Abstract

This study examines the legal protection of inheritance rights for childless wives whose husbands have passed away in Lambu Subdistrict. This study was conducted because there remains a discrepancy between the provisions of Islamic inheritance law and the actual practice of inheritance distribution in the community. The methods used were empirical legal research with a sociological approach and a case study approach. The results of the study indicate that the distribution of inheritance is still influenced by customs, family traditions and the dominance of the husband’s family, resulting in the wife’s rights often not being fulfilled fairly. Legal protection for the wife has not been optimally implemented due to the community’s limited understanding of the law and the weak enforcement of legal provisions in the practice of inheritance distribution within the community.

Abstract

This study aims to analyze the urgency of enacting the Asset Confiscation Bill in optimizing the recovery of state losses and to examine the position of the Asset Confiscation Bill as a national legal framework in relation to existing sectoral regulations. This research employs a normative juridical approach with a descriptive-analytical method. The legal materials used consist of primary and secondary legal materials, which are analyzed qualitatively through the theory of legal protection, Lawrence M. Friedman’s theory of the legal system and the theory of justice. The novelty of this study lies in its mapping of the Asset Confiscation Bill not merely as an additional instrument in corruption eradication, but as a national legal framework that integrates asset recovery mechanisms currently dispersed across the Criminal Code, the Criminal Procedure Code, the Anti-Corruption Law and the Anti-Money Laundering Law. The findings show that the main weakness of Indonesia’s asset confiscation system lies in its dependence on the mechanism of criminal forfeiture, which often obstructs asset recovery when the offender dies, flees, transfers the assets, or when the criminal process has not yet resulted in a final and binding court decision. The Asset Confiscation Bill introduces a legal reform through the mechanism of non-conviction based asset forfeiture using an in rem approach, which places the asset as the object of examination without eliminating the protection of the rights of bona fide owners. This study also finds that the Bill performs a harmonizing function, as it regulates in a more integrated manner the stages of asset tracing, freezing, seizure, confiscation, management and recovery, while also clarifying coordination among law enforcement institutions. Therefore, the enactment of the Asset Confiscation Bill is necessary to strengthen legal certainty, enhance the effectiveness of state loss recovery and protect the public interest.

Abstract

The final and binding principle is a fundamental principle in arbitration that grants arbitral awards permanent legal force and binds the parties without the availability of ordinary legal remedies. This study aims to analyze the regulation and implementation of the final and binding principle in national arbitral awards in Indonesia. The research employs a normative juridical method through the examination of statutory regulations and related legal documents. The results indicate that the final and binding principle provides legal certainty and supports dispute resolution in a fast and effective manner. However, its implementation remains limited by the mechanism for annulment of arbitral awards and the principle of public policy.

Abstract

This research aims to analyze the judges' considerations and the implementation of the best interests of the child principle regarding the marriage dispensation decree Number 209/Pdt.P/2025/PN.Sgr, as well as to examine the existence of Balinese customary law concerning the protection of children's rights related to marriage dispensations. The method employed is normative legal research with statutory and conceptual approaches. The findings indicate that the judges' considerations in granting the marriage dispensation were based on the best interests of the child principle. However, Balinese customary law and national law regarding child marriage remain unaligned, meaning that the granting of marriage dispensations still leaves a loophole for underage marriages. Therefore, harmonization between customary law and national law is required to strengthen the protection of children's rights and prevent early-age marriages.

Abstract

Unlicensed tin extraction activities in the Bangka Belitung Islands Province have generated widespread social, economic, and ecological consequences. The present study seeks to examine the efforts undertaken to address illegal tin mining by employing a socio-legal framework. The study adopts an empirical legal methodology grounded in a socio-legal perspective. Findings reveal that efforts to curb illegal mining have remained suboptimal, attributable to inadequate oversight mechanisms, the heavy economic reliance of local communities on the tin industry, and the absence of coherent alignment between penal and non-penal regulatory frameworks. Accordingly, the formulation of an evidence-based criminal policy that cohesively brings together law enforcement, regulatory oversight, and community empowerment is urgently needed.

Abstract

This study aims to analyze the criminal liability of perpetrators with personality disorders and assess the judge's considerations in the verdict. The research method used is normative juridical with a doctrinal approach through a literature study of laws and regulations, court decisions, and legal and forensic psychiatric literature. The results of this study indicate that the perpetrator was diagnosed with an emotionally unstable personality disorder of the impulsive type and an adjustment disorder, but was still declared capable of being responsible and sentenced to 4 (four) years in prison. The judge's considerations have not fully integrated the results of the forensic psychiatric examination, so that integrated regulations are needed with a legal and forensic psychiatric approach to achieve a more proportional and just verdict.

Abstract

This study aims to analyze the factors causing the non-implementation of criminal decisions that have permanent legal force and examine the legal consequences that arise from the perspective of legal certainty. The research method used is normative juridical. The results of the study indicate that the non-implementation of criminal decisions that have permanent legal force is caused by the defendant not being in the detention process, so that after the decision has permanent legal force, the defendant goes into hiding or runs away; the defendant during the trial process until after the verdict is read out his status is still under city or house arrest; and the defendant runs away during the trial stage. The legal consequence of the non-implementation of criminal decisions that have legal force is that the state risks losing the authority to carry out criminal penalties due to the passing of the expiration of the grace period.

Abstract

This study aims to analyze the legal framework and legal liability for the use of patients' medical data in health research without patient consent. The findings show that medical data constitute specific personal data under Article 4(2) of Law Number 27 of 2022 on Personal Data Protection, requiring informed consent or another lawful basis for processing. Unauthorized use of medical data may result in administrative, civil and criminal liability under Article 67 of the Personal Data Protection Law and Article 30 in conjunction with Article 46 of the Electronic Information and Transactions Law when involving unauthorized access to electronic systems. Strengthening regulatory guidelines, institutional oversight and informed consent procedures is essential to protect patients' medical data.

Abstract

The issue of informed consent in emergency medical treatment creates legal problems related to the protection of patient autonomy and the application of the emergency exception doctrine. The research uses a normative juridical method with a comparative approach between the Indonesian and Japanese legal systems. The study shows that Japan has a more progressive system through the strengthening of shared decision-making, hospital risk management and patient rights protection, while Indonesia still faces weaknesses in medical communication standards and the regulation of emergency medical treatment. This study concludes that Indonesia’s health law reform should focus on strengthening hospital liability, protecting patient rights and ensuring legal certainty in emergency medical treatment.

Abstract

This study examines the responsibilities of adoptive parents according to Islamic law. The problem is, many parents still confuse kafalah with tabanni, which is prohibited by religion. As a result, adopted children are often given the name of the adoptive father, considered heirs and treated like mahrams. This violates Surah Al-Ahzab: 5 and triggers inheritance disputes and slander. This normative study examines the limits of adoptive parents' responsibilities in Article 209 of the Compilation of Islamic Law (KHI). In conclusion, the responsibility is limited to providing a living, educating and caring for the child without changing the lineage.
