Abstract

This study examines the Implementation of UU No. 11 Tahun 2012 on the Criminal Justice System of Children against traffic violations committed by the Child. This is motivated by the process of settling cases of traffic violations committed by the Child ranging from the level of investigator to trial in court is not based on UU No. 11 Tahun 2012, so that contrary to the principle of the Criminal Justice System of the Child such as not paying the best interest for the Child, The right of the Child to deal with the law. This study uses secondary data as the main data obtained from literature / document studies supported primary data in the form of interviews. Based on the result of the research, it is found that Implementation of UU No. 11 Tahun 2012 on traffic violations conducted by children has not been applied maximally, not yet apply the concept of restorative justice so that contrary to the principles of the Criminal Justice System Law of Children does not give priority to the best interests for the Children. Second, the obstacles faced in the implementation of UU No. 11 Tahun 2012 on the Criminal Justice System for Child Trafficking violations committed by the Child is caused by several factors, including: Disharmony UU No. 11 Tahun 2012 on Child Criminal Justice System with UU No. 22 Tahun 2009 on Road Traffic and Transportation, Lack of Implementing UU No. 11 Tahun 2012 on Child Criminal Justice System, Regulation of UU No. 22 Year 2009 on Traffic and Road Transport that is not appropriate with the current situation, Knowledge and Law enforcement mindset.

Abstract

The role of the substitute clerk in the implementation of the judicial principle that is fast, simple and inexpensive, as referred to in Article 45 of the Regulation of the Supreme Court of the Republic of Indonesia No. 7 of 2015 concerning the Organization and Work Procedure of the Registrar and Secretariat of the Court. The role of the criminal justice bureaucracy in the courts is very important to realize substantial justice because the Criminal Procedure Code adheres to a service model in the administration of criminal justice. The Substitute Registrar in the implementation of fast, simple, low-cost judicial principles at the Padang Class IA District Court is very decisive in the trial process to produce a quality decision to fulfill a sense of justice for the parties involved. The principle of a simple, fast and low-cost judicial system is one of the principles in the justice system in Indonesia as regulated in Article 4 Paragraph (2) of Law No. 48 of 2009 concerning Judicial Authority which reads "The court helps justice seekers and tries to overcome all obstacles and obstacles to achieve justice. simple, fast, and low-cost justice can be achieved". The role of the substitute clerk in the implementation of fast, simple, low-cost judicial principles at the Padang Class IA District Court is in charge of preparing the trial before the trial, during the trial and or the trial is in progress and after the trial and post-trial, such as assisting the judge in the trial, recording the course of the trial. then put it in the minutes of the trial. The obstacles encountered by the substitute clerk in the implementation of the principle of justice are fast, simple, low cost at the Padang Class IA District Court, both internally and externally. Internal factors, namely: a) The large number of incoming cases, making it difficult to determine the day of the trial; b) The existence of one of the Panel of Judges who handles criminal cases who are sick, on leave or are carrying out other tasks outside the city, thus causing disruption of the trial agenda that has been previously determined. External factors, namely: a) The presence of witnesses who are not on time from the trial agenda that has been set; b) The condition of the defendant who is sick, which is confirmed by a doctor's statement; c) The Public Prosecutor cannot present witnesses for several trials; e) The defendant or victim is unable to present a witness, because the witness is domiciled outside the city of Padang.

Abstract

In the law has been discussed about the investigation of Law No. 8 of 1981 on the Criminal Procedure Code (KUHAP) as the basis of the footing process at the level of investigation. For that, a truly real process is needed to find errors that may not cause the mistrust caused by the process. Thus the legal process can be upgraded to an investigation to determine the primary and can be found by the real culprit.

