Abstract

Indonesia is a country inhabited by various tribes, races and religions. A long history of Indonesian nation with various ethnics make kind of multicultural religious which is brought lives phenomenon. Islam as the majority religion in Indonesia provides significant meaning in appreciating benefit and respecting the diversity religious of people in Indonesia. The concept of rahmatan lil Alamin is seeded according to the context in Indonesia. Thus, an inclusive understanding by collocated Islam as a progressive religion nowadays becomes a necessity to solve problems and the importance of a complex human beneficial. On the other hand, the necessity of multicultural awarenness of religious in Indonesia made this country as barometer of other country in appreciating a fair law to all the citizens, but when the diversity of this nation does not respect other religions, it will bother the religious‟ stability and national life in the country. Islam has given point of views in national life and taught how to respect other people who has different belief. So, people who has different belief should do the same to appreciate Islam. The history of the world has taught us about the importance of appreciate people and respect the law for the nation, then the nation will be a peaceful and prosperous country.

Abstract

Ibnu Khaldun is a thought-leader who is proficient in the various fields of study such as politics, social, philosophy, history, and economy. So, Ibnu Khaldun is known as one of the originators of economic theory and as the largest Muslim economists recognized by Western economists. Unlike previous scholars who had tendencies to be normative, Ibnu Khaldun used historical and social approach to understand economy of a nation. Ibnu Khaldun was very positive in comprehending economy. So, his ways of thinking will be very worthy to put forward in this paper, especially on market mechanisms. Market is a place where buyers and sellers meet and do transactions of buying and selling goods or services. The importance of market in Islam cannot be separated from the function of the market as a place for buying and selling activities. Sale and purchase itself has an important function, since buying and selling are parts of the economic activities which are "accredited" in Islam. Islam is very concerned with buying and selling as one of the economic fundamentals. It can be seen in Al-Baqarah 275 saying that "God justifies the purchase and forbids usury". The market mechanism is a system that determines the formation of prices, which is in the process can be influenced by many things: demand and supply, distribution, government policies, labor, money, taxes and security. In the process of market mechanisms requires the principles of morality, such as fair competition (fair play), honesty, transparency and justice.

Abstract

Contract has an important role in the agreement and the engagement of either Islamic law or in the positive law. The existence of the contract with the Islamic principles would sustain the contract to the benefit and avoid deception and fraud between the parties. Islamic principles are based on permissible, voluntary, welfare and justice needs to be embedded in the Islamic contracts. If these principles are at parties, then the contract will not be a contract that is imperfect.

Abstract

Based on the factual circumstances nowadays, many people tried to explore the short way to collect the treasures. Supported by the information Technology development made the spreading of any information and business growth easily. Direct selling, Multi Level Marketing, Online Business and Money Game have its upportunities. Dream for Freedom (D4F) with the Key as a symbol, is one of the money game business which growth successfully between years 2015 – 2016. Thousands of participants or members joined the community (known by the dream team). Spectacularly the founder recruited some of influence person, asked them to promote the business through their statements, pictures and videos. Islam as the belief of most people in Indonesia particularly has the guidance in business through the most principles rules, Al-Qur‟an and Hadith. Therefore the writer tried to explore the Dream for Freedom from Islamic Jurisprudence Perspective.

Abstract

United Kingdom is a country that is predominantly by non-Muslim, but development of Islamic banking and finance is very good. This is evidenced by the operation of six full sharia bank and the sixteen banks that serve Islamic windows. Sukuk deals for investors is also growing as evidenced by the increasing demand on the London Stock Exchenge with a total of £51 billion. Likewise with takaful products, UK re/insurance markets that are transacting Islamic finance. As one of the largest insurance markets in the world, and the leading global centre for wholesale insurance and reinsurance, the UK has the potential to support the growth of takaful business in the coming years. The development of Islamic banking and finance did not escape from the multicultural population of the UK. From the research, UK residents both Muslims and non-Muslims showed 66% of respondents believe the Islamic financial system is suitable for western economic communities such as the UK. 65% of respondents understand the workings of Islamic banking differs from conventional banking workings. 60% of respondents agree Islamic banking relevant to all religions. 57% of respondents also knew of Islamic banking to give the profit, not the interest. This means that they responded positively to the products offered Islamic banking and finance. There are several factors that lead to Islamic banking and finance can be grown in the UK, there are: including the global expansion of Islamic financial, single banking and financial regulator, public policy and taxation, the establishment of the Islamic Bank of Britain, the excess liquidity in the Middle East, Islamic windows of regular banks, and the development of educational and training institutions in the UK. This paper will describe the history of Islamic banking and finance in the UK, its development, factors that support and the its future prospects for giving additional knowledge to the academics and practitioners.

