Abstract

Corruption constitutes an extraordinary crime that has serious implications for both national and regional development, as it causes substantial financial losses to the State and hinders public welfare. One of the most prevalent forms of corruption is the abuse of authority by public officials for the purpose of enriching themselves, other individuals, or corporations. This study aims to examine the criminal liability of perpetrators involved in the corruption of Regional Government Property in the form of the Toro Lema land assets located in Labuan Bajo Village, Komodo District, West Manggarai Regency, as adjudicated in Decision Number 25/Pid.Sus-TPK/2021/PT Kpg. The research employs a normative juridical method using statutory and case approaches through an analysis of relevant legislation and judicial decisions. The findings indicate that the defendant’s conduct fulfilled the constituent elements of corruption as stipulated in Article 2(1) and Article 3 of Law Number 31 of 1999 concerning the Eradication of Corruption Crimes, as amended by Law Number 20 of 2001. The court correctly applied the relevant legal provisions by taking into account the abuse of official authority that resulted in substantial financial losses to the State, thereby ensuring legal certainty while reinforcing Indonesia’s commitment to combating corruption.

Abstract

The enactment of the National Criminal Code under Law Number 1 of 2023 and the Criminal Procedure Code under Law Number 20 of 2025 marks a major reform of Indonesia's criminal justice system by reinforcing the position of advocates as equal law enforcement officers. Nevertheless, the effectiveness of these reforms is constrained by the fragmented structure of advocate organizations, which creates inconsistencies in professional standards, ethical enforcement, legal education, and institutional accountability. This study examines the urgency of reconstructing the regulation of advocate organizations to support the implementation of advocates' functions within the new criminal justice framework and proposes an institutional model that promotes professionalism, integrity, and legal certainty. The research applies a socio-legal approach with a dominant normative juridical method through library research, utilizing legislation, court decisions, books, and scientific journals as primary and secondary legal materials. The findings indicate that the current multi-bar system weakens professional standardization and ethical supervision, thereby reducing advocates' effectiveness in fulfilling their constitutional role. The study concludes that regulatory reconstruction is essential through an integrated institutional framework that standardizes professional education, strengthens ethical enforcement, and improves supervision while respecting the constitutional freedom of association. Such reform is expected to reinforce the advocate profession as an officium nobile and enhance justice, legal certainty, and the effectiveness of Indonesia's criminal justice system.

Abstract

The principle of fiduciary duty is an obligation that requires directors to manage the company in good faith, prudence, loyalty, and solely in the best interests of the company. In practice, directors who hold concurrent positions have the potential to create conflicts of interest that can reduce independence and increase the risk of violations of fiduciary obligations. This study aims to examine the legal regulations regarding the principle of fiduciary duty for directors who hold concurrent positions in limited liability companies and analyze the forms of fiduciary duty violations and their legal responsibilities based on Supreme Court Decision Number 1005 K/Pdt/2016. This study uses a normative legal research method. Legal materials are analyzed qualitatively through legal interpretation and legal reasoning. The results of the study indicate that in Supreme Court Decision Number 1005 K/Pdt/2016, the actions of directors who issue corporate guarantees without the approval of the Board of Commissioners are declared as a violation of the principle of fiduciary duty so that directors are held personally and jointly responsible for losses suffered by the company. This study concludes that it is necessary to strengthen legal regulations regarding fiduciary duty, clarify regulations regarding conflicts of interest due to dual positions, and implement the principles of good corporate governance more comprehensively to increase legal certainty, accountability in company management, and protection for shareholders and other stakeholders.

Abstract

The enactment of Government Regulation Number 56 of 2021 concerning the Management of Copyright Royalties for Songs and/or Music represents a significant step toward strengthening the protection of the economic rights of creators and copyright holders in Indonesia. However, its implementation has raised legal issues regarding the determination of royalty-paying business actors, overlapping royalty obligations, and the balance between copyright protection and business interests in the digital era. This study aims to analyze the legal framework governing music royalty collection, evaluate whether the current system reflects the principles of justice, legal certainty, and proportionality, and formulate a fair limitation of royalty-paying subjects. The research employs a normative juridical method supported by a socio-legal approach through statutory, conceptual, comparative, case, and socio-legal analyses. The findings indicate that the existing regulatory framework does not clearly classify commercial music users, creating legal uncertainty and the potential imposition of disproportionate royalty obligations on businesses that use music only as a supporting element of their activities. Accordingly, this study proposes a reformulated royalty system that classifies users into Primary Users and Secondary Users based on the extent of direct economic benefit obtained from musical works. This approach is expected to promote a more balanced, equitable, and proportionate royalty management system while ensuring effective copyright protection and supporting sustainable business activities.

