Abstract

Contract istisnā’ is one of the form contract transaction Which functioning important in transaction production based order, okay in context jurisprudence classic and practice contemporary Islamic economics. Although no mentioned in a way explicit as contract alone in the Qur'an and hadith, legitimacy contract istisnā ' built through generality arguments transaction as well as mechanism istinbā ṭ the law of the fuqahā’. This article aim for analyze legitimacy contract istisnā' in perspective verses and hadiths transaction with use approach ushul fiqh . Research This is study normative Islamic law with method literature (library research), which is based on verses of the Koran, hadith of the Prophet ﷺ , books of tafsir, hadith, fiqh, as well as literature ushul jurisprudence classic and contemporary. Analysis done through study dalālah word verse, analysis’ god hadith, as well as review difference method istinbā ṭ law between sect jurisprudence. Research results show that legitimacy contract istisnā' can confirmed through generality word verses transaction, like order fulfill contract (QS. al- Mā'idah: 1), permissibility sell buy (QS. al-Baqarah: 275), principle clarity transactions (QS. al-Baqarah: 282), as well as prohibition cheating (QS. al- Mu ṭ affifīn: 1-3), which is reinforced by the hadiths of the Prophet ﷺ about contract greetings and practice booking. Difference view between sect jurisprudence related contract istisnā’ reflect difference approach ushul jurisprudence in understand evidence and reality transaction. In a way overall, research This confirm that contract istisnā ' is contract transaction which legitimate in a way sharia and relevant for implemented in practice contemporary Islamic economics during fulfil principles the basis of sharia and maqā ṣ id al- sharī' ah.

Abstract

Every economic system has characteristics, so a system deserves to be called an established economic system. No exception to the Islamic economic system. The property ownership model is among the unique features of the Islamic economic system. This study aims to determine the extent to which the principle of ownership in Islamic economics can be used as a basis from a hadith perspective. The method used in this research is a literature study using the Jamami'ul Kalim software to find the position and quality of hadith related to property ownership. In the search, it has been found several hadiths that do have the quality of sanad and Matan, which are classified as vital. However, some hadiths have dho'if qualities. The paper concludes that Islamic economics can be called an economic system that stands alone, which differs from capitalist and socialist systems based on the ownership model. Islamic economics offers 3 types of ownership: relative, individual, and general. Based on the hadith search, these 3 offers have their basis. According to the author's opinion, all three of them deserve to be used as the basis of ownership in Islam, even though there are weak hadiths in the general ownership section

Abstract

Before June 2014, Dolly is well known as the biggest prostitute location in East Java and even in Southeast Asia. But now, Dolly is exchanged to the religious zone and economic center both by the government and such social organizations. So, this paper tries to explain how shifting models of religiosity in sexual prostitute localization, specifically in ‘Dolly’ Surabaya. The researcher uses an ethnographical methodology of the research by configuring observational data combined with deep interview of the object containing the government, religious elite, local people and sexual prostitute actors. So, this paper firstly contains with the former dolly description as the locus of sex trade before it closed officially by government. Then it continues to re-question about how religion comes as a strategy to change prostitute location. And at the last, the writing discusses about process of negotiation of faith and the current religious life of the former sex trade location. The research finds that (1) there is a specific model of religiosity negotiated in localization to change the sexual prostitute to be more religious place. (2) The religionization of ‘dolly’ through how local inhabitants and organizations implementing faith negotiation. (3) The government with locals gives an awareness to ‘rethinking’ about sexual prostitution as the way of life through promoting Mbah Kapiluddin pilgrims. By this case, the writer argues that the sex trade has a contrasting idea with the religious life so the more strengthens religious promotion, the more prostitute decreases with the process of tackled negotiation.

Abstract

Political development and bureaucratic reform are two interrelated strategic agendas in the effort to realize democratic, accountable, and public interest-oriented governance. This article aims to examine political development as a conceptual framework for bureaucratic reform through a review of the latest literature. This research uses a qualitative approach with library research methods and a narrative literature review design enriched with thematic analysis. Data were obtained from scientific books, reputable national and international journal articles, and relevant policy documents from the past five years. The results of the study indicate that political development is understood as a process of institutionalizing democratic values, the rule of law, public participation, and political accountability, which play a crucial role in shaping a professional and neutral bureaucracy. The literature also reveals the development of bureaucratic reform paradigms, ranging from New Public Management, New Public Governance, to Public Value Governance, which emphasizes that bureaucratic reform cannot be separated from the political context and the quality of democracy. Further analysis shows a reciprocal relationship between political development and bureaucratic reform, where both can either strengthen or weaken each other. However, this study also identified a research gap in the form of a lack of integrative conceptual models that operationally link political development to bureaucratic reform, particularly in developing countries. The findings suggest that Islamic political ethics—centered on the principle of Maslahah (public interest) and the accountability of leaders to both God and society—provide a robust framework for creating a professional, transparent, and service-oriented bureaucracy. This study concludes that integrating these transcendental values into modern administrative systems can strengthen the moral integrity of bureaucrats and ensure more sustainable institutional transformations.