Abstract

The purpose of this study is the effect of temporary syirkah funds, liabilities and equity of the financing risk and profitability of Islamic banks in Indonesia; analysis of effect financing risk on profitability. The population is Islamic bank in Indonesia. The sample was selected using purposive sampling method. Observation number 11 bank research. Method of data analysis used the path analysis. Results of this study indicate that the fund temporary syirkah positive significant effect on the risk of financing received. The more the amount of funds held temporary syirkah the risk of non-performing loans to finance or Islamic banks NPF indicator becomes smaller. Obligations positive significant effect on the risk of financing. The larger a bank's liabilities, the risk of non-performing loans to the financing or NPF indicator will also be greater. no significant effect on the risk of financing. This means that the level of equity had no impact on the level of financing risk. Fund temporary syirkah positive significant effect on profitability. Obligations positive significant effect on profitability. Debt obligations or received will indirectly increase the amount of income. Equity does not significantly influence the risk of financing. This means that the size of the equity has no effect on the level of profitability and ROA indicators received by commercial banks financing syariah.Risiko significant negative effect on profitability. Conclusion the study shows that the temporary syirkah funds and liabilities have a significant effect on the risk of equity financing and profitability while no significant effect on risk financing and profitability.

Abstract

Awareness of the risks are well understood is an integral part of efforts to optimize the benefits of a business, especially in the business in the financial sector. The purpose of this study was to determine the risk management and strategies to deal with it in a murabaha financing in BTN Syariah Yogyakarta. Qualitative approach used in this study. While the data obtained through interviews, observation, and documentation. The results showed that the management of risk in murabahah financing in BTN Syariah Yogyakarta must be doing by minimize the risk that happening, either ona precontractand postcontract. Mitigation pre-contract is done in compliance with Standard Operating Procedureset of internal bank, do selecting to mudharib’s candidate, and feasibility analysis mudharib’s candidate. Abstract

Interdisciplinary is a collaboration between several disciplines to respond to developments and problems of human civilization. Mu'amalah science, economics, sociology, and psychology work together to examine the behavior of Muslim consumers. Consumer behavior is the study of how individuals, groups and organizations select, purchase, use and dispose of goods, services, ideas or experiences to satisfy their wants and needs. Consumer behavior studies focused on how individuals make the decision to utilize their resources (time, money and effort) to buy goods and services consumed. This interdisciplinary approach to the Islamic bank consumer behavior is required, because basically Islamic economics as a subject of study is the contribution of the various sciences. In a study of consumer behavior resulted in two conclusions Islamic bank. Religiosity influences customer behavior Islamic bank, and other conclusions stated that in a certain level of religiosity does not affect the behavior of bank customers Shari'ah.

Abstract

Khulu' is the greatness of Islamic law in the fight for women's rights, so that if a wife is very tortured and there is no longer a sense of love and affection towards her husband, she can divorce her husband, even though divorce is hated by Allah. Khulu' also is divorce accompanied by a number of property as iwadh given by the wife to the husband in order to redeem themselves loose from marriage. Islamic law has given way to a wife who wants a divorce by filing khulu' as Islamic law gives way to the husband to divorce his wife by talak. Khulu' hated by the shari'ah as well as divorce. All sense and sense of well being refused khulu’, and only Allah that allow it to avert danger when it is unable to enforce Islamic laws. And the wisdom of khulu' is to avoid danger, namely the time of the quarrel that turmoil in a conjugal relationship until they could no longer united in the bonds of the household, then khulu’ allowed.
