This study aims to analyze legal protection for licensees in cancelled trademark license agreements and examine the strength of license agreements for cancelled trademarks from the perspective of legal certainty. The research method used is normative juridical with a legal and conceptual approach. The results of the study indicate that Law Number 20 of 2016 concerning Trademarks and Geographical Indications does not explicitly regulate the position of licensees after trademark cancellation. Legal protection for licensees is obtained through contract law, the principle of good faith and civil liability mechanisms. License agreements cannot be implemented after the trademark cancellation decision has permanent legal force.

The growth of financial technology has increased the use of online lending services in Indonesia while simultaneously encouraging the emergence of illegal online lending practices. This study aims to analyze the legal framework, the implementation of legal protection and the obstacles to protecting victims of illegal online lending in Cirebon City. An empirical juridical method with a qualitative approach was employed through library research and interviews. The findings indicate that legal protection has been regulated under several laws and regulations; however, its implementation remains ineffective due to low legal literacy, weak supervision and limitations in cyber law enforcement. Strengthening legal education, inter-agency coordination and technology-based supervision is necessary to improve victim protection.

The implementation of restorative justice at the investigation stage reflects a development in the Indonesian criminal justice system that emphasizes recovery rather than mere punishment. This study examines the mechanism for implementing restorative justice during the investigation stage and its relation to the presumption of innocence principle. The study aims to analyze the legal basis and implementation of restorative justice in the investigation process. The research method used is normative legal research employing statutory and conceptual approaches. Data were obtained through library research consisting of primary, secondary and tertiary legal materials analyzed qualitatively. The results indicate that the implementation of restorative justice at the investigation stage has obtained a legal basis through Police Regulation Number 8 of 2021 as well as the provisions of Article 79 and Article 83 of criminal procedural law. The mechanism is carried out through an agreement between the victim and the offender facilitated by investigators. Its implementation must still uphold the presumption of innocence, protection of the parties’ rights, and proper supervision to ensure legal certainty and substantive justice.

The forgery of health certificates during the COVID-19 pandemic is one of the criminal offenses that has had an impact on efforts to control the spread of the disease. This study aims to analyze the application of Article 263(1) of the Criminal Code, Article 268 of the Criminal Code, Article 14 of Law No. 4 of 1984 and Article 93 in conjunction with Article 9(1) of No. 6 of 2018 in Judgment No. 814/Pid.B/2021/PN SRG. The results of the study indicate that the defendant’s actions are more appropriately classified as the criminal offense of forging a medical certificate under Article 268 of the Criminal Code in conjunction with Article 55(1) of the Criminal Code.

The development of information technology has encouraged the transformation of health services through telemedicine services that allow health services to be carried out remotely by utilizing digital technology. In practice, telemedicine services involve the use of electronic medical records that contain patients' personal data that are confidential and sensitive so that they require adequate legal protection. The problems studied in this study are the form of legal protection for patient medical record data in the implementation of telemedicine services in Indonesia and the legal responsibility of telemedicine platform operators against the leakage or misuse of patient medical record data. This research uses normative legal research methods with a legislative approach and a conceptual approach. The legal materials used consist of primary, secondary and tertiary legal materials that are analyzed qualitatively through analytical descriptive methods. The results of the study show that legal protection of patient medical record data in telemedicine services in Indonesia is regulated in Law Number 17 of 2023 concerning Health, Law Number 27 of 2022 concerning Personal Data Protection, Regulation of the Minister of Health Number 20 of 2019 concerning the Implementation of Telemedicine Services between Health Service Facilities and Regulation of the Minister of Health Number 24 of 2022 concerning Medical Records. Legal protection is carried out preventively through the obligation to maintain the confidentiality and security of patient data and repressively through the provision of sanctions against personal data violations. In addition, telemedicine platform operators have administrative, civil and criminal responsibilities in the event of a leak or misuse of patient medical record data due to negligence in the management of electronic systems.

The constitutional judiciary occupies a strategic position in Indonesia’s constitutional system because it serves to uphold the supremacy of the Constitution while protecting the constitutional rights of citizens. This article examines the status, functions and division of powers of the Constitutional Court and the Supreme Court as the two main pillars of Indonesia’s constitutional judiciary following the amendments to the 1945 Constitution. The research employs a normative legal method using a statutory approach and a conceptual approach, through the examination of primary and secondary legal sources analyzed using descriptive-qualitative methods. The results of the study indicate that the constitutional judiciary performs three main functions: protecting citizens’ constitutional rights, reviewing the constitutionality of legislative acts and resolving jurisdictional disputes among state institutions. This study also found that the division of authority between the Constitutional Court and the Supreme Court which is coordinative rather than hierarchical has the potential to create a dualism in the review of legal norms that requires further harmonization, while the growing phenomenon of “no viral, no justice” reveals a new sociological dimension that also influences the legitimacy of administrative court rulings in the digital age.

Digital transformation in Indonesia’s land sector encourages implementation of electronic PPAT deeds under Government Regulation Number 18 of 2021. This policy creates juridical issues concerning deed authenticity and PPAT responsibility as personal data controllers under the Personal Data Protection Law. This study analyzes the legal position of electronic PPAT deeds, PPAT responsibilities and regulatory synchronization within electronic land administration. The research applies a normative juridical method using statute, conceptual and comparative approaches. Results indicate that electronic PPAT deeds do not fully satisfy authentic deed requirements under the ITE Law. Furthermore, PPATs must ensure personal data security, privacy protection and certainty.

The digital transformation of the Indonesian judiciary through the e-Court system presents significant normative questions, particularly regarding the coherence of electronic evidence rules within existing civil procedural law. This article examines two primary issues: (1) the legal standing of electronic documents as evidence in civil proceedings conducted via e-Court under HIR (Herzien Inlandsch Reglement), RBg (Rechtsreglement voor de Buitengewesten), the Electronic Information and Transactions Law and relevant Supreme Court Regulations; and (2) the regulatory consistency of e-Court in realizing the principles of simple, expeditious and affordable justice as mandated by Article 4(2) of the Judicial Power Law. Employing a normative juridical method through statutory, conceptual and comparative approaches, this study reveals that electronic documents in e-Court occupy an ambivalent normative positionprocedurally recognized yet lacking equivalent evidentiary weight to authentic deeds under the classical HIR/RBg framework. Furthermore, an incongruence exists between the ideals of efficiency and accessibility embedded in e-Court and the structural reality of digital infrastructure disparities across Indonesian regions. This article contributes a normative reconstruction framework that aligns e-Court regulation with the substantive not merely procedural dimensions of access to justice.

This study examines the legal liability of electronic system providers for the leakage of consumer personal data in electronic transactions based on Article 1365 of the Civil Code and the legal remedies consumers can take to obtain compensation. The study uses a normative juridical method with a statutory and conceptual approach. The results show that personal data leakage can be classified as an unlawful act if it meets the elements of Article 1365 of the Civil Code. Consumers can pursue civil lawsuits, seek protection under the Consumer Protection Law and seek administrative mechanisms to obtain legal protection and compensation for personal data leakage.

This article examines state responsibility for marine degradation as human rights violation through a Human Rights-Based Approach. Utilizing normative research method that combine multiples approaches, the article argues that marine pollution is not human rights violations, but inherently constitutes a violation of the rights to health, food and a healthy environment. Through the elaboration of the concept of the right to environment at sea on state responsibility under human rights obligations, this article concludes that the transformation from a monitoring model based on voluntary corporate compliance to an obligationbased model is a legal obligation, rather than a mere choice.
