Abstract

 Praktik perjanjian internasional di Indonesia, diterjemahkan sebagai “pengesahan” dalam Pasal 1 angka (2) Undang-Undang Nomor 24 Tahun 2000 tentang Perjanjian Internasional, adanya pengesahan menjadi niscaya karena kepala negara merasa perlu untuk meyakinkan bahwa delegasi yang diberi kuasa penuh olehnya tidak melampaui batasan wewenangnya, sehingga pada tanggal 22 November 2018 Mahkamah Konstitusi memutuskan permohonan Nomor 13/ PUU-XVI/2018, dasar permohonan uji materil ini karena dianggap telah menimbulkan kerugian konstitusional yang dirasakan pemohon disebabakan oleh adanya perjanjian internasional yang berdampak luas terhadap kehidupan rakyat dan  MK mengganti kriteria yang ada dalam Pasal 10 UU PI dengan kriteria dalam Pasal 11 (2) UUD, yaitu perjanjian harus mendapat persetujuan DPR. Pada penulisan ini dilatarbelakangi dengan adanya permaslahan yaitu, apa implikasi yuridis Putusan Mahkamah Konstitusi Nomor 13/PUU-XVI/2018 terhadap perluasan peran DPR dalam perjanjian internasional di Indonesia, dan apa urgensi perluasan peran DPR dalam perjanjian internasional di Indonesia. Jenis penelitian yang digunakan adalah penelitian yuridis normаtif. Sedangkan pendekatan penelitian yakni pendekаtаn perundаng-undаngаn, pendekаtаn konseptuаl, dan pendekаtаn perbandingan. Kesimpulannya bahwa implikasi yuridis putusan Mahkamah Konstitusi Nomor 13/PUU-XVI/2018 terhadap perluasan peran DPR dalam perjanjian internasional berupa persetujuan DPR hanya diperlukan apabila materi perjanjian internasional menimbulkan akibat yang luas dan mendasar yang terkait dengan beban keuangan negara atau mengharuskan perubahan atau pembentukan undang-undang. This writing is motivated by the existence of problems, namely, what are the juridical implications of the Constitutional Court Decision Number 13/PUU-XVI/2018 on the expansion of the role of the DPR in international agreements in Indonesia, and what is the urgency of expanding the role of the DPR in international agreements in Indonesia. The type of research used is normative juridical research. While the research approach is a statutory approach, a conceptual approach, and a comparative approach. The conclusion is that the juridical implications of the decision of the Constitutional Court Number 13/PUU-XVI/2018 on the expansion of the DPR's role in international agreements in the form of DPR approval are only needed if the material of an international agreement causes broad and fundamental consequences related to the burden of state finances or requires changes or the formation of laws. law. Meanwhile, the urgency of expanding the role of the DPR in international agreements can be seen from two sides, namely, interaction with the president including the supremacy of the constitution, the nature of supervision and interaction with the people through representative institutions, either the President or the DPR.Keywords: International Agreement, Material Testing, Authority.

Abstract

Since 2005 the rule of Bank Indonesia is already issued a policy about consumer credit facilities in order to get a place or a home for foreign people who live in Indonesia, but it is not enough to make all the bank that took place in Indonesia give that facilities. One of the reasons discrepancy of a number banks to give that credit facilities to foreign people is because the risk in case there is a failure or the person is not fulfilling the obligation. Considering the debtor is a foreigner, while the object of the guarantee is a land with a right of use that has a limited period, and until now there is still no regulations from both the Indonesian government and from Bank Indonesia that specifically provide protection against banks on consumer credit facilities for foreigners. In this paper, the writer will discuss the effort of legal protection that can be done by the Bank are preventive effort and repressive effort. Preventive legal protection efforts undertaken by banks is with credit agreements. Repressive legal protection effort, if the foreign debtors can not fulfill the obligation one of them is to stop the consumer credit agreement.

Abstract

ASEAN had created the ASEAN Regional Guidelines on Competition Policy and Handbook on Competition Policy and Law in ASEAN for Business as guides for assessment of the behaviour of business people in the industry and market. The Regional Guidelines “only” help member countries in increasing awareness of the importance of business competition policies. The execution of business competition is then left to the ASEAN member country, to be in accordance with national business competition policies. Meanwhile, the ASEAN Economic Community will allow business people in ASEAN countries to conduct business transactions in whichever country they prefer. Without clear regulations, businesspeople can freely carry out cross-border transactions that can disrupt the domestic market of each ASEAN member country. Differences in regulatory substances and the absence of competition law regulations in several ASEAN member countries will undoubtedly become a challenge for the application of competition laws by businesspeople in the ASEAN regional market. However, in relation to AFTA, the primary urgency is instead the realization of imposing tariffs of 0-5% by performing the harmonization of regulations in the field of Customs and the removal of other forms of Non-Tariff Barriers (NTBs). The removal of trade barriers is one of the things that are also regulated in competition law. This article is the result of normative juridical research that analyzes the differences in the substance of competition law in several ASEAN countries along with their juridical implications, to be able to evaluate the urgency of harmonizing legal regulations on business competition among the member countries of ASEAN.

