Abstract

Restorative justice menempatkan nilai yang lebih tinggi dalam keterlibatan yang langsung dari para pihak. Korban mampu untuk mengembalikan unsur kontrol, sementara pelaku didorong untuk memikul tanggung jawab sebagai sebuah langkah dalam memperbaiki kesalahan yang disebabkan oleh tindak kejahatan dan dalam membangun sistem nilai sosialnya. Proses Restorative Justice Melalui Mediasi Penal dalam menangani Tindak Pidana dalam sistem peradilan pidana di Indonesia dilatar belakangi pemikiran yang dikaitkan dengan ide-ide pembaharuan hukum pidana (penal reform), dan dikaitkan dengan masalah pragmatism.Jenis penelitian ini merupakan jenis penelitian deskriptif kualitatif dengan pendekatan penelitian yang digunakan adalah: yuridis-normatif, dan yuridis-empiris. Selanjutnya, metode pengumpulan data yang digunakan adalah observasi, wawancara, dokumentasi dan penelusuran referensi. Teknik pengolahan data dilakukan yaitu reduksi data, penyajian data, dan penarikan kesimpulan. Selanjutnya analisis data yang digunakan adalaah analisis data kualitatif.Lahirnya Undang-undang Nomor 11 tahun 2012 tentang Sistem Peradilan Pidana Anak menjadi payung hukum dalam melakukan penyelesaian perkara pidana yang dilakukan oleh Anak dimana Anak belum dikatagorikan sebagai subjek hukum. Oleh sebab itu, adanya proses diversi, restoratif justice dan mediasi penal dalam Undang-undang tersebut memberikan dampak yang signifikan terhadap penyelesaian perkara Anak Ciri utama dalam konsep restorative justice adalah dalam melihat suatu kejahatan menempatkan gejala kejahatan dan berbagai konflik sosial sebagai tindakan sosial daripada sebagai pelanggaran hukum pidana

Abstract

The theory of the Welfare State is the theory which is in line with the basis of the Indonesian state. The welfare state is reflected in the 1945 Constitution of the Republic of Indonesia. Malnutrition, especially in developing countries, including Indonesia, is a problem that is still of concern to the world today. In the duty to tackle malnutrition, local governments have a legal basis, namely Ciamis District Regulation No. 20 of 2011 on Health Implementation.The approach methods are normative juridical, descriptive analytic research specification. Secondary data sources, including statutory regulations, text books, legal dictionaries, legal journals, legal articles. Data collected using literature analysis, presented systematically organized as narrative text, and analyzed using qualitative methods. The results showed that the factors affecting malnutrition among children under five in Ciamis Regency were nutritional intake, family income, maternal education, infectious diseases, environmental sanitation, and basic health services. In addition, the responsibility of the local government of Ciamis Regency is based on the Ciamis Regency Regional Regulation No. 20 of 2011 concerning Health Implementation in Chapter XI concerning Overcoming Nutritional Problems, specifically by carrying out programs such as Supplementary Food (PMT), Infant and Child Feeding (PMBA), Healthy Living Community Movement (GERMAS), Nutrition-Conscious Family (KADARZI), Youth Care Health Service (PKPR), Golden Chain innovation, Movement to Prevent Stunting, Sijaga, Gumelis and in 2021 there will be the DeBes movement (Stunting Free Village), and the integrated health post movement that cares about stunting.