Abstract

Land is a very important need because all human activities take place on the ground. Provisions on land rights are regulated in Law no. 5 of 1960 concerning Basic Agrarian Regulations. Among the land rights there are Building Use Rights and Property Rights. And for this reason, it is necessary to register and upgrade from Hak Guna Bangunan to Hak Milik. Building use rights have a limited period of time and need to be upgraded to property rights in order to have legal certainty for the rights holders. The increase in HGB to become property rights must be registered at the Land Office where the object is located. The formulation of the problem in this study is, First, how is the implementation of increasing the status of land from building use rights to property rights at the Solok City Land Office? Second, what are the obstacles that occur in the implementation of increasing land status from building use rights to property rights at the Solok City Land Office? The specification of this research is descriptive analysis. The approach used in this study is a normative juridical approach Based on the results of the study, it was shown that (1) the implementation of the improvement of land status from building use rights to ownership rights at the Solok City Land Office was carried out based on sample certificates, namely increasing building use rights to property rights on house building land, in addition, in the process of increasing land rights from the use of the building becomes property rights by fulfilling the conditions specified in the laws and regulations and other regulations. (2) Obstacles that occur in the implementation of improving the status of land from building use rights to property rights at the Solok City Land Office due to the increase in rights caused by the lack of public knowledge regarding the increase in rights, such as in terms of costs, conditions, uses or benefits. of the increase in rights. In addition, an increase in the right to use a building that is encumbered with a mortgage can be carried out, but with the approval of the creditor and accompanied by the submission of a certificate of mortgage held by the creditor to the debtor.

Abstract

The implementation of intelligence tasks within the Police is regulated in Article 39 of theRegulation of the Chief of Police of the Republic of Indonesia Number 23 of 2010. Thefunction of the Intelligence and Security Unit of Solok Selatan Police Resort has been tocarry out early detection and investigation of alleged mining crime. Seen from 2012 until2014 has been completed investigation followed up with the investigation of mining crime.The problem is optimizing the function of Satintelkam Polres Solok Selatan in theinvestigation of mining crime and obstacles encountered in the investigation. Specificationof this research is an analytical descriptive research with sociological juridical approach.The results show: first, optimization is done by conducting special and advancedintelligence education, conducting intelligence training in the field of mining crime, andestablish cooperation with related parties and communities. Both obstacles in theinvestigation of mining crime are lack of personnel capability and personnel behavior thatoften cooperate with the perpetrator as well as lack of supervision and control. Externally,the obstacles faced are most people are not providing information about the existence ofmining crime.

Abstract

One of the basic principles of contract law is the principle of Freedom of Contract.As the name implies, the principle dictates that private or public individuals and groupsare free to form contracts without any restriction. As free as it is, the principle howeverdoes have some restriction, In the Indonesia Civil Code (Kitab Undang-Undang HukumPerdata) there are some provisions that limits such freedom. Article 1320 of IndonesiaCivil Codes stipulates four conditions to be fulfilled in order an agreement to be valid.Others limitation could come from any other laws and regulations such as the PresidentialRegulation Number 16 of 2018 Regarding The Government’s Procurement Of Goods andServices. The principle of freedom of contract bestows a great number of authorities to theCommitment Making Officer in terms of making procurement agreements with provider.However, such authority doesn’t go as well in practice, breach of contract and abuse ofpower by the officer are some of the common problems in the government’s procurement.This thesis analyzes those problems, specifically that indicates corruption in theprocurements by the Office of Public Work of Sijunjung Regency.

Abstract

Given the importance of the presence of a witness in the criminal justice process to discover material truths, the function and position of witnesses are privileged and desirable for the parties involved in the criminal justice process. Especially for the relieving witness, his presence is expected by the defendant to provide information in the proceedings aimed at relieving the defendant and can be used as a consideration for the prosecutor in filing a lawsuit in the criminal justice process, as well as to convince the judge in taking the decision. Witnesses filed by a suspect or a defendant who is expected to provide a favorable testimony to him is called a de charge witness.