Abstract

Land mafia practices in Indonesia have become a systemic phenomenon that threatens legal certainty and human rights. The contradiction between the principle of the rule of law and the vulnerability of old land title documents (Girik/Letter C) often triggers maladministration and abuse of authority by officials at the village and sub-district levels. Ideally, land governance should guarantee the protection of community rights by adhering to the General Principles of Good Governance (AAUPB), particularly the principles of accuracy and legality. This normative juridical legal research analyzes the legal implications of government maladministration in issuing invalid land transfer letters and evaluates the role of the State Administrative Court (PTUN) as an instrument for rights restoration. Through a statutory approach and case studies, it was found that the actions of officials who failed to verify documents legally fulfilled the elements of an unlawful act by the government (onrechtmatige overheidsdaad). The results of the study indicate that the PTUN plays a crucial role as a corrective and repressive instrument for victims. As reflected in Decision Number 533K/TUN/KI/2019, the judiciary is capable of restoring the rights of legitimate owners in full (restitutio in integrum). As a solution, strengthening administrative order and accelerating the digitization of land documents at the village level is necessary. This step is urgently needed to close the vulnerabilities exploited by land mafia networks to ensure legal certainty for the community.

Abstract

This research discusses the inheritance rights of children born from unregistered marriages (kawin siri) from the perspective of the Indonesian Civil Code (Kitab Undang-Undang Hukum Perdata) and the Compilation of Islamic Law (Kompilasi Hukum Islam). The focus of the study is directed at two issues: the legal status of children born from unregistered marriages and their inheritance rights under the two applicable legal frameworks. This study utilizes a normative legal research method with a qualitative approach, conducted through a literature review of the Civil Code, the Marriage Law, the Compilation of Islamic Law, the Constitutional Court Decision Number 46/PUU-VIII/2010, and relevant scientific literature. The results of the study indicate that children born from unregistered marriages are in a vulnerable legal position because their parents' marriage is not officially registered and is often difficult to prove. Under the Civil Code, a child can obtain legal status and inheritance opportunities if they can be proven to be a legitimate child or a legally recognized child born out of wedlock. Meanwhile, under the Compilation of Islamic Law, a child's inheritance rights from the father depend on proving a lineage (nasab) relationship that arises from a valid marriage. Consequently, a biological relationship alone is insufficient to establish inheritance rights; an acknowledged and provable legal relationship is strictly required.

Abstract

The presumption of innocence is a fundamental principle in the criminal justice system, ensuring that every individual is considered innocent until proven guilty by a legally binding court decision. However, the application of this principle faces serious challenges in cases of sexual violence, particularly when the victims are individuals with intellectual disabilities (tuna grahita) who experience double vulnerability, both physically, psychologically, and socially. This article aims to analyze how the presumption of innocence is implemented in law enforcement processes and the obstacles encountered when dealing with victims with intellectual disabilities. The research method used is normative juridical with statutory, conceptual, and case approaches. The findings indicate a tension between safeguarding the rights of suspects/defendants and the urgent need for maximum protection of vulnerable victims. The main challenges include limited legal accessibility, insufficient understanding of law enforcement officers regarding disability conditions, and the lack of evidence mechanisms sensitive to persons with intellectual disabilities. Therefore, more comprehensive legal policies are required to balance the presumption of innocence and victim protection principles, through regulatory strengthening, capacity building for law enforcement, and the provision of special assistance for victims with disabilities.

