Abstract

The advancement of artificial intelligence (AI) technology opens new possibilities for images generated by AI to be used as objects in Notarial Sale and Purchase Deed. The images produced by AI are regarded as representations of human intellectual work due to the process of giving instructions and curation. Therefore, these images hold legal status as object of agreement in Notarial Sale and Purchase Deed, provided they comply with the applicable regulations in Indonesia.

Abstract

Judicial power is the main pillar in the judicial system that guarantees the upholding of law and justice. Judges as law enforcers have a strategic role in maintaining the integrity and public trust in judicial institutions. The independence and professionalism of judges must always be maintained so that they are not tainted by violations of the code of ethics and behavior that is contrary to judicial values. This study aims to analyze the role of the Judicial Commission in enforcing the code of ethics of judges with Judge DA case study, who was involved in drug abuse and other ethical violations. The research methods used are normative law and empirical juridical, with a focus on laws and regulations, Judicial Commission decisions, academic literature, and media coverage. The results of the study show that Judicial Commission has implemented a systematic supervisory mechanism, starting from verifying reports to imposing sanctions by the Judges' Honorary Council. The dishonorable dismissal of Judge DA reflects Judicial Commission's firmness in enforcing the code of ethics, but also highlights weaknesses in the system of selection, coaching, and supervision of judges. This case has an impact on the decline in the image of the judicial institution, but also becomes a momentum for improvement and evaluation of the supervision system to be more effective and preventive. This study concludes that strong supervision and cooperation between the Judicial Commission and other institutions, such as the Supreme Court, are very necessary to maintain the dignity of judges and increase public trust in the judiciary in Indonesia.

Abstract

This research aims to examine the implementation of government policies and the role of legal politics in preventing and combating the crime of money embezzlement. The research method employed is juridical-normative through literature study using statutory and conceptual approaches, with deductive data analysis. The discussion results indicate that law serves a dual function: preventing through norms and sanctions, and prosecuting perpetrators, with the evidentiary focus on malicious intent and the impact of the actions. Combating money embezzlement requires a combination of penal (repressive law enforcement) and non-penal (preventive measures) approaches. Non-penal efforts encompass environmental improvements, legal education, raising public awareness, and securing potential crime targets. Government criminal policy, as part of broader social policy, is manifested through legal socialization by authorities, case analysis, and coordination among institutions and with community leaders. Although penal measures have shown results, their effectiveness still faces challenges such as slow investigations and sophisticated perpetrator methods, making the integration of non-penal strategies crucial. In conclusion, addressing money embezzlement demands firm and comprehensive law enforcement, synergistically integrating penal and non-penal approaches to achieve optimal prevention and control effectiveness.

Abstract

The purpose of this research by raising a normative legal approach is to reveal the form of legal responsibility of the parking management based on the provisions of laws and regulations. The Supreme Court rejected the cassation filed by PT Nusapala Parkir, reaffirming the responsibility of the parking management to compensate consumers for losses. The analysis shows that parking management must comply with applicable regulations and not use standard clauses that shift responsibility. This research provides insight into the importance of consumer protection and legal responsibility in the parking industry, as well as the pressure on the need for effective law enforcement efforts in protecting consumer rights.

Abstract

This study examines the aspect of abuse of circumstances in making authentic deeds by Notaries in Decision Number 214/Pdt.G/2014/PN.Jkt.Sel. This study provides an understanding of the legal framework needed to protect vulnerable parties in contract agreements and suggests steps to prevent similar incidents in the future. This study uses a normative legal method. The conclusion is that the deed of sale and purchase made by a Notary with abuse of circumstances is considered invalid, and the injured parties can file a lawsuit with the District Court to file for cancellation of the deed of sale and purchase. When forming an authentic deed, it should be ensured in advance regarding the background of the sale and purchase relationship and its object.

Abstract

This study examines the enforcement of election crime law in Bone Regency, focusing on the role and effectiveness of Bawaslu and Sentra Gakkumdu. The research aims to identify the dominant forms of election violations and analyze the mechanisms used to address them. Using a qualitative-descriptive method, the study gathers data through interviews, documentation, and legal analysis. The findings reveal that the most common violations involve state civil apparatus involvement, vote buying, and the misuse of government facilities. While enforcement efforts adhere to existing legal frameworks, challenges persist, including limited coordination between institutions and time constraints in legal processing. The study concludes that improving legal enforcement in regional elections requires not only regulatory consistency but also stronger institutional synergy and community-based preventive strategies. These insights contribute to the development of a more effective and integrity-driven election law enforcement model.

