Abstract

Corruption, a pervasive socio-economic problem, has a significant impact on Morocco, reflecting a global challenge that undermines trust in public institutions and hinders development. This phenomenon, often defined as the abuse of public power for private gain, results in widespread citizen distrust of their government and public institutions. Recognizing the critical need to address this issue, Morocco has implemented various strategies and reforms at the institutional and civil society levels to combat corruption. Our study aims to provide a sectoral analysis of corruption in Morocco, assessing the prevalence of corrupt practices and the effectiveness of anti-corruption measures put in place. Using a descriptive methodology, our research relies on secondary data from various databases, including Transparency International's Corruption Perceptions Index (CPI) from 2004 to 2023. This index provides a longitudinal perspective on how perceptions of corruption have evolved in Morocco over the years and serves as a key indicator of the effectiveness of anti-corruption efforts. Our findings indicate that despite these efforts, corruption remains entrenched in several sectors, suggesting that the strategies adopted have not yet succeeded in significantly changing the corruption landscape. This analysis underscores the complexity of fighting corruption in Morocco and highlights the need for continued efforts and innovative strategies to effectively address this endemic problem.

Abstract

This study aims to disclose the impact of Islamic law and Indonesian state law on organizing zakat distribution for persons with disabilities. Utilizing a descriptive comparative methodology, this study analyzes how both Islamic law and Indonesian state law influence efforts to provide zakat funds to people with disabilities in Indonesia. We examined scholarly literature, reports, articles on Fiqh Zakat, zakat distribution, the rights of people with disabilities, and regulations to obtain pertinent background knowledge. A comparative analysis assessed the impact of the similarities and differences between these laws on the right to receive zakat. The findings evaluate the contribution of zakat distribution to addressing the needs of people with disabilities from the perspectives of both Islamic law and state law. This study emphasizes the importance of protecting individuals with disabilities in various countries, including those with secular legal frameworks, as a crucial aspect of social policies. It advocates equal access to education, healthcare, and employment opportunities, fostering inclusivity and eliminating discrimination.

Abstract

This study examines obstacles to sustainable development in the Islamic world through the lens of Islamic teachings and principles. Utilizing a qualitative research approach, this study selected relevant Islamic teachings on sustainability, cases of sustainable development in Islamic countries, and places facing specific challenges. Primary data were gathered from religious texts, while secondary data were collected from a comprehensive literature review, including the Quran, Hadith, and scholarly articles. The research process involves extensive literature review and data analysis through data reduction to identify key themes, with comparative analysis highlighting the differences and similarities between Islamic and non-Islamic countries' approaches. The key obstacles identified included corruption, social injustice, and wealth inequality. This study advocates for a comprehensive approach guided by scholars, policymakers, and local communities, involving the reinterpretation and implementation of Islamic values in development strategies. Education and awareness campaigns are proposed to empower individuals with the knowledge required to make ethical choices. By integrating scientific advancements with traditional wisdom, this study underscores the need to ensure that progress aligns with Islamic teachings of compassion, justice, and responsible stewardship.

Abstract

This research aims to determine how to develop a Halal Tourism Area in Ngebel Lake Ponorogo in terms of DSN MUI Fatwa Number 108/DSN-MUI/X/2016. There are two discussions, namely: 1) How to implement halal tourism development in Ngebel Lake Ponorogo based on DSN-MUI Fatwa Number 108/DSN-MUI/X/2016 Guidelines for Organizing Tourism Based on Sharia Principles. 2) What is the inhibiting and supporting factors in the development of the Ngebel Lake Ponorogo tourism area based on the DSN-MUI Fatwa Number 108/DSN-MUI/X/2016 Guidelines for Organizing Tourism Based on Sharia Principles? The type of research carried out by the researchers is field research using qualitative methods. Data collection techniques included observation, interviews, and documentation. The data analysis method used by researchers is inductive. The research results show that, first, the implementation of development based on DSN-MUI Fatwa Number 108/DSN-MUI/X/2016 has not been fully carried out in accordance with the guidelines for implementing halal tourism, even though it has fulfilled several development aspects as stated in the fatwa, namely, related to the provision of tourist-friendly Muslim facilities and services. Second, the fulfillment of implementation factors in accordance with DSN-MUI Fatwa Number 108/DSN-MUI/X/2016 influenced the success factors in supporting halal tourism activities at Ngebel Lake Ponorogo. However, the non-implementation of some of the supporting factors has created an obstacle in developing halal tourism in the Ngebel Lake Ponorogo area because it has not been implemented, as stated in the implementation guidelines according to Fatwa.

Abstract

Personal data security is the right of every person to protect their personal data confidentially. This research discusses regulations for consumer protection, personal data protection, and their implementation from the perspective of the maqāṣid sharīʿah. The aim of this research is to determine the extent to which laws related to consumer data protection have been implemented to prevent leaks in the personal data of WhatsApp application users. This study used a qualitative approach with normative empirical research methods. Normative research examines Law No. 8 of 1999 concerning Consumer Protection and Law No. 27 of 2022 concerning Personal Data Protection, while empirical research examines the implementation of these regulations. Researchers draw the conclusion that regulations related to the protection of consumers' personal data and their implementation fall within the concept of maqāṣid sharīʿah, especially the basic principle of maintaining one's honor (ḥifẓ al-ʿirḍ) because these regulations were made to protect one's privacy.

