Abstract

The purpose of this research is to learn of how far satisfaction level perceived by customers to internet banking sevice and the influence of internet banking service to customers satisfaction. The analysis outcome of customers satisfaction to internet banking system service (click BCA) shows that customers have gotten satisfaction from internet banking service by PT BCA Tbk. Regression analysis result of quality influence of internet banking service to customers satisfaction is function-y = 51,598 + 0,423 (x). This result means that if variable point (x) of internet banking service quality = 1, customers satisfaction nowadays = 52,021. This equation functions to predict if variable (x) of service quality increases, customers satisfaction will increase as well. From counting result of correlation coefficient, it can be found out that r = 0,436. It means that there is moderate and significant correlation between the quality of internet banking service and customers satisfaction. The outcome of determinant coefficient shows that the quality of internet banking service has contribution runs at 19,009% in creating customers satisfaction and the rest runs at 83,991% is influenced by other service quality such as m-banking service, BCA ATM, credit facility, BCA cash, export-import facility, foreign currency facility, and guarantee bank. Abstract

Gym is one of the sports that require a fee . Not only for health and body fitness course , fitness is also a major goal for most people in shaping the muscles of the body in order to appear ideal even slimming. From the start of a long time of exercise , eating rules , types of supplements that must have been consumed in the set by an instructor or coach . it is necessary for dietary supplements as supporters . L -Men is one type of milk beverage supplements for those who exercise . L -Men are not the only dairy brand supplements on the market . Realizing various brands of products and competition in the market , then the company will not cease promotion to establish communication with the consumer . Promotion in the L -Men do one through the electronic media , namely television . The purpose of this study was : ( 1 ) To determine ad impressions L -Men in the television version of The Shoot and brand image of L -Men . ( 2 ) Determine the effect of L -Men commercials on television to brand image among members of Fitness Diamond Tangerang . With explanative method with a quantitative approach . The results of this study to determine the benefits for the development of communication , especially in the field of advertising that is based on ethics , manners and manner of advertising in Indonesia.

Abstract

This research purpose is to design a Knowledge Management System (KMS) in Bina Nusantara IT to facilitate knowledge sharing and knowledge management dashboard view to see the development of employee knowledge achieved in KMS. The high turnover rate caused the walkout knowledge. The knowledge is not well structured so that employees often have difficulty in searching for knowledge. Methods of the research conducted by the method of Software Development Life Cycle (SDLC), model iterations. The next step is formulating a study literature to find references to these problems. Then do a system design in the form of UML diagrams user interface and database. The results achieved in the form of KMS-based design to support knowledge sharing among IT BINUS employees. The conclusion from this study is that spread knowledge can be identified, stored and reused. Through this system, documentation of knowledge is optimized so that it can be a solution for walkout knowledge. There are a variety of KM applications in the system, such as Blog, Wiki, Forum, and Document.

Abstract

Penjual dan pembeli mempunyai kewajiban yang harus dipenuhi sebelum melakukan penandatanganan akta jual beli misalnya melakukan pembayaran pajak pengalihan hak atas tanah dan/atau bangunannya. Permasalahan dalam penelitian ini adalah mengenai kepastian hukum keabsahan akta jual beli yang telah ditandatangani oleh para pihak dan saksi-saksi namun belum ditandatangani oleh PPAT dikarenakan pajak pengalihan hak atas tanah dan/atau bangunannya belum dibayarkan, akibat hukum dari Putusan MA No. 541 PK/PDT/2019 dan sanksi PPAT dalam pembuatan akta jual beli tersebut. Metode penelitian yang dipakai adalah metode penelitian yuridis normatif. Jenis data yang dipakai adalah data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier. Teknik pengumpulan data yaitu dengan studi kepustakaan. Data-data yang telah diperoleh selanjutnya dianalisis secara kualitatif untuk mendapatkan hasil penelitian yang bersifat deskriptif. Penelitian ini menunjukkan bahwa akta jual beli tersebut dikatakan sah apabila telah memenuhi syarat materiil dari jual beli serta telah memenuhi Pasal 1320 dan Pasal 1458 KUHPerdata. Akibat hukum dari Putusan MA No. 541 PK/PDT/2019 yaitu akta jual beli tersebut terdegadrasi menjadi akta dibawah tangan. PPAT yang membuat akta jual beli tersebut dapat dikenakan sanksi administratif berupa teguran tertulis sampai dengan pemberhentian dengan tidak hormat dari jabatannya dan sanksi perdata berupa dapat dimintai pertanggungjawaban dalam bentuk penggantian biaya, ganti rugi dan bunga.

