Abstract

One of the persistent problems in energy distribution in Indonesia is the misuse of the transportation and trading of 3 kg liquefied petroleum gas (LPG). This gives rise to subsidy distribution that fails to reach its intended recipients, causing harm to the community as a whole and to the state budget. A notable discrepancy continues to exist in judicial practice between the criminal penalties prescribed by law and the sentences actually handed down by judges, despite the fact that legal provisions have established significant criminal threats for such offences. This study aims to analyse the form of legal accountability applicable to those who abuse the transportation and trading of subsidised 3 kg LPG. The method employed is normative legal research, utilising a legislative approach and a conceptual approach. The results of the study show that the actions of perpetrators fulfil the elements of criminal offences as stipulated in the applicable laws and regulations, such that perpetrators may be held criminally accountable. However, in practice, judges tend to impose relatively lighter sentences than those threatened under the law, taking into account mitigating factors and the judge's assessment of the circumstances of each case.

Abstract

Sexual violence against children remains a serious concern in Indonesia, with the number of cases continuing to increase each year. The enactment of Law Number 12 of 2022 concerning Sexual Violence Crimes (Tindak Pidana Kekerasan Seksual, TPKS Law) marks a significant milestone in providing a more comprehensive legal framework for protecting victims and prosecuting perpetrators. This research aims to assess the implementation of legal protection for child victims of sexual violence at the Cirebon City Police Department and to identify the challenges faced in its application. Using a normative juridical research method with a legislative approach and a case approach, this study analyses primary legal materials — including the TPKS Law, the Child Protection Law, and the Kitab Undang-Undang Hukum Pidana (KUHP) — as well as secondary materials such as legal literature and field data obtained from the Cirebon City Police. The findings indicate that the TPKS Law provides a comprehensive legal basis for victim protection, rehabilitation, and the prosecution of perpetrators. However, its implementation faces a number of obstacles, including the psychological condition of victims, fear and shame within families, a tendency toward amicable settlement, the withdrawal of reports, and limited law enforcement authority. The study concludes that the effectiveness of legal protection is not solely determined by the regulatory framework, but is also shaped by social, cultural, and psychological factors. Accordingly, a collaborative approach among law enforcement, the government, and the community is essential to ensure optimal protection and justice for child victims. Strengthening public awareness, improving victim support services, and enhancing law enforcement capacity are crucial steps toward realising a child-friendly justice system.

Abstract

Waste management remains a critical challenge in urban areas, particularly in Cirebon City, where increasing waste generation and limited infrastructure have created significant environmental and public health concerns. To address this issue, the Cirebon City Government enacted Regional Regulation Number 4 of 2018 concerning Waste Management as the legal foundation for sustainable and effective waste management. However, the implementation of this regulation in practice continues to face various obstacles, as reflected in the management of the Kopi Luhur Landfill (Tempat Pemrosesan Akhir, TPA), which continues to struggle with operational limitations and inadequate facilities. This research examines the implementation of Regional Regulation Number 4 of 2018 by the Cirebon City Environmental Agency (Dinas Lingkungan Hidup), as well as identifying the obstacles encountered in the field. The method employed is empirical legal research, utilising a direct approach through interviews, observations, and literature studies. The results of the study show that waste management is already underway, particularly at the transportation stage, which is considered relatively effective. However, at the stage of waste reduction at the source, implementation remains suboptimal due to low levels of public awareness regarding waste sorting. Furthermore, the condition of the Kopi Luhur Landfill does not yet fully meet the required standards owing to limited facilities, budget, and human resources. Additional obstacles include weak law enforcement and the limited authority of the Environmental Agency. Improvement efforts are therefore needed, including increased public awareness, stricter enforcement of regulations, and the development of a more modern and integrated waste management system

