Abstract

Mineral and coal mining activities in Indonesia frequently leave serious environmental problems, particularly regarding the failure to implement post-mining reclamation. Although regulations strictly govern this obligation, field realities show inconsistency on the part of the government in supervision and law enforcement, opening loopholes for corporations to neglect land rehabilitation obligations. This article aims to (1) map the pattern of law enforcement applied to violations of post-mining reclamation obligations, (2) identify the factors causing weak professionalism and consistency of officials in carrying out supervisory functions, and (3) formulate an ideal law enforcement reconstruction model. This study employs a Socio-Legal Studies approach combined with a Systematic Literature Review (SLR) of primary, secondary, and tertiary legal materials. The findings indicate that law enforcement of reclamation obligations remains partial and selective, influenced by overlapping central-regional authority, weak deterrent effects of administrative sanctions, and limited transparency in the Reclamation Guarantee (Jamrek) mechanism. As a contribution, this article proposes a "Consistent-Restorative" law enforcement model that integrates administrative legal certainty with restorative justice principles and public participation as a check-and-balance mechanism.

Abstract

This study aims to analyze the legal framework governing the application of choice of law in international business contracts between Indonesian business actors and foreign partners, identify the juridical obstacles encountered in its implementation, and formulate an ideal legal framework capable of ensuring legal certainty, justice, and legal utility. This research employs a normative legal research method using statutory, conceptual, comparative, and case approaches. The legal materials consist of primary legal sources, including the Indonesian Civil Code, Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution, as well as international legal instruments such as the UNIDROIT Principles of International Commercial Contracts, the Hague Principles on Choice of Law in International Commercial Contracts 2015, and the Convention on the Recognition and Enforcement of Foreign Arbitral Awards 1958 (New York Convention). Secondary legal materials include legal textbooks, scientific journals, previous research, and scholarly opinions. The collected legal materials are analyzed qualitatively using a descriptive-analytical approach. The findings reveal that the application of choice of law in international business contracts reflects the principle of freedom of contract and has been widely accepted in international commercial practice. Nevertheless, its implementation in Indonesia continues to face significant challenges, including the absence of a codified Private International Law, the lack of explicit regulations governing the limitations of choice of law, and the continued reliance on legal doctrines, judicial precedents, and the principle of public policy. This study proposes the reconstruction of Indonesia’s legal framework through the enactment of a comprehensive Private International Law Act regulating choice of law, choice of forum, the recognition and enforcement of foreign judgments and arbitral awards, and harmonization with internationally accepted principles of commercial law.

Abstract

As a developing nation where prosperity is not yet evenly distributed, Indonesia has an obligation to ensure the health of its citizens; consequently, the state established a health insurance program to guarantee healthcare for the entire population. This initiative aims to realize public welfare through a Social Security System (SSS), designed to provide a sense of security throughout a person’s life from birth to death. In 2014, the government implemented a universal health insurance policy known as the Social Security Agency for Health (BPJS Kesehatan), regulated by Law Number 24 of 2011 concerning the Social Security Agency (BPJS). Physicians affiliated with “Dokter Indonesia Bersatu” (DIB) have discussed the detrimental aspects of the BPJS program; these issues have significantly impacted hospitals’ ability to provide optimal patient care, leading to instances where patients under the BPJS program have been refused service in West Java. Conflicts have arisen between hospital administrations and BPJS due to ineffective collaboration. This thesis examines three key issues: the nature of the partnership between hospitals and BPJS; legal protections for hospitals regarding BPJS’s failure to settle payments for patient healthcare services; and the legal avenues available to hospitals should BPJS fail to make such payments. The study employs an empirical juridical legal research method, utilizing primary, secondary, and tertiary legal materials. It adopts both statutory and socio-juridical approaches, gathering data through fieldwork and literature reviews. Data processing involves editing and coding, followed by quantitative descriptive analysis and the drawing of conclusions via the inductive method.

Abstract

The purpose of this research is to analyze the Criminal Law Policy Against Persecution from a Restorative Justice and Human Rights Perspective in Indonesia and to identify the obstacles encountered in its implementation in Indonesia. The method used in this research is normative juridical research, namely examining laws and regulations, legal norms, and legal theory, and carefully observing how these laws are implemented and their impact on society. Furthermore, at the beginning of the research, the author conducted an inventory of positive law, which is a fundamental preliminary activity for conducting legal research. The research results show that the crime of persecution has not been regulated as a stand-alone offense in Law Number 1 of 2023 concerning the Criminal Code, so law enforcement still uses existing criminal provisions in accordance with the elements of the act. Furthermore, resolving the crime of persecution through a restorative justice approach is more effective in achieving case resolution through an admission of guilt by the perpetrator, an apology, restitution of the victim's losses, and reconciliation between the parties, thus providing justice, legal certainty, and benefits, without neglecting the protection of human rights.

