Abstract

Penelitian ini bertujuan untuk mengetahui faktor-faktor yang menyebabkan terjadinya tindak pidana pencabulan terhadap anak di Kabupaten Jeneponto, dan upaya kepolisian untuk mengatasi tindak pidana pencabulan terhadap anak di kabupaten jeneponto. Penelitian ini dilaksanakan di Polres Jeneponto Unit Perlindungan Perempuan dan Anak. Metode penelitian yang digunakan adalah hukum normatif yaitu merupakan penelitian yang mengkaji studi dokumen, yakni menggunakan berbagai bahan hukum primer dan sekunder adapun bahan hukum yang digunakan yaitu bahan hukum primer melalui wawancara langsung kepada narasumber yang berkaitan dengan tulisan ini, dan bahan hukum sekunder denganmengumpulkan data dari berbagi literatur yang ada, berupa buku, artikel-artikel yang diperoleh dari penelusuran internet, termasuk aturanperundang-undangan yang terkait dengan permasalahan dalam penelitianini. Hasil penelitian menunjukkan bahwa, (1) faktor-faktor penyebab terjadinya tindak pidana pencabulan terhadap anak yaitu faktor rendahnya Pendidikan dan ekonomi, factor lingkungan atau tempat tinggal, dan faktor teknologi, dan (2) Upaya kepolisian untuk mengatasi tindak pidana pencabulan terjadap anak di kabupaten jeneponto yaitu: Dalam Upaya Preventif pihak kepolisian melakukan beberapa hal yaitu mengadakan penyuluhan hukum dan keagamaan, memberikan arahan kepada masyarakat agar memakai pakaian yang sopan, menciptakan suasana yang tidak menyimpang dengan tata nilai yang dianut oleh masyarakat dan pihak kepolisian rutin melakukan patroli dan razia untuk menanggulangi tindak pidana pencabulan. Sedangkan dalam upaya represif pihak kepolisian melakukan penyelidikan dan penangkapan terhadap tersangka. This study aims to determine the factors that led to the crime of sexual abuse of children in Jeneponto Regency, and the police's efforts to deal with crimes against children in Jeneponto Regency. This research was conducted at the Jeneponto Regional Police Unit for the Protection of Women and Children. The research method used is normative law, namely research that examines the study of documents, which uses a variety of primary and secondary legal materials while the legal material used is primary legal material through direct interviews with sources related to this paper, and secondary legal material with collecting data from sharing literature that exists, in the form of books, articles obtained from internet searches, including laws related to problems in this study. The results showed that, (1) factors that cause the occurrence of criminal acts of sexual abuse against children, namely low education and economic factors, environmental or residential factors, and technological factors, and (2) police efforts to overcome criminal offenses against children in jeneponto district, namely: In Preventive Efforts the police do several things, namely providing legal and religious counseling, giving direction to the public to wear polite clothes, creating an atmosphere that does not deviate from the values adopted by the community and the police regularly conducting patrols and raids to deal with criminal acts of sexual abuse. Whereas in repressive efforts the police conduct investigations and arrests of suspects.

Abstract

This study aims to determine the implementation of assessments to obtain rehabilitation for drug users by members of the police, as well as knowing the factors that become obstacles in the implementation of assessments in handling narcotics users by members of the police. The research method used is descriptive analysis with data from field interviews and literature. The results showed that the person detected using narcotics will be carried out an assessment process to develop a case carried out by the Narcotics Unit unit investigator Polrestabes Makassar to find out where their involvement was as a dealer, precursor or just a user. While the process of enforcing the code of ethics does not directly take firm action against members who are caught in criminal cases of narcotics abuse. The inhibiting factors in the enforcement of narcotics criminal law by the police are the application of sanctions to members of the police who commit violations. As well as a sense of solidarity between fellow members of the National Police, problems with inadequate facilities and infrastructure and limited budget support.