Abstract

This study aims to analyze the role of local wisdom figures and the Office of Religious Affairs (KUA) in realizing the sakinah family in Solok City, as well as identify obstacles and challenges in the synergy of the two in family development. This study is motivated by the fact that the Minangkabau people have a strong value system based on the custom of basandi syarak, syarak basandi Kitabullah, while KUA is present as a formal state institution that carries out the function of family development through marriage guidance and religious services. The research uses a descriptive qualitative approach with a phenomenological perspective. The data was obtained through in-depth interviews with ninik mamak, Bundo Kanduang, LKAAM and KAN administrators, the Head of KUA of Lubuk Sikarah and Tanjung Harapan Districts, as well as documentation of the Sakinah family development program. The results of the study show that local wisdom figures, especially ninik mamak and Bundo Kanduang, still play a significant role in family development through premarital debriefing, instilling customary and religious values, strengthening social responsibility, and mediating domestic conflicts. Meanwhile, KUA carries out strategic functions through marriage guidance, post-marriage coaching, consulting services, and synergy with BP4. This study also found that the synergy between local wisdom and KUA has not been fully optimal because it is hampered by a shift in community values towards a more individualistic direction, limited participation due to socio-economic factors, and the lack of a strong institutionalization of cooperation between KUA and customary institutions. This study confirms that the development of the sakinah family in Solok City will be more effective if it is built through a collaborative model that integrates customary, religious, and institutional forces of the state in a contextual and sustainable manner.

Abstract

The study of the status of hadith and its categorization in a number of hadith books has always been a debate among scholars and experts in hadith, including related to the book of Sunan Ibn Majah. One of the hadith figures who often criticizes the books of hadith is Nasir al-Din al-Albani. One of his famous works entitled Da’if Sunan Ibn Majah contains hadiths that are considered weak according to al-Albani. This study examines al-Albani’s hadith assessment methodology and its comparative position vis-à-vis classical hadith scholarship, with specific reference to the book Sunan Ibn Majah. This study employs a qualitative comparative approach (comparative hadith analysis) to analyze al-Albani’s methodology in grading hadith as weak (da‘if), focusing on the methodological patterns he applies and how they compare with classical hadith scholars such as Ibn Hajar al-‘Asqalani and al-Dhahabi. The primary objective of this study is to examine al-Albani’s methodological framework, rather than merely determining the status of hadith. The results of the study show that al-Albani’s assessment methodology differs systematically from the approach taken by the majority of scholars, particularly in his application of sanad criticism criteria. Al-Albani tends to establish the status of hadith based primarily on textual-critical analysis without always providing an in-depth examination of narrator credibility (‘adl and dhabith) or cross-referencing with mutabi’ and shahid reports, which has led some scholars to contest the basis of his grading decisions.

Abstract

The accuracy of Qur’anic recitation is an essential prerequisite, as errors in the articulation of letters, vowel length, and the application of tajwid rules may reduce the quality of recitation and affect the learning process in Qur’anic education institutions (TPQ). The phenomenon of recitation variation is still found among teachers and participants of Qur’anic recitation training, including those in the Majelis Mu’allimil Qur’an (MMQ) Malang Branch, which applies the Qiraati method. This study aims to analyze the phonological variations in the recitation of QS. Al-Insyirah verses 3–7 among MMQ participants and to explain the role of MMQ training in correcting these variations. The research employs a descriptive qualitative method, with data collected through observation of training sessions, audio recordings of recitation, interviews with instructors and participants, and documentation. The findings indicate that recitation variations mainly occur in the accuracy of makhraj and sifat al-huruf, consistency in applying the rules of nun sukun/tanwin at specific letter junctions, accuracy of madd, as well as tempo and orderliness of wasl and waqf. These variations are influenced by prior recitation habits, differences in learning references, training intensity, and articulatory stability. MMQ training plays a role through recitation monitoring, direct correction (tashih), modeling of correct recitation, and guided repetition, resulting in more accurate and consistent recitation. These findings contribute to the formulation of more focused correction points and specific training recommendations to improve the quality of Qur’anic recitation among Qur’an teachers.

Abstract

This study examines marriage during a wife’s iddah period from the perspective of Islamic family law by analyzing Circular Letter of the Director General of Islamic Community Guidance No. 05 of 2021 and its implementation in Solok Regency. The research addresses a normative gap in Indonesian positive law, which does not explicitly regulate restrictions on ex-husbands remarrying during the ex-wife’s iddah, potentially leading to legal uncertainty, gender inequality, and weak protection for women after divorce. Using a qualitative socio-legal approach, data were collected through in-depth interviews, observation, and documentation involving KUA officials, religious counselors, and community leaders. The findings indicate that the circular letter functions as an administrative policy (beleidsregel) that guides KUA in controlling marriage registration and preventing harmful practices such as serial marriages and disguised polygamy. However, its implementation varies between strict and adaptive approaches, influenced by bureaucratic discretion, local socio-cultural contexts, and uneven legal literacy. While KUA officials generally show consistent understanding, religious counselors and community leaders demonstrate diverse interpretations due to limited policy dissemination and persistent conventional fiqh perspectives. From the maqāṣid al-syarī‘ah perspective, the policy supports the protection of lineage, dignity, and psychological well-being, while promoting gender justice. The study concludes that the circular letter represents institutional ijtihad, though its effectiveness depends on consistent implementation and strengthened legal communication.
