Abstract

Ketidakpastian (gharar) dalam proyeksi keuntungan pada akad mudharabah di lembaga keuangan syariah menimbulkan tantangan bagi pengelolaan risiko dan kepatuhan terhadap prinsip syariah. Hal ini memerlukan pendekatan yang mampu menyeimbangkan prinsip kepercayaan dengan kebutuhan akan manajemen risiko yang terukur. Penelitian ini bertujuan untuk menganalisis batasan gharar dalam proyeksi keuntungan akad mudharabah serta mengidentifikasi mekanisme mitigasi risiko ketidakpastian yang dapat diterapkan di lembaga keuangan syariah. Adapun metode penelitian yang digunakan adalah metode penelitian kualitatif dengan pendekatan deskriptif-analitis berbasis studi kepustakaan, mengacu pada literatur terkait fiqh muamalah dan praktik keuangan syariah modern. Hasil penelitian menunjukkan bahwa ketidakpastian keuntungan pada akad mudharabah masih dapat ditoleransi selama masuk dalam kategori gharar yasir (ketidakpastian minimal) dan menggunakan kaidah "al-ghurm bil ghunm" yang memastikan bahwa keuntungan yang didapatkan beriringan dengan risiko yang timbul dikemudian hari. Ketidakpastian ini muncul dari fluktuasi pasar, kinerja pengelola dana, dan risiko operasional. Untuk memitigasi gharar, diperlukan proyeksi keuntungan yang realistis, penggunaan data akurat, transparansi informasi kepada nasabah, serta penerapan sistem monitoring yang berkelanjutan. Dengan pendekatan ini, lembaga keuangan syariah dapat menjaga prinsip syariah sekaligus memenuhi tuntutan bisnis modern.

Abstract

Penerapan akad tunggal dan multi-akad pada transaksi keuangan di Lembaga Keuangan Syariah Bank telah lama dipraktekkan. Diantara akad tunggal yaitu murabahah dan mudharabah, sedangkan pada akad multikontrak dikenal adanya ada (MMQ) dan akad Ijarah Muntahiyah bi Tamlik. Dalam perspektif fiqh, penerapan akad tunggal tidak menimbulkan perbedaan mengingat akad tunggal lebih mudah diidentifikasi dari segi rukun, syarat, dan konsekuensinya sesuai fiqih. Beda halnya dengan multi akad yang berisiko terkait pelanggaran prinsip syariah, seperti gharar (ketidakjelasan), riba, atau maisir (spekulasi). Menyikapi hal tersebut perlu dilakukan kajian lebih mendalam dari beberapa perspektif. Dengan mengadopsi metode studi literatur, artikel ini mencoba menggali lebih dalam kepada beberapa sumber hukum syariah Al-Qur'an, Hadis, Ijma’, Qiyas serta DSN MUI untuk memastikan bahwa baik akad tunggal

Abstract

Penelitian ini mengkaji dinamika penerapan akad tunggal dan multi akad pada Pegadaian Syariah di Indonesia, khususnya dalam menyediakan solusi pembiayaan berbasis syariah yang inovatif dan sesuai dengan prinsip Islam. Dengan menggunakan metode kualitatif dan pendekatan studi kasus, penelitian ini mengeksplorasi keunggulan, tantangan, serta dampak implementasi kedua jenis akad tersebut terhadap inovasi produk keuangan syariah. Akad tunggal, seperti rahn dan ijarah, menonjol karena kesederhanaan, efisiensi, dan kepatuhannya terhadap syariah. Namun, kebutuhan masyarakat yang semakin kompleks mendorong penggunaan multi akad, seperti pada produk Arrum Haji yang menggabungkan akad rahn dan ijarah.Hasil penelitian menunjukkan bahwa multi akad menawarkan fleksibilitas dan peluang untuk menciptakan produk keuangan yang lebih adaptif, tetapi juga menghadapi tantangan dalam menjaga kejelasan struktur akad, menghindari gharar, dan meningkatkan literasi masyarakat. Dukungan regulasi, seperti fatwa DSN-MUI, memberikan landasan hukum yang kuat untuk mengatasi kendala tersebut. Penelitian ini merekomendasikan peningkatan pengawasan syariah dan edukasi publik guna mengoptimalkan multi akad sebagai instrumen strategis untuk memperluas inklusi keuangan syariah dan memperkuat daya saing Pegadaian Syariah di tengah dinamika ekonomi modern.

