Abstract

Abstract: Inheritance, according to Minangkabau custom, is given to girls, not boys. In Islam, property inheritance is regulated by Far?i? fiqh, which gives to daughters, sons, spouses of heirs (husband or wife) and even the inheritor's parents. Property inherited from generation to generation in the Minangkabau community is called "pusaka tinggi” which means high heritage. In contrast, the legacy of the parents' livelihood is called "pusaka rendah” which means low inheritance. This article wants to answer about how the inheritance of the Minangkabau community in Koto Tangah Subdistrict and Nanggalo Padang City Subdistrict. The authors use a qualitative research model and an empirical juridical approach, with the data in this article obtained from interviews, observations and document studies. The result is that the distribution of the Minangkabau community's inheritance in Koto Tangah Subdistrict and Nanggalo Padang City Subdistrict is divided into two. "Pusaka tinggi" which is the people's property and cannot be traded, will always be inherited, controlled and owned from generation to generation from the traditional female line. While the "pusaka rendah" is individual property, the inheritance distribution follows the Heir religion; if Moslem, then Far?i? fiqh can be applied. Keywords: Inheritance Law; High Heirloom; Low Inheritance; Minangkabau custom.   Abstrak: Harta peninggalan menurut adat masyarakat Minangkabau diberikan kepada anak perempuan bukan kepada anak laki-laki. Sedangkan dalam Islam, peninggalan harta diatur oleh ilmu Far?i? yang memberikan kepada anak perempuan, anak laki-laki, pasangan pewaris (suami atau istri) bahkan orang tua pewaris. Harta hasil warisan turun temurun di masyarakat Minangkabau disebut “pusaka tinggi” sedangkan peninggalan hasil pencaharian orang tua disebut “pusaka rendah”. Artikel ini ingin menjawab tentang bagaimana pembagian harta waris masyarakat Minangkabau di Kecamatan Koto Tangah dan Nanggalo Kota Padang. Penulis menggunakan model penelitian kualitatif dan pendekatan yuridis empiris, dengan data dalam artikel ini diperoleh dari hasil wawancara, observasi dan studi dokumen. Hasilnya, bahwa pembagian harta waris masyarakat Minangkabau di Kecamatan Koto Tangah dan Nanggalo Kota Padang dibedakan menjadi dua. “Pusaka tinggi’ yang merupakan harta Kaum dan tidak dapat diperjualbelikan akan selalu diwarisikan, dikuasai dan dimiliki secara turun temurun dari garis perempuan secara Adat. Sedangkan “pusaka rendah” yang notabennya harta individual, pembagian warisnya mengikuti agama Pewaris, jika Muslim maka ilmu Far?i? dapat diterapkan. Abstract

Abstract: The role of risk management in banking is crucial in realizing a good and healthy banking industry. This research aimed to determine how the Covid-19 pandemic impacted operational risks at the Muamalat bank Lamongan branch office. The research method used is a qualitative research method using a case study approach. This research describes how the current Covid-19 pandemic impacts banking operational risks at the Muamalat Lamongan bank branch office. The results of this research are that several operational risks must be faced by the Muamalat bank Lamongan branch office, namely reduced banking operating hours, implementation of WFH (work from home) policies for banking employees, and increased bank operational costs. There are two operational risk factors, namely, internal and external factors. To overcome operational risks during the Covid-19 pandemic, the Muamalat bank Lamongan branch office made several efforts, including implementing health protocols, opening accounts for new customers outside the office, maximizing existing technology, and restructuring financing for customers affected by Covid-19. Penelitian ini bertujuan untuk mengetahui bagaimana dampak pandemi Covid-19 terhadap risiko operasional pada Bank Muamalat Kantor Cabang Lamongan. Metode penelitian yang digunakan adalah penelitian kualitatif dengan menggunakan pendekatan studi kasus. Penelitian ini fokus ingin mendeskripsikan tentang bagaimana dampak pandemi Covid-19 saat ini terhadap risiko operasional perbankan di kantor cabang bank Muamalat Lamongan. Hasil dari penelitian ini adalah beberapa risiko operasional yang harus dihadapi bank Muamalat kantor cabang Lamongan yaitu pengurangan jam operasional perbankan, penerapan kebijakan WFH (work from home) bagi pegawai perbankan, serta peningkatan biaya operasional bank. Ada dua faktor risiko operasional, yaitu faktor internal dan faktor eksternal. Untuk mengatasi risiko operasional di masa pandemi Covid-19, Bank Muamalat kantor cabang Lamongan melakukan beberapa upaya, antara lain menerapkan protokol kesehatan, pembukaan rekening bagi nasabah baru di luar kantor, memaksimalkan teknologi yang ada, dan melakukan restrukturisasi pembiayaan bagi nasabah yang terdampak Covid-19. Abstract

