Abstract

Agrarian Act is a form of protection in the agrarian sector. Agrarian law is the law that regulates land, both in relation to civil and government matters and the institutions authorized to do so. The number of regulations related to land makes the author interested in writing about the development and differences in arrangements between pre Government Regulation Number 18 of 2021 concerning Management Rights, Land Rights, Flat Units, and Land Registration and after the enactment of Government Regulation Number 18 of 2021 concerning Management Rights, Land Rights, Flat Units, and Land Registration.

Abstract

The main problem of the existence of indigenous law communities has occurred since before Indonesia became independent until now, namely with the establishment of Land Management Rights by the government without being based on laws and regulations such as the mandate of the Indonesian Constitution. In fact, the existence & recognition of indigenous peoples has been recognized since before the independence phase of Indonesia. The arrangement regarding the recognition of the existence of indigenous law communities can be recognized because it is used as a basis in the preparation of the National Land Law. The author suggests that North Lombok Regency immediately formulate and issue a Regional Regulation with regard to the Recognition and Respect of “The Paer Rights”, especially with regard to the strengthening of Handlers (customary forests). Because the existence of this regulation has been a government policy; This conception should be turned into a common rule.

Abstract

There are several ways to obtain land that can be done through two ways, namely; 1) "Originair" or the acquisition of rights is dwarfed by government determination, be it in the form of conversion or registration of land for the first time. The position of the land can be obtained through the application of rights; 2) Derivatives or land obtained through certain legal acts such as buying and selling, grants, inheritance, auctions, or investment. Especially in Samarinda City, with the birth of Samarinda City Regional Regulation No. 2 of 2019 on Permits to Open Land in the Country resulted in state land in Samarinda City becoming the basis of mastery of state land. However, land allocation with the label Of State Land Clearing Permit (IMTN) is prone to misuse of its designation. Basically, IMTN is only a basis for the use of state land to realize legal certainty and as a follow-up to the improvement of land certification. The object of IMTN itself is not intended in the framework of land commercialization. IMTN in Samarinda which is the implementation of Law No. 23 of 2014 on Local Government has been contained in Samarinda City Regional Regulation No. 2 of 2019 and Samarinda City Mayor Regulation No. 61 of 2019. In the provisions of the local regulations, there is a prohibition to transfer land with IMTN that can have an impact on the buying and selling deeds carried out. The efforts of the parties, both local governments and stakeholder stakeholders, and the community are shoulders to shoulder so that there is no horizontal conflict.

Abstract

Health development is one of the national goals of the Indonesian nation based on the Preamble to the 1945 Constitution of the Republic of Indonesia. After the enactment of the 1945 Constitution of the Republic of Indonesia, the discussion of the right to health is re-regulated in Article 28H paragraph (1). Regulations regarding patient rights are listed in Law no. 36 of 2009 concerning Health, Law no. 29 of 2004 concerning Medical Practice, and Law no. 44 of 2009 concerning the Hospital. However, patients' rights cannot be fully implemented during the COVID-19 pandemic. So, the author will discuss how the legal protection of the right to privacy and medical records during the COVID-19 pandemic. This research is normative legal research. The conclusion of this research is that in an emergency condition, guaranteeing that the fulfillment of patient rights categorized as derogable rights is a right that can be limited or postponed.

Abstract

This paper discusses the legal protection of nurses in hospitals based on law number 38 of 2014. The type of research used in this research is normative research, namely research that examines document studies, namely using various secondary data as normative research. The results of this journal show that nurses who receive delegations or mandates in carrying out medical tasks are more careful and continue to communicate with doctors who delegate these tasks so that malpractice does not occur. In addition, so that nurses do not accept demands both from the aspect of speech, civil and administrative aspects, it is better if the delegation of tasks is in the form of written documents.

Abstract

The Riau Provincial Government launched the Universal Health Coverage (UHC) program as of November 1, 2012, and has been regulated in Riau Provincial Regulation No. 7 of 2011 on the Implementation of Health Insurance. With this program, the community will get health services at First Level Health Facilities (FKTP) and services at 3rd class Hospitals managed by BPJS Kesehatan Riau Province. So it is expected that the UHC program in Riau Province can reduce the BPJS health deficit. But of course, in the implementation, there are obstacles that must be resolved by the Riau Provincial Government so that its implementation can be realized well for underprivileged communities. UHC is an innovation to provide health insurance for all communities that have not been covered by any health insurance. The innovation of the flagship program becomes the focus of research that can later be known the process and results provided so that it can be applied in other areas. The implementation of UHC is one of the concrete efforts made by the Riau Provincial Government to ensure public health services which is one of the criteria in the quadrant of the City Resilience Index (Riau Provincial Resilience Index). The presence of UHC itself is in line with the pillars of Riau province's resilience strategy that has been proclaimed by the Riau Provincial Government to reduce the risk of impact from disease outbreaks. UHC plays a role in the recovery of communities affected by the disease outbreak so that UHC does have a contribution in building the resilience of Riau Province but not much contribution has been made considering that the health sector has not been the main focus of the Riau Provincial Government.

Abstract

COVID-19 has caused a multidimensional crisis in a global society. Many mitigation policies were made to handle the crisis, especially in South Korea and Indonesia. South Korea’s policies were judged to be effective as the success increased public opinion and participation. As a result, the COVID-19 case’s curve flattened rapidly because of responsive policies and based on international law. Meanwhile, Indonesia continues to show an increase in the case curve because of inconsistent policies and weak law instruments towards emergency health response. As a result, the crisis has more long-term effects and gets worse. It can be concluded that South Korea has more responsive policies and follows more of the International Health Regulation of 2005 compared to Indonesia.

Abstract

Since the WHO declared that the Covid-19 outbreak had reached the level of a global pandemic, it had prompted governments in many countries to take urgent and aggressive action to immediately stop the spread of the deadly virus. Various policies are made and implemented by the governments of each country to control the spread of the disease. One of the concerns in Indonesia, where the majority of the population is Muslim, is the policy for the burial of corpses due to Covid-19. Taking into account that the corpse of a Covid-19 patient is a corpse infected with a contagious disease and must be handled specifically to protect the burial officers by still paying attention to the provisions of Shara' which are the rights of the corpse.

Abstract

Indonesia is a country with the highest animal wealth in the world. However, the wealth of these animals is threatened by the wildlife trade. Therefore, law enforcement for wildlife trade is carried out. However, the perpetrators develop their modus operandi to deceive law enforcers, one of which is through cross-state jurisdictions. The results of this study indicate that the urgency of strengthening cross-border cooperation in eradicating wildlife trade is due to the high potential for biodiversity in Indonesia, accompanied by high cases of animal trafficking, law enforcement that has not been optimal, and problems in regional and international cooperation in eradicating wildlife trade. illegally wild. Then efforts that can be made to strengthen this cooperation are by improving the provisions in CITES, improving the governance of CITES authorities in Indonesia and strengthening cooperation between countries in the ASEAN region.