Abstract

This study evaluates the effectiveness of Danantara, Indonesia’s Sovereign Wealth Fund, in promoting economic equity and supporting national economic reform. Established under Law No. 1 of 2025, Danantara is designed as a strategic investment institution tasked with optimizing state assets through a legal-administrative investment framework. Drawing inspiration from international models such as Temasek Holdings and Khazanah Nasional, Danantara adopts a broader mandate by consolidating state assets and enhancing inter-agency synergy. Through a normative juridical approach supported by statute, conceptual, and case-based methods, this research reveals that Danantara plays a significant role in broadening access to economic resources—particularly for MSMEs—and improving the transparency, efficiency, and sustainability of state asset management. The digitalization of assets has transformed them into active instruments of economic growth, contributing directly to job creation, regional development, and improved competitiveness in strategic sectors such as infrastructure, energy, and logistics. Despite these achievements, challenges persist in regulatory harmonization, institutional coordination, and digital infrastructure—especially in underdeveloped regions. The success of Danantara relies on strong legal oversight, adaptive policies, professional management, and continuous monitoring. The study concludes that while Danantara has demonstrated promising results in fostering inclusive growth, sustained regulatory support and cross-sector collaboration are essential to maximize its transformative potential in Indonesia’s evolving economic landscape.

Abstract

This study aims to analyze the expansion of monopoly rights granted by the President to State-Owned Enterprises under Law No. 1 of 2025 from the perspective of legal philosophy. The research method used is normative-philosophical with conceptual, historical, and juridical approaches through literature and regulatory analysis. The monopoly rights provision explicitly expands presidential authority to appoint State-Owned Enterprises’ as sole operators in vital sectors. While constitutionally grounded in Article 33 of the 1945 Constitution, such expansion raises concerns regarding distributive justice and legal certainty. Law No. 1/2025 lacks clarity on the required regulatory form, opening room for ambiguous interpretation and potential market inequality. From both positive law and progressive legal theory perspectives, unchecked monopolies may harm healthy market competition. Analysis through Aristotle’s justice theory, utilitarianism, progressive law, and law and economics approaches reveals the need for limitations based on justice, transparency, and public service efficiency. In conclusion, the expansion of monopoly rights must be regulated within a clear and accountable legal framework to protect public interest and avoid harming other business actors.

Abstract

The development of artificial intelligence, becoming increasingly complex, has sparked profound debates regarding its legal status, particularly whether AI can be considered a legal subject. To address this issue, this study adopts an existentialist philosophical approach, focusing on the concepts of freedom, consciousness, and responsibility as the fundamental elements of human existence. The research employs a qualitative approach with a philosophical analysis of the concepts of subjectivity and existence, drawing on the ideas of prominent existential thinkers such as Jean-Paul Sartre and Martin Heidegger. The findings indicate that although AI is capable of independent action and mimicking decision-making processes similar to humans, it lacks self-consciousness and existential freedom—traits that are inherently human. Therefore, from an existentialist perspective, AI does not meet the criteria to be regarded as a legal subject, as it does not possess authentic existence or the moral responsibility associated with legal subjects. Based on these findings, it can be concluded that the legal status of AI is more appropriately viewed as an object of law, requiring special regulation, rather than as an entity with legal rights and obligations akin to humans.

Abstract

The independence of the Attorney General's Office of the Republic of Indonesia is a fundamental factor in realizing a fair and free justice system from external intervention. However, in practice, many obstacles are faced, including how to apply legal philosophy in the policies and institutional practices of the Attorney General's Office to maintain its independence and how relevant legal philosophy is in realizing the independence of the Attorney General's Office of the Republic of Indonesia. The research method used is normative legal research sourced from secondary data. The results of the study indicate that the application of legal philosophy in the institutional policies and practices of the Attorney General's Office of the Republic of Indonesia has a crucial role in maintaining its independence as a law enforcement institution. The independence of the Attorney General's Office must be realized through policy reforms that emphasize the autonomy of prosecutors in the prosecution process, strengthening internal oversight mechanisms, and increasing the integrity and professionalism of law enforcement officers. Legal philosophy has strong relevance in forming a conceptual foundation for the institutional independence of the Attorney General's Office. The Attorney General's Office must act based on law, ethics, and the interests of justice, not certain political or economic interests. Without strong independence, the Attorney General's Office risks losing credibility and becoming a tool of power.