Abstract

Terjadinya tumpang tindih kewenangan penyitaan aset dalam perkara kepailitan dan perkara tindak pidana pencucian uang (TPPU) menimbulkan ketidakpastian hukum dalam praktik penegakan hukum di Indonesia. Di satu sisi, seluruh harta debitur yang dinyatakan pailit menjadi boedel pailit yang berada di bawah penguasaan kurator berdasarkan Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang. Di sisi lain, aparat penegak hukum memiliki kewenangan melakukan penyitaan terhadap aset yang diduga berasal dari tindak pidana berdasarkan Kitab Undang-Undang Hukum Acara Pidana dan Undang-Undang Nomor 8 Tahun 2010 tentang Pencegahan dan Pemberantasan Tindak Pidana Pencucian Uang. Kondisi tersebut menimbulkan konflik kewenangan, menghambat pemberesan harta pailit, serta berpotensi merugikan kreditor maupun kepentingan negara dalam pemberantasan kejahatan. Penelitian ini bertujuan untuk menganalisis pengaturan hukum mengenai penyitaan aset dalam perkara kepailitan dan tindak pidana pencucian uang, mengkaji faktor-faktor yang menyebabkan terjadinya ketidakpastian hukum, serta merumuskan konsep harmonisasi pengaturan yang mampu memberikan kepastian, keadilan, dan kemanfaatan hukum. Penelitian menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, pendekatan konseptual, pendekatan kasus, dan pendekatan perbandingan. Bahan hukum dianalisis secara kualitatif dengan menggunakan teori kepastian hukum, teori perlindungan hukum, dan teori keadilan. Hasil penelitian menunjukkan bahwa belum adanya pengaturan yang secara tegas mengatur prioritas kewenangan atas penyitaan aset antara rezim kepailitan dan rezim hukum pidana menyebabkan terjadinya disharmonisasi norma, perbedaan penafsiran, serta inkonsistensi dalam pelaksanaan putusan. Diperlukan harmonisasi regulasi melalui pengaturan yang lebih komprehensif mengenai koordinasi antarpenegak hukum dan kurator, mekanisme penentuan status aset, serta penegasan prioritas penyelesaian terhadap aset yang berasal dari hasil tindak pidana tanpa mengabaikan perlindungan hak kreditor yang beritikad baik. Harmonisasi tersebut diharapkan mampu mewujudkan kepastian hukum, efektivitas penegakan hukum, dan perlindungan terhadap seluruh pihak yang berkepentingan.

Abstract

An agreement to purchase land creates rights and responsibilities for both parties. The seller has the obligation to deliver the land, while the buyer must pay the agreed amount. In practice, sellers often unilaterally cancel land purchase agreements, even though the buyer has made installment payments. This situation raises legal issues regarding legal certainty, protection for good-faith buyers, and the application of the principle of pacta sunt servanda in contract law. This study aims to analyze whether the cancellation of a land purchase agreement by the seller after installment payments have been made is legally valid, as well as to examine the legal consequences for both parties. The method used is normative legal research with a statutory approach and a conceptual approach, analyzing the Civil Code, relevant land regulations, as well as related theories and court decisions. The results of the study indicate that if a seller cancels a land purchase agreement without a valid reason based on the contract or the law, such action is impermissible. This cancellation can be considered a breach of contract (wanprestasi), requiring the seller to pay damages and granting the buyer the right to demand the execution of the agreement or its cancellation through a court decision. Therefore, it is crucial to provide legal protection to buyers who have paid in installments to ensure legal certainty and justice for all parties.

Abstract

An agreement to purchase land creates rights and responsibilities for both Bullying is a negative act repeatedly committed by a group of people with the intent to cause harm. It is not limited to physical actions; bullying manifests in various forms, ranging from cyberbullying and sexual harassment to verbal abuse. If not properly addressed, these actions can have negative consequences for the victims. Bullying is an intentional act designed to harm others physically, verbally, or emotionally. This phenomenon resembles an iceberg; many victims are reluctant to report it, and some members of society still dismiss it as mere joking. Data from the Indonesian Child Protection Commission (KPAI) and the Indonesian Education Monitoring Network (JPPI) indicate a sharp rise in cases of violence against children in 2024—an increase of over 100% compared to 2023. Emotional education is a learning process that helps individuals recognize, understand, manage, and express their own emotions as well as those of others in a healthy manner. Its goal is to foster self-awareness, self-control, empathy, and social skills—enabling individuals to build healthy relationships, make responsible decisions, and achieve emotional well-being. Relevant legal frameworks include Law Number 23 of 2002 concerning Child Protection (subsequently amended by Law Number 35 of 2014 and Law Number 17 of 2016), Law Number 12 of 2022 concerning the Crime of Sexual Violence (TPKS), and the Criminal Code (KUHP) Chapter XXIII regarding Extortion and Threats (Article 368 paragraph 1). This study employs both normative-juridical and empirical-juridical approaches, utilizing literature reviews and secondary data analysis. The research focuses on addressing bullying cases through emotional education.