Abstract

This study aims to determine the regulation of a single Regional Election for Regional Head Election simultaneously after the decision of the Constitutional Court Number 100 / PUU-XIII / 2015 in South Sulawesi Province, and the implementation of the selection of a single regional head candidate in South Sulawesi Province. This research was conducted in the Makassar City KPU, Enrekang Regency and Bone Regency. The research method used is normative law. The results obtained by the author from this study, namely 1). Regulation of the Single Candidate for Regional Head Election Simultaneously regulated in the Constitutional Court Decision Number 100 / PUU-XIII / 2015, Law no. 10 of 2016 and PKPU No. 13 of 2018.2). Implementation of Election of Candidates for Regional Heads in the Province of South Sulawesi consisting of; a). Requirements for Nominating a Single Candidate, b). Single Candidate Selection Dispute Process, c). Regulatory Standard for Inauguration of Single Candidate Candidates and, d). Single Candidate Selection Results in South Sulawesi Province.3). Abstract

Tujuan penelitian ini adalah, untuk mengetahui pelaksanaan dan faktor yang mempengaruhi efektifitas pengawasan Komisi Penyiaran Indonesia Daerah Sulawesi Selatan terhadap Program Pemilihan Kepala Daerah Tahun 2018, dilaksanakan di Kantor Komisi Penyaiara Indonesia Daerah Sulawesi Selatan di Kota Makassar. Metode yang gunakan adalah metode kuantitatif dengan tujuan untuk menguji pelaksanaan pengawasan Komisi Penyiaran Indonesia Daerah Sulawesi Selatan terhadap program Pemilihan Kepala Daerah tahun 2018. Hasil penelitian ini menunjukkan bahwa pelaksanaan pengawasan Komisi Penyiaran Indonesia Daerah Sulawesi Selatan terhadap program siaran Pemilihan Kepala Daerah tahun 2018 telah dilaksanakan, namun belum berjalan sebagaimana mestinya. Adapaun faktor-faktor yang memengaruhi efektivitas pelaksanaan pengawasan Komisi Penyiaran Indonesia Daerah Sulawesi Selatan terhadap program siaran Pemilihan Kepala Daerah tahun 2018 yaitu kurangnya sarana dan prasarana, kurangnya sumber daya manusia staf pengawas siaran (monitoring) dan sanksi hukum yang tidak memberikan efek jera kepada lembaga penyiaran yang melakukan pelanggaran. The purpose of this study was to determine the implementation and the factors that influence the effectiveness of the South Sulawesi Regional Indonesian Broadcasting Commission's supervision of the 2018 Regional Election Program, carried out at the South Sulawesi Regional Indonesian Commissioner's Office in Makassar. The method used is a quantitative method with the aim of testing the implementation of the supervision of the South Sulawesi Regional Indonesian Broadcasting Commission on the Regional Head Election program in 2018. The results of this study shows that the implementation of the supervision of the South Sulawesi Regional Indonesian Broadcasting Commission on the Regional Head Election Broadcast Program in 2018 has been carried out, but it has not been running as it should. The factors that influence the effectiveness of the implementation of the South Sulawesi Regional Indonesian Broadcasting Commission's supervision of the Regional Election Broadcasting program in 2018 are the lack of facilities and infrastructure, the lack of human resources of broadcast supervisors (monitoring) and legal sanctions that do not provide a deterrent effect to broadcasters who committed the violation.

Abstract

Penelitian ini bertujuan untuk mengidentifikasi pemberian izin perkawinan beda agama. Penelitian menggunakan metode kualitatif, yang bersumber dari data informan kunci, dokumen-dokumen dan wawancara serta bahan-bahan dari pustaka yang berlaku dan berkaitan dengan pemberian izin nikah beda di Pengadilan Negeri Makassar. Hasil penelitian menun-jukkan bahwa fenomena perkawinan beda agama yang terjadi di kalangan masyarakat Indonesia bisa menimbulkan berbagai macam permasalahan dari aspek hukum dan lingkungan masyarakat. Perkawinan beda agama menurut Undang-Undang No 1 Tahun 1974 adalah perkawinan yang sah, karena berdasarkan Pasal 2 ayat (1) Undang-Undang Perkawinan No 1 Tahun 1974, perkawinan yang sah adalah perkawinan yang dilakukan menurut hukum masing-masing agama dan kepercayaan. Dari Pasal 2 ayat (1), berbunyi bahwa undang-undang perkawinan menyerahkan sahnya suatu perkawinan dari sudut agama, jika suatu agama memperbolehkan perkawinan beda agama maka perkawinan agama boleh dilakukan, tetapi jika suatu agama melarang perkawinan beda agama, maka tidak boleh melakukan perkawinan beda agama. Berda-sarkan hasil penelitian lapangan menunjukkan bahwa setiap agama di Indonesia melarang untuk melakukan perka-winan beda agama. Oleh karena itu, perkawinan beda agama adalah perkawinan yang tidak sah menurut undang-undang perka-winan, serta Hakim juga harus melihat bagaimana rumah tangga pelaku perkawinan beda agama ke depannya, karena sulit terjadi keharmonisan dalam keluarga jika masing-masing pasangan tunduk pada agama yang berbeda, dan rentan perse-lisihan antar pasangan dalam hal mengasuh anak. This study aims to identify the licensing of interfaith marriages. The study uses qualitative methods, which are sourced from key informant data, documents and interviews as well as material from applicable libraries and are related to granting different marriage licenses in the Makassar District Court. The results showed that the phenomenon of interfaith marriages that occurred among Indonesian people could cause various kinds of problems from the legal aspects and the community environment. Interfaith marriage according to Law No. 1 of 1974 is a legal marriage, because based on Article 2 paragraph (1) of Marriage Law No. 1 of 1974, a legal marriage is a marriage conducted according to the law of each religion and belief. From Article 2 paragraph (1), it states that the marriage law gives up the validity of a marriage from the point of religion, if a religion allows interfaith marriages then religious marriages are permissible, but if a religion prohibits interfaith marriages, then no marriages may be of different marriages. religion. Based on the results of field research shows that every religion in Indonesia forbids interfaith marriages. Therefore, interfaith marriages are illegitimate marriages according to marriage law, and the Judge must also look at how households of interfaith marriages in the future, because harmony in the family is difficult if each partner is subject to different religions, and prone to disputes between partners in parenting.