The proliferation of cooperatives in the community has become a phenomenon. This phenomenon can be classified into positive and negative side. Positive feedback can be seen from public access to capital, as it has been demonstrated that cooperatives provide business loans or consumption to the community through a mechanism that is simpler than banks. A negative assessment can be seen in the practice of loan sharks operating under the guise of saving and loan cooperative. This is in contrast to previous research, which still focuses on comparing the concept of Hatta cooperatives with the Islamic economic system. This study will look into how the cooperative system works in an Islamic boarding school. Is the system used Sharia-based, or does it refer to Hatta cooperatives' thinking? This study employs a qualitative research method (case study). The case study meant here is the existence of cooperatives under the auspices of boarding schools, but the cooperatives do not declare themselves to be sharia cooperatives. The findings show that community-based cooperatives can work great when their focus is not solely on profit. Keywords: Cooperatives, Shariah Cooperative Concept, Hatta Cooperative Concept.   Abstrak: Menjamurnya badan koperasi di masyarakat sudah menjadi sebuah fenomena. Fenomena ini dapat diklasifikasikan menjadi hal yang positif dan negatif. Umpan balik positif dapat dilihat dari akses masyarakat terhadap permodalan, seperti yang telah ditunjukkan bahwa koperasi memberikan pinjaman usaha atau hal yang bersifat konsumtif kepada masyarakat melalui mekanisme yang lebih sederhana dari pada bank. Penilaian negatif terlihat pada praktik rentenir yang berkedok koperasi simpan pinjam. Hal ini berbeda dengan penelitian sebelumnya yang masih fokus membandingkan konsep koperasi Hatta dengan sistem ekonomi syariah. Kajian ini akan melihat bagaimana sistem kerja sama di sebuah pondok pesantren. Apakah sistem yang digunakan berbasis syariah, atau mengacu pada pemikiran koperasi Hatta? Penelitian ini menggunakan metode penelitian kualitatif (studi kasus). Studi kasus yang dimaksud di sini adalah adanya koperasi yang bernaung di bawah pondok pesantren, namun koperasi tersebut tidak menyatakan diri sebagai koperasi syariah. Temuan menunjukkan bahwa koperasi berbasis masyarakat dapat bekerja dengan baik jika fokus mereka tidak semata-mata pada keuntungan. Abstract

Abstrak: Penelitian ini bertujuan untuk menelaah signifikansi peran Lembaga Filantropi yang berbasiskan Islam dalam mengelola dana umat untuk pemberdayaan ekonomi masyarakat. Kondisi perekonomian masyarakat yang mengalami tekanan, khususnya di masa pandemi covid-19 saat ini, merupakan sebuah tantangan, dan membutuhkan perhatian dari berbagai pihak. Dan Lembaga LAZISNU Rejoso – Nganjuk sebagai salah satu Lembaga filantropi memiliki beberapa program yang dipandang dapat menjawab tantangan tersebut. Penelitian ini menggunakan pendekatan kualitatif, dan menggunakan teknik observasi partisipan dalam pengumpulan data. Peneliti kemudian memaparkan data tersebut secara deskriptif analitis. Penelitian ini berusaha untuk menjawab bagaimana gerakan Filantropi yang memiliki landasan teologis dalam Islam mampu untuk menjadi solusi pemberdayaan ekonomi masyarakat, khususnya di masa pandemi covid-19. LAZISNU - Rejoso - Nganjuk dipilih sebagai locus penelitian karena lembaga ini memiliki beberapa program unggulan. Dan Penelitian ini menunjukkan bahwa program-program tersebut yang di antaranya adalah Santuy Dua, Pena, Portal, One Week One Manja, Abya, Dan Lazis Skill mampu untuk menjadi alternatif pemberdayaan masyarakat sekitar. Kata Kunci: Filantropi Islam, Pengelolaan Zakat, Lazisnu Rejoso.   Abstract: This study aims to examine the significance of the role of Islamic-based Philanthropic Institutions in managing people's funds for community economic empowerment. The economic condition of the people who are experiencing pressure, especially during the current covid-19 pandemic, is a challenge, and requires attention from various parties. And the LAZISNU Rejoso – Nganjuk Institution as one of the philanthropic institutions has several programs that are considered to be able to answer these challenges. This study uses a qualitative approach, and uses participant observation techniques in data collection. The researcher then presented the data in an analytical descriptive manner. This study seeks to answer how the Philanthropy movement which has a theological foundation in Islam is able to become a solution for community economic empowerment, especially during the COVID-19 pandemic. LAZISNU - Rejoso - Nganjuk was chosen as the research locus because this institution has several excellent programs. And this research shows that these programs, which include Santuy Dua, Pena, Portal, One Week One Manja, Abya, and Lazis Skill, are able to become an alternative to empowering the surrounding community. Abstract

