Abstract

As Indonesia is a democratic state, general election is a means to run the people sovereignity. To achieve a qualified election, we need a proffesional institution there on. Such a professional institurion has been conducted by the Constitution 1945, Article 22E section (5) as saying that the election is held by a national election commission, whics is permanent and autonom. The provision underlines that such an institution shall be free from any form of intervention and from whatever parties, in conducting its all tasks, function and authorities. Today there has been the law No. 22/2007 on The Election Organizer ruling the National Election Commission, Election Oversight Body and its their function and authorities. However, refering to the evaluation of the election in 2009, there have been many problem arising from organizing, tentative eligible voters, the seats allocation to the determination for the elected legislators. The main reason for such problems count for both doubtedness of the integrity and capacity of the commissioners and unsincronized electoral legal frameworks. Therefore, there shall be a concrete effort to organise an election through a more comprehensive codified legal frameworks. Partial amandement of the Law No. 22/2007 shall be viewed as an intervening goal to achieve a comprehensive electoral legal frameworks.

Abstract

The dispute between the European Union (EU) and Indonesia over palm oil issue was triggered by the EU boycott of palm oil commodities. Indonesia as the largest producer of palm oil certainly feels disadvantaged by the EU's stance because it lost the market. The EU boycotted oil palm because it was not in line with its commitments on Sustainable Development Goals (SDGs) which focus on the environment. Palm oil is considered as a commodity that causes a lot of environmental damages. Indonesia challenged the EU at the World Trade Center (WTO) due to EU’s discrimination against the trade of palm oil in the European market. Indonesia also questioned EU's commitment to the SDGs with regard to poverty eradication, which Indonesia was working on. The dispute between the two parties in their defense has left questions about the truth behind their standpoints. As the world embarks into the age of post-truth, critical thinking is required to analyze the truth of an issue. This paper is made to question the truth of the defense carried out by the EU and Indonesia so that people are able to take a stand on what they believe is true. The truth is too often determined by the most massive information reported by the media, so to analyze the issues in this paper the author uses literacy observation method, especially through observations of the news in the media related to this issue. To analyze the real truth about the dispute between Indonesia and the EU on the issue of palm oil, it is necessary to understand the post truth theory, trade-off theory and national theory so as to analyze all the interests behind EU and Indonesian policies. Being critical by exploring the reality behind a truth that has been constructed by the media that distributes information is an absolute necessity for every individual in the post truth era.AbstrakPerseteruan antara Uni Eropa (UE) dan Indonesia tentang kelapa sawit dipicu oleh pemboikotan UE terhadap komoditas kelapa sawit. Indonesia sebagai produsen terbesar kelapa sawit tentu merasa dirugikan oleh sikap UE tersebut karena kehilangan pasar. UE memboikot kelapa sawit karena tidak sesuai dengan komitmen UE dalam Sustainable Development Goals (SDGs) yang berfokus pada lingkungan. Kelapa sawit dinilai sebagai komoditas yang menimbulkan banyak kerusakan lingkungan. Indonesia menggugat perlakuan UE ke World Trade Centre (WTO) akibat diskriminasi UE terhadap kelapa sawit di pasar Eropa. Indonesia juga mempertanyakan komitmen UE terhadap SDGs yang seharusnya memperhatikan juga poin pemberantasan kemiskinan yang sedang diusahakan Indonesia. Perseteruan antara keduanya dengan pembelaan masing-masing menyisakan pertanyaan tentang kebenaran yang mereka bawa. Dunia yang masuk di era post truth memerlukan pemikiran yang kritis untuk menganalisa kebenaran akan suatu isu. Tulisan ini dibuat untuk mempertanyakan kembali kebenaran dari pembelaan yang dilakukan UE dan Indonesia sehingga masyarakat mampu menempati posisi yang benar-benar mereka inginkan. Kebenaran telah terlalu sering ditentukan oleh informasi yang paling masif diberitakan oleh media, sehingga untuk menganalisa isu pada tulisan ini penulis menggunakan pengamatan literasi, terutama mengamati berita-berita yang media distribusikan terkait isu ini. Untuk menganalisa kebenaran sesungguhnya tentang perseteruan Indonesia dan UE pada isu kelapa sawit perlu untuk memahami post truth theory, trade off theory, dan national theory sehingga mampu menganalisa segala kepentingan dibalik kebijakan UE dan Indonesia. Bersikap kritis dengan menggali kenyataan dibalik sebuah kebenaran yang telah terkontruksi oleh media yang mendistribusikan informasi adalah sebuah hal yang mutlak untuk dilakukan oleh setiap individu di era post truth.

Abstract

Partisipasi politik masyarakat di tengah maraknya izin pertambangan perlu memperoleh perhatian yang lebih serius. Melalui penggunaan metodologi kualitatif, penelitian mengenai masalah ini berupaya mengungkap partisipasi politik masyarakat dalam masalah pertambangan. Tujuan penelitian ini adalah untuk memperoleh informasi mengenai politik pertambangan oleh pemerintah daerah dan dampaknya. Hasil penelitian menunjukkan, konsultasi publik mengenai kebijakan pertambangan masih lemah dampaknya bagi tata kelola kebijakan pertambangan yang baik Penulis mengusulkan agar pengaturan utama masalah pertambangan di bawah UU Pemerintahan Daerah, dan jangan tersebar mengikuti pengaturan secara sektoral operasi pertambangan.

