Abstract

This study discusses the challenges of trademark protection for SMEs, with a case study of Deswa Craft in Serang. Using a normative juridical approach and descriptive analytical method, it was found that the effectiveness of trademark protection is hindered by low legal literacy, high registration costs, and lack of assistance. However, IPR is a strategic asset in enhancing competitiveness. The government has digitized the system, but its implementation remains uneven. This research recommends improving legal education, simplifying registration procedures, and fostering cross-sector collaboration to ensure SMEs' inclusive and sustainable access to IPR protection.

Abstract

This study aims to analyze (1) the vagueness of the norm in Article 27 A concerning defamation affects freedom of expression (2) how the vagueness of the norm in Article 28 Paragraph 1 concerning the spread of fake news impacts freedom of expression in the digital era. This study uses a normative legal method. The object of this study is Law Number 1 of 2024 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions. The results of the study indicate that (1) the vagueness in Article 27 A concerning defamation can lead to violations of the law, because its interpretation is subjective. This can cause fear for individuals or groups to express opinions or criticism in the digital space, because of the threat of unclear sanctions. (2) Article 28 Paragraph 1 which regulates the spread of fake news also shows vagueness in the definition of "information that surrounds" or "is detrimental," which can risk curbing legitimate criticism of the government or certain policies, given the very broad scope and interpretation that tends to be subjective.

Abstract

This study aims to analyze the potential monopoly practices of Danantara as Indonesia’s state-owned digital superholding from the perspective of competition law. The research method employed is normative juridical, using statutory and secondary legal sources. The formation of Danantara as the primary manager of major SOE assets risks creating market dominance and hindering fair competition. The excessive concentration of economic power may reduce competitiveness and limit market access for private actors, potentially violating principles of justice and legal certainty. Although Danantara aims to accelerate economic growth and redistribute wealth, its ownership structure and weak oversight mechanisms raise public concerns over potential corruption and mismanagement. Law No. 5 of 1999 on the Prohibition of Monopolistic Practices serves as a crucial tool to assess the legality of such dominance. Therefore, legal structuring and oversight must be implemented transparently and accountably to prevent market distortion. In conclusion, the government must establish clear authority limits and strengthen regulatory supervision to ensure Danantara’s strategic role aligns with fair competition principles.

Abstract

The revision of Law No. 19 of 2019 which established the KPK Supervisory Board (Dewas) has sparked debate regarding its impact on the performance and independence of this anti-corruption institution. This topic is very relevant considering the decline in the KPK's performance in handling major corruption cases after the enactment of the law. This study aims to evaluate the effectiveness of the KPK Supervisory Board in supervising the institution and its impact on the success of corruption eradication. The method used in this study is a qualitative approach with in-depth interview techniques, document studies, and participant observation. Data were collected from interviews with legal experts, anti-corruption activists, and former KPK employees, as well as analysis of the KPK's annual report and related articles. The results of the study show that although the Dewas aims to increase accountability, its presence actually slows down the KPK's operational processes and reduces the effectiveness of corruption eradication. The Dewas' bureaucratic function risks affecting the KPK's independence, while the politicization of supervision worsens the internal conditions of the institution. This study suggests the need for an in-depth evaluation of the Dewas' role, as well as strengthening the KPK's operational flexibility to be more responsive to corruption. The implications of this study provide an important picture of the challenges faced by the KPK after the revision of the law, as well as recommendations for further research in examining institutional reform in Indonesia.

Abstract

The economic exploitation of animals in Indonesia threatens the sustainability of species and the balance of ecosystems. Practices such as entertainment, social media content, poaching, and illegal trade have far-reaching impacts. Results show limited human resources and budget, low public awareness, weak law enforcement, and lack of coordination across sectors. A comprehensive approach is needed that includes legal strengthening, public education, and community participation. This research is expected to contribute to biodiversity conservation and animal protection in Indonesia

Abstract

The covernote issued by a notary is a statement letter that falls outside the scope of the notary's official authority and does not constitute a legal product of the notary. The authority to issue a covernote is not regulated by any existing laws or regulations. Based on the Supreme Court Decision Number 4242 K/Pid.Sus/2023, a notary was found guilty of committing a criminal act of corruption for abusing their authority as a notary, in accordance with Article 3 of Law Number 31 of 1999 in conjunction with Law Number 20 of 2001 concerning the Eradication of Corruption, in conjunction with Article 56 paragraph (1) of the Indonesian Penal Code. The issuance of a covernote by a notary is typically done at the request of a bank in relation to deeds and documents for the provision of credit facilities. Therefore, in such cases, the notary may also be subject to administrative sanctions for maladministration.

