Abstract

Taxes are mandatory contributions to the state owed by a person or entity that is coercive under the Law, by not getting rewarded directly and used for state purposes for the greatest prosperity of the people (Article 1 number 1 of the KUP Law). While resistance to the tax collection process is a phenomenon that often occurs both by utilizing legal loopholes (Tax Avoidance) and through tax evasion efforts.The approach method used in this research is the method of sociological juridical approach. The research specifications carried out are descriptive analysis that describes the symptoms in the community environment to a case studied, the approach taken is a qualitative approach that is a research procedure that produces descriptive data, with primary and secondary data sources.The Juncto KUP Law on Job Creation Law does not regulate the forced implementation of criminal fines that cause inconsistencies in the judge's decision in imposing criminal fines making it difficult for prosecutors as executors in optimizing state revenue from the payment of criminal fines. Legal awareness of taxpayers who want to benefit as much as possible from the business they have run and there is still a presumption that tax money is part of the profits obtained by taxpayers, so that there is abuse and non-compliance of taxpayers who are not right in implementing the self assessment system which ultimately leads to criminal acts in the field of taxation. Taxpayers as convicts prefer to undergo a replacement confinement rather than pay a high fine.

Abstract

The juvenile criminal justice system is the entire process of resolving child cases that face the law from the investigation stage to the guidance stage after undergoing criminal proceedings based on protection, justice, non-discrimination, best interests for the child, respect for children, survival and child development, proportional, deprivation of independence and prosecution as a last resort and avoidance of retaliation.The type of research conducted is descriptive research with normative legal research types related to the implementation of the juvenile justice system that is faced with the law.The results showed that the implementation of the juvenile justice system against children who faced the law had been implemented in accordance with the legislation No. 11 of 2012 concerning the juvenile justice system. The implentation of the implementation of children who face the law in the juvenile justice process is done through a diversion approach. Government efforts in protecting children who face the law are carried out with investigation efforts, prosecutions up to the trial process. These protection efforts are pursued by the diversion process. If the implementation of this diversion cannot be done eating the judicial process is to become ultimum remidium while still paying attention to the best interests of the child by placing children in LPAS, LPAK and LPKS which the institution is expected to be able to provide new expectations and protection for children who face the law.

Abstract

Munculnya eksploitasi terhadap anak baik oleh orang tua maupun pihak lain sebagai pengemis merupakan kejahatan atau tindak pidana karena bertentangan dengan Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak hal ini menimbulkan kekhawatiran yang mendalam karena kasusnya semakin banyak. Adanya viktimasi anak dimana anak menjadi korban sehingga   mengalami penderitaan fisik, mental dan/atau kerugian ekonomi yang disebabkan oleh tindak pidana.Penelitian ini mengkaji anak sebagai objek viktimologi dengan memposisikan anak sebagai korban kejahatan, bentuk-bentuk viktimisasi, akibat dan pengaruhnya di dalam masyarakat dengan tujuan memberikan pengetahuan bagi anak sebagai korban kejahatan di ruang lingkup eksploitasi secara ekonomi sebagai pengemis. Metode yang digunakan dalam penelitian ini adalah dilakukan dengan      pendekatan   Yuridis Normatif dan pendekatan Yuridis empiris.Hasil penelitian dan pembahasan menunjukan bahwa Akibat Eksploitasi anak dan pengaruhnya terhadap korban akibat dari adanya tindak eksploitasi kepada anak-anak sebagai pengemis dan pengamen, akan menyebabkan trauma dan menimbulkan efek kesehatan karena selama anak diekploitasi sebagai pengemis anak dibius agar anak selalu tidur sehingga menimbulkan efek kesehatan dan perkembangan otak anak menurun, lebih jauh dari adanya trauma dan efek kejahatan itu juga menyebabkan terhambatnya generasi bangsa. Kenyataan di dalam masyarakat masih sering anak. Faktor penyebab adanya viktimasi terhadap anak dengan cara eksploitasi adalah karena kondisi ekonomi orang tua yang kurang, dipengaruhi lingkungan yang juga melakukan eksploitasi anak, adanya paksaan keluarga, kurangnya kesadaran hukum masyarakat khususnya orangtua pengemis dan pengamem, Program Pemerintah yang kurang menyentuh.