Penelitian ini bertujuan untuk mengetahui bagaimana penerapan metode RGEC (risk profile, governance, earnings dan capital) dalam menganalisis kesehatan Bank BNI Syariah Tahun 2015 dan bagaimana analisis tingkat kesehatan dengan menggunakan metode RGEC (risk profile, governance, earnings dan capital) dalam menjaga stabilitas kesehatan Bank BNI Syariah tahun 2016. Metodologi penelitian yang digunakan adalah pendekatan kualitatif dengan jenis penelitian deskriptif. Hasil penelitian yang diperoleh adalah Berdasarkan penilaian tingkat kesehatan PT. Bank BNI Syariah tahun 2015 dengan menggunakan metode RGEC yang meliputi aspek risk profile, governance, earnings dan capital, didapatkan hasil bahwa kesehatan PT. Bank BNI syariah berada pada peringkat 2 yaitu SEHAT dengan nilai keseluruhan 83,33%. Dalam hal ini PT. Bank BNI syariah mampu menghadapi pengaruh negatif yang signifikan dari perubahan kondisi bisnis dan faktor eksternal lainnya. Dan juga PT. Bank BNI syariah mampu menjaga stabilitas kesehatan bank syariah di tahun 2016. Hal ini dibuktikan dengan penilaian kesehatan PT. Bank BNI syariah di triwulan pertama dan kedua tahun 2016 dengan peringkat SANGAT SEHAT.Dari hasil dari penilaian kesehatan dengan menggunakan metode RGEC ini juga dapat dijadikan acuan untuk evaluasi, saran perbaikan dan menjaga stabilitas kesehatan bank syariah.

Abstract

Penelitian yang berjudul “Strategi Pondok Pesantren Sunan Drajat dalam Mengimplementasikan branding Sebagai Pondok Kewirausahaan dan Implikasinya Terhadap Jiwa Kewirausahaan Santri”. Ini merupakan penelitian kualitatif yang bertujuan menjawab pertanyaan tentang apa dan bagaimana strategi Pondok Pesantren Sunan dalam mengimplementasikan branding sebagai pondok kewirausahaan dan bagaimana implikasinya terhadap santri serta faktor apa yang menjadi penghambat dna pendukung dalam pengimpleementasian branding sebagai pondok kewirausahaan. Metodologi penelitian yang digunakan adalah pendekatan kualitatif. Data dalam penelitian ini dikumpulkan dan dianalisis secara sistematis. Pengumpulan data dilakukan dengan wawancara secara langsung dengan informan dalam penelitian ini, yaitu Kepala perekonomian Pondok Pesantren Sunan Drajat beserta staff dan santri Pondok Pesantren Sunan Drajat. Hasil penelitian menunjukkan bahwa Strategi yang dilakukan oleh Pondok Pesantren Sunan drajat dalam mengimplementasikan branding sebagai pondok kewirausahaan dilakukan dengan cara sebagai berikut : Pengitegrasian ke dalam lembaga formal (kurikulum) , Pengintegrasian ke dalam Lembaga non Formal (Pengajian), Pelatihan dan Praktik Lapangan. Dari kelima strategi yang paling berpenggaruh dalam jiwa kewirausaahaan santri adalah pengajian yang dilakukan oleh kiai, hal tersebut dapat dibuktikan dari 10 Informan yang telah dikumpulkan oleh peneliti 7 diantaranya termotivasi untuk membuka usaha dari nasehat, motivasi yang diberikan oleh kiai. Faktor yang membuat pengajian yang dilakukan oleh kiai menjadi sangat berpengaruh dikarenakan keberadaan kiai yang menjadi sentral pondok pesantren. Faktor Pendukung dan Penghambat Pengimplementasian Branding Sebagai Pondok Wirausaha, terdapatnya berbagai macam usaha dengan berbagai bidang yang berbeda dalam pondok pesantren, terlibatnya santri dalam unit usaha pondok pesantren, dukungan yang penuh dari pengasuh pondok pesantren. Sedangkan faktor penghambatnya anatara lain : Kurangnya kesadaran santri mengenai enterpreuner, padatnya jadwal kegiatan santri, dan Minimnya SDM. Melihat keadaan tersebut hendaknya Pondok Pesanren Sunan Drajat, untuk lebih memaksimalkan strategi branding kewirausahaan yang tidak hanya terpusat pada pengasuh dan ustadz tetapi juga pada kurikulum lembaga formal. Hendaknya pengintegrasian kurikulum kewirausahaan kedalam lembaga formal melibatkan semua lembaga formal yang ada di Pondok pesantren Sunan Drajat.