Abstract

The existing legal construction of information technology-based loaning services essentially creates high interest rates in the community and leads to non-performing loans. Therefore, in essence, it is necessary to formulate a new legal construction to solve these problems. Considering that the problem is complex and systemic, ideally the legal construction formulated is convergence, which is the result of the unification of all existing variables. Related to this, the question arises how the legal construction of determining interest rates in information technology-based loaning services reflects the convergence of law and the principle of justice. The purpose of this study is to identify, describe and analyze the application of the legal construction of determining interest rates in information technology-based loaning services in the future. The research method used in this study is a normative juridical research using a statutory approach, a conceptual approach and a convergence approach. The results of this legal research indicate that the legal construction of determining interest rates in information technology-based loaning services which reflects the convergence of law and the principle of justice is the determination of interest rates that refer to the interest rates set by Bank Indonesia. Konstruksi hukum layanan pinjam meminjam uang berbasis teknologi informasi eksisting saat ini pada hakikatnya menciptakan penetapan suku bunga yang tinggi di masyarakat dan marak berujung kepada non performing loan. Maka dari itu pada hakikatnya perlu dirumuskan sebuah konstruksi hukum baru untuk dapat memecahkan permasalahan tersebut. Mengingat permasalahan tersebut bersifat kompleks dan sistemik, maka idealnya konstruksi hukum yang dirumuskan bersifat konvergensi, yakni merupakan hasil dari penyatuan seluruh variabel-variabel yang ada. Terkait hal tersebut muncul lah pertanyaan bagaimana konstruksi hukum penentuan suku bunga dalam layanan pinjam meminjam uang berbasis teknologi informasi yang mencerminkan prinsip konvergensi hukum dan prinsip keadilan. Tujuan Penelitian ini adalah untuk mengidentifikasi, mendeskripsikan dan menganalisis mengenai penerapan konstruksi hukum dari penentuan suku bunga dalam layanan pinjam meminjam uang berbasis teknologi informasi di masa yang akan mendatang. Metode penelitian yang digunakan pada penelitian ini merupakan jenis penelitian yuridis normatif dengan menggunakan pendekatan perundang-undangan, pendekatan konseptual dan pendekatan konvergensi. Hasil penelitian hukum ini menunjukkan bahwa Konstruksi hukum penentuan suku bunga dalam layanan pinjam meminjam uang berbasis teknologi informasi yang mencerminkan prinsip konvergensi hukum dan prinsip keadilan adalah penentuan suku bunga yang mengacu kepada suku bunga yang ditetapkan oleh Bank Indonesia.

Abstract

Pemasaran apartemen dengan sistem pre project selling diperbolehkan sepanjang pengembang harus memenuhi persyaratan pada Pasal 42 ayat (2) UU Rumah Susun, ketentuan tersebut bersifat imperatif artinya wajib dipatuhi oleh pengembang. Pengembang telah melakukan promosi untuk memasarkan produknya tetapi disisi lain pengembang belum memiliki izin-izin pembangunan. Tujuan penelitian untuk menganalisis dan menemukan batasan pemasaran dalam transaksi jual beli apartemen dengan sistem pre project selling. Penelitian hukum normatif ini menggunakan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Hasil penelitian adalah praktik pre project selling yang dilakukan pengembang seringkali tidak memenuhi persyaratan-persyaratan dalam pembangunan apartemen. Masyarakat dapat dirugikan dari praktik tersebut, sehingga Pemerintah perlu melakukan pengawasan yang ketat terhadap praktik pre project selling agar dapat memberikan perlindungan hukum bagi masyarakat sebagai konsumen apartemen.

Abstract

This paper aims to understand the suitability of the regulations regarding the legalconsequences for notaries who are declared bankrupt. This type of normative legalresearch uses a statutory approach. Based on the results of the discussion, it was concluded that the provisions regarding legal consequences for notaries who weredeclared bankrupt in UUJN were specialist lex of similar provisions in the UUKand PKPU. This is also because the bankruptcy concept in UUJN is different fromthe bankruptcy concept in UUK and PKPU. Bankruptcy under UUK and PKPUoverrides the position of a person who is bankrupt, however bankruptcy in theUUJN may involve a person’s position as a Notary if the bankruptcy is the result ofan error committed by someone in his / her position as a Notary Public. Then thelegal consequence that can be accepted by a Notary who is declared bankrupt is thedismissal of his position as a Notary Public. Notaries can be sued for the fulfillmentof reimbursement of expenses, compensation or interest by the parties on the basis ofacts against the law. Abstract

A number of regulations and policies implemented by some countries regarding the limitations of freedom to manifest religion or belief have been highly debated since the Covid-19 pandemic. Many argue such policies are discriminative and inconsistent with human rights law. Thus, this paper aims at analyzing the concept of human rights in the implementation of religion manifestation during the pandemic, and investigating how states implement policies according to the international human rights legal framework. This normative research which uses comparative and conceptual approach concludes that policies established by states in general can be legitimized on several conditions, among others for public health concerns. In addition, the proportionality and the non-discrimination principles need to be applied accordingly.