Abstract

Notary public is a public official who has the duty and obligation to provide legal services and consultation to the public need. Legal assistance that can be given from a notary isin the form of making an authentic deed or other authority as referred to in Act Number 30 of 2004 concerning Notary Position (Notary Position Law). According to Article 15 paragraph (1) of Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning the Position of Notary, the criminal law policy regarding the limitation of authority in the investigation of a Notary Public is at the stage of legal formulation governing the authority of the Notary Honorary Council in the process trial of a notary in the case of providing recommendations of approval or rejecting requests from investigators, public prosecutors, or judges to take photocopies of the Minutes of Deed and / or documents attached to the Minutes of Deed or Notary Protocol in Notary Storage.Based on the discussion and analysis, it can be concluded that: 1. Notary Honor Advisory Considerations in providing recommendations to the Police Investigator regarding alleged criminal acts committed by the Notary, in the event that the Notary Honorary Council does not give permission to the police investigator because the consideration of the Notary Honorary Council is not sufficient reason for examine and take the minutes of the deed to the Notary Public, in the event that the Notary Honorary Council gives permission to the police investigator because there is sufficient evidence of a criminal act committed by the Notary Public. 2. Legal protection of the Notary Public on the recommendation of the Notary Honorary Council (MKN) to investigators regarding the alleged criminal act, the position of the Notary Public through the MKN can be carried out repressively because it is related to the application of Article 66 paragraph (1) of the UUJN, namely in giving approval or rejecting requests the investigator who wishes to summon a Notary in the trial process of the existence of the Notary Honorary Council as a legal protection institution for the position of a Notary Public. The legal protection given to a Notary aims to avoid the arbitrary actions of the investigator who wishes to summon a Notary in court.

Penyidikan Tindak Pidana Pemilu Pada Masa Kampanye Pemilu 2019 Oleh Penyidik ​​Satreskrim Polres Solok Kota diawali dengan kegiatan Penyidik ​​mendampingi Bawaslu untuk menerima temuan/laporan dugaan tindak pidana Pemilu, selanjutnya paling lambat 14 (empat belas) hari penyidik ​​akan mendampingi Bawaslu dalam melakukan klarifikasi dan penelitian, setelah disimpulkan bahwa temuan/laporan tersebut merupakan tindak pidana pemilu, maka laporan tersebut diteruskan kepada Kepolisian dengan membuat Laporan Polisi, selanjutnya paling lambat 14 (empat belas) hari Penyidik ​​akan melaksanakannya. penyidikan dan paling lambat 14 (empat belas) hari berkas perkara hasil penyidikan tersebut telah diserahkan kepada Penuntut Umum. Umum. Dalam jangka waktu paling lama 6 (enam) hari terhitung sejak tanggal penerimaan berkas perkara, penyidik ​​melimpahkan tanggung jawab perkara tersebut kepada penuntut umum tanpa atau setelah melalui proses pengembalian berkas perkara. Kendala yang dihadapi Penyidik ​​Satreskrim Polres Solok Kota dalam Penyidikan Tindak Pidana Pemilu pada Masa Kampanye Pemilu 2019 antara lain, kendala eksternal yaitu a) penanganan laporan tindak pidana pemilu tidak dapat ditindaklanjuti jika salah satu unsur Gakkumdu (Bawaslu, penyidik, jaksa) tidak setuju untuk menindaklanjuti alasan normatif mereka sendiri; (b) pembatasan jangka waktu penanganan tindak pidana pemilu tidak diikuti dengan akibat hukum yang akan terjadi apabila penanganan tindak pidana yang dilakukan melebihi jangka waktu yang telah ditentukan; (c) keterbatasan waktu penanganan tindak pidana Pemilu sangat menghambat Penyidik ​​untuk bekerja maksimal dalam mengumpulkan bukti. kendala internal yaitu a) terbatasnya sarana dan prasarana yang diperlukan untuk kegiatan penyidikan dan penyidikan; b) Penyidik ​​Tindak Pidana Pemilu masih lemah dalam penguasaan peraturan perundang-undangan terkait Pemilu 2019.
