Abstract

The development of waqf assets in the form of adding the function of waqf is a new phenomenon in the problems of Islamic law jurisprudence even in positive law in Indonesia. In national law (positive), Indonesia has regulated this issue with the existence of laws and government regulations regarding waqf both movable and immovable waqf assets, even in its development every property in waqf must have an Deed and / or certificate. Whereas in Islamic jurisprudence, the development of waqf assets in the form of additional functions is one of the problems that can be said to be new, it needs legal conclusions and even has to be seen from various theoretical concepts such as maqashidu sharia. Therefore this research will examine the issue of developing waqf assets based on the Waqf Law and maqashid syari'ah. This research is an empirical legal research using a sociological legal approach, with data collection through documentation and interviews. The results of the research show that the development of waqf assets is permitted according to the law, but with the stipulated conditions, besides that the development of waqf assets is also permissible in Islamic jurisprudence as long as it is solely for reasons in accordance with the concept of maqasidu syari'ah and the point is to seek maslahat.

Abstract

The belief that God, or the Supreme Being, is the source of all that exists is common among a wide range of African communities that still retain a good measure of their traditional religio-cultural heritage. The Abagusii of Western Kenya is one of the communities that has been exposed to and actually embraced the western culture. This notwithstanding, the Abagusii are still proud of their traditional customs and still maintain a good measure of these practices, either in their original form or with modifications. In this paper we examine the influence of belief in God on the day-to-day activities of the Abagusii and assess the similarity of their religiosity with that of the Judeans as reflected in the book of Ruth. The purpose of this work is to contribute to the on-going debate on inculturation by projecting a trajectory that appreciates the authenticity of all cultures. In comparing the similarity between Abagusii and Judean conception of and interaction with the divine, this paper covers the following key areas: the nature and function of God, human limitations, the relationship between God and humans, the notion of divine intervention, and the influence of religious consciousness on the daily life of the community and its members. The author is cognizant that the Book of Ruth may not provide a comprehensive picture of the Judean concept of God. But it provides a basis for a comparative study on the way community members utilized their religious awareness and identity to govern their daily lives.

Abstract

One of the oldest dayahs in the Masjid Raya area of Samalanga District is Dayah Manyang Gampong Meulum and in recent years the wheels of education have been renewed by adding formal education in the form of lectures from IAI Al-Aziziyah Samalanga, but the salafiyah education system is still running. Seeing the current phenomenon in the dayah, the author tries to further examine the yellow book learning method in a scientific paper entitled Learning Management of the Kitab Kuning in Dayah Aceh ”(Case Study of Dayah Manyang Gampong Meulum Samalanga). There are three problem formulations in this scientific paper, the first is how the management method of the yellow book learning planning at Dayah Manyang Gampong Meulum Samalanga, the two management methods of learning the yellow book and finally what are the obstacles in learning the yellow book in the Dayah. The approach used in this research is qualitative using descriptive analysis method. The results showed that Dayah Manyang in the yellow book learning method adopted the bandongan (syarah) method where the teacher explained the book and its contents to their students and the students only listened carefully, wrote the translation and understood it. Another method is sorogan, which is the opposite of bandongan, this method is that the students are more active in learning and come to the teacher to read the book in front of the teacher. The last method is the rote method which focuses on memorizing verses and other types of memorization by students. Furthermore, the obstacles faced in yellow kitav learning revolve around the lack of discipline of the students so that time is not paid attention and causes drowsiness while studying. The lack of private tutors or guree peulang is also an obstacle in addition to very low management science, only armed with natural expertise. Lack of interest in learning is also an obstacle. Hopefully there will be a change towards the better for the advancement of the Dayah Manyang Gampong Meulum Samalanga education.

Abstract

Dayah is the oldest dakwah development institution in the archipelago, which emphasizes the formation of community morals to be civilized and polite. At first the dayah was not only a place for community religious learning, but also as a school institution to study general education, but when colonialism took place in this country, education was divided into two categories, namely religion and general. From then on, the effect of the decline in dayah education occurred, so that the interest of the community to study in the dayah was reduced and the function of the dayah began to change from its existence. Dayah institutions exist in society, and are community-owned educational institutions, which are built and developed by the community themselves independently. Dayah institutions are still consistent with religious education, so that this becomes a distinctive feature for dayah which is different from other educational institutions. Dayah has a special education system and pattern that is arranged in the form of a curriculum that is taught to its students. This learning pattern aims to be able to give birth to future generations who have strong faith and have broad insight.

Abstract

In its development, the number of tarekat found in Madura was three, namely the tarekat Qadiriyah, the tarekat Qadiriyah Wa Naqshabandiyah, and the tarekat Tijaniyah. In addition, the tarekat Syatariyah, which had a lot of contact with the traditions of the local Madurese community, had also been influential, even though it was not so big. In this case it is known that starting from the development of the performing arts among the Madurese population called rateb, or from the Arabic language ratib which is similar to the debus performances in Banten and Aceh, there is a strong suspicion that the tarekat Samaniyah has also developed in Madura since the 18th century. In its journey, the popularity of the tarekat Sammaniyah, especially in Madura, was replaced by the Qadariyah wa Naqsabandiyah. This tarekat in its development has replaced the fame of the tarekat Sammaniyah in the archipelago. The description from the sketch shows that in reality, we are often faced with local Islamic sketches, in the form of rituals, such as tarekat, tahlilan, salvation, and so on. The approaches used to telescope this are textual-contextual and structural-functional approaches. From the analysis, it is found that the patterns of understanding and attitudes of the majority of rural communities, especially Madurese, practice Islamic teachings in the form of rituals that are independent, walk alone, without recognizing the relationship between students and sheikhs or murshids.