Abstract

The purpose of this study was to find out the Fingerprint Function for investigators in disclosing criminal cases of murder and barriers experienced by investigators in conducting evidence with Fingerprint (Dactyloscopy) at the South Sulawesi Regional Police Regional Police Directorate. This study uses a type of qualitative research, by examining and studying a science of fingerprint identification which is used as the basis for conducting problem solving and qualitative analysis. The results of the research are: fingerprint function for investigators in disclosing criminal cases of murder which states that by identifying or observing fingerprints, one can find out one's identity in detail and clearly because as we know in this world no one has a fingerprint. the same so that the fingerprints possessed by humans are not the same and the obstacles of investigators in conducting evidence with the science of fingerprinting, ie the crime scene is no longer in the status quo or the crime scene is damaged so investigators have difficulty identifying fingerprints. This can be seen by the existence of criminal cases of murder in the South Sulawesi Regional Police Headquarters Ditreskrimum

Abstract

Penelitian ini bertujuan untuk mengetahui faktor-faktor yang menyebabkan terjadinya kejahatan di pelabuhan Bajo’e Kabupaten Bone, dan upaya kepolisian untuk mengatasi kejahatan Premanisme di pelabuhan Bajo’e Kabupaten Bone. Penelitian ini dilaksanakan di Polsek Pelabuhan. Metode penelitian yang digunakan adalah hukum empiris yaitu merupakan penelitian hukum sosiologis, yaitu mengkaji ketentuan hukum yang berlaku serta apa yang terjadi dalam kenyataanya di masyarakat, dan menggunakan berbagai data primer dan sekunder adapun data primer yang digunakan yaitu melalui wawancara langsung kepada narasumber yang berkaitan dengan tulisan ini dan membagikan angket kepada responden, adapun data sekunder dengan mengumpulkan data dari berbagi literatur yang ada, berupa buku, artikel-artikel yang diperoleh dari penelusuran internet, termasuk aturan perundang-undangan yang terkait dengan permasalahan dalam penelitian ini. Hasil penelitian menunjukkan bahwa: (1) faktor-faktor penyebab terjadinya kejahatan premanisme yaitu faktor lingkungan, factor ekonomi, dan faktor rendahnya pendidikan. (2) Upaya kepolisian untuk mengatasi kejahatan premanisme di pelabuhan Bajo’e kabupaten bone yaitu, dalam upaya pre-emtif pihak kepolisian melakukannya dengan cara menanamkan nilai-nilai/norma-norma yang baik kepada masyarakat melalui penyuluhan hukum dan keagamaan. Dalam upaya preventif pihak kepolisian melakukan patroli dan pengawasan secara rutin dan berkelanjutan. Sedangkan dalam upaya represif pihak kepolisian melakukan penyelidikan, penangkapan dan pembinaan psikologis dan penyadaran disertai latihan-latihan keterampilan kerja dalam masa hukuman agar punya modal untuk mencari pekerjaan. This study aims to determine the factors that led to the occurrence of crime in the Bajo'e district of Bone port, and the police efforts to overcome the crime of thuggery in the port of Bajo'e Bone. This research was conducted at the Port Police Station. The research method used is empirical law which is a sociological legal research, which examines the applicable legal provisions and what happens in reality in the community, and uses a variety of primary and secondary data while the primary data used is through direct interviews with sources related to writing this and distributing questionnaires to respondents, as for secondary data by collecting data from sharing existing literature, in the form of books, articles obtained from internet searches, including legislation related to the problems in this study. The results of the authors obtained from this study, namely (1) factors that cause the occurrence of thuggery namely environmental factors, economic factors, and educational factors. (2) Police efforts to overcome the crime of thuggery in Bajo'e regency bone port, namely: In the pre-eminent effort the police did it by instilling good values / norms with the community through legal and religious counseling. In preventive efforts the police conduct regular and ongoing patrols and supervision. Whereas in repressive efforts the police conduct investigations, arrests and psychological coaching and awareness accompanied by work skills training in the period of punishment so that they have the capital to find work.