Abstract

This study examines the concepts of ba'i, tijarah, and khiyar from the perspective of four major schools of Islamic jurisprudence (Hanafi, Maliki, Shafi'i, and Hanbali) and their implications for modern economic transactions. The complexity of contemporary transactions and variations in fiqh muamalah interpretations among schools create challenges in harmonizing Islamic financial practices. Using a qualitative approach with content analysis method, this research analyzes classical fiqh literature and contemporary sources to identify similarities and differences in interpretations among the four schools. The findings reveal that the diversity of views among schools provides flexibility in developing modern Islamic financial products while maintaining fundamental sharia principles. The Hanafi and Hanbali schools tend to be more flexible in responding to transactional innovations, while the Maliki and Shafi'i schools emphasize prudential aspects and consumer protection. This research contributes to developing a theoretical framework that accommodates the diversity of fiqh interpretations in the modern economic context.

Abstract

Penelitian ini menganalisis keterkaitan antara halal branding dan positioning brand di pasar Muslim global yang semakin berkembang pesat. Halal branding tidak hanya membangun kepercayaan konsumen Muslim, tetapi juga memperkuat citra merek dan diferensiasinya di tengah persaingan yang ketat. Temuan penelitian menunjukkan bahwa penerapan strategi halal branding berperan penting dalam menciptakan loyalitas konsumen, memperkuat posisi merek, serta memberikan keunggulan kompetitif. Dalam hal ini, perusahaan yang ingin berhasil di pasar Muslim global perlu menyadari pentingnya halal branding sebagai strategi yang meningkatkan daya saing melalui nilai-nilai syariah. Penelitian ini dilakukan dengan pendekatan kualitatif melalui studi pustaka, yang mengumpulkan data dari berbagai literatur terkait konsep halal branding dan positioning merek. Dengan analisis konten, penelitian ini menemukan bahwa halal branding berpengaruh kuat terhadap persepsi dan keputusan pembelian konsumen, khususnya konsumen Muslim yang semakin mempertimbangkan aspek halal suatu produk. Hasil penelitian ini menegaskan bahwa halal branding merupakan strategi positioning yang efektif untuk menarik perhatian konsumen Muslim, memberikan nilai tambah pada merek, dan mendukung pertumbuhan industri halal secara global.

Abstract

In sharia pawning practices, problems often arise regarding whether the murtahin is allowed to use the pawned goods for his own benefit or not. Each school of thought has a different rationale and basis for arguments regarding this matter. This research aims to analyze comparative laws regarding the ability of murtahin (pawn recipients) to utilize pawned goods (rahn) based on the perspective of four madhhab imams (Hanafi, Maliki, Syafi'i, and Hanbali) and evaluate its application in sharia pawn products in Indonesia. This research uses a qualitative approach with a comprehensive literature study method, including analysis of classical fiqh books, accredited national journals and indexed international journals. The research results show that there are significant differences in views between the four madzhab imams. The Hanafi Madzhab allows murtahin to use pawned goods on condition that they have explicit permission from the rahin (pawnshop), because it is considered a form of ijarah (lease) agreement. On the other hand, the Maliki school of thought only allows it in emergency conditions or when there is a clear agreement, while still emphasizing the principle of avoiding the element of usury. The Syafi'i Madzhab strictly prohibits the use of pawned goods by murtahin, because it is seen as potential exploitation of the pledgor. Meanwhile, the Hanbali madzhab provides concessions provided that both parties agree and there are real benefits. In the practice of sharia pawning in Indonesia, referring to the Fatwa of the National Sharia Council-Indonesian Ulema Council (DSN-MUI) No. 25/DSN-MUI/III/2002 concerning Rahn, which emphasizes the prohibition on the use of pawned goods by murtahin, except in the context of a separate ijarah contract.