Abstract

The rapid expansion of digital financial transactions has significantly increased the prevalence of online investment fraud, including fraudulent online arisan schemes that exploit public trust through promises of unrealistic returns. Despite the enactment of Indonesia's new Criminal Code, challenges remain regarding the legal interpretation and judicial application of fraud provisions in technology-based financial crimes. This study aims to analyze the modus operandi of online arisan investment fraud, evaluate the effectiveness of positive criminal law in protecting victims, and examine the legal reasoning employed by judges in Decision Number 47/Pid.B/2025/PN.Cbn. This research employed a qualitative normative juridical approach using a case study design. Primary legal materials consisted of court decisions, the Indonesian Criminal Code, Law Number 1 of 2023 concerning the Criminal Code, and relevant statutory regulations, while secondary materials included scholarly journals, legal doctrines, books, and official publications. Data were collected through document analysis and literature review, and analyzed using statutory, case, and conceptual approaches supported by qualitative thematic analysis. The findings demonstrate that the defendant intentionally employed deception, false promises, and misleading investment offers to unlawfully obtain financial gain from multiple victims. The court concluded that all legal elements of fraud under Article 378 of the Criminal Code had been satisfied, resulting in a conviction supported by comprehensive judicial reasoning grounded in the principles of legal certainty, justice, and evidentiary standards. The study concludes that judicial reasoning plays a crucial role in ensuring effective law enforcement against online investment fraud, while reinforcing legal certainty and strengthening victim protection within Indonesia's evolving digital legal environment.

Abstract

This study investigates the role of the public prosecutor in ensuring the right to restitution for children who are victims of sexual violence within Indonesia’s criminal justice system. Although the right to restitution for child victims is normatively guaranteed under the Child Protection Law, the Law on Sexual Violence Crimes, and related Government Regulations, the active participation of the prosecutor as dominus litis is essential for its implementation. The findings show that prosecutors are responsible for including restitution claims in the indictment or sentencing demand, ensuring that restitution is granted in court decisions, and coordinating the tracing and sale of the defendant’s assets to guarantee the execution of restitution. However, prosecutors continue to face several challenges in carrying out this responsibility. These include offenders who are unable or unwilling to pay, unclear technical regulations, and limited understanding of restitution procedures. As a result, restitution orders are often not fully enforced, thereby preventing victims’ rights to recovery from being effectively fulfilled. Therefore, there is a need to strengthen prosecutorial capacity, promote more active enforcement from the prosecution stage through execution, and establish clear guidelines for handling restitution claims in cases involving child victims of sexual violence as part of broader child protection efforts.

Abstract

The condition of road pavement that continues to experience degradation due to traffic loads and environmental factors requires regular evaluation to determine appropriate maintenance priorities. This study aims to evaluate the pavement condition of Jalan Guru Bangkol, Mataram City, using the Surface Distress Index (SDI) method as a basis for determining road maintenance priorities. The study used a descriptive quantitative approach through a visual survey of the road surface condition. The 1.25 km road section was divided into 13 observation segments with 100-meter intervals. Primary data were obtained through direct observation of the parameters of crack area, crack width, number of potholes, and wheel groove depth (rutting), then analyzed based on the SDI guidelines of the Directorate General of Highways. The results showed that of the 13 observed segments, 10 segments (76.92%) were in good condition, 1 segment (7.69%) was in moderate condition, and 2 segments (15.39%) were in a condition of slight damage, while no segments were found with severe damage. Based on the SDI value classification, most road sections are recommended for routine maintenance, while one segment requires periodic maintenance and two segments require road rehabilitation. The research results show that the SDI method is able to provide a systematic evaluation of pavement conditions and supports the determination of more objective and effective maintenance priorities as a basis for decision making in urban road infrastructure management.

Abstract

Poverty alleviation in resource-rich regions faces the critical challenge of high Gross Regional Domestic Product (GRDP) levels that have not been effectively translated into reductions in social inequality. This study aimed to analyze the alignment of collaborative governance commitments within regional planning documents and integrated data systems, map the extent of program synergy, and identify governance gaps between the Local Government of West Sumbawa Regency (Kabupaten Sumbawa Barat, KSB) and PT Amman Mineral Nusa Tenggara (AMNT). A qualitative policy document analysis approach was employed using secondary data triangulation, including the KSB Medium-Term Regional Development Plan (Rencana Pembangunan Jangka Menengah Daerah, RPJMD) 2021–2026, technical documentation of the Integrated Social Welfare Data Management Information System (Sistem Informasi Manajemen Data Terpadu Kesejahteraan Sosial, SIMDATUSOS), PT AMNT Sustainability Reports, and official statistics from the Central Bureau of Statistics (Badan Pusat Statistik, BPS) KSB for 2024–2025. The findings revealed that, despite a reduction in KSB’s poverty rate to 10.98% and extreme poverty rate to 0.40% in 2025, social interventions remained constrained by a parallel synergy phenomenon. The SIMDATUSOS application’s capacity to support the Kartu KSB Maju Sosial program was not yet integrated through Application Programming Interfaces (APIs) with PT AMNT’s corporate social responsibility (CSR) database. The absence of digital data interoperability, misalignment between regional annual work plans (Rencana Kerja Pemerintah Daerah, RKPD) and corporate budgets (Rencana Kerja dan Anggaran Biaya, RKAB), and the suboptimal role of the Regional Poverty Reduction Coordination Team (Tim Koordinasi Penanggulangan Kemiskinan Daerah, TKPKD) Secretariat at the Regional Development Planning Agency (Badan Perencanaan Pembangunan Daerah, Bappeda) as a Digital Single Clearing House created significant risks of beneficiary targeting errors. This study recommends the enactment of a Regent Regulation on Cross-Sectoral Data Interoperability to establish a more accurate, accountable, and integrated single source of truth for poverty alleviation governance.

