binary business literature and legality both in the Indonesian context and internationally. So, based on the results of the study and discussion, we can conclude that the legal status of binary options trading is a business that is forbidden due to the nature of its work is highly speculative or chancy, and this is not in line with the context of the legal status in Indonesia. It is hoped that these findings will add to the repertoire of scientific understanding of business and trade in Indonesia, especially in the digital era.

Data sources are primary and secondary data sources. Primary data sources are lecturers at the Faculty of Teacher Training and Education (FKIP) who submit 2020 PNBP research spread across four majors, namely the Department of Education, Department of Mathematics and Natural Sciences, Department of Language and Literature and Department of Social Studies. While secondary data sources are reports and articles on the results of PNBP research in 2020. Data collection techniques use interviews and documentation. Data analysis uses data collection, data condensation, data display and drawing conclusions. Test the validity of the data using triangulation methods and references. The mandatory output in this research is scientific publication in national journals or proceedings. The additional output is an academic text that can be used as a policy at FKIP Mataram University. The results of the study show that there are still some obstacles faced by lecturers in publishing research results, namely: the ability to write and find ideas, the ability to use technology, foreign language skills, lack of cooperation, literature review.

The series of procedures for processing competency certification test data are currently not systemized properly and are still carried out manually starting from the registration stage to storing test results. The LSP data management method which is currently still done manually needs to be changed to a more systematic and automatic method. Therefore, to define the required ASN data according to the needs and to streamline data exchange between the system and the interface, it will be made using an API-based ASN Competency Certification Test System with GraphQL architecture.
