Abstract

This paper discusses the management of natural resources in Indonesia, particularly focusing on the revocation of Mining Business Licenses (IUP) by the Badan Koordinasi Penanaman Modal (BKPM). Referring to Article 33 paragraph (3) of the 1945 Constitution, the state controls mineral and coal resources for the welfare of the people. With the enactment of the Mineral and Coal Law and related policies, the authority to revoke IUP has shifted from local to central government. This study analyzes the legal basis, process, and implications of IUP revocation by BKPM, as well as the legal challenges arising from this delegation of authority, highlighting the importance of sustainable and transparent regulations in natural resource management.

Abstract

The impacts that occur due to waste disposal by PT Pelabuhan Indonesia II (Persero) Cabang Panjang which indirectly results in damage to the ecosystem in the sea around Ringgung Island, Pasaran, and Pahawang. So that the community who work as grouper farmers are harmed due to the damage to the ecosystem so that the fish they farm die en masse. So that the grouper farmers sue for the losses they have received. The results obtained are known that the permit for dredging the sail current has been obtained but related to dumping has not been obtained which results in exceeding the sea water quality standards. As well as legal protection for the community, there are 3 existing legal instruments, namely administrative law, criminal law, and civil law. The grouper farmer community has also tried to obtain legal protection through these 3 instruments.

Abstract

This study examines the legality of the IUP issuance process in Konawe Islands Regency, identifies potential administrative and legal violations, and provides recommendations to strengthen regulatory compliance. The research method used is normative juridical with a legal and case study approach. The results show that most IUPs in Konawe Islands Regency are issued without meeting administrative requirements, such as adequate environmental studies and consultations with affected communities. In addition, inconsistencies were found in the licensing process, such as procedural violations by the authorities that caused conflicts of interest and losses to the local community. This shows that there is a gap in the supervision and implementation of regulations.

Abstract

This study aims to analyze the legal and political dynamics in the alleged corruption case involving PT Pertamina and its implications for Indonesia’s national energy policy. The research method used is normative with statutory and case approaches. This case reveals the weakness oversight in energy governance, with indications of oil import manipulation and fuel adulteration. National political dynamics affect the independence of law enforcement processes, with potential interference from vested interests. These irregularities have wide-ranging effects on public trust, consumer protection, and national energy supply stability. The financial loss to the state is enormous, reaching hundreds of trillions of rupiah, alongside consumer losses due to substandard fuel products. Additionally, poor SOE governance underscores the urgency of reforming energy policy and strengthening oversight mechanisms. In conclusion, strategic measures are needed, including transparency, stronger law enforcement independence, and energy policy reform that serves the public interest.

Abstract

Household waste problems in Tanjung Jabung Timur Regency continue to escalate along with population growth and increasing community activities. The local government has issued Regional Regulation Number 20 of 2013, which regulates waste management obligations and the imposition of administrative sanctions for violations. This study aims to examine the implementation, obstacles, and mechanisms of administrative sanctions in household waste management. The method used is empirical juridical with a descriptive qualitative approach. Data were obtained through interviews and document studies. The results show that administrative sanctions have not been effectively enforced. The government prioritizes persuasive approaches, while sanctions such as warnings, government coercion, and license revocation have not been implemented. Major obstacles include low public awareness, inadequate waste facilities, and weak supervision. This study suggests strengthening the role of law enforcement officials, increasing legal education for the public, and consistent application of sanctions to ensure waste management complies with regulatory objectives.

Abstract

With the increasing population and consumption activities, Semarang City generates approximately 1,110–1,200 tons of waste daily, all disposed at the Jatibarang Final Processing Site (TPA). This study employs an empirical juridical approach using qualitative methods, including interviews with the Environmental Agency (DLH) and field observations. Findings show that DLH’s waste management practices do not fully comply with Regional Regulation No. 6/2012, particularly Article 22 on final-stage principles. Due to budget constraints, controlled landfill is used instead of sanitary landfill. Despite efforts in public education, infrastructure development, and green technology planning (PSEL), systemic improvements and broader community participation remain essential.

Abstract

This research highlights the imbalance between foreign investment growth and human rights protection in Indonesia. The main problem is the potential for human rights violations in investment activities, such as land conflicts and socio-economic impacts that harm local communities. The purpose of this study is to evaluate the policies and strategies implemented by the government to ensure that investment is in line with respect for human rights, and to identify obstacles that hinder the effectiveness of such protection. The results show that while foreign investment can drive economic growth, stricter regulations, active stakeholder engagement, and effective oversight are needed to prevent human rights violations. This approach is expected to create a fair and sustainable investment environment, while safeguarding social and humanitarian interests in the midst of investment globalization.

Abstract

The installation of Campaign Props (APK) is part of the democratic process regulated in Article 298 of Law Number 7 Year 2017 on General Elections. However, the practice of installing APKs often has a negative impact on the environment, such as visual pollution and plastic waste. This research analyses the implementation of APK installation rules in the 2024 General Election in North Sulawesi with a normative legal approach. The results show that there are still many violations, such as installation in public facilities and the use of environmentally unfriendly materials. Stricter supervision, strict law enforcement, and socialisation are needed to increase awareness of sustainable APK installation rules.