Abstract

ABSTRAKArah peradilan pidana di Indonesia pada saat ini mengalami pergeseran dari retributif ke restoratif-rehabilitatif atau daad-dader-strafrecht atau model keseimbangan kepentingan. Hal ini terkonfirmasi melalui Undang-Undang No. 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak, yang dalam Pasal 6 jo Pasal 8 menekankan pada konsep keadilan restoratif melalui diversi. Kedua konsep ini memungkinkan penyelesaian perkara anak ke luar peradilan pidana. Namun demikian tidak semua tindak pidana yang dilakukan oleh anak dapat diselesaikan di luar pengadilan (diversi) kecuali terpenuhi dua syarat yaitu tindak pidana diancam pidana penjara di bawah tujuh tahun dan bukan merupakan pengulangan tindak pidana (residivis). Inti dari keadilan restoratif yaitu: Pertama, dalam penyelesaian perkara anak diupayakan agar pelaku dan keluarganya serta korban dan keluarganya dapat duduk bersama untuk membicarakan penyelesaian masalah termasuk pemulihan kepada korban (restitution in integrum). Kedua, keadilan restoratif hakikatnya adalah memberi hukuman kepada pelaku tetapi hukuman tersebut bersifat mendidik sehingga memberi manfaat baik kepada pelaku maupun korban. Hal ini sejalan dengan adagium delinquens per iram provocatus puniri debet mitius. Ketiga, peraturan a quo menggunakan dua pendekatan yakni pendekatan mediasi korban dan pelaku (victim offender mediation) seperti yang diterapkan di Amerika Utara serta pendekatan yang menekankan pada ganti kerugian dan pemulihan (court based restitutive and reparative measure), seperti yang dipraktikan di Inggris.Penyelesaian perkara anak yang berkonflik dengan hukum harus tetap mengutamakan prinsip-prinsip hak anak, dimana penangkapan, penahanan, atau bahkan pemenjaraan hanya dilakukan sebagai upaya terakhir (ultimum remedium) dan dalam jangka waktu yang sesingkat-singkatnya. Restorative justice merupakan konsep penyelesaian perkara yang menekankan pemulihan kembali pada keadaan semula bukan pembalasan. Karena masih dibutuhkannya waktu penyesuaian dengan aturan yang baru berlaku, guna memenuhi kelengkapan fasilitas serta tambahan sumber daya penegak hukum dan tenaga profesional yang terlatih khusus untuk menangani perkara anak. Keadilan Restoratif merupakan suatu proses Diversi, yaitu semua pihak yang terlibat dalam suatu tindak pidana tertentu bersama-sama mengatasi masalah serta menciptakan suatu kewajiban untuk membuat segala sesuatunya menjadi lebih baik dengan melibatkan korban, anak, dan masyarakat dalam mencari solusi untuk memperbaiki, rekonsiliasi, dan menenteramkan hati yang tidak berdasarkan pembalasan. Diversi adalah pengalihan penyelesaian perkara anak dari proses peradilan pidana ke proses di luar peradilan pidana.Kata Kunci: Keadilan Restoratif, Peradilan Anak, Pidana Anak.

Abstract

Children who are faced with the law in Law Number 11 of 2012 concerning the Juvenile Justice System are children who are in conflict with the law, children who are victims of criminal acts, and children who are witnesses of criminal acts. A child who is in conflict with the law or a child perpetrator of a criminal act is a child who has reached the age of twelve but has not yet reached the age of eighteen who is suspected of having committed a criminal act. One of the activities in a series of activities in the criminal justice system is carried out by the Correctional Center (BAPAS) which is part of the activities of the prisoners' penitentiary system or the criminal justice sub-system. The duties and functions of the Correctional Center, hereinafter referred to as BAPAS, in this case, assist and assist the juvenile criminal justice system. It is hoped that it can facilitate and provide input to judges who try children's cases by seeing the results of the work of BAPAS, especially Community Advisors in making the results of social research. Based on this background, the authors formulate the problem, namely how the effectiveness of BAPAS Purwokerto in fostering and guiding children in conflict with  the  law  who  get  parole  and  what  constraints  are  experienced  by  BAPAS Purwokerto in guiding children in conflict with the law who get parole . This study aims to  explain  the  analysis  of  the  effectiveness  of  BAPAS  in  dealing  with  community guidance as a form of legal protection for children. conflict with a law that gets parole. Analyzing the obstacles experienced by BAPAS in providing guidance to children who get paroleThis research is a sociological juridical type of research, by examining the legal provisions of primary data obtained from informants and resource persons by conducting field research in the form of observations and interviews and secondary data in the form of primary, secondary and tertiary legal materials, then analyzed qualitatively and  the results  of the analysis. which is  explained  by the descriptive method. Research location at BAPAS PurwokertoFrom the results of research and discussion it can be concluded that the effectiveness of BAPAS Purwokerto in fostering and guiding children in conflict with the law who get parole is in accordance with the provisions contained in Law Number12  of  1995  Concerning  Corrections  and  Law  Number  11  of  2012  concerning  the System. Juvenile Criminal Court, but in its implementation it has not been effective, because there are child clients who have committed repeated crimes or are recidivists. Abstract

