Abstract

This research juridically analyzes the assignment of PT Jaminan Kredit Indonesia (Jamkrindo) in the People's Business Credit (KUR) guarantee scheme based on Law Number 19 of 2003 concerning State-Owned Enterprises, as last amended by Law Number 1 of 2025. Government assignments to SOEs often create an intersection between corporate principles (business judgment rule) and public service obligations. The research method used is normative legal research with a statutory approach. The results show that the assignment of PT Jamkrindo in KUR guarantees is an embodiment of the SOE's function as a constitutionally valid development agent, but requires regulatory harmonization to ensure legal certainty in guarantee risk management. Furthermore, the synchronization of rules regarding capital changes and assignment mechanisms in the latest SOE Law provides a stronger legal basis for PT Jamkrindo in supporting the sustainability of the MSME sector through inclusive financing. The conclusion of this research emphasizes the importance of legal protection for SOE directors in carrying out government assignments to remain accountable and not violate good corporate governance principles.

Abstract

The Sarjana Penggerak Pembangunan Indonesia (SPPI) Program deploys university graduates as Heads of the Nutrition Fulfillment Service Units (SPPG) to support the "Golden Indonesia 2045" vision. However, delays in salary payments have impacted their welfare and the quality of services provided. This empirical legal research conducted at the SPPG in Palangka Raya City indicates that these delays are caused by administrative factors, budgetary constraints, regulatory issues and coordination challenges. Legal protection for these graduates can be implemented through both preventive and repressive measures.

Abstract

In carrying out their duties, notaries have the right to take leave as employees. This study examines the legal certainty and responsibilities of notaries regarding notarial leave permits and the appointment of replacement notaries. From a normative juridical perspective, this study shows that submitting a notarial leave permit as regulated in Article 25 of the Notary Law is part of an effort to ensure legal certainty and the continuity of notarial services. Violations of the obligation to obtain leave permits, including leaving the office without permission or continuing to make deeds during leave, result in administrative sanctions up to dismissal and the downgrading of the deed to an unsigned deed. In addition, notaries who violate this obligation can be held legally accountable and are required to compensate for any losses incurred, so compliance with the leave mechanism is an important aspect in maintaining legal certainty and protection.

Abstract

The acceleration of the digital economy has popularized endorsement practices that often operate without adequate legal certainty. This legal study examines the validity of contracts and the implications of default through the lens of Commutative Justice Theory. The findings show that although legally valid electronically, contracts are vulnerable to cancellation due to issues surrounding the competence of underage influencers. Furthermore, breach of contract has been proven to distort the equality of exchange value. Therefore, this study recommends reconstructing contracts based on the Principle of Balance through a mechanism of gradual payment and data transparency in order to restore substantive contractual justice for the parties involved.

Abstract

This research explores the legal accountability of influencers and selebgrams in the context of social media endorsements in Indonesia, employing a qualitative empirical legal methodology. The study is grounded in the growing prominence of influencers as digital marketing agents, whose legal standing remains ambiguously defined within Indonesia’s current regulatory landscape. The empirical legal inquiry was carried out through in-depth interviews with managers, influencers and selebgrams actively engaged in endorsement practices. The findings reveal the unclear legal status of influencers, the dominant role of managers in organizing endorsement collaborations and the gap between legal regulations and actual endorsement practices. The study concludes that a proportional legal responsibility framework is necessary.

Abstract

Nitrous oxide is a medical gas increasingly misused for recreational purposes in Indonesia. Its distribution through social media and online marketplaces has facilitated public access outside medical channels. This study applies an empirical qualitative legal method through interviews with users, the National Narcotics Agency and medical professionals. The findings reveal significant health and social impacts of nitrous oxide abuse, while legal regulation remains administrative without clear criminal sanctions. This situation creates a legal vacuum that weakens law enforcement effectiveness.

Abstract

This study examines the legal liability of the Al-Khoziny Islamic Boarding School management for construction negligence that led to the failure of the building structure and the victims. The study was conducted in a normative-analytical manner through a review of regulations, legal doctrine, construction literature, and technical reports. The results of the study indicate that the management can be asked for civil compensation under Article 1369 of the Civil Code, with reference to Law Number 28 of 2002 concerning Buildings which regulates technical standards and permits. The study recommends regular structural audits, the use of certified construction services, digitalization of permits, and an easy claims mechanism to ensure legal accountability and building safety in the Islamic boarding school environment.

Abstract

Copyright on songs and/or music is a form of intellectual property protected by law to guarantee the economic rights of the creator. In practice, the use of songs in commercial performances is still frequently carried out without the creator's permission, under the assumption that royalty payments through collective management organizations are sufficient to fulfill legal obligations. The problem examined in this research is: what are the legal implications of using artistic works in commercial performances without the creator's permission? This research employs a normative legal research method with a statutory approach and a conceptual approach. The results indicate that the creator's permission is the primary requirement for the commercial use of a song, while royalty payment is a consequence of authorized use. Government Regulation Number 56 of 2021 regulates the mechanism for collective royalty management, but it does not abolish the creator's exclusive right to grant permission. Therefore, the use of songs without the creator's permission still entails legal liability for the user and legal protection for creators must be consistently enforced to create legal certainty within the music industry.

Abstract

Sexual gratification enforcement in Indonesia faces legal ambiguity. This study examines its position in Indonesian criminal law through a comparative study with Singapore. Using normative methods and a socio-legal approach, findings show that Indonesia's "other facilities" phrase in Article 12B of the AntiCorruption Law causes legal uncertainty and evidentiary difficulties. Conversely, Singapore’s Prevention of Corruption Act (PCA) applies a broad interpretation of "undue advantage," covering all subjective benefits, including sexual services, supported by established jurisprudence. This research recommends a transformation toward substantial justice in Indonesia.

Abstract

The advancement of digital services in Indonesia has significant implications for personal data protection as an integral part of the right to privacy and human dignity. The right to privacy serves as a prerequisite for individual autonomy within a constitutional state (Rechtsstaat). The increasing utilization of data prompted the enactment of Law Number 27 of 2022 concerning Personal Data Protection (PDP Law), which replaces the partial regime of the Electronic Information and Transactions (ITE) Law. This research employs a Systematic Literature Review (SLR) using the PRISMA protocol on 30 national and international journals (2018–2025) to examine the implementation of the PDP Law, data breach cases, as well as normative and practical gaps. The results indicate that while the PDP Law is more comprehensive, its implementation faces several obstacles: low data literacy, limited capacity of data controllers, the absence of an independent supervisory authority, and weak enforcement mechanisms. Effective data protection requires regulatory strengthening, the establishment of an independent supervisory body, and capacity building for all stakeholders.
