Abstract

The digital transformation within the constitutional justice ecosystem has shifted the evidentiary paradigm from conventional methods to electronic data-based systems, carrying fundamental implications for the principle of judicial independence. This study aims to analyze the reality of Constitutional Judges' independence amidst the complexity of decision-making reliant on digital data and to identify new forms of threats to judicial autonomy that are technical and psychological in nature. Employing a normative legal research method with a socio-legal approach, this study deconstructs the regulatory construction of digital evidence under the Constitutional Court Law and its derivatives, while evaluating their impact on the judicial deliberation process. The findings reveal that the absence of standardized protocols for digital data authentication and cybersecurity creates a "normative vacuum," compelling judges to rely excessively on external expert interpretations (technical dependency), thereby eroding their intellectual autonomy. Furthermore, the phenomenon of "algorithmic pressure," stemming from data-driven manipulation of public opinion on social media, is proven to induce subconscious cognitive biases that disturb the judges' internal freedom of mind. This study argues that judicial independence in the digital era can no longer be secured solely through traditional political protections; rather, it requires a conceptual reconstruction encompassing "digital sovereignty." As a solution, this research proposes the establishment of an internal Digital Forensics Center for the Constitutional Court, the enactment of Constitutional Digital Evidence Standards mandating algorithmic auditability and the ratification of a Digital Ethics Protocol to mitigate risks of subtle technology-based interventions.

Abstract

This study examines the implementation of mediation in divorce lawsuits at Religious Court of Pekanbaru as an effort to resolve disputes peacefully. This empirical legal research employs a sociological approach through interviews, observations and literature studies. The results show that mediation has been conducted in accordance with procedures; however, its success rate remains low due to legal uncertainty, limited facilities, conflict complexity, the psychological condition of the parties and the legal culture of society that views divorce as the final solution.

Abstract

The development of QRIS as a digital payment instrument provides convenience for consumers and merchants. However, some merchants still charge Merchant Discount Rate or QRIS administration fees to consumers. This study examines MDR regulation, the phenomenon of additional QRIS charges and its legal implications from the perspective of digital economic law. This research uses a normative juridical method with statutory, conceptual and limited comparative approaches. The study concludes that charging MDR to consumers is inconsistent with price transparency, consumer protection and legal certainty in digital payment systems.

Abstract

Alluvial land is land formed by sedimentation in coastal areas that is often used as an object of waqf; however, legally it still holds the status of state land, thereby creating legal uncertainty. This study aims to analyze the legal administrative procedures for alluvial land as well as the legal certainty of its waqf status. The method used is a legal-normative approach, employing a legislative and conceptual framework through a literature review. The results of the study indicate that the legality of oloran land waqf depends on land rights status, registration procedures and the integration of land and waqf administration. Without legal certainty, waqf has the potential to lead to disputes. Therefore, regulatory strengthening is necessary to ensure legal certainty and protection for waqf.

Abstract

This article examines the implementation of CEISA 4.0 as a form of digital transformation in customs administration from the perspective of Indonesian State Administrative Law. The discussion focuses on the relationship between service digitalization, legality of administrative action, general principles of good governance, accountability, transparency, and protection of service users. The study applies a qualitative method with a normative juridical approach supported by document analysis of statutes, customs policies, and Indonesian scholarly articles published within the last five years. The findings show that CEISA 4.0 strengthens administrative efficiency, process standardization, audit trails, and integration of customs services. However, system effectiveness is not determined solely by the availability of the application. Network reliability, data interoperability, human resource capacity, continuity management during service disruption, and administrative complaint mechanisms remain decisive factors. From the perspective of State Administrative Law, CEISA 4.0 generally aligns with the principles of legality, legal certainty, utility, transparency, and proper public service, yet operational norms still need to be reinforced so that legal protection for service users does not depend on fragmented technical policies. This article recommends regulatory harmonization, stronger standard operating procedures, continuity governance, and broader digital literacy to support lawful, efficient, and accountable customs services.

