Abstract

This study aims to analyse the role of citizens as subjects of environmental law in environmental management in densely populated areas, particularly in RT 008 RW 004, Malaka Jaya Village, East Jakarta. It employs a qualitative legal method with a socio-legal approach. The results show that citizens no longer act merely as policy objects but have transformed into active legal subjects through various community-based programs. However, challenges remain, including low environmental legal literacy, limited access to information and insufficient policy and budgetary support. Therefore, stronger synergy among government, communities and other stakeholders is required to achieve sustainable environmental management.

Abstract

This study aims to analyze the Constitutional Court Decision and its impact on the presidential election system in Indonesia. The researcher used a normative legal research method using a jurisprudential approach, a conceptual approach, and an analytical approach. Data were analyzed descriptively to obtain research results regarding the Presidential Threshold. The results of the Constitutional Court (MK) Decision Number 62/PUU-XXII/2024 tested the constitutionality of Article 222 of Law Number 7 of 2017 concerning General Elections which regulates the presidential threshold (threshold requirements for presidential and vice presidential nominations). In its decision read on April 29, 2024, the Constitutional Court stated that the presidential threshold provision was contrary to the 1945 Constitution and did not have binding legal force.

Abstract

This study examines the transformation of protected forest management into agricultural land in the Sekaroh area, Jerowaru Subdistrict, East Lombok Regency, from the perspective of fiqh al-bi’ah. There are three questions to be addressed: what are the ecological impacts resulting from the conversion of the protected forest; Second, what is the legal framework and third, how does the fiqh al-bi’ah perspective view this phenomenon. This study employs a descriptiveanalytical paradigm with a qualitative research design and utilizes a normative sociological approach. Data collection techniques include observation, interviews and documentation. To validate the data, the researcher employed triangulation, extended fieldwork and discussions. The results of this study indicate that the conversion of protected forest land into agricultural land for corn cultivation in the Sekaroh Forest Area is unavoidable to meet the economic needs of the surrounding community. However, the conversion of protected forest into agricultural land, without sound environmental planning, is not justified under the principles of fiqh al-bi’ah because it disrupts ecological balance and disregards the public interest.

Abstract

This study analyzes the responsibility of Notaries in issuing Covernotes at the request of PT Bank Perkreditan Rakyat NBP-15 Berastagi. A Covernote is a temporary statement arising from banking practice, although not explicitly regulated in the Notary Office Act and not an authentic deed. This empirical juridical research shows that a Covernote only serves as an administrative and moral guarantee without perfect evidentiary power. A Notary's liability may arise in administrative, civil, or criminal spheres if negligence or intentional misconduct causing losses is proven. Notaries must apply the prudential principle when issuing them to avoid legal risks.

Abstract

As an archipelagic state, Indonesia possesses vast fishery resource potential but faces the threat of overfishing. In response, the government implemented the Measured Fishing (Penangkapan Ikan Terukur or PIT) policy, regulated under Government Regulation Number 11 of 2023 and Ministerial Regulation of Marine Affairs and Fisheries Number 28 of 2023, which includes the mandatory landing of fish at designated base ports. This policy has raised concerns regarding distributive justice due to infrastructure disparities, limited facilities and a disproportionate administrative burden on small-scale fishermen. This research aims to analyze the regulation of base ports in ensuring equitable access and resource distribution, as well as to formulate more just policy frameworks. The method employed is normative legal research using a statutory approach and an analysis based on John Rawls' Theory of Distributive Justice. The findings reveal procedural and economic injustices resulting from the misalignment between legal obligations and infrastructural availability. This condition creates structural discrimination against fishermen in regions with limited facilities. Therefore, a policy reconstruction based on distributive justice is required through the implementation of tiered tariffs, prioritization for small-scale fishermen and the equitable distribution of cold chain facilities to ensure that legal compliance does not disadvantage traditional fishermen.

Abstract

A grant deed constitutes a written instrument with full evidentiary force when executed in compliance with applicable legal requirements. In practice, however, grants are frequently made over inherited property that has not yet been partitioned, thereby giving rise to unlawful acts. This study analyzes legal protection for heirs, the validity of grant deeds derived from unlawful conduct, and judicial reasoning in Mahkamah Agung Decision No. 3013 K/Pdt/2022. Employing a normative juridical method with a descriptive-analytical approach based on secondary legal materials, this research finds that grant deeds concerning undivided inherited estates without the consent of all heirs are legally invalid and lack binding force, as they contravene inheritance law and infringe the subjective rights of co-heirs.