Abstract

Asas desentralisasi dalam otonomi daerah yang diatur dalam Undang-Undang Nomor 23 Tahun 2014 tentangPemerintahan Daerah menjelaskan adanya pembagian penyelenggaraan urusan pemerintahan di pusat dan di daerah. Masalah dalam penelitian ini adalah 1) Bagaimana kewenangan pemerintah Provinsi Banten dalam pelaksanaan program pengendalian penduduk; 2) Bagaimana keseimbangan program pengendalianpenduduk pada BKKBN dan DP3AKKB Provinsi Banten ditinjau berdasarkan Undang-Undang Nomor 52Tahun 2009. Penelitian ini merupakan penelitian yuridis empiris digunakan untuk melihat hal-hal yang menjadi urusan pemerintah Provinsi Banten dalam program pengendalian penduduk serta kesimbangan program dari BKKBN dan DP3AKKB Provinsi Banten sebagai stakeholder yang berwenang melaksanakannya. Berdasarkan penelitian yang dilakukan, diperoleh kesimpulan 1) kewenanganpemerintah Provinsi Banten dalam bidang pengendalian penduduk diatur dalam pasal 11 ayat (1) dan (2) serta pasal 12 ayat (2) Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintah Daerah dan berimplikasi pada hubungan keuangan sebagaimana diatur dalam Undang-Undang No. 33 Tahun 2004 tentang Perimbangan Keuangan; 2) Program pengendalian penduduk pada BKKBN dan DP3AKKB Provinsi Bantenditinjau berdasarkan Undang-Undang Nomor 52 Tahun 2009 diketahui masih belum bisa seimbang danmaksimal sebagai implikasi dari perubahan Kewenangan program pengendalian penduduk berupa KB yang dulunya berada di pusat (BKKBN) dan kini diserahkan kepada pemerintahan daerah, yang menyebabkan ada berbagai kebijakan yang berbeda satu daerah dengan lainnya. Kata kunci: Pengendalian Penduduk, Pembangunan Keluarga, dan Urusan Pemerintah

Abstract

The provisions regarding the minimum age limit for marriage are now increasing as stipulated in Article 7 paragraph (1) of Law No. 16 of 2019, namely for women to be 19 years equated with men. Setting a minimum age of marriage that differs between men and women will lead to discrimination and unfulfilled child rights. The age limit of 19 years for lawmakers is considered to have matured his body soul to hold a marriage so that the purpose of marriage is realized and without ending in divorce. Constitutional Court Decision No. 22/PUU-XV/2017 on Testing of Law No. 1 of 1974 ordered the establishment of the Law to make changes to Law No. 1 of 1974 on changes to Law No. 1 of 1974 on Marriage.Based on the above on October 14, 2019, the President of the Republic of Indonesia passed Law No. 16 of 2019 on Amendments to Law No. 1 of 1974 on Marriage which changes the provisions of Article 7. Article 7 paragraph (1) has the aim of eliminating discrimination and basic rights by preventing the occurrence of underage marriages that are at high risk to both maternal and infant health and formal education of women due to dropping out of school.

Abstract

Banks are financial institutions that are a place for individuals, state-owned enterprises, private business entities, even government institutions to store their funds. Money laundering is a difficult problem to prove. Money laundering is often done by utilizing the services or facilities provided by banks. The Financial Services Authority is an institution established under Law No. 21 of 2011. This institution was established to conduct supervision of the financial services industry in an integrated manner in preventing the occurrence of money laundering crimes. The Financial Transaction Reporting and Analysis Center (PPATK) is an independent institution that is tasked with combating money laundering in Indonesia. Its two main tasks are to detect the occurrence of money laundering crimes and assist law enforcement related to money laundering and predicate crimes.This research aims to analyze the role of PT Bank Pembangunan Daerah West Java and Banten (Bank bjb) in preventing money laundering and analyze inhibiting factors in preventing money laundering crimes in PT Bank Pembangunan Daerah West Java and Banten (Bank bjb) Cirebon. This research was conducted using sociological juridical legal research methods (socio-legal research). The collected legal materials will be comprehensively reviewed and analyzed deductively with systematic presentation.In this study it can be concluded that the role of Bank bjb in preventing money laundering crimes has been effectively carried out. This is evidenced by the results of bank bjb procedure that identifies / verivikasi customer data / prospective customer / walk in customer through bjb AMOLA so that customer data / prospective customers can be accessed through BJB AMOLA by using From Identification TKM so that Bank bjb becomes a healthy Bank. Inhibiting Factors in Tackling Money Laundering Crimes at PT Bank Pembangunan Daerah West Java and Banten (Bank bjb) Cirebon is a factor of law enforcement itself, which is related to juridical and technical constraints in finding evidence in finding evidence in conducting the results of identification, verification and monitoring of transactions carried out by money laundering criminals and the difficulty of asking for information from banks about the deposits of perpetrators against banks if money is made. The proceeds of the crime are stored in an account that does not belong to the perpetrator but is stored in the account of another party. In addition, there are still some customers who do not update data to Customer Service so as to cause a difference between the amount of income and the customer profile.

