Abstract

Rural government is the lowest level of Indonesian administrative system under regency or city and province. Itsexistence under the Dutch colonial era is admitted as part of the colonial government’s recognition to customary law. There was, however, a new dynamic in post-independence era, during which under Law No. 19/1965, its role was diminished, and after the enactment of law No. 5/1979, its existence has been admitted again. Using its public administration point of analysis, this paper generates question whether or not the rural government similar with local state government, local self government or non-government organization. To answer this question, the writer conducted field research in Jabon Mekar, applying observation method, combining with in-depth interview, document studies. Data was also gathered from FGD, and further analyzed by using descriptive-qualitative method. From this empirical research, the writer concludes that rural government could be considered as a pseudo-government body.

Abstract

Illegal fishing still frequently occurs in Indonesian waters although many efforts have been conducted to stop it. Illegal fishing is not a typical problem Indonesia facing since it experienced also by other rich resource-countries due to its nature as a transnational crime. The writer therefore argues that the solution to overcome such transitional crime shall be done through a cross-national cooperation, including through a bilateral one. Although cooperation with neighboring countries have been conducted by Indonesia, multilateral- and bilaterally, however, all these still cannot secure the waters from illegal fishing. That is why a more serious and a better cooperation, in particular bilaterally, must be fostered by Indonesia’s government to effectively counter such a transnational crime. This research report discusses illegal fishing in the Indonesian waters, its causes, and the ways to handle it so far in the region.

Abstract

This Study discusses current situation in the Riau Archipelagic Province, which needs a special development approach. Its analysis is made based on library studies and reports of discussions of Bill on Development Acceleration of the Archipelagic Provinces. This research looks further into the constraints facing in Riau. Its finding reveals some problems, for instance, geographical conditions, low general allocation fund, and poor education and health services. Therefore, central government’s intervention is needed, together with DPR, to issue special policy to accelerate development in the archipelagic province.

Abstract

Moratorium of new recruitment of civil servant (CPNS) has been set by the government in the framework of budget savings and improving management of human resources (HR). The HR policies is carried out under the direction of policy in the grand design and road map of the national bureaucratic reforms. The aims of this article to analyze steps and the implications taken by the government in managing the re-organization of PNS and Its staff by issuing the moratorium policy. This policy, in addition to cut personnel expenditure budget, is also intended to restructure civil servants and their organization in order to optimize the bureaucratic reform agenda.

Abstract

The granting of special autonomy or special authority by the central government to the Province of Aceh through the concept of asymmetric decentralization was aimed at embracing the province of Aceh to remain within the territory of the Republic of Indonesia and improve the welfare of the people of Aceh. Nevertheless, in its implementation, various problems were identified. This paper is intended to assess the implementation of Law No. 11 of 2006 concerning the Government of Aceh. The reason for this is because through the asymmetric decentralization policy, the central government has granted extensive concessions to the Province of Aceh by delegating various administrative and political authorities, managing local identity, to providing financial resources, in accordance with the LoGA. However, the challenge that comes with asymmetric decentralization policy is with the risk of failure in implementation if the central government and the provincial government of Aceh did not implement the mandate of the law optimally.AbstrakPemberian otonomi khusus atau kewenangan khusus oleh pemerintah pusat kepada Provinsi Aceh melalui konsep desentralisasi asimetris bertujuan untuk merangkul provinsi Aceh agar tetap berada dalam kesatuan NKRI dan meningkatkan kesejahteraan masyarakat Aceh. Meski demikian dalam implementasinya ditemukan berbagai permasalahan.Tulisan ini bertujuan untuk melihat bagaimana implementasi Undang-Undang No. 11 Tahun 2006 tentang Pemerintahan Aceh dilaksanakan. Hal ini karena melalui kebijakan desentralisasi asimetris pemerintah pusat telah memberi konsesi-konsesi yang luas kepada Provinsi Aceh dengan melimpahkan berbagai kewenangan administrasi, politik, mengakomodasi identitas lokal, sampai memberikan sumber-sumber keuangan, sebagaimana yang diatur dalam UU PA. Akan tetapi yang menjadi tantangannya adalah, kebijakan desentralisasi asimetris itu bisa terancam gagal apabila dalam pelaksanaannya kinerja pemerintah pusat dan pemerintah provinsi Aceh tidak maksimal dalam melaksanakan amanat UU tersebut.

Abstract

The virtual world is one territory that is now taken into account in a national security state, in addition to land, sea and air territories. As one of the largest internet user countries in the world, Indonesia is vulnerable to cyber threats. In response to the said threat, the Indonesian government established the National Cyber and Encryption Agency (BSSN) as a national cyber institution mandated with the responsibility to maintain cyber security and sovereignty. This paper uses a qualitative approach to interpret concepts, definitions, characteristics, metaphors, symbols, and descriptions of things through library research. It elaborates further on the role of BSSN in the management of cyber security in Indonesia as well as in the implementation of Indonesian cyber diplomacy both through bilateral and multilateral cooperation.AbstrakDunia maya merupakan salah satu aspek yang saat ini ikut diperhitungkan dalam sebuah keamanan nasional suatu negara, di samping ranah darat, laut dan udara. Sebagai salah satu negara pengguna internet terbesar di dunia, telah menjadikan Indonesia rentan atau tidak luput dari ancaman siber. Oleh sebab itu, untuk merespons ancaman tersebut, pemerintah Indonesia kemudian membentuk Badan Siber dan Sandi Negara (BSSN) sebagai institusi siber nasional yang berfungsi menjaga keamanan dan kedaulatan siber. Pendekatan yang digunakan dalam tulisan ini menggunakan pendekatan kualitatif untuk menginterpretasikan konsep, definisi, karakteristik, metafora, simbol, dan deskripsi dari suatu hal melalui studi pustaka. Tulisan ini akan memaparkan lebih jauh mengenai peran BSSN dalam tata kelola keamanan siber di Indonesia sekaligus dalam pelaksanaan diplomasi siber Indonesia baik yang dilakukan melalui kerjasama bilateral maupun multilateral.

Abstract

Education is not only an important pillar to bring progress to the nation, but also a necessary condition for improving the welfare of the people. Unfortunately, RSBI as a public policy in education is considered to have failed to achieve its goal to improve the quality of education in this country. It is argued in this essay that RSBI againts the 1945 state constitution article 50 paragraph 3 of Law No. 20 2003 is contrary to the Constitution which has guaranteed education for all Indonesian people. Because of this controversy and many criticism, the Constitutional Court has finally revoked the RSBI policy.