Abstract

Village in Indonesia is the lowest governmental hierarchy which is directly in contact with community dynamics. Because of its autonomy, village has to be responsible to manage its own businesses for the interest of local communities. For this reason, the Indonesian government needs to make a bill on village which has been long to become aspirations of many villages in the country. In comparison to this, in Cina, although there is no need to regulate villages in from of law, the central and regional governments give priority to the development of villages. That is why there are many developed villages in Cina, particularly recently. This essay discusses village autonomy in Indonesia, and steps needed to be taken strengthen village autonomy.

Abstract

A democratic country needs political parties. They become the driving force in the implementation of democracy in Indonesia considering the important role that they play in various political processes in the legislature, government, and other state institutions. Given the importance of political parties in Indonesia in the Reform era, it turns out that most problems come from political parties. This paper aims to gain an understanding of the development and role of political parties in the Reform era based on the public perception of the existence of political parties. Based on the objective of the study, the significance of this study can hopefully be elicited, which is to provide an understanding and an input on the development and role of political parties in the Reform era. Results of the study suggests that public perception of the performance of political parties as political infrastructure was still poor and that political parties were also responsible for the poor performance of the political superstructure institutions. Therefore, the researcher recommends that political parties internally need to strengthen party institutionalization, while on the other hand, there needs to be an effort to simplify party systems in Indonesia. AbstrakSebuah negara demokratis membutuhkan adanya partai politik. Partai politik menjadi tulang punggung bagi berjalannya demokrasi di Indonesia, sebab peran penting dalam aneka proses politik di lembaga legislatif, pemerintahan, dan lembaga-lembaga negara lainnya tidak bisa dilepaskan dari partai politik. Mengingat pentingnya posisi partai politik di Indonesia pada era reformasi ini, malah ternyata letak permasalahan ada di partai politik. Penulisan ini memiliki tujuan untuk memperoleh pemahaman mengenai perkembangan dan peran partai politik di era reformasi berdasarkan persepsi masyarakat atas eksistensi partai politik. Dari tujuan itu diharapkan dapat dihasilkan kegunaan kajian ini, yakni memberikan pemahaman dan masukan terhadap perkembangan dan peran partai politik di era reformasi ini. Penulisan ini menemukan fakta bahwa persepsi publik atas kinerja partai politik sebagai infrastruktur politik masih buruk dan partai politik juga dianggap bertanggung jawab atas masih buruknya kinerja lembaga suprastruktur politik. Oleh karena itu, rekomendasi yang ditawarkan adalah partai politik secara internal perlu melakukan penguatan institusionalisasi partai, di sisi lain perlu adanya upaya penyederhanaan sistem kepartaian di Indonesia.

Abstract

Rome Statute as an international agreement has the jurisdiction on the enforcement of the prosecutions of grave human rights violations. Although Indonesia attended the conference which endorsed the Rome Statute in 1998, in fact, the country has not yet ratified it. Indonesia worries that the Rome Statute gives chance to punish Indonesians in cases of past serious human rights violations. This study’s finding, against, however, that worrisome due to the existence of the principle of the non-retroactivity and the complementary of the international criminal court. The implementation of the International Criminal Court will actually respect national law, especially which will make more effective the protection of human rights. As a Party State, Indonesia will obtain a lot of benefits in absorbing the provisions in the Rome Statute into national law.

A fast increase of world population without being followed by the world capability toprovide food and other basic needs is a cause of global environmental degradation. Thewriter argues that countries response to further prevent this degradation influenced bytheir national interests, thus, an equal and a fair international cooperation which givesmutual benefits to developing and industrial countries is needed. This essay discussesInter-Parliamentary Cooperation (IPU) to preserve environment within the frameworkof sustainable development. It is found here that the IPU, since 1992, has beenintroducing an initiative focused on the preparation and implementation guidanceon protecting the environment and sustainable development based on United NationsConference on Environment and Development (UNCED’s) recommendations.However, the effectiveness of the IPU solution has been questioned due to its limitedcapability in implementing this.

Abstract

Syrian conflict seemed to be an endless war, which has claimed more lives of civilians, causing thousand seekingrefuge and children losing their parents. Since March 2011, a large number of houses, infrastructure, and public service are devastated. This article describes the cause of the conflict, the actors, and the impacts of the continuity of the civilian war to Syria and international community. The writers conclude that conflict was not caused by sectarian factors, but political and economic interests of opposition groups and their supporting countries. There were three major warring parties, namely President Bashar and his loyalists, Syrian opposition group, and the jihadists. While, the number of refugees has reached 2.4 million, 75% of them are women and children, and there are also 4 million internally displaced people.

Abstract

Indonesian foreign policy is always mentioned by the country’s leaders for the sake of achieving national interest. Under the SBY administration, its implementation is carried out by introducing its soft power policy, by offering foreign aids, performing its new role as donor to developing countries through South-South Cooperation (SSC). It is considered by the Indonesian leaders that performing an active role in SSC would give political benefit or positive image for the country. This paper resulted from research report conducted in 2014, adopting a qualitative method of analysis with collecting data activities in Surabaya and Gorontalo. The research is aimed to know how far Indonesia can take benefits from SSC. Its finding concludes that the country’s involvement is intended to gain political support from developing countries for the country’s political interest in international arena. Unfortunately, it has not yet given significant contribution for the country’s economic development, especially in the regions.
