Abstract

Although marijuana is banned from use in healthcare in Indonesia, medical developments show its potential benefits. This research will examine Islamic views on the legalization of medical cannabis in the context of Indonesian positive law. This research will examine the regulation, legality, and implications of the use of medical cannabis in Indonesia, focusing on legal, religious, and health aspects. Given the gap between medical needs and existing regulations, this research aims to fill the knowledge gap regarding the regulation of medical cannabis in Indonesia. This research shows that regulations related to medical cannabis are contained in Law No. 35 of 2009. From a positive legal perspective, cannabis is recognized as having health benefits that are proven to help various diseases, as recorded in history. However, in the view of Islamic law, marijuana is considered haram, including for use as medicine, except in emergency conditions or for the sake of benefit. Some scholars allow the use of haram objects for treatment if there is no halal alternative available; however, if there is a halal option, it should be used. Therefore, further research on medical marijuana is needed to ascertain its benefits and conditions of use.

Abstract

This paper critically examines the position of the Judicial Commission within Indonesia's post-reform judicial structure, focusing on its constitutional mandate established through the 1999–2002 constitutional amendments. Although initially designed as an independent supervisory body tasked with overseeing judicial behaviour and ethics, the Commission's constitutional authority has been significantly constrained by the legal resistance from the Supreme Court, particularly through lawsuits brought before the Constitutional Court. Central to this study is the Judicial Positions Bill (RUU Jabatan Hakim), which reimagines the procedure of judicial appointments through a collaborative framework between the Supreme Court and the Judicial Commission to encourage judicial independence, accountability, and integrity through a transparent and merit-based selection process. Using a socio-legal and comparative approach, the study advocates for a more inclusive and participatory approach to judicial selection by incorporating public engagements such as civil society, experts, and professionals. The findings highlight the need to strengthen the Judicial Commission’s role, emphasising that its involvement in the recruitment process is crucial to tackling judicial corruption and enhancing the integrity of Indonesia’s judiciary. This study contributes to the broader discussion on judicial reform in the Global South, emphasising the importance of integrating institutional frameworks with accountability.

Abstract

Human trafficking remains a major humanitarian crime problem worldwide. Indonesia has made efforts to combat human trafficking by establishing various regulations that serve as the main foundation in this fight, one of which is Law No. 21 of 2007. The framers of the law used the Palermo Protocol as the foundation for its creation. As a transnational crime, human trafficking has also prompted ASEAN, as a regional organization, to take a stand. Since the 1990s, ASEAN has included human trafficking in its agenda to be collectively eradicated. However, human trafficking practices in Indonesia and ASEAN continue to increase, with various methods of operation. Unfortunately, the majority of the victims of this crime are women and children. This article aims to examine the formalization of national law and ASEAN's role at the regional level in combating human trafficking within the framework of international law. This research employs a normative legal approach. The findings indicate a disconnection between national regulations and the fundamental norms upon which they were based, as well as disharmony with other national regulations. Meanwhile, in the ASEAN context, the formation of hard law has not yet been fully implemented, a situation further compounded by the rigid principle of non-intervention in ASEAN.
