Abstract

Integrity is a fundamental pillar in enforcing just law. As a law enforcement agency that has a strategic role in maintaining the supremacy of law and justice in Indonesia, the Attorney General's Office of the Republic of Indonesia is required to always maintain professionalism and integrity in all its duties and authorities. The problem faced in this study is how the legal policy is applied in strengthening the integrity of the Attorney General's Office of the Republic of Indonesia as a pillar of just law enforcement and the right strategy and policy in strengthening the integrity of the Attorney General's Office of the Republic of Indonesia so that it plays an optimal role in enforcing just law. The research method used is normative juridical legal research sourced from secondary data. The results of the study indicate that the legal policy applied in strengthening the integrity of the Attorney General's Office of the Republic of Indonesia aims to make the Attorney General's Office the main pillar in enforcing just law and through the implementation of the right legal policy, the integrity of the attorney's office can be strengthened so that the role of the attorney's office in realizing legal justice can be more optimal and reliable. The right strategy and policy in strengthening the integrity of the Attorney General's Office of the Republic of Indonesia is needed so that the Attorney General's Office can play an optimal role in realizing just law enforcement. With effective strategies and policies, the Prosecutor's Office can improve professionalism, accountability, and transparency in carrying out law enforcement duties.

Abstract

This study aims to examine the application of justice and legal certainty principles in the bankruptcy process of PT Sritex from a legal philosophy perspective. The research method used is normative juridical with statutory, case, and philosophical analysis approaches. The discussion reveals that although positive law mandates the protection of workers' rights, in practice there is a disparity in prioritizing secured creditors over workers. Legal epistemology highlights how legal knowledge in the Sritex case tends to favor economic power over substantive justice for vulnerable groups. Court decisions are seen as neglecting distributive justice and overlooking the humanistic dimension of law enforcement. The theory of legal certainty becomes crucial as the bankruptcy process causes uncertainty among workers and creditors regarding their rights. Satjipto Rahardjo's progressive law approach argues that law should side with the weak, calling for reform in the bankruptcy mechanism toward social justice. In conclusion, Indonesia’s bankruptcy system must be reformed to strengthen worker protection through fair debt settlement schemes and regulations that ensure inclusive legal certainty.

Abstract

This study aims to analyze the regulatory challenges and dilemmas concerning the right to privacy and freedom of expression in Indonesia’s digital era through the lens of legal philosophy. The research method employed is normative, using statutory and conceptual approaches with descriptive-analytical analysis. The digital era blurs the lines between privacy and freedom of expression, where both often intersect in online public spaces. In legal philosophy, privacy is not only a personal sphere but also a domain shaped by state and institutional power through digital surveillance. Meanwhile, freedom of expression, while foundational to democracy, is vulnerable to misuse for spreading hate speech or disinformation. Indonesian law recognizes these rights through constitutional and statutory guarantees, yet their implementation faces structural and technical challenges. Legal philosophy plays a critical role in balancing these rights by emphasizing justice, legal morality, and human dignity. In conclusion, a reform of digital law is needed—one that is not only technically adaptive but also grounded in ethical and philosophical values to ensure equal protection of privacy and freedom.

Abstract

This study discusses the restrictions on freedom of expression in Indonesian legislation and the perspective of human rights (HAM). Through the normative legal research method, this study examines these restrictions based on legal principles and international human rights standards. The results of the study indicate that (1) restrictions are permitted, they must meet strict requirements, namely stipulated by law, and proportional. (2) Freedom of expression is a fundamental right protected by various international instruments, such as Article 19 of the Universal Declaration of Human Rights (UDHR) and the International Covenant on Civil and Political Rights (ICCPR). In Indonesia, it is regulated in Law of the Republic of Indonesia Number 9 of 1998 concerning Freedom of Expression in Public and Law of the Republic of Indonesia Number 12 of 2005 concerning Ratification of the ICCPR.

Abstract

This article aims to examine the concept of law as a tool of social engineering based on Roscoe Pound’s theory and its relevance within the Indonesian legal system. The study employs a normative juridical approach, using conceptual, historical, and comparative methods. Findings show that although Indonesia adopts a civil law system with legalistic tendencies, social engineering through law is still possible via legislative reform and strengthening law as an agent of change. The adapted ideas of Pound by Mochtar Kusumaatmadja and Satjipto Rahardjo indicate that law must remain responsive and adaptive to social demands. This article emphasizes the importance of integrating legal theory with public policy in advancing national legal reform.