Abstract

The rapid development of technology has transformed conventional business practices, with digital platforms such as Shopee providing innovative features, such as live streaming and flash sales. However, these features have the potential to enable unfair business competition. This study examines the impact of live streaming on Shopee Live and Toko Saya flash sales on a Shopee platform from the perspective of business competition. Using a qualitative approach, this study focuses on the policies and practices surrounding these features. The findings reveal that while certain promotional practices are legitimate, the ongoing practice of providing conditional discounts and low prices may violate business competition laws and principles of business competition jurisprudence in Islam. Sellers and buyers have indicated that these practices are not based on the principles of honesty and balance and can be detrimental to smaller businesses with limited capital. This study highlights the need for businesses to prioritize moral ethics and adhere to religious and state rules to create a fair and competitive market that protects consumer rights. As digital platforms continue to grow, it is crucial to address the potential for unhealthy business competition and to ensure that all parties, including conventional business actors, can participate fairly in the market.

Abstract

This study investigates the impact of Islamic Corporate Social Responsibility (ICSR) on financial performance and corporate reputation in the context of Islamic commercial banks in Indonesia. Specifically, it examines how ICSR affects return on assets (ROA) and return on equity (ROE) as indicators of financial performance and deposits from customers (DPK) as a measure of firm reputation. The research uses data from the annual reports of nine Shariah commercial banks over five years, from 2015 to 2019.  The results show that ICSR does not significantly affect ROA, indicating a limited impact on banks' asset-based financial performance. However, ICSR has a positive effect on ROE, suggesting that it enhances investor confidence and contributes positively to equity-based financial performance. In contrast, the study concludes that ICSR does not have a significant impact on corporate reputation, suggesting the complexity of factors that influence public perception beyond ICSR activities. This research provides valuable insights into the differential impact of ICSR on different dimensions of Islamic commercial banks' performance and highlights potential areas for further research in the field of corporate social responsibility and financial management in the Islamic banking sector.

Abstract

This study examines the characteristics of Islamic scholars in issuing fatwas, highlighting concerns that financial institutions may seek fatwas aligning with their profit-driven motives, potentially contradicting Islamic principles. Focusing on Nigeria, it assesses the qualifications of advisors and supervisors in Islamic financial institutions and examines their link to the issuance of fatwas. Gathering insights from 250 randomly selected Shariah scholars and students, the research employs structural equation modeling (SEM) for analysis. The reliability of survey responses was assessed using a 5-point Likert scale. The consistency of the data was verified using mean-variance extracted, composite reliability, and Cronbach's alpha. SEM was used to assess the relationship between scholars' qualifications and the issuance of fatwas. The results underscore the importance of attributes such as knowledge, piety, sincerity, honesty, and legal responsibility in the issuance of fatwas, reflecting broader concerns about fatwa shopping. The study's scope was limited to Nigeria, focusing on scholars' perceptions of fatwa shopping

Abstract

Islamic financial inclusion is the openness of providing access and use of a variety of convenient and affordable financial services by sharia. In supporting the realization of the Sharia financial inclusion target and the Indonesian Sharia Banking Development Roadmap (RPSI) for 2020-2025, Bank Syariah Indonesia strives for customer convenience and comfort by providing access to various products and services digitally. The research method uses a type of qualitative descriptive research with a library research method. The types of data used are primary data and secondary, primary data obtained from BSI's official website and result reports, secondary data obtained from other people's research, documentation data, and studies relevant to this study. The purpose of the study was to determine 1) the level of financial literacy index and Islamic financial inclusion index in Indonesia. 2) to recognize Bank Syariah Indonesia's efforts in seeking Sharia financial inclusion targets and the Indonesian Sharia Banking Development Roadmap (RPSI) for 2020-2025. The results showed that the level of Islamic financial literacy and inclusion index in 2022 increased to 9.14% and 12.12% from the previous 8.93% and 9.10%

Abstract

Indonesia is a country with the largest Muslim population in the world. However, since Islamic banks were established in Indonesia in about 20 years, the participation of Muslims in using Islamic banks is relatively low. The purpose of this study is to analyze and find out the impact of service innovation, reputation risk, and word of mouth on customer behavior in choosing Islamic banks as a place for financing, investing, and so on. The research method uses quantitative. with an experimental and survey approach. Probability sampling of 250 questionnaires distributed to customers throughout Indonesia. The research findings show that service innovation and reputation risk have good external validity to the culture of Indonesian society. The most interesting finding is that the word-of-mouth variable greatly increases customer intention and participation in choosing an Islamic bank. Therefore, this research recommends targeting community leaders or opinion leaders to explain Islamic banking to the whole community.