Abstract

UUPA mengatur pendaftaran tanah yang bertujuan memberikan jaminan kepastian hukum. Permasalahan yang terkait dengan pendaftaran tanah adalah perjanjian pinjam nama (nominee). Salah satu sengketa pertanahan tersebut yaitu Putusan Mahkamah Agung No. 2305/K/Pdt/2020. Penelitian dilakukan untuk mengetahui jawaban dari perumusan masalah mengenai keabsahan akta perjanjian pinjam nama atas hak kepemilikan tanah oleh badan hukum, tanggung jawab notaris atas akta perjanjian pinjam nama atas hak kepemilikan tanah dan pertimbangan hukum perjanjian pinjam nama dalam putusan mahkamah agung no.2305 K/Pdt/2020.Metode penelitian yang digunakan adalah metode penelitian yuridis normatif. Jenis data yang dipakai adalah data sekunder, terdiri dari bahan hukum primer, sekunder dan tersier. Teknik pengumpulan data dengan studi kepustakaan. Data-data yang telah diperoleh selanjutnya dianalisis secara kualitatif untuk mendapatkan hasil penelitian yang bersifat deskriptif.Berdasarkan hasil penelitian diketahui bahwa perjanjian pinjam nama kepemilikan hak atas tanah oleh badan hukum mengandung kausa yang tidak halal karena tujuan dibuatnya untuk menghindari Pasal 21 ayat (2) UUPA dan Pasal 26 ayat (2) UUPA sehingga akta notarisnya juga tidak sah. Tanggung jawab notaris dalam pembuatan akta perjanjian pinjam nama atas hak kepemilikan tanah berupa tanggung jawab secara perdata, administrasi dan kode etik. Pertimbangan hakim dalam perkara nomor 2305K/Pdt/2020 dinilai tidak mempertimbangkan faktor-faktor yuridis lainnya seperti hak milik atas tanah dalam UUPA, ketentuan pendaftaran tanah, keabsahan akta perjanjian pinjam nama, konflik ahli waris dan laporan pajak.Kata Kunci: Perjanjian Pinjam Nama, Badan Hukum, Notaris

Abstract

This research uses a normative juridical approach method, with the data used is secondary data, namely data that supports information or supports the completeness of Primary Data obtained from libraries and the author's personal library collection carried out by means of library or literature studies. Data analysis used normative analysis, that is, the collected data is expressed in the form of a logical and systematic description, then analyzed to obtain clarity in solving the problem, then conclusions are drawn deductively, namely from general matters to specific matters. Based on the results of the research, it can be seen that the validity of the Deed of Sale and Purchase Number 619/2012 is considered to be legally flawed in subjective terms because of fraud or engineering fraud, mistakes, lies or deception is related to to whom the sale and purchase transaction of the disputed object should be carried out. The result is that the transfer of the Certificate of Ownership Number 2636/Sukawati Village is declared invalid and does not have binding legal force, so in this case the Plaintiffs are still the legal owners of the disputed object.

Abstract

In 2009 PT. Sarwo Indah sold one of the housing units in Merapi Regency with Lie Anita (hereinafter referred to as LA). In the process of settling the bankruptcy assets of PT. Sarwo Indah experienced legal problems which later became the focus of this research. As in the Determination of the Supervisory Judge in case Number: 02/Pailit/2011/PN. Commerce. Smg, dated 13 June 2014, one of the contents was the determination of the Curator appointed by PT. Sarwo Indah (in bankruptcy) on behalf of Nasrullah Nawawi. The type of research in this research is normative juridical. This type of research was used because the researcher wanted to examine something related to the curator's legal actions in selling land and houses on the basis of PPJB and becoming the object of bankruptcy. As long as the house certificate that is the object of the PPJB agreement is still in the name of the bankruptcy debtor, the house becomes a bankruptcy debtor. This is based on Article 21 of the K-PKPU Law which explains that bankruptcy covers all of the debtor's assets at the time the decision to declare bankruptcy is pronounced. Application of the Law of the Panel of Judges in Supreme Court Decision No. 436 K/Pdt.Sus-Pailit/2019 is appropriate considering the juridical aspect, namely referring to the applicable law, namely assessing the relationship between the function of the curator and the settlement of the bankruptcy estate's assets so that there is no obligation for the Curator to continue the agreement between the Buyer and Seller (in bankruptcy)

Abstract

Before the Constitutional Court decision Number 69/PUU-XIII/2015, prenuptial agreements were only made at the time or before the marriage took place. However, after the issuance of the Constitutional Court decision Number 69/PUU-XIII/2015, Article 29 paragraph (1) prenuptial agreements no longer had to be made before or on the day of the marriage, but rather, married couples can create a prenuptial agreement while in the marital bond. This study discusses the obligations of a Notary in performing their duties regarding the request to create a Prenuptial Agreement by a married couple related to third parties, the status of the assets of the married couple who made the prenuptial agreement in deed number 76 dated July 21, 2022, concerning the guarantee of debt to third parties, and legal protection for third parties in the Prenuptial Agreement made before the Notary based on Prenuptial Agreement Deed Number 76 dated July 21, 2022. The method used in this research is a normative juridical method with a descriptive-analytical nature. The type of data used is secondary data consisting of primary, secondary, and tertiary legal materials. The data collection techniques include literature study and interviews. The collected data is then analyzed qualitatively to obtain descriptive-analytical results. The results of this study indicate that: 1) The obligations of a Notary in performing their duties regarding the request to create a Prenuptial Agreement by a married couple related to third parties involve creating the prenuptial agreement in an authentic form and validating the prenuptial agreement made by the parties under private hand and signed by the parties in accordance with Article 15 paragraph (1) of the Notary Office Law. 2) The status of the assets of the married couple who made the prenuptial agreement in deed number 76 dated July 21, 2022, concerning the guarantee of debt to third parties, does not apply retroactively (change). 3) Legal protection for third parties with the creation of Prenuptial Agreement Deed Number 76 dated July 21, 2022, made before the Notary, is that the personal assets of each spouse who enters into an agreement with the third party remain.
