Abstract

·       This study focuses on the first problem of solving traffic accident criminal cases that have been applied in law enforcement and how to reconstruct the ideal traffic accident crime resolution based on a restorative justice approach. The method used in this study is normative juridical research with a research approach in the form of a normative approach. The result of this study is that the settlement of criminal cases of traffic violations in Indonesia to date (ius constitutum), basically still prioritizes conventional legal approaches and criminal sanctions. Cases of traffic accident violations are processed and resolved within the framework of the criminal justice system normally, starting from the police, prosecutor's office, and court levels, according to the criminal procedure law, (2) Reconstruction of the settlement of traffic accident violations is very likely to be applied in Indonesia with several non-litigation models (mediation), namely the independent perpetrator-victim mediation approach and perpetrator-victim mediation  involving law enforcement (restorative justice agencies). Settlement efforts through the courts can only be pursued if restorative efforts fail to reach an agreement. With these results, it is suggested: (1) The police, prosecutors, and courts should be more intensive to socialize and provide education related to the application of restorative justice, especially for traffic accident crimes, (2) The principle of restorative justice needs to be realized in the main legal form, namely a law that comprehensively and integratively covers the regulation of all components of the criminal justice system.

Abstract

This research is a quantitative-research using an experimental approach. The type of research used is experimental research. The objectives of this study are (1) to determine the significant effect of the jigsaw cooperative learning model on the motivation to learn Applied Physics for cadets at the Merchant Marine Polytechnic of Makassar, (2) to determine the effect of the level of motivation before and after using the jigsaw cooperative learning model. The research was carried out at the Merchant Marine Polytechnic of Makassar from April to September 2022. The population in this study were all cadets of the Engineering Study Program semester II for the Academic Year 2021/2022 at the Merchant Marine Polytechnic of Makassar, totaling 48 cadets. Data collection techniques using a questionnaire. The data analysis technique used normality test, correlation test, homogeneity test, and test of difference in average value (t test). The results showed that the application of the Jigsaw learning model had a significant effect on the motivation to learn applied physics for cadets at the Merchant Marine Polytechnic of Makassar with a correlation coefficient of 0.436. Furthermore, there are differences in the level of learning motivation in the control class and the experimental class. The learning motivation in the control class is in the medium category while the experimental class is in the high category.

Abstract

The spread of Covid-19 in Indonesia shows a relatively high increase throughout the Pandemic. The government is trying to run various programs to break the chain of transmission of Covid-19, but the refusal of some people makes controlling the pandemic more difficult to achieve. The spread of hoax news and oppositional attitudes towards the government also influenced public rejection. This condition also increases the escalation of conflict between the government and some community groups. Proven in this study, intellectual humility correlates with the formation of conflict resolution, so it can be a good predictor in seeing public acceptance of government policies, especially related to the determination of interventions to groups that are not cooperative with Covid-19 response. This research is participatory, with a phenomenological framework whose data is converted into quantitative. Next, it is analyzed using parametric statistical calculations.

Abstract

This article is a study of foreign policy that aims to understand the reasons for South Korea's refusal to join the trilateral military alliance with the U.S. and Japan in countering North Korea’s nuclear and missile provocation. Due to the crisis of the two Koreas and the North keeps doing any efforts that leads to escalate the conflict, the U.S. initiated trilateral military alliance with its allies, namely South Koarea and Japan. Surprisingly, South Korea stated that they do not want to join trilateral military alliance with U.S. and Japan.Using an extensive literature review method with an interpretive approach, it finds that South Korea’s domestic political condition and a high pressure from China regarding this issue were influential in South Korea’s decision to refuse to join the alliance. The domestic political condition refers not only to political leader, but also to historical burden, and the changing generational priorities. This study also shows that China has got a stronger bargaining position in international relations in the East Asia region.

Abstract

The elderly population in Indonesia is increasing every year. Aging is associated with loss and decline in testosterone levels in elderly men. Testosterone deficiency is associated with decreased body mass, decreased bone density, decreased physical function and activity, decreased cognitive function, increased fat mass, increased depressive symptoms and increased risk of falls and fractures. Muscle mass is the largest tissue which covers 40%-50% of the body. To assess muscle strength, hand grip strength can be measured and to assess muscle mass, anthropometric measurements can be made, especially calf diameter. While for body fat can be measured body mass index. The age-related decrease in skeletal muscle mass also affects respiratory muscle function which can be seen from the decline in lung function (FEV1 and FVC). In addition, increased blood pressure is also common in elderly people. Objective: To determine the relationship between the hormone testosterone with hand grip strength, calf diameter, lung function, body mass index (BMI) and blood pressure in elderly men. Method: This study is observational analytic with a cross-sectional study design conducted in Manado on elderly men. Results: From this study, 38 samples of elderly men were obtained who had a significant positive relationship between testosterone levels and FVC values (p = 0.004). There was a significant positive relationship between testosterone levels and the strength of the right-hand grip (p = 0.245) and left-hand grip (p = 0.354), the same was true for FEV1 values (p = 0.078) and systole (p = 0.340) and diastole (p = 0.216). In this study there was a significant negative relationship between testosterone levels with the diameter of the right calf (p = 0.009) and left (p = 0.009) and the same thing also in the BMI value (p = 0.003). Conclusion: The better the testosterone level, the better the FVC value, while the lower the testosterone level, the greater the calf diameter and BMI. FEV1 values, hand grip strength and blood pressure were not significantly affected by testosterone levels.

Abstract

Understanding the importance of jurisprudence in relation to the role of judges in processing a case in court, all of this indicates that jurisprudence is an integral part when judges process a case to make a decision when the written legal rules are not textually stated. And this is also the principle of freedom of action for judges, when the legal text does not stipulate concretely, this is all done to fill the legal void. However, what needs to be considered is the principle of freedom of action (freies ermeseen/discretion) for a state official (judge), may not act as freely as one's own will, but that freedom of action must result in legal decisions that are guided by the values ??of justice, the value of usefulness and the value of justice. certainty to be felt by all components of society. Thus, the role and existence of a prudential jurist in the legal system in Indonesia is highly expected to build and enforce socially just laws for all Indonesian people. For this reason, a legal issue arises, what is the role and existence of jurisprudence in the legal system in Indonesia? This requires a legal reasoning that is firm, clear and concrete so that in practice the law can be touched by all levels of Indonesian society.
