Abstract

This study examines Supreme Court Decision No. 560 K/Pdt.Sus-PHI/2023 regarding the arbitrary dismissal of a fixed-term contract (PKWT) worker due to COVID-19. Using normative judicial methods, it highlights violations of human rights and legal protection. Findings show that under Article 62 of the Labor Law, employers must pay the remaining contract wages for early termination. The Supreme Court granted the worker’s appeal, citing the lower court's legal errors. Consequently, the company was ordered to pay IDR 33,400,000 in compensation to ensure substantive justice and protect the worker’s normative rights.

Abstract

This study analyzes the Decision of the Kalianda Religious Court Number 407/Pdt.G/2025/PA.Kla concerning the fulfillment of the rights of wives and children after divorce in a contested divorce case. The legal issue examined in this study is how legal protection for child custody (hadanah), child support, iddah maintenance and mut’ah is provided when the divorce is caused by neglect of financial support and domestic conflict. This decision was selected because it demonstrates the use of the judge’s ex officio authority in determining the rights of women and children, even though the case was filed as a contested divorce. This research employs a normative-juridical method using statutory and court decision approaches. The results show that the judges considered not only formal juridical aspects, but also sociological aspects and the best interests of the child. The decision reflects the integration of Islamic law and positive law in providing fair legal protection for women and children after divorce.

Abstract

Legal protection for female workers regarding working hours is regulated by Law No. 13 of 2003 concerning Manpower, but remains Vulnerable to violations such as excessive working hourse and inadequate nighttime facilities. A case study at PT. TMI revealed obstacles stemming from workers’ lack of understanding, minimal company attention and suboptimal union support. The conclusion emphasizes the synergy between the three parties and the need for specific Regional Reglations to close regulatory gaps, through efforts to socialize the Collective Labor Agreement (PKB) and proactively respond to complaints.

Abstract

This study aims to analyze the effectiveness of the Integrated Assessment implementation in determining the eligibility for rehabilitation of drug abusers at the Palangka Raya City National Narcotics Agency (BNN), as well as to identify strategies to overcome various operational obstacles in the field. The research method used is empirical juridical with a descriptive qualitative approach. The results indicate that during 2024, 124 clients underwent drug rehabilitation. The assessment was conducted through medical examinations and legal analysis to determine the offender's status and support a restorative justice approach. Despite obstacles such as limited budget, facilities and inter-agency coordination, the Palangka Raya City BNN continues to make improvements through crossagency collaboration and the use of communication technology.

Abstract

This research analyzes the legal construction of asset recovery in Indonesia from a follow the money perspective and formulates its optimization model. Findings show that the normative framework under the Anti-Corruption Law and the Anti-Money Laundering Law has not comprehensively accommodated non-conviction based confiscation. Regulatory fragmentation, the absence of an Asset Forfeiture Law, weak inter-agency coordination and international jurisdictional barriers are the main obstacles. The study recommends enactment of the Asset Forfeiture Bill, strengthening PPATK's pro justitia authority, optimizing mutual legal assistance and integrating big data and artificial intelligence in asset tracing as operational steps.

Abstract

Traffic and road transportation are systems consisting of various elements aimed at ensuring safety, order, and smooth traffic flow. Increased public mobility that is not balanced with infrastructure capacity causes congestion, especially at intersections that have the potential to cause conflict and accidents. One of the traffic control devices is the Traffic Signal Device (APILL) regulated in Article 27 of the Minister of Transportation Regulation Number PM 49 of 2014, which includes placement, maintenance and removal based on technical needs and evaluation of traffic conditions. This study aims to analyze the implementation of Article 27 in the Bandar Lampung City Transportation Agency and review it from the perspective of Siyasah Tanfidziyah. This study uses field research. The data used are primary and secondary data. Data collection techniques in this study are through observation, interviews and documentation. Data processing techniques are carried out through data reduction, data presentation and drawing conclusions. Data analysis used a qualitative method using analytical descriptive methods. The results of the study indicate that normatively the APILL policy is in accordance with applicable provisions, but in fact its implementation is not optimal. From the perspective of Siyasah Tanfidziyah, implementation has been in line with the principles of trust, justice, and public welfare, but has not been fully effective. Therefore, strengthening inter-agency coordination, increasing implementation effectiveness, and optimizing infrastructure management are necessary to enhance public safety and welfare.

Abstract

The protection of customer personal data, security mechanisms and legal remedies for customers who suffer losses at Bank Syariah Indonesia, Palangka Raya Branch, are essential aspects in ensuring the security of digital banking services. This research employs an empirical legal method with a sociological approach through interviews and the examination of statutory regulations. The findings reveal that Bank Syariah Indonesia, Palangka Raya Branch, has implemented personal data protection in accordance with applicable legal provisions through the application of standard operating procedures, information technology security systems and restrictions on access to customer data. However, the losses experienced by customers in the examined case resulted from the customers’ own negligence in maintaining the confidentiality of their personal data; therefore, the bank could not be held legally liable. As a contribution of this study, preventive and repressive legal measures are proposed, including improving digital security education for customers, strengthening the bank’s internal supervision system and optimizing the implementation of personal data protection in digital banking services.

Abstract

This study aims to analyze the legal liability of QRIS merchants for consumer losses due to settlement failures in the electronic payment system. Problems arise when a transaction is declared successful in the consumer application, but the funds are not received by the merchant within a certain period, creating legal uncertainty. The study uses a normative juridical method with a statutory and conceptual approach. Legal materials were analyzed based on the Civil Code, the Consumer Protection Law, Government Regulation Number 71 of 2019 and Bank Indonesia's QRIS regulations. The results show that the division of responsibilities between merchants and Payment System Service Providers (PJSPs) has not been clearly regulated, resulting in disharmony in norms in resolving QRIS transaction disputes. Merchants are, in principle, only responsible for the initial transaction verification stage and providing information to consumers, while responsibility for the settlement process rests with the PJSP. This study recommends strengthening regulatory harmonization and implementing the principle of joint liability to create legal certainty and consumer protection in digital payment transactions.

Abstract

This study examines the validity of probationary clauses in Fixed-Term Employment Agreements (PKWT) within the maritime shipping sector based on Decision No. 108/Pdt.Sus-PHI/2023/PN Medan. The findings indicate that probationary clauses in PKWT violate Article 58 of the Indonesian Labor Law and are therefore invalid. Maritime law does not specifically regulate probationary periods, making labor law applicable. Judicial considerations differ, with the Medan District Court emphasizing freedom of contract, while Decision No. 289 K/Pdt.Sus-PHI/2024 affirms the prohibition of probationary periods in PKWT as a mandatory legal provision.

Abstract

Criminal liability of foreign-flagged vessels for national water pollution remains inadequately integrated between international maritime law and domestic criminal law, particularly in the context of internal waters. This research examines the MV Ever Judger oil spill in Balikpapan Bay to analyze Indonesia’s criminal jurisdiction under UNCLOS 1982 and corporate criminal liability under Indonesian positive law. Employing normative legal research with statutory and conceptual approaches, this study affirms that Indonesia holds full criminal jurisdiction based on the territorial principle and the ship-owning corporation may be held liable pursuant to the doctrine of vicarious liability and Article 116 of Law No. 32 of 2009.