Abstract

The study aims to analyze, first, the BUMN sub-holding loss as a state loss and secondly, the responsibility of the BUMN holding company for the BUMN sub-holding loss. There is a dualism in the conception of state assets that are separated from BUMN in Indonesian laws and regulations. The research methods was normative legal research with a statutory approach and a case approach. The shares of BUMN sub-holding don’t come from the state but come from the BUMN and also the public. The capital investment which it does by the BUMN holding company to the BUMN sub-holding doesn’t make the BUMN sub-holding become a BUMN. In the Group Company, the principle of a separate entity continues to apply which leads to the principle of limited liability holding as a subsidiary shareholder. However, if BUMN as the majority shareholder has the right to actively intervene and it is proven that there is control of the company, then the principle of piercing the corporate vision can be applied. So the BUMN holding company must be responsible for BUMN sub-holding because of the control carried out by these BUMN holding companies. The results show that the BUMN sub-holding loss isn’t state loss.

Abstract

Abstract: Based on the background, the formulation of the problem is: How is the legality of the act of receiving tax receipts by Land Titles Registrar (PPAT) as a public official and How juridical implications of PPAT who receive tax and income tax of Acquisition of Land and Building Rights (PPHTB) from taxpayers. The method used to examine these issues is normative legal research using a statute approach to examine legislation relating to legal issues under review. Based on the results of the research, the results obtained that the legality of accepting tax receipts by PPAT as public officials actually still does not exist, in other words has not established a definite rule that regulates the act of receiving tax receipts by PPAT. Then about juridical implication to PPAT which accept tax day income tax and BPHTB from taxpayer is even though the act have not have legal legality but its implementation still included in legitimate category because that action depart from habit that have been accepted and accepted by society. As long as there is no rule of law to realize the legality of this act then as long as it is also this habit will continue, although there is no guarantee of legal protection for this act but as long as it does not cause harm to anyone then considered not a problem Abstrak: Tujuan penulisan ini adalah mendeskripsikan legalitas perbuatan menerima kuasa menyetor pajak oleh Pejabat Pembuat Akta Tanah (PPAT) selaku pejabat umum dan implikasi yuridis terhadap PPAT yang menerima penitipan Pajak Penghasilan (PPh) dan Bea Perolehan Hak Atas Tanah dan Bangunan (BPHTB) dari wajib pajak. Metode yang digunakan untuk meneliti permasalahan tersebut adalah penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan (statute approach) untuk menelaah peraturan perundang – undangan yang terkait dengan isu hukum yang sedang dikaji. Legalitas perbuatan menerima kuasa menyetor pajak oleh PPAT selaku pejabat publik sesungguhnya masih belum ada, dengan kata lain belum dibentuk suatu aturan pasti yang mengatur tentang perbuatan menerima kuasa menyetor pajak oleh PPAT. Kemudian tentang Implikasi yuridis terhadap PPAT yang menerima penitipan pajak PPh dan BPHTB dari wajib pajak adalah meskipun perbuatan tersebut belum memiliki legalitas hukum namun pelaksanaannya masih termasuk dalam kategori sah sebab perbuatan tersebut berangkat dari kebiasaan yang berlaku selama ini dan diterima oleh masyarakat. Selama belum ada aturan hukum untuk mewujudkan legalitas dari perbuatan ini maka selama itu pula kebiasaan ini akan terus berlanjut, walaupun tidak ada jaminan perlindungan hukum atas perbuatan ini tetapi selama tidak menimbulkan kerugian bagi siapapun maka dianggap tidak masalah DOI : http://dx.doi.org/10.17977/um019v2i12017p018

Abstract

This article described the effectiveness of limiting the age of marriage based on Act No.1 of 1974 about marriage. The method used empirical juridical or sociological juridical in Probolinggo Regency. The informants in this study were principles, teachers of Counseling Guid- ance, Heads of Religious Affairs Offices in Probolinggo District, and dropout students who under- age marriages. The results of the study showed that restrictions on marriage age have not been effective in the implementation domain. This fact showed from a large number of underage marriages conducted among the public. Factors causing marriage under age were: (1) community culture, matchmaking, (2) relationships that were too close in dating, (3) pregnancy outside marriage.DOI: http://dx.doi.org/10.17977/um019v3i12018p100