Abstract

Penelitian ini bertujuan untuk mengetahui bentuk pelanggaran dan penerapan sanksi yang diberikan kepada anggota Polri yang melanggar kode etik profesi kepolisian, serta dampaknya akibat proses hukum yang timbul setelah penjatuhan putusan sidang Kode Etik Profesi Polri di Wilayah Hukum Kepolisian Daerah Sulawesi Selatan. Penelitian ini dilak-sanakan pada Kantor Kepolisian Daerah (POLDA) Sulawesi Selatan, dengan menggunakan pendekatan normatif empiris, artinya pendekatan yang dilakukan untuk menganalisis tentang sejauhmana suatu peraturan atau hukum yang sedang berlaku secara efektif dalam lingkungan Polri mengenai pemecatan anggota Polri melalui sidang Kode Etik Profesi pada wilayah Kepolisian Daerah Sulawesi Selatan. Hasil penelitian ini menunjukkan bahwa bentuk pelanggaran dan penerapan sanksi yang diberikan kepada anggota Polri yang melanggar Kode Etik Profesi Polri (KEPP) di wilayah hukum Kepolisian Daerah Sulawesi Selatan, pada tahun 2016-2019 telah terjadi pelanggaran dan sanksi KEPP sebanyak 75 kasus. Sedangkan dalam penjatuhan putusan sidang Komisi Kode Etik Polri (KKEP) dengan sanksi rekomendasi Pemberhentian Tidak dengan Hormat (PTDH) dari tahun 2016-2019 sebanyak 39 kasus PTDH. This study aims to determine the form of violations and the application of sanctions imposed on members of the National Police who violate the police profession code of ethics, and their impact due to the legal process arising after the decision of the Polri Profession Code of Ethics hearing in the South Sulawesi Regional Police Legal Area. This research was carried out at the Regional Police Office (RPO) of South Sulawes, using an empirical normative approach, meaning the approach taken to analyze the extent to which a regulation or law is being applied effectively within the National Police regarding the dismissal of members of the National Police through the Professional Code of Ethics in the region South Sulawesi Regional Police. The results of this study indicate that the form of violations and the application of sanctions given to members of the Police who violated the National Police Profession Code of Ethics (PCE) in the South Sulawesi Regional Police jurisdiction, violations and PCE sanctions occurred in 75 cases. Whereas in the ruling of the decision of the National Police Ethics Code (PCE) Commission with recommended sanctions, the Dismissal Not with Resignation (DNWR) from 2016-2019 was 39 cases of DNWR.