Abstract

The mudharabah agreement is a form of cooperation in muamalah fiqh which is widely used in sharia banking products in Indonesia. This contract has two important aspects, namely material law (substance of the agreement) and formal law (implementation procedures). In the context of sharia banking, there are challenges in integrating fiqh principles with national banking regulations, so a more in-depth study is needed regarding the application of these two legal aspects. This research aims to analyze aspects of material law and formal law in mudharabah contracts for sharia banking products in Indonesia. The research method used by researchers is a qualitative descriptive approach. Data was obtained through a study of muamalah fiqh literature, statutory regulations, and sharia banking practice documents. The research results show that in the material legal aspect, mudharabah contracts are generally in accordance with sharia principles. However, in the formal legal aspect, there are still several obstacles, especially in terms of documentation and compliance with formal regulations set by banking authorities. The discussion indicated the need for harmonization between sharia banking regulations and the principles of muamalah fiqh, in order to increase compliance and clarity in the implementation of mudharabah contracts. Abstract

The development of sharia cooperatives in Indonesia has undergone significant transformation alongside the rapid advancement of digital technology, which has reshaped how people conduct transactions and interact. In recent years, the sharia cooperative sector has experienced considerable growth, driven particularly by changes in societal behavior that increasingly prioritize the use of digital platforms in various economic activities. This study aims to analyze the challenges and opportunities faced by sharia cooperatives in navigating the digital era. Using a qualitative research approach through a literature review of various relevant journals and reports, the study explores factors influencing the development of sharia cooperatives and how these cooperatives can leverage digital technology to enhance efficiency and competitiveness. The findings reveal that digitalization can expand market access, improve operational efficiency, and support service innovation. However, challenges such as limited technological understanding among members and regulatory barriers remain significant hurdles. The study concludes that sharia cooperatives must undergo digital transformation with a structured strategy to ensure sustainability and competitiveness. Abstract

Islamic cooperatives have a significant contribution in improving the economic welfare of the community through financing in line with sharia principles. In this digital era, Islamic cooperatives have a great opportunity to expand access and efficiency of financing services through the use of digital technology. Even so, this transformation process also presents several obstacles. This study aims to identify the opportunities and challenges faced by Islamic cooperatives in channeling financing in the digital era and formulate strategies that can be applied to optimize these opportunities. The method used is a literature study by reviewing various sources related to the digitalization of Islamic cooperatives from the aspects of technology, operations, and sharia compliance. The results indicate that digitalization enables the expansion of service coverage, increased efficiency, and improved competitiveness. However, challenges related to data security, increasing members' digital literacy, and regulatory adjustments still need to be addressed. The strategies presented are expected to help Islamic cooperatives utilize digital technology more effectively and continue to play a role in supporting Islamic financial inclusion in Indonesia. Abstract

This study aims to analyze consumer behavior models and decision-making processes from the perspective of Islamic economics and their application in marketing management. Using a literature review method, this research examines relevant literature on key concepts in consumer behavior and the underlying principles of Islamic economics. In Islamic economics, consumer behavior is not solely based on economic rationality but is also guided by ethical and moral values in Islam, such as justice, honesty, and balance. The decision-making process in this perspective considers aspects of halal and haram, sustainability, and the social impact of the decisions made. The study finds that applying Islamic economic principles in marketing management can enhance consumer trust and loyalty toward marketed products or services. Thus, a deep understanding of consumer behavior within the scope of Islamic economics offers a strong opportunity to implement effective marketing management in line with Sharia principles..
