Abstract

This study analyzes dispute resolution in the Indonesian construction sector, focusing on the preference for Arbitration and Alternative Dispute Resolution (ADR) mechanisms over traditional litigation. Indonesia's construction industry, intertwined with its political history and legal transformation, frequently faces disputes arising from payment delays, non-compliance with technical specifications, ambiguous contractual responsibilities, and land use conflicts. While litigation is available, Arbitration and ADR is favored due to its quicker, more cost-effective, and confidential processes. A normative legal research method is applied to examine legal phenomena through analytical evaluation of secondary data. Findings indicate that mediation and arbitration, in particular, are relevant for their flexibility, ability to preserve business relationships, and binding decisions. Arbitration stands out for its capacity to select expert arbitrators and apply the ex aequo et bono principle. The adoption of Arbitration and ADR aligns with Indonesian socio-cultural values like musyawarah-mufakat, which emphasize communal harmony and "win-win" solutions. This analysis confirms that Arbitration and ADR, particularly arbitration, is a more effective choice for construction dispute resolution, supporting sustainable and equitable growth in the sector.

Abstract

A notary’s official duties and authority are not solely for personal interest, but also serve the public interest. A notary is obligated to ensure the truthfulness of the deeds they draw up. Therefore, a notary is expected to act with honestly, fairness and transparency in preparing authentic deeds to safeguard all parties directly involved. This study employs a normative legal research method, using primary, secondary, and teriary legal materials, analyzed qualitatively. In the Courd Decision Number 433/Pdt.G/2021/ PN Mdn, the panel of judges considered that if a notary is proven to have knowingly or negligently include false information in a deed, this contitues both a violation of the notarical code of ethics and unlawful act. As a concequence, the notarial deed in question, being based on false statements, in declrared null and void by law.

Abstract

The right of pledge serves as a property security instrument that grants a privileged position to creditors in the event of debtor default. While this right provides legal certainty for creditors, its application can affect third parties with an interest in the secured object. This situation often leads to legal conflicts, particularly when third parties are unaware of the existence of a pledge on the acquired assets. This study aims to explore the forms of legal protection available for third parties and the legal responsibilities of creditors in the execution of the pledge. Utilizing a normative juridical method, this research analyzes regulations, principles of prudence, and the role of notaries in maintaining transparency. The findings indicate that despite existing regulations, challenges such as a lack of transparency and public awareness still hinder optimal legal protection. Therefore, measures are needed to enhance transparency in the registration of pledges and to educate the community. This study recommends regulatory improvements and increased oversight to ensure the protection of third-party rights and to establish legal certainty in transactions involving pledges.

Abstract

Village-Owned Enterprises, known by the abbreviation BUMDes, are a form of business formed and run by the village government. Regulations related to BUMDes have undergone various changes over time. Law Number 11 of 2020 is the latest legal basis governing the development, establishment, mechanisms, and position of BUMDes. These regulations are then further elaborated through Government Regulation (PP) Number 11 of 2021 as its implementing regulations. Therefore, it is important to conduct further discussion regarding the essence of PP No. 11 of 2021 concerning the implementation of BUMDes, as well as to assess whether BUMDes can be categorized as a legal entity after this regulation comes into effect.

Abstract

Credit agreements secured by land certificate mortgage rights are key legal instruments in financial lending. In practice, legal protection for creditors often faces obstacles such as land disputes and enforcement delays. This study reveals that although creditors are legally protected under the Mortgage Law, its implementation remains suboptimal. It concludes that legal protection for creditors must be reinforced through administrative certainty in land registration and more effective mortgage enforcement mechanisms.

Abstract

This study aims to analyze the role of the village head as a mediator in resolving land disputes in Rupe Village, Langgudu Subdistrict, Bima Regency. The village head serves not only administratively, but also strategically in mitigating conflict through local wisdom-based mediation. The findings indicate that the village head holds high social legitimacy, effectively facilitating peaceful agreements between disputing parties. The study concludes that mediation success is strongly influenced by public trust in the village head as a neutral figure.

Abstract

This study discusses the delegation of authority of the State Administrative Court (PTUN) to the general court regarding land certificate disputes, with a case study of Decision Number 20/G/2022/PTUN.SMG. The focus of this study is to analyze the legal basis, judges' considerations, and the legal implications of the delegation of authority. The research methods used are normative juridical and decision studies. The results of the study indicate that in this case, the land dispute that originated from the State Administrative decision was transferred to the general court because it was considered to involve civil aspects. However, this has given rise to a legal debate regarding the absolute jurisdiction between the PTUN and the general court. The findings of this study indicate the need for legal reform so that the authority of the judicial institution is clearer in handling overlapping disputed objects, especially regarding land certificates. This study recommends harmonization of regulations and legal understanding between judicial institutions to ensure legal certainty.

Abstract

The merit system is a fundamental principle for promoting professionalism and neutrality among civil servants. However, in Indonesia, its implementation faces structural challenges, especially following the dissolution of KASN as an independent oversight body. This article examines the current gaps in merit system supervision and proposes a managed devolution with central oversight model, inspired by Australia's framework. The study suggests a legal and institutional reform that limits PPK’s discretionary authority and strengthens the role of BKN by establishing an independent merit oversight board to uphold accountability and impartiality in the civil service.

Abstract

This research explores the urgency of term limits for legislative members within the framework of constitutional democracy, aiming to prevent abuse of power, oligarchic dominance, and political stagnation. Using a normative juridical method and qualitative descriptive analysis, the study reveals that the absence of legislative term limits reflects a weakness in Indonesia’s legal system. The findings emphasize the importance of structural term limits as a mechanism for power control, ensuring political regeneration, and strengthening the principles of equality before the law and fair representation in a democratic constitutional state.

Abstract

In the era of public service digitalization, electronic mortgage registration (HT-el) has become an important breakthrough in improving the efficiency and accessibility of land services, but its implementation poses new challenges regarding the legal responsibility of Land Deed Making Officials (PPAT) who are directly involved in the registration process through electronic systems. Juridical empirical research conducted at the Land Office of Pekanbaru City shows that when errors occur in the Mortgage Granting Deed (APHT) or during electronic registration, PPAT is given 5 (five) days to correct the errors, but if they cannot be corrected within that timeframe, the application will be declared null and void. Uncorrected errors can result in the deed losing its authentic power based on court decisions for not meeting formal and material requirements, so that the power of the deed is only as an underhand deed which makes it difficult for the parties entitled to use the deed as valid legal evidence, and to overcome this requires solutions in the form of correcting the deed in APHT and correcting registration in the HT-El application through the process of re-inputting accurate data and re-paying administrative fees.
