Shautuna: Jurnal Imiah Mahasiswa Perbandingan Mazhab adalah jurnal akademik yang telah menerbitkan karya ilmiah sejak tahun 2013. Jurnal ini diterbitkan oleh Program Studi Perbandingan Madzhab dan Hukum, Fakultas Syariah dan Hukum, UIN Alauddin Makassar. Abstract

The rise of LGBT movements in Indonesia has caused public unrest and prompted the Indonesian Ulema Council (MUI) to issue Fatwa Number 57 of 2014 as a guideline in Islamic law. This article aims to analyze the legal foundations, scholarly views, and content of the MUI fatwa concerning LGBT issues. The method employed is library research using a normative-shar‘i approach, examining operational definitions, Qur’anic verses and hadiths, scholarly consensus (ijma‘), and the MUI fatwa in a descriptive-analytical manner. The results show that sihaq (lesbianism), liwath (sodomy/gay), and molestation are classified as abominable acts (fahishah) that are absolutely forbidden (haram) based on Surah al-A‘raf verses 80-81 and hadiths concerning the curse upon the people of Prophet Lut. Scholars unanimously agree (ijma‘) on this prohibition, although they differ regarding sanctions: the majority (including Imam Shafi‘i) prescribe the death penalty, while Imam Abu Hanifah maintains that the punishment is ta‘zir (discretionary punishment). MUI Fatwa Number 57 of 2014 affirms the prohibition of LGBT activities, the invalidity of same-sex marriage, and recommends severe penalties up to the death penalty for perpetrators of sodomy, alongside rehabilitation and prevention efforts. In conclusion, the MUI fatwa serves as a moral compass for Indonesian Muslims to safeguard public interest and national resilience against moral decadence.

Abstract

Chemotherapy, as a major therapeutic modality for cancer, frequently causes hair discoloration and alopecia, affecting approximately 60–65% of patients. Beyond physical consequences, these conditions often result in psychological distress, diminished self-esteem, social withdrawal, and even refusal to continue life-saving treatment. Contemporary Islamic legal opinions, particularly the Indonesian Council of Ulama (MUI) Fatwa No. 23 of 2012 concerning hair dye, have not specifically addressed this medical context, creating a normative gap (farāgh tashrī‘ī). This study examines the permissibility of applying rukhṣah (legal concession) for chemotherapy patients to dye their hair within the framework of Maqāṣid al-Sharīʿah. This study employed normative legal research based on library sources, utilizing a maqāṣid-oriented approach. Primary and secondary legal materials, including classical juristic opinions, contemporary fatwas, and medical literature on chemotherapy, were analyzed qualitatively through doctrinal and maqāṣidic analysis. The findings reveal that hair alterations resulting from chemotherapy constitute pathological conditions beyond the patient's volition. The effective cause (‘illah) underlying the prohibition of black hair dye, namely deception (khidā‘) concerning age or appearance, is absent in this context. Furthermore, the legal construction of rukhṣah can be established upon four principles: psychological self-preservation (ḥifẓ al-nafs), preservation of human dignity (ḥifẓ al-‘irḍ), elimination of hardship (raf‘ al-ḥaraj), and maṣlaḥah mursalah. The study concludes that chemotherapy patients may be granted a rukhṣah to dye their hair as a means of preserving psychological well-being and human dignity. Contemporary fatwas should therefore incorporate specific provisions addressing medical conditions experienced by patients. The novelty of this study lies in reconstructing the jurisprudential basis for hair dye permissibility through the integration of medical realities and Maqāṣid al-Sharīʿah.

Abstract

Marriage constitutes a fundamental constitutional right and serves as an essential institution for protecting family life. However, the legal status of interfaith marriage remains one of the most contested issues in Indonesian family law due to the absence of explicit statutory regulation and inconsistent judicial and administrative practices. This study examines the legal certainty surrounding the implementation and registration of interfaith marriages under Indonesia's national legal framework. Employing normative legal research, the study analyzes constitutional provisions, statutory regulations, judicial decisions, and relevant legal doctrines using statutory and conceptual approaches. The findings reveal that the absence of comprehensive legislation has created legal uncertainty regarding the procedures, requirements, and authorities responsible for registering interfaith marriages. Consequently, many couples resort to overseas marriages, unregistered marriages, religious conversion solely for administrative purposes, or litigation to obtain legal recognition. The fragmented regulatory framework has also generated inconsistent interpretations among marriage registrars and courts, undermining the constitutional principles of legal certainty, equality before the law, and protection of citizens' civil rights. This study argues that harmonizing marriage legislation with constitutional guarantees is essential to establish a clear, uniform, and legally certain registration system for interfaith marriages while balancing religious values and constitutional rights within Indonesia's pluralistic legal order.