Abstract

This study aims to analyze the efforts of the Patemon Village Government in eradicating alcoholic beverages based on Probolinggo Regency Regional Regulation Number 4 of 2019 concerning the Control and Supervision of Alcoholic Beverages and to identify obstacles faced in its implementation. The research applies an empirical juridical method with a qualitative approach using interviews, observations, and documentation techniques. The results indicate that the village government’s efforts are carried out through preventive, persuasive, and coordinative measures. Preventive actions include regulation, socialization, community guidance, and involvement of religious and community leaders. Persuasive efforts are conducted through familial and religious approaches toward offenders and residents. Coordinative measures are implemented in collaboration with security officers such as Linmas, Bhabinkamtibmas, and Satpol PP. However, policy implementation still faces several obstacles, including limited village authority in law enforcement, low public legal awareness, economic factors, limited administrative resources, and clandestine distribution of alcoholic beverages from outside the village. Therefore, strengthening villagelevel regulations, enhancing inter-institutional coordination, and increasing community participation are necessary to ensure more effective alcohol control.

Abstract

Cases of forced marriage by parents against minors remain a serious issue in Indonesia, despite laws that have established a minimum legal age for marriage and guaranteed the protection of children’s rights. This practice generally begins with a unilateral decision by parents to arrange a marriage for their child, who is still a student, with a certain partner due to economic reasons, social pressure, customary expectations, or concerns about family honor. In many cases, the child is not given the opportunity to provide free and full consent and instead experiences psychological pressure and the loss of opportunities to continue education and determine their own future. This situation creates a conflict between ongoing social practices and national legal provisions that prioritize the best interests of the child. This study aims to examine the legal framework for protecting children from forced marriage and to analyze it from a human rights perspective. The research uses a normative legal method with statutory and conceptual approaches. The results indicate that forced marriage against minors constitutes a violation of children’s rights and can be categorized as psychological violence, as well as contradicting the principle of free consent in marriage. Furthermore, the practice of marriage dispensation still has the potential to legitimize child marriage. Therefore, stronger legal protection, improved supervision, and active involvement of the state and society are necessary to ensure the protection of children’s rights as legal subjects.

Abstract

This journal discusses the legal concept of Cessie as a transfer of claims or debts, especially in the context of banking and credit agreements in Indonesia. Although not explicitly mentioned in the Civil Code, Cessie is regulated through a combination of contract law and property law, particularly regarding the transfer of receivables under a name. Cessie is often used in the world of bankruptcy as a mechanism to transfer the right to collect from Separatist Creditors to another party or third party, usually as collateral for credit facilities. Based on Article 613 of the Civil Code, the transfer of collection rights through Cessie must be carried out in the form of an authentic or private deed, and must be notified in writing to the debtor (cessus). In addition, this transfer only applies to existing claims and requires the debtor's acknowledgment and approval. However, regulations related to the transfer of receivables through Cessie are still considered insufficient to protect Curators in the world of bankruptcy because often the transfer of receivables actually hinders the Curator from carrying out his duties.

Abstract

Production forest destruction is a serious environmental problem that disrupts the balance of the ecosystem and the sustainability of community life. According to Government Regulation Number 26 of 2020 concerning Forest Rehabilitation and Reclamation, the participation of village governments and communities is crucial in restoring forest function. This study aims to analyze the forms of participation of village governments and communities in Nogosaren Village, Gading District, and the factors that influence it according to the PP. Using qualitative empirical legal methods through interviews, observations, and literature studies, the results show that participation has been carried out through forest rehabilitation, informal supervision, and socialization, but it is still not optimal and has not been legally institutionalized. Influencing factors include legal, institutional, sociocultural, economic, and environmental legal awareness. The study concludes that strengthening village regulations, increasing the capacity of apparatus, and community awareness are key to optimizing participation for sustainable production forest management according to PP No. 26 of 2020.
