Abstract

This study examines legal certainty in the fulfillment and protection of street vendors' rights at the Traditional Market of Sila, Bima Regency. Using a juridical-sociological approach, the findings reveal that although vendors' basic rights are normatively recognized, their implementation remains weak due to the lack of technical regulations and firm local governance. The study concludes that strengthening local regulations and law enforcement roles is essential to ensuring real protection for street vendors.

Abstract

In the era of globalization, the development of criminal acts continues to increase. Human trafficking is a form of modern slavery, even a mother as a parent is willing to sell her child because of material needs. This study aims to analyze the criminal liability for mothers who commit child trafficking against their children, as well as to examine the factors behind the act. The results of the study indicate that mothers involved in child trafficking can be charged with the provisions of Law Number 21 of 2007 concerning the Eradication of the Crime of Human Trafficking, with a heavier criminal threat if carried out against children. This study uses an empirical juridical type, namely field research, using a qualitative approach, namely methods and techniques based on the author's curiosity about juridical symptoms or how to find truth in knowledge. Abstract

The Indonesian government's recent fiscal efficiency policy reflects a rigorous approach to controlling national spending. In this context, both foreign and domestic investment serve as strategic and vital alternative sources of financing for national development. Analogous to an oasis amid a fiscal desert, investment plays a key role when the state's fiscal space is increasingly constrained. However, legal protection for investment still faces numerous challenges, such as weak law enforcement, overlapping regulations, and disruptions by non-state actors such as community organizations (ormas). This research aims to analyze the legal protection of investment amid the government's budget efficiency efforts. The study employs a normative juridical method with statutory, conceptual, and case-based approaches. The findings reveal that although Indonesia's investment regulations have developed normatively, their implementation remains weak, particularly in ensuring legal certainty and security for investors. This research concludes that a responsive, equitable, and sustainable legal protection model is urgently needed for investment to effectively serve its function as a development instrument in times of limited fiscal capacity.

Abstract

Overlapping land disputes are an agrarian issue that often arises in Indonesia, including in the city of Semarang. This study highlights the resolution of disputes over a plot of land in Kalipancur village, Ngaliyan district, which involves two different land ownership certificates for the same object. The purpose of this research is to examine the mediation process and the legal consequences of the agreement reached. The method used is a qualitative approach through case studies. The land office plays a crucial role in facilitating communication, assisting the resolution process, and ensuring that the mediation results have legal force and can be implemented by both parties.

Abstract

The sale and purcase agreement (PPJB) of land accompanied by a power of attorney to sell is frequently used as collateral in debt agreements. However, such a PPJB does not constitute valid legal collateral because it lacks executorial power and is susceptible to annulment by the court. This creates legal risk for creditors in the event of default by the debtor. Notaries must be held accountable for eansuring the accuracy and conformity of documents with actual conditions to prevent legal losses. Therefore, it is advi for creditors to use legally recognized forms of collateral, such a mortage risk (hak tanggungan), to ensure legal protection and debt repayment certanly. Legal protection for creditors can also be strenghened through fair contractual clauses and legal action in cases of default or unlawful condut.

Abstract

The Sale and Purchase Binding Agreement (PPJB) is a preliminary agreement made before the execution of the Sale and Purchase Deed to transfer land rights. However, in practice, it is often misused as a guarantee for the settlement of debts, resulting in legal uncertainty. This normative juridical research analyzes the legal standing of debt-based PPJB and finds that such agreements are null and void because they deviate from their original function. Therefore, legal protection is only available through repressive means in the form of a lawsuit for cancellation to the court. An analysis of two court decisions shows that judges will cancel the PPJB if it is proven to contain elements of debt (as in Decision No. 23/Pdt.G/2018/PN.Dpu Jo Decision No. 1615 K/Pdt/2020), but will not cancel it if there is no proven element of debt (as in Decision No. 364/Pdt.G/2016/PN.JKT.Sel Jo Decision No. 539 PK/Pdt/2020). This research concludes that to avoid legal problems, debt relationships should be set forth in a separate debt agreement deed that clearly regulates the rights and obligations of the parties, not through a PPJB which can be detrimental and does not provide legal certainty.

Abstract

This research discusses the practice of covert sexual exploitation or white collar pimping perpetrated by certain individuals in Human Resource Development (HRD) against female doctors in remote areas. Using methods such as grooming, pseudo-mentoring, conditioning private meetings, and non-clinical requests, female doctors are manipulated into situations of unequal power. This study employs a qualitative-descriptive approach and normative legal analysis. It was found that HRD's involvement in facilitating unethical relationships between doctors and organizational leaders constitutes a violation of civil law and professional ethics. This article also examines the legal consequences for organizational leaders and other employees involved. These findings underscore the urgency of establishing an independent reporting system and organizational policies that protect female medical personnel in remote areas.

Abstract

The growing elderly population in Indonesia is not matched by integrated regulation ensuring the right to community-based healthcare. Although Law No. 13 of 1998 mandates elderly health services, its implementation faces policy fragmentation, absence of standards, and sustainable funding. This study aims to formulate a regulatory framework for implementing Community-Based Integrated Care using a welfare state perspective. A normative-juridical method with regulatory analysis was applied. Findings reveal the need for a Presidential Regulation integrating inter-ministerial coordination, national service standards, and a hybrid funding scheme to fulfill the mandate of Law No. 13 of 1998 and realize welfare state principles in Indonesia.

Abstract

The state is responsible for fulfilling women’s representation through the obligation of conduct, which means not only creating regulations that support gender equality but also actively and effectively implementing these policies. The state must create conditions that enable women to participate equally in politics. Although women’s quotas in the legislature have been implemented, women’s representation in elections remains low. The obligation of conduct perspective emphasizes the importance of the state’s role in fulfilling human rights, particularly women’s political rights, by creating an environment that genuinely and sustainably supports participation and gender equality.

Abstract

This study discusses the application of the omnibus law method in the formation of regional regulations (perda) in Cianjur Regency as a strategic effort in organizing regional regulations that tend to overlap, have multiple interpretations, and are inconsistent. The purpose of this study is to identify the urgency and mechanism for using the omnibus law method in the formation of regional regulations to support synchronization and harmonization with higher laws and regulations, especially after the enactment of the Job Creation Law. This study uses a normative legal approach with conceptual and historical analysis of applicable legal provisions. The results of the study show that the omnibus law method is effective in simplifying regional legal products through the consolidation of various related perda into one more comprehensive regulation. The implementation mechanism includes the formation of a drafting team, inventory, grouping of content materials, to the formal legislative process through the regional regulation formation program (Propemperda). Although this method offers regulatory efficiency, challenges are still faced, especially the absence of technical implementing regulations from the central government which has the potential to cause formal legal problems in the future. Therefore, further policies are needed that guarantee legal certainty in the application of the omnibus law method at the regional level.
