Abstract

In the era of Dutch colonial, the majority of entrepreneurs in Central Java and Yogyakarta come from the students. But after Indonesian independence, the students did not show up in the business world because of political policy. Nowadays the entrepreneur students bounced back with Islamic banks that one of its products is a Musharakah finance. Musharakah finance deal with the birth of the free market, namely the ASEAN Economic Community so that the question arises how the prospect Musharakah finance in Indonesian Islamic banks of facing the ASEAN Economic Community (AEC). This paper aims to describe the prospect of Musharakah finance to face AEC. The results showed that the Musharakah finance has a lot of prospects such as financing products that can be performed well and have a competitive value because it has a solid legal basis. From the network side, Islamic banks have been supported by a network offices that much better at home and abroad with excellent quality customer service. In addition, the presence Bank Indonesia blueprint of the Islamic banking institution can strengthen the Musharakah finance products so that can be applied in the ASEAN Economic Community (AEC).

Abstract

The discourse on Islam Nusantara has become quite popular discussion among Indonesian society in the last two to three years. Not only in the grassroots level, Islam Nusantara also becomes a study in several Islamic institutions in Indonesia. In fact, there are some Islamic universities that have opened Islam Nusantara study program. On the one hand, many groups welcomed the studies of Islam Nusantara after being proclaimed by Nahdliyyin in the 33th NU Congress in Jombang, 2015. But on the other hand, there are some groups who reject Islam Nusantara and considered it as heresy in Islam. Essentially, Islam Nusantara is not a new movement, not a new mazhab, not a new ideology, and certainly not a new religion. Islam Nusantara is Islam that exists in the nation and is not sourced from the nation. However, Islam Nusantara accepts and accommodates national cultures as long as it does not contradict the Islamic rules (sharia). It means, Islam Nusantara compromises the culture, appreciates the land where they live, but it does not eliminate tradition as long as it is still in harmony with Islamic sharia. This can become the foundation of our nationalism inauguration. In other words, Islam Nusantara does not only discuss about religious issues, but also about nationalism.

Abstract

The idea of Umer Chapra in building Muslim civilization was based on his research on the position of Muslims who from time to time more and more felt strange with the civilization and Islamic values itself, even the civilization was gradually increasingly eroded and marginalized by Western culture. He tried to restore the Muslim position which should be done as the Messenger of Allah had pointed out, and their positive role in building civilization. The Islamic civilization has the power that lies in the development of morals and material strength. For Chapra, the moral development without being integrated with the economic development cannot be realized. And at the same time, this economic development must also have a worldview and strategy that is in line with religious objectives (maqashid asy-syari’ah). The development of Muslim civilization requires the transformation of human beings and their institutions, focusing in the increasing of education and personality development, and the simultaneous mobilization of material, economic and technological resources for the rearrangement of community structures over the principles of deliberation and accountability, unity, independence and justice.

Abstract

This paper will discuss how the Qanun Jinayah differentiate the concept of private and public space in the implementation of sharia in Aceh. This paper will particularly discuss how private and public space being defined in the Qanun and how broad the scope of this Qanun is. This paper finds that there is no private space in Qanun Jinayah. There are only two conditions that listed in Qanun Jinayah, first, when at the work place, second evidence by the family card. A person who committed to criminal Act (Jarimah) in private and public space, he or she will be punished by Qanun Jinayah. Because of that Government in this case Wilyatul Hisbah and investigator has right to enter a person’s private space if that person is suspected to Jarimah crime. This paper sees that the authority has changed to violate the human right.

Abstract

This study aims at addressing the extent of proximity and relationship between the contemporary Islamic movements and the Kharijites. Many contemporary scholars, regardless of their motives and trends, describe modern Islamic movements as Kharijites, due to their advocacy for radical social and political reform in many of the Muslim countries. Therefore, there is a need for addressing the genuineness of this description, especially when it is generally attributed to the whole contemporary Islamic movements across the Muslim nations, as it is the case in the view of the Madkhalists. Indeed, the misplacement of this description on some Islamic movements opens the door of political oppression and leads to the justification of shedding the innocent blood and the persecution of the righteous Muslims, based on the political disagreement, as it is the case in many Arab and Muslim countries, i.e., Egypt. So, this study discusses the historical background of the contemporary Islamic movements and their relationship with the Kharijites in order to figure out the range of correspondence between the principles of Kharijites and contemporary Islamic movements. The qualitative method is being applied in the study by adopting a historical, inductive, and analytical approach. It reveals that the contemporary Islamic movements can be loosely categorized into two major groups, one of which cannot be described as the Kharijites in all perspectives, while the other one can be described as the Kharijites due to the tight closeness between their trends and ideologies and the principles of the Kharijites. Likewise, their unjustifiable and terrorist acts against innocent people permit the ascription of the name to such groups among the contemporary Islamic movements.

Abstract

This article aims to study and analyze the Islamic spiritual sides of the deconstruction in Kanjeng Ratu Kidul belief from the perspective of Kiai Ibnu Hajar. Kanjeng Ratu Kidul is a very popular myth among people in the southern part of Java Island. Most of them hold annual ceremonies as a way to express their request for having the blessing and being avoided from disasters. The data of this research were collected through in-depth interviews and participatory observations. Derrida’s deconstruction theory was applied to analyze the spirituality aspects. There are three deconstruction processes: (1) logocentric identification; (2) internal contradiction return; (3) difference or building new construction. This research found that Kiai Ibnu Hajar’s deconstruction spirituality was performed in three stages: (1) visual identification stage, which is done through eliciting the discourse of Kanjeng Ratu Kidul by her pictures or photos; (2) returning stage, which is done through mind-verbal activities, i.e. by understanding the nature and existence of human being through religious teachings and informal chats; (3) building new concept, which is actualized through the use of new terms among the members of Jamaah Aolia Panggang Mosque.