Abstract

 Penelitian ini bertujuan untuk mereview efektivitas penegakan hukum terhadap dugaan pelanggaran Peraturan Daerah Nomor 6 Tahun 2012 tentang Pengelolaan Sampah di Kabupaten Banyumas serta faktor-faktor yang mempengaruhinya. Peraturan Daerah ini mengatur norma-norma yang ditaati oleh masyarakat, namun pada kenyataannya masih terdapat dugaan-dugaan pelanggaran yang dilakukan. Penegakan hukum terhadap dugaan pelanggaran tidak berjalan efektif karena pengaruh faktor kendala lembaga pelaksana (legal structure) yakni jumlah personil yang terbatas, kemampuan serta integritas petugas yang kurang serta hubungan koordinasi antarinstansi yang tidak maksimal

Abstract

The authority of the Regional Government as the organizer of regional government affairs according to the principle of autonomy and co-administration is expected to be able to explore financial sources through Regional Original Revenue. In the process of collecting Rural and Urban Land and Building Taxes in the context of exploring regional financial sources, there are many differences of opinion or tax disputes between taxpayers and the government regarding the amount of tax to be paid, tax objects that no longer exist, and applications for relief in the form of installments in the form of installments. payment of taxes.This study aims to analyze legal policies and legal implications for the provision of reduction, relief, and exemption from land and building taxes in rural and urban areas in Brebes Regency. This study uses a normative juridical approach, descriptive analysis research type, secondary data sources, and data obtained by using literature studies, presented in the form of narrative texts that are arranged systematically, and analyzed qualitatively normative.The results of the study indicate that the Legal Policy for the Granting of Reductions, Relief, and Exemption of Land and Building Taxes in Rural and Urban, is based on the principles of financial politics, economic principles, and the principles of justice. Administrative principles, juridical principles. The legal implications arising from the granting of reduction, relief, and exemption from land and building taxes in rural and urban areas are: Implications of authority, Implications of Supervision, Implications of Finance and Implications of Human Resources.

Abstract

Pancasila merupakan sumber hukum dasar negara Indonesia sedangkan Undang-Undang Dasar 1945 merupakan  konstitusi negara Indonesia. Pancasila sebagai sumber hukum dasar negara dalam berbangsa dan bernegaranya bangsa Indonesia maka perlu dijabarkan dalam UUD 1945.Penelitian ini dilakukan dengan menggunakan tipe penelitian yuridis normative dengan menggunakan sumber bahan hukum meliputi bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier yang akan dianalisis menggunakan analisis normatif kualitatif.Hasil penelitian UUD 1945 sebagai konstitusi negara merupakan uraian terinci dari nilai-nilai Pancasila atau UUD 1945 bersumber dan atau dijiwai oleh Pancasila. Sehingga dengan dijabarkannya pokok-pokok pikiran pikiran Pembukaan UUD 1945 yang bersumber dari Pancasila ke dalam pasal-pasal UUD 1945, maka Pancasila tidak saja merupakan suatu cita-cita hukum, melainkan juga telah menjadi hukum positif, dan mempunyai kekuatan yang mengikat bagi setiap warga negara Indonesia.

Abstract

The criminal proceedings for the 2019 Election are carried out based on the Criminal Procedure Code, as long as Law Number 7 of 2017. That is not stipulated otherwise by Law Number 7 of 2017. That is the essence of what is contained in Article 477 of Law Number 7 of 2017 concerning General Elections. The rules regarding the procedural process for election criminal justice contained in Law Number 7 of 2017 along with its implementing regulations have created a framework for a separate judicial system that is different from the general criminal procedural law as regulated in the KUHAP, even though the KUHAP is stated as the main basis for implementation. Election criminal procedure law. Abstract

Traffic problems are one of the problems that often occur in developed and developing countries. So far, the resolution of traffic accident cases is mostly resolved by penal efforts compared to non-penal efforts. Based on this, the author wants to analyze and understand the expansion of the application of the concept of restorative justice in solving traffic accident cases and the legal consequences for perpetrators by applying the concept of Restorative Justice in traffic accident cases. This study uses a descriptive analysis method with a normative juridical approach. The results of this study indicate that the concept of applying restorative justice in solving traffic accident cases is the goal of punishment because imprisonment is not the best solution in solving traffic accident cases, because the losses caused to victims can still be restored so that the spirit to seek recovery at once ensure the creation of a sense of justice and humanity, prioritizing the interests of victims and perpetrators. And the legal consequences for the perpetrators are the obligation to return, replace or restore all losses caused by traffic accidents caused by the perpetrators so that justice can be achieved for the victims.