Legal aid is constitutional rights for every citizen to get guaranteed legal protection and equality before the law. Legal aid in court hearings is an important instrument in the criminal justice system because it is part of the protection of human rights for every citizen. Legal aid is a right held by a defendant for the purpose of his defense in the criminal justice process. Through the provision of legal aid, it is hoped that fair and impartial criminal justice can be achieved and defendants receive humane treatment. Providing legal assistance is seen as a social responsibility in the context of law enforcement to anyone. Legal aid in a broad sense can be interpreted as an effort to help groups who are less fortunate in the field of law. Based on this, it is interesting to conduct research if it is viewed from the applicable regulations related to its implementation, especially in this research in the Banyumas District Court.The method used in this research is empirical legal research. Sources of data contained in this study come from primary data and secondary and, with data collection techniques based on interviews with informants and literature study. The data analysis technique in this study uses the deductive method.Based on the results of this study, it is known that the law enforcement components such as judges and lawyers / law enforcers have implemented it according to the mandate of the laws and regulations. However, because in essence legal aid is the right of the Defendant, it is an option for the Defendant to be accompanied by a Legal Counsel or not through access to legal assistance. In the case that what the defendant experiences is a criminal threat of more than 5 years, the Legal Aid Post (Posbakum) can be a means of obtaining free legal assistance and this facility is already available in every court, especially the Banyumas District Court. The obstacles that were often faced were precisely the Defendants whose criminal threats were under 5 years, because the Defendants lacked knowledge and information, as well as difficult access to administrative requirements in the form of SKTM, made the Defendants reluctant to choose to be accompanied by a Legal Counsel through legal aid. Meanwhile, on the other hand, from the law enforcement component such as Judges or Advocates, because Defendants who are sentenced to under 5 years of punishment are not obliged to be assisted by a Legal Counsel, this means that there is no direct approach to the Defendant regarding their right to obtain legal assistance. in the form of assistance or legal advisors to defend their rights and interests in court.

Abstract

Legal politics determines the direction of legal development, if the direction of legal development is laid on a solid foundation and foundation, then the law will provide protection for people's lives. The policy of developing national law is in line with the ideals of the proclamation of the Indonesian nation, to achieve a just and prosperous Indonesia. The preparation of regional budgets has a very important meaning in the same goal of achieving a prosperous society.Legal politics is directed towards the creation of regional revenue and expenditure budgets in accordance with laws and regulations, implementation of the vision, mission and development programs of regional governments, both the Regional Development Work Plan (RKPD), the Regional Medium-Term Development Plan (RPJMD), and the Regional Long-Term Development Plan (RPJMD). RPJPD).The Regional Revenue and Expenditure Budget (APBD) is the basis for regional financial management within 1 (one) fiscal year. The Regional Head is required to prepare a General Budget Policy (KUA)/Priority and Temporary Budget Ceiling (PPAS) based on the Regional Development Work Plan (RKPD). The KUA PPAS, which has been agreed by the regional head with the DPRD, becomes the guideline for regional apparatuses in preparing work plans and budgets for regional apparatus work units. The work plan and budget of the SKPD are submitted to the Regional Financial Management Officer (PPKD) as material for the preparation of the draft Perda APBD for the following year. The process of preparing the Regional Revenue and Expenditure Budget (APBD) begins with the preparation of the draft General Budget Policy (KUA) as well as the Priority and Temporary Budget Ceiling (PPAS) document. Then the two documents were discussed with the DPRD to produce a Memorandum of Understanding between KUA and PPA. Based on the Memorandum of Understanding, the Regional Head submits a circular containing the Guidelines for the Preparation of the RKA-SKPD followed up by the SKPD-SKPD by preparing the RKA SKPD. Furthermore, the Regional Financial Management Officer (PPKD) compiles the RKA SKPD into a Raperda APBD to be discussed and obtain joint approval with the DPRD before being submitted to the evaluation process.