Abstract

During this time, zakat and its management just ideal in level of discourse and theory, while the realization is always constrained by two things: the synchronization of management of zakat which is still partially addressed institutional and the distribution of zakat overlap between agencies. This has led to the potential for a national charity - in the range of Rp. 217 trillion to Rp eventually absorbed only Rp. 1.7 trillion. Given this reality, East Java BAZ strives to formulate and implement measures that are considered able to eliminate or at least to minimize—the effects of 2 problems above. The initial thing to do is optimize the strategic plan through the actualization of the vision and mission of BAZ Java that is focused on optimizing the distribution of ZIS in order to realize the mandate of Law Number 38 of 1999 Jo. Law No. 23 of 2011 on Zakat. Various forms of innovation regarding methods of distribution and ZIS revenue optimization continue to be encouraged and realized, with the ultimate goal of successful realization of zakat management function effectively and efficiently, for the welfare of the people and regional poverty reduction.

Abstract

The historical development of Islamic system economic in Indonesia reflects the dynamics of the aspirations and wishes of the Indonesian people themselves, to have an alternative fair economic system, in the real sector. as an alternative search process in the monetary system which is characterized by the principles of transparency, fairness, balance and ethics in creating a prosperous society materially and spiritually. The initial of this alternative search system, initiated by scientific studies about Islamic economic and financial. The result of those studies is the publication of islamic banking laws. The initial of Islamic economic system of banking began in the early 1980's, when the government issued a policy package on Banking liberalization.The scholars' at that time established an interest-free rate, bank Muamalat (Islamic banks) at the end of 1991 and operational in early 1992, but none of the legal device that can be used as a reference.This condition lasted until the year 1997, in which Indonesia was hit by the economic and moneter crisis.At that time, when conventional banks had been liquidated, , Islamic banks showed their existence and do not experience economic shocks. Aspiration of Indonesian people had been growing to have an Islamic financial institutions, non bank financial institutions and the banking through the application of system for a favorable outcome for the customer and the bank. Furthermore, the trial conducted by the public along with academics and practitioners to realize and practice the idea of monetary systems ranging from small-scale enterprises both bank and non bank financing are trying to apply the concept of revenue sharing. At this stage, the establishment of Islamic banks are seen as an indicator of economic progress is happening in Islamic economic, so almost society equate Islamic Economic with Islamic banks, or non-bank sharia financial institutions other. Though the scope of Islamic economics is much broader than just a Sharia finance. It covers macroeconomic concepts, micro-economic, fiscal, monetary, and also the much concept of economic development policies and instruments with all the variables.

Abstract

The Birth of shariah capital market in Indonesia is a breakthrough, in order to open a new niche on the trading floor. With distinct segmentation, it is expected that local Moslem investors and Middle Eastern investors will be colouring investment growth in it. The existance of sharia capital markets, will also participate in enhancing the development and the growth of national economic because it can strengthen industries and companies financial position. In which industries and companies engaged in efforts dealing with shariah, which can provide a positive contribution to people’s live. However modern economy will rely heavily on strong capital markets, global competitivenes and also good system. And it is expected that sharia capital market in Indonesia could have strong competitivenes so that can develop, deliver profit and benefit for the community of investors, industry sectors and society in general.