Abstract

This article analyzes the status of adopted and biological daughters in Balinese customary inheritance law following the 2023 Decree of the Pasamuhan Agung IV of the Balinese Traditional Village Council. The inheritance system remains based on patrilineal descent (purusa), encompassing customary and religious rights and obligations. Adopted children are, in principle, equal to biological children, while daughters are recognized as heirs as long as they have purusa status. The status of ninggal kedaton (retirement from the royal family) affects inheritance rights, except under certain conditions, such as sentana rajeg (retirement from the royal family). This development demonstrates the expansion of recognition of women within the framework of Balinese customary law.

Abstract

This normative legal research examines the compatibility of Lethal Autonomous Weapons Systems (LAWS) with International Humanitarian Law (IHL). Although principles of distinction, proportionality, and humanity apply, fundamental normative gaps exist due to AI's limitations in moral and contextual judgment. The findings highlight serious accountability challenges in state responsibility attribution under the ILC 2001 framework caused by the systems' autonomous nature. The study recommends establishing a binding international legal instrument at the 2026 CCW Review Conference and encourages active Indonesian diplomacy in regulating autonomous weapons globally to ensure compliance with humanitarian principles.

Abstract

Housing development is not solely aimed at providing housing, but must also ensure the provision of public and social facilities as part of consumers' rights to a decent living environment. This study aims to examine the application of the principle of balance in housing purchase agreements, specifically regarding developers' obligations to provide public and social facilities, and to analyze the legal implications of failure to fulfill these obligations in North Lampung Regency. This study uses a normative legal research method with a statutory and conceptual approach, supported by primary and secondary legal materials, and then analyzed qualitatively. The results indicate that the principle of balance in housing purchase agreements has not been optimally implemented, primarily due to the dominance of developers through the use of standard agreements that weaken consumers' bargaining power. The failure to provide public and social facilities, as occurred in the Matrix Sukajadi Housing Complex, reflects an imbalance between the rights and obligations of the parties. Legally, this developer's negligence can be classified as a breach of contract and a violation of the principles of fairness in contracts and consumer protection. Therefore, strengthening the supervisory role of local governments and consistent law enforcement are crucial to ensuring consumer protection and realizing equitable and sustainable housing provision.

Abstract

The rapid growth of e-commerce in Indonesia has introduced digital negotiation transactions that lack adequate legal regulation. This study analyzes the legal liability construction of e-commerce platform operators toward consumer protection in digital negotiation transactions under Indonesian positive law and formulates an ideal reconstruction model. Using a normative juridical method, the study finds that existing legal instruments the Consumer Protection Law, the Electronic Information and Transactions Law and the Government Regulation on Electronic Commerce fail to explicitly regulate platform liability in digital negotiation, creating a normative vacuum that structurally disadvantages consumers. Reconstruction requires integrative regulatory reform, institutional strengthening, minimum technical standards and sustained consumer legal literacy enhancement.

Abstract

This study examines the differences in binding force and executorial power between notarial settlement deeds and court settlement deeds (acta van dading) within the framework of legal certainty. The research is motivated by the existence of two forms of dispute resolution through settlement that produce different legal consequences, particularly in terms of enforcement. The objective of this study is to analyze the binding force of notarial settlement deeds and the binding as well as executorial force of court settlement deeds, and to compare both instruments in ensuring legal certainty for the parties. This research applies a normative legal method using statutory and conceptual approaches. The findings indicate that notarial settlement deeds bind the parties contractually as authentic deeds with perfect evidentiary value, yet they do not possess executorial force. In contrast, court settlement deeds have executorial power equivalent to final court judgments, allowing direct enforcement. The absence of executorial force in notarial deeds creates a disparity in legal protection and enforcement effectiveness. The study concludes that court settlement deeds provide stronger legal certainty compared to notarial settlement deeds.