Abstract

The KPU as the respondent in the Supreme Court decision, as previously explained, was ordered to amend Article 8 paragraph (2) of PKPU 10/2023, this was not followed up by the KPU. Instead of revising the regulations, the KPU decided to make an official letter containing a request to Political Parties to comply with the Supreme Court decision, the implications of this Article make the list of permanent candidates for female DPRD members of Bandung Regency many less than 30% in each electoral district, The method used by researchers in this study is the Empirical Normative Legal Method which uses a normative or binding and regulatory rule or law which is combined with factual empirical data. The results of the study show that the KPU did not comply with the Supreme Court decision to revise Article 8 paragraph 2, The implications of rounding the decimal down caused 33 electoral districts on the list of permanent candidates for DPRD members from 18 contesting parties to be less than 30% female representation. From the perspective of the industrial policy, there is no prohibition regarding women in politics or becoming a leader, especially if what a woman is fighting for are good things and things that are beneficial for everyone.

Abstract

This study aims to examine the criminal act of human trafficking from the perspective of Indonesia’s positive law and its impacts on victims and society. The research method used is normative juridical with descriptive analysis of statutory regulations and legal doctrines. Law No. 21 of 2007 serves as the legal foundation for combating human trafficking, covering recruitment to exploitation through various criminal modes. Human trafficking causes severe social, economic, and psychological impacts, from deep trauma to social exclusion of victims. The state has established a comprehensive protection system, including rights recovery and international cooperation mechanisms. Despite existing regulations, challenges remain in enforcement and limited rehabilitation facilities. Therefore, effective TPPO eradication strategies require synergy between the government, civil society, and international actors to achieve substantive justice and comprehensive protection. In conclusion, addressing human trafficking must be holistic, with strengthened legal enforcement, victim protection, and sustainable public participation.

Abstract

This study aims to analyze the legal and political implications of establishing Danantara as Indonesia’s Sovereign Wealth Fund. The research employs a normative legal method with conceptual and statutory approaches. Danantara’s formation through Law No. 1 of 2025 provides a strong legal basis to consolidate strategic SOE assets for national economic efficiency and growth. However, placing Danantara under direct presidential oversight raises concerns about political interference and weakened independent monitoring. Its superholding status necessitates effective coordination among SOEs to prevent conflicts of interest. From a legal perspective, Danantara demands more adaptive investment regulations to ensure legal certainty for investors. Additionally, the exclusion of oversight by the Audit Board and Anti-Corruption Commission creates risks of power abuse. In conclusion, the government must reinforce independent supervision and ensure fair and transparent regulations so Danantara can operate professionally and accountably.

Abstract

This study aims to examine the responsiveness of Indonesia’s legal system to contemporary social and economic dynamics. Employing a qualitative-descriptive approach with an exploratory case study design, the research explores how legal policies—such as the Job Creation Law and the Omnibus Law—are implemented and how effectively they address the needs of society, particularly marginalized groups. Findings reveal a significant gap between the theory of responsive law—which emphasizes adaptability, public participation, and substantive justice—and legislative practices that remain top-down, lacking transparency, and heavily influenced by political and economic interests. Bureaucratic rigidity, low legal literacy, and social inequality further hinder the implementation of genuinely responsive laws. This research highlights the urgency of institutional reform, capacity-building for legal actors, and active civil society engagement in policymaking. Thus, the law can transform into a tool for social and economic empowerment, rather than merely an instrument of control. The findings are expected to contribute both theoretically and practically to the development of a more adaptive, inclusive, and equitable legal system in Indonesia.
