Abstract

This study investigates the relationship between participatory budgeting and managerial performance, with a focus on the mediating role of goal commitment. Utilizing purposive sampling, data was collected from 65 respondents via Google Forms and analyzed using the Outer Model to assess data validity and reliability. Subsequently, the Inner Model was employed to test hypotheses through SmartPLS 3.0. Results indicate a significant influence of participatory budgeting on both managerial performance and goal commitment. However, goal commitment was found to have no direct impact on managerial performance, and it did not mediate the relationship between participatory budgeting and managerial performance. This research underscores the importance of participatory budgeting in enhancing managerial performance while highlighting the need for further exploration of the mechanisms underlying this relationship. Highlights: Participatory budgeting's significant influence: This study uncovers the substantial impact of participatory budgeting on managerial performance. Role of goal commitment: It examines the role of goal commitment as a mediating factor in the participatory budgeting and managerial performance relationship. Implications for organizational effectiveness: The research highlights implications for organizations aiming to enhance their effectiveness through participatory budgeting strategies. Abstract

This study delves into the complex interplay between domestic violence and the institution of marriage within the framework of Iraqi family law, focusing on the rights of wives to seek separation in cases of abuse. Abstract

This study rigorously delineates the imperative of pre-contractual disclosure in technical assistance contracts, spotlighting the legal necessity for suppliers to provide indispensable technical information vital for efficient recipient resource utilization. Emphasizing informed consent and mutual satisfaction, this pre-contractual mandate, rooted in the principle of good faith, addresses negotiation power imbalances. It clarifies that meeting this obligation differs from mere due diligence, demanding a specific outcome prior to contract formation. It asserts that debtors must be apprised of negotiated data unbeknownst to the creditor, justifiably. The ramifications are dual: rectifying power differentials and ensuring parity in knowledge among contracting parties. The study aims to enrich legislative frameworks for party protection, utilizing qualitative methods for definition and analysis. Results shed light on the nuanced aspects of pre-contractual disclosure, impacting contractual rebalancing and knowledge equality. This research advocates global attention to legislative actions promoting transparency and fairness in technical assistance agreements. Highlights : Clarifies the Legal Imperative: The study meticulously defines the legal obligation for suppliers to disclose crucial technical information in technical assistance contracts, ensuring informed consent. Abstract

This study investigates the legal protection afforded to consumers in the context of e-commerce, focusing on the liabilities of expedition services in cases of delayed or damaged goods. The primary objective is to explore the forms of legal protection provided to consumers for losses due to delays or damages in goods transported by expedition services, and to understand the legal responsibilities of these services in such scenarios. Utilizing a normative research method, the study examines relevant consumer protection laws and regulations governing shipment agreements. The findings reveal that consumers are entitled to various forms of legal protection, including the right to compensation in the form of refunds, replacement of goods, or payments based on the value of loss; entitlement to indemnities for healthcare costs or beneficiary allowances in cases of life-threatening harm; and the right to compensation from expedition services for material and immaterial losses beyond mere refunds. Additionally, the study underscores the government and consumer protection agencies' duty to educate and guide businesses, including expedition services. The legal responsibility of expedition services extends to compensating consumers for delayed shipments or lost goods, through either refunds or replacements. Moreover, the services are obligated to provide compensation or replacements for undelivered or damaged goods. Consumer claims for compensation can be resolved through direct negotiation with the expedition service, legal action, or alternative dispute resolution mechanisms like BPSK. The study concludes that while consumers are legally protected to obtain compensation from expedition services, the enforcement of these services' responsibilities needs to be strengthened for more optimal fulfillment of consumer rights.Highlights: Legal Protections: Consumers have the right to compensation, including refunds, replacements, or payment for losses, and indemnities for life-threatening damages. Expedition Services' Obligations: These services must compensate for delays, lost, or damaged goods, with options for direct negotiation, legal action, or alternative dispute resolution. Enforcement Needs: Despite existing protections, there is a necessity to strengthen the enforcement of expedition services' responsibilities to better fulfill consumer rights.