Abstract

Tujuan penelitian ini adalah untuk mengetahui dan menganalisis faktor-faktor apa saja yang mempengaruhi efektifitas hukum terhadap pelaksanaan program Dana Desa (DD) dan Alokasi Dana Desa (ADD) untuk wilayah terpencil, khususnya di Desa Sabaru Kecamatan Liukang Kalmas, Kabupaten Pangkep. Penelitian ini menggunakan jenis penelitian kualitatif, dengan cara menelaah dan mengkaji peraturan perundang-undangan yang berlaku untuk digunakan sebagai dasar dalam melakukan pemecahan masalah dan dianalisis secara normatif kualitatif. Hasil penelitian menunjukkan bahwa proses Pengelolaan ADD telah mengikuti aturan dan petunjuk teknis yang telah diatur dalam peraturan perundang-undangan, namun dalam prosesnya masih belum optimal. Hal tersebut terlihat dari proses pelaporan dan pertanggungjawaban yang mengalami keterlambatan. Faktor yang menghambat pengelolaan Alokasi Dana Desa (ADD) yakni Rendahnya partisipasi masyarakat dalam mengibahkan tanahnya kepada Pemerintah Desa, Sarana dan Prasarana yang kurang memadai, Keterbatasan kualitas Sumber Daya Manusia Aparat pemerintah Desa di Desa Sabaru yang rata-rata berpendidikan SMA/SMK. Hal tersebut menyebabkan kurangnya pengetahuan tentang pengelolaan ADD dan petunjuk teknis pengelolaan ADD yang setiap tahun berubah. Feno-mena ini menyebabkan tim pelaksana kegiatan ADD mengalami kesulitan dalam malaksanakan tugasnya serta komunikasi masyarakat yang kurang mampu mengutarakan pendapat di depan umum. The purpose of this study is to find out and analyze what factors influence the effectiveness of the law on the implementation of the Village Fund (VF) and Village Fund Allocation (VFA) programs for remote areas, particularly in Sabaru Village, Liukang Kalmas District, Pangkep Regency. This study uses qualitative research, by examining and reviewing the applicable laws and regulations for use as a basis for solving problems and analyzing normatively qualitatively. The results show that the ADD Management process has followed the rules and technical guidelines that have been regulated in the legislation, but the process is still not optimal. This can be seen from the process of reporting and accountability that is experiencing delays. Factors that hamper the management of Village Fund Allocation (VFA) are the low participation of the community in donating their land to the Village Government, Inadequate Facilities and Infrastructure, Limitation of the quality of Human Resources Village government officials in Sabaru Village who are generally educated at SMA/SMK. This causes a lack of knowledge about VFA management and VFA management technical guidelines that change every year. This phenomenon has caused the VFA activities implementing team to experience difficulties in carrying out their duties and public communication that is unable to express opinions in public.

Abstract

Tujuan penelitian ini adalahuntuk mengetahui dan menganalisis upaya kepolisian dalam menanggulangi tindak pidana Kekerasan Dalam RumahTangga di wilayahhukumPolsekMandai dan. untuk mengetahui dan menganalisis Hambatan-hambatan yang dihadapi penyidik kepolisian dalam upaya menanggulangi tindak pidana Kekerasan Dalam RumahTangga di wilayah hokum Polsek Mandai. Penelitian yang digunakan adalah penelitian hukum empiris yaitu suatu metode penelitian hukum yang berfungsi untuk melihat hukum dalam artian nyata dan meneliti bagaimana bekerjanya hukum di lingkungan masyarakat. Penelitian dilakukan di wilayah hukum Polsek Mandai Polres Maros, dan yang menjadi fokus pada peneilitian ini ada dua yakni: Preventif dan Represif: Hasil penelitian menujukkan bahwa upaya penanggulangan dilakukan secara preventif dan represif. Sementara kendala yang dihadapi dalam perlindungan perempuan korban kekerasan dalam rumah tangga adalah tidak adanya peraturan pelaksana terkait perintah perlindungan, keterbatasan dana dan keluarnya hasil visum et repertum membutuhkan waktu yang lama, keterbatasan sumber daya manusia seperti tidak adanya tenaga psikolog, kurang maksimalnya pelayanan konseling untuk korban, dan kurangnya pemahaman polisi terhadap pentingnya perintah perlindungan bagikorban. Keempat, keterbatasan sarana prasarana dan terdapat korban yangenggan ditempatkan di rumah aman. The purpose of this study is; (1) To find out and analyze the efforts of the police in tackling the crime of violence in the household in the area of the Police Police in Mandai. (2) To find out and analyze the Obstacles faced by police investigators in the effort to overcome the crime of violence in the household in the area of Mandai Police. The research used is empirical legal research, which is a legal research method that functions to see the law in the real sense and examine how law works in the community. The study was conducted in the jurisdiction of the Mandai Police Station Maros Police, and the focus of the study was twofold: Preventive and Repressive: the results of the study showed that prevention efforts were carried out preventively and repressively. While the obstacles faced in protecting women victims of domestic violence are the absence of implementing regulations related to protection orders, limited funds and the release of visum et repertum results require a long time, limited human resources such as the absence of psychologists, lack of maximum counseling services for victims and the lack of understanding of the police regarding the importance of the order to protect victims. Fourth, limited infrastructure and there are victims who are reluctant to be placed in safe houses.