Abstract

This Community Service (Pengabdian kepada Masyarakat / PkM) activity aimed to evaluate and strengthen the implementation of ecopedagogical values in the preservation of Wae Barong Spring through the revitalization of regis traditional values integrated with the spirituality of Laudato Si’ and the local wisdom of the Manggarai community. Springs are regarded as sacred spaces that maintain connections between ancestors, nature, and community sustainability. The activity was conducted at Gendang Langgo, Manggarai Regency, involving 32 participants consisting of traditional leaders, youth groups, and local community members. The methods included socialization, environmental education, participatory discussions, cultural reflection, community assistance, and participatory evaluation. The evaluation was conducted using participant observation sheets, reflection notes, and brief interviews to assess participant involvement, changes in understanding of the relationship between regis, ecological education, and Laudato Si’ spirituality, as well as awareness of spring conservation efforts. The results showed active participation from all participants in discussions and reflections regarding the relationship between humans and nature. Participants recognized that regis functions as a cultural mechanism for maintaining spring water quality through the protection of vegetation, fauna, and surrounding ecological areas. The findings also indicated increased ecological awareness and strengthened collective commitment among community members to conserve Wae Barong Spring. This activity demonstrated that the integration of regis customary values, ecopedagogy, and Laudato Si’ spirituality can effectively strengthen local culture-based ecological education and support sustainable environmental conservation.

Abstract

This study examined the economic structure of Kudus Regency and its vulnerability to tobacco excise policy shocks using Location Quotient (LQ) and Shift-Share analyses. Employing a descriptive quantitative approach with secondary time-series data from Statistics Indonesia (BPS) for 2023–2024, the study identified the manufacturing sector as the only economic base sector, with an average LQ of 2.296, while the other 16 sectors were classified as non-base sectors primarily serving local demand. The Shift-Share analysis revealed a substantial erosion of the manufacturing sector's competitive advantage, as indicated by a negative Differential Shift of IDR 989.29 billion, suggesting that the sector grew considerably more slowly than the corresponding sector in Central Java Province. This decline was associated with cumulative increases in Tobacco Products Excise (Cukai Hasil Tembakau [CHT]) rates, which increased production costs and reduced profitability. The Kudus Regency Government reported economic growth of only 2.78% in the first semester of 2025, considerably below the national average. Despite these challenges, several non-base sectors showed promising trends, with Construction and Other Services recording positive Differential Shifts of IDR 90.48 billion and IDR 73.74 billion, respectively, indicating potential opportunities for economic diversification. These findings underscore the need for strategic investment in economic diversification and the effective allocation of Tobacco Products Excise Revenue-Sharing Funds (Dana Bagi Hasil Cukai Hasil Tembakau [DBH CHT]) toward workforce development and non-tobacco enterprises to foster a more resilient regional economic structure.

Abstract

The implementation of Hajj and Umrah has transformed from a religious ritual into a strategic economic ecosystem; however, Indonesia has not yet fully captured its economic potential due to fragmented policies. This paper evaluates strategic options for optimizing Indonesia’s Hajj economic ecosystem. Using a mixed-method approach that combined secondary data analysis with a mini-survey of key decision-makers, three strategic options were evaluated: strengthening inward spending, increasing workforce participation, and optimizing the benefit value of managed Hajj funds. The survey findings revealed that strengthening inward spending was the highest priority for immediate implementation. This finding highlights the necessity of prioritizing inward spending to prevent capital outflows and maximize national economic growth. By strengthening trade logistics, expanding direct investment, and integrating domestic MSMEs into Saudi Arabia’s global supply chain, Indonesia can develop a resilient economic model that generates sustainable national value. Consequently, this option serves as a primary leverage point for capturing greater economic value, minimizing capital outflows, and enhancing the national multiplier effect.