Abstract

This study aims to analyze the benefits of songs and/or music that provide economic benefits to creators and/or copyright holders to be used as an object of fiduciary guarantee in banking institutions in supporting the creative economy sector that can support the development of the country's economy. The results of this study show that the legal basis of songs and/or music used as fiduciary guarantees in bank institutions has been regulated in the applicable regulations, the use of songs and/or music as fiduciary guarantees has not been optimally implemented and is not in line with the applicable provisions so that creative economy actors do not feel the benefits of songs and/or music as collateral objects. As a form of implementation of the provisions, the role of the government should be to provide socialization in an integrated manner with related institutions in improving the creative economy sector and realizing a good creative economy ecosystem.

Abstract

This article comparatively analyzes the alignment of Indonesian national law (Law 18/2017) and Malaysian national law (Employment Act 1955) with the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families (ICMW). Findings indicate that Law 18/2017, driven by Indonesia's ratification of the ICMW, comprehensively adopts international protection standards. Conversely, Malaysia's Employment Act 1955, without ICMW ratification, aligns only partially, leaving significant gaps, particularly concerning non-labor rights. The difference in ratification status is the key factor driving the divergence in migrant worker protection approaches between the two countries, highlighting the challenge of legal harmonization for more effective protection.

Abstract

This study discusses a comparison of criminal law regulations against cybercrime in Thailand and Indonesia, as well as the challenges faced in their enforcement. This normative research uses a legislative approach to evaluate the effectiveness of the legal frameworks of both countries in preventing and dealing with cybercrime. Thailand relies on the Computer Crime Act (CCA) which focuses on various types of cybercrime, while Indonesia has the Information and Electronic Transactions Law (ITE Law) which regulates more broadly aspects of digital transactions and information dissemination. The study found that although the legal framework in both countries is quite comprehensive, limited human resources and technical skills are major challenges in law enforcement against cybercrime. Cyber law enforcement requires very high technical skills, and many law enforcement agencies in both countries still lack personnel who have competence in information technology and cybersecurity. Another important aspect of this study is international cooperation which is key in tackling cross-border cybercrime. Thailand and Indonesia, like other countries, deal with cybercrime that often involves perpetrators and victims in various countries. In this regard, international conventions such as the Budapest Convention on Cybercrime play an important role. The Convention provides an international legal basis for cooperation in combating cybercrime, including procedures for requesting legal assistance and extradition. In addition, international organizations such as Interpol also play an important role in the coordination and exchange of information between countries to deal with cybercrime. The results of this study show that further efforts are needed in terms of inter-agency coordination, law enforcement training, and public education to improve protection against cybercrime in Thailand and Indonesia. Closer international collaboration, both through bilateral and multilateral forums, is also very important to increase the effectiveness of cyber law enforcement.

Abstract

The strategy of limited liability companies (PTs) in facing the challenges of the global capital market includes various important approaches. First, increasing transparency and implementing good corporate governance (GCG) to attract investor confidence. Second, diversify products and markets as a risk mitigation measure. Third, utilize technology and innovation to improve efficiency and competitiveness. Fourth, comply with international regulations to avoid legal issues. In addition, HEIs need to strengthen international networks and adapt to global market dynamics, in order to maintain a competitive position and expand opportunities in an increasingly complex and globally connected capital market.

Abstract

Along with the times, E-commerce develops hand in hand with social media. Social media, which was originally a means of entertainment, has transformed into a multipurpose platform that contains social media (entertainment) and shopping (shopping) and even completing payments, which is commonly called social commerce. social commerce provides many benefits to users, but it also threatens the sustainability of micro, small and medium enterprises (MSMEs). This happens because MSMEs with limited capital will lose to entrepreneurs with large capital from other countries. Large entrepreneurs can minimize prices because their production is large, while MSMEs are still limited. This allows online sellers to prefer to market goods from large entrepreneurs rather than MSMEs. The security of users' personal data is also a concern because social commerce contains personal data to bank accounts for payment. The purpose of this research is to answer the Application of social-commerce and Personal Data Protection Standards According to Indonesian Positive Law. The type of research used is normative legal research. The result of this research is that social commerce can be applied in Indonesia if it has met the requirements in accordance with the Regulation of the Minister of Trade Number 31 of 2023 concerning Business Licensing, Advertising, Guidance, and Supervision of Business Actors in Electronic Commerce and Personal Data Protection Standardization can provide a guarantee of fulfilling the rights of personal data subjects in accordance with Law Number 27 of 2022 concerning Personal Data Protection.