Abstract

Penghentian penuntutan berdasarkan keadilan restoratif yang diatur  dalam Peraturan Kejaksaan Republik Indonesia Nomor 15 Tahun 2020 tentang Penghentian Penuntutan Berdasarkan Keadilan Restoratif dilakukan dengan upaya perdamaian antara korban dengan pelaku dan Penuntut Umum sebagai fasilitator. Apabila upaya perdamaian diterima oleh kedua pihak dan proses perdamaian berupa sepakat berdamai disertai pemenuhan kewajiban tertentu maka Tersangka wajib memenuhi hak-hak korban sesuai kesepakatan perdamaian. Dalam hal kesepakatan perdamaian tercapai, dan Tersangka sebelumnya ditahan maka Tersangka wajib dibebaskan. Akan tetapi seharusnya Tersangka tidak dibebaskan secara sebebas-bebasnya, yakni Tersangka diberi pembinaan dan pengawasan agar Tersangka benar-benar tidak mengulangi kejahatannya.

Abstract

Indonesia sedang menerapkan sistem Peradilan pidana yang dilaksanakan melalui teleconference sebagaimana Peraturan Mahkamah Agung No.4 tahun 2020. Persidangan secara teleconference pada perkara pidana merupakan hal yang baru, perlu diketahui bagaimana penerapannya dalam hal ini apakah penerapannya telah sesuai dengan Peraturan Mahkamah Agung No 4 tahun 2020 atau tidak dan juga perlu melihat hambatan apa saja pada pelaksanaannya khususnya di pengadilan negeri cilacap. Penelitian ini dilakukan dengan meneliti bahan-bahan pustaka yaitu peraturan-peraturan dan literatur-literatur yang berkaitan dengan permasalahan penerapan persidangan secara elektronik terhadap sistem peradilan pidana. Kondisi ini melihat penerapan persidangan perkara pidana secara teleconference. Penerapan peradilan secara elektronik sebagai pembaharuan sistem peradilan hukum pidana dapat berlajalan dengan efektif atau tidak. Hasil penelitian juga menunjukkan bahwa Pengadilan Negeri Cilacap telah menerapkan Persidangan Perkara Pidana Secara Teleconference sebagaimana Peraturan Mahkamah Agung  No.4/2020, baik dari tahap Pemberkasan, Persidangan, Proses Pembuktian dan Pembacaan Putusan. Meskipun masih terdapat hambatan pada pelaksanaannya masih terdapat hambatan dalam penyelenggaraan perkara pidana secara teleconference antara lain, Pembatasan yang dilakukan penegak hukum dengan alasan penyebaran covid-19 sehingga pendampingan yang dilakukan oleh penasehat hukum kepada terdakwa menjadi tidak efektif dan dapat menimbulkan tidak terpenuhinya hak-hak terdakwa. Kurangnya perangkat digital dan akses internet yang lambat menjadikan penyelenggaraan persidangan perkara pindana menjadi kurang efektif dalam hal penerimaan informasi pada saat persidangan berlangsung. Kurangnya sosialisasi dan edukasi adanya penyelenggaraan persidangan perkara pidana secara online dimasyarakat terutama bagi pihak penasehat hukum, saksi/ahli, korban maupun terdakwa dan masih terdapat banyaknya budaya gaptek bagi para pihak terutama dari pihak penasehat hukum maupun saksi/hali dalam menggunakan perangkat digital dan system secara online. Berdasarkan hambatan yang ada dapat dikatakan bahwa Penerapan PerMa No.4/2020 di Pengadilan Cilacap belum efektif.Keywords: Penerapan, Persidangan, Teleconference