Abstract

This study analyses the role of the Jayapura City Land Office, particularly its Dispute Control and Handling Section, in resolving overlapping land ownership certificate disputes under Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency (ATR/BPN) Regulation Number 21 of 2020. Using an empirical juridical approach that combines structured interviews and observation with a review of primary, secondary, and tertiary legal materials, the study is descriptive-qualitative in nature. The results show that overlapping certificates in Jayapura City are mainly caused by inaccurate manual land measurement, old certificates that have not been digitally mapped, and errors made by landholders in indicating boundaries. Case handling follows a structured administrative sequence consisting of complaint registration, internal case exposure, field verification, summoning of the parties, and mediation, which has resolved twelve cases without recourse to litigation. Obstacles include differing perceptions among disputing parties, the absence of parties who reside far from Jayapura, and limited integration of land data. The Land Office responds through repeated mediation invitations, community outreach, mediator capacity-building, and digital transformation of land records, while upholding the mediation principles of peace, willingness, justice, deliberation, and mutual benefit.

Abstract

This study aims to analyze the implementation of Pancasila values in Indonesian law-making following the enactment of Law Number 13 of 2022 on the Second Amendment to Law Number 12 of 2011 on the Formation of Laws and Regulations, as well as to identify obstacles and efforts to strengthen its application in the legislative process. This study employs a normative juridical method with statutory, conceptual, and historical approaches. Research data were obtained through literature review and documentation of legal materials, and data analysis was conducted through a qualitative-juridical approach comprising data reduction, classification, interpretation, and synchronization stages to evaluate the alignment of both the process and substance of law-making with Pancasila values. The results indicate that the implementation of Pancasila values can be analyzed through philosophical, procedural, and substantive aspects. Philosophically, Pancasila remains positioned as the source of all sources of state law. Procedural aspect shows that strengthening public participation and applying the omnibus method have become crucial parts of reforming the legislative mechanism. Substantively, laws and regulations must reflect the values of divinity, humanity, unity, democracy, and social justice. However, its implementation still faces obstacles, including the dominance of political interests, sub-optimal public participation, the complexity of the omnibus method, limitations in human resource quality, and the diversity of public interests. Therefore, it is necessary to strengthen Pancasila as a substantive parameter, enhance public participation, increase the professionalism of lawmakers, and conduct regulatory evaluation and supervision.

Abstract

The technological developments of the Industry 4.0 era have brought transformations to the implementation of mining activities, including gold mining. The utilization of Artificial Intelligence, the Internet of Things, Big Data, Remote Sensing, Geographic Information Systems, and digital monitoring systems provides opportunities to enhance the effectiveness of mining management and supervision. However, these developments also pose legal challenges regarding licensing, supervision, data integration, transparency, environmental protection, and legal liability. This study aims to analyze mining law policies in regulating and supervising gold mining activities in the Industry 4.0 era, as well as to analyze the ideal direction of legal policy in utilizing technology to achieve effective, transparent, sustainable, and environmentally sound mining management. This study employs a normative juridical method with statutory, conceptual, and policy approaches. Primary, secondary, and tertiary legal materials are analyzed through a qualitative-juridical approach using descriptive-analytical and prescriptive methods. The results indicate that Indonesian mining policy has geared toward the digitalization of governance and supervision through the MODI, MOMS, MOMI, e-PNBP, and MinerbaOne systems. However, obstacles persist, such as sub-optimal data integration and validation, information security issues, and regulatory limitations in accommodating technological developments. Therefore, adaptive legal policies are required through integrated data-based governance, the utilization of digital technology, the strengthening of preventive and predictive supervision, transparency, public participation, and environmental protection.

Abstract

Pertumbuhan perdagangan digital dan e-commerce global telah merekonstruksi pola hubungan ekonomi internasional sekaligus menciptakan kerentanan baru terhadap perlindungan Hak Asasi Manusia (HAM). Data pribadi pengguna telah berubah menjadi komoditas strategis yang bernilai ekonomi tinggi, namun pada saat yang sama membuka peluang pelanggaran privasi, penyalahgunaan data, diskriminasi algoritmik, serta eksploitasi pekerja platform. Kesenjangan normatif muncul antara rezim perdagangan digital yang berorientasi liberalisasi pasar dengan rezim HAM yang menempatkan martabat manusia sebagai pusat perlindungan hukum. Penelitian ini bertujuan untuk: (1) menganalisis integrasi prinsip HAM dalam regulasi perdagangan digital internasional berdasarkan ICCPR dan GDPR; (2) membandingkan efektivitas kebijakan Indonesia, Singapura, dan Thailand; serta (3) merumuskan model harmonisasi hukum ASEAN yang berperspektif HAM. Metode yang digunakan adalah penelitian yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan komparatif. Hasil penelitian menunjukkan bahwa arsitektur hukum ASEAN melalui ASEAN Agreement on Electronic Commerce masih menitikberatkan fasilitasi transaksi dan belum mengintegrasikan kewajiban HAM secara eksplisit. Terdapat disparitas standar perlindungan data antarnegara yang berpotensi menciptakan safe haven pelanggaran lintas batas. Penelitian merekomendasikan pembentukan ASEAN Digital Rights Framework, kewajiban akuntabilitas algoritma, serta penguatan otoritas perlindungan data independen guna memastikan pertumbuhan ekonomi digital tetap sejalan dengan kewajiban negara berdasarkan ICCPR.
