Abstract

Socio-economic problems in society demand something new in achieving a more prosperous standard of living. Cash waqf has a big role in solving the problems of contemporary society. However, normatively, cash waqf is still being debated among fiqh experts, especially the Syafiiyyah school of thought, which tends to see waqf as the spirit of the immortality of objects, not benefits. This is certainly a problem for people affiliated with this school. However, positive law provides fresh air for the validity of cash waqf through Law Number 41 of 2004 concerning Waqf and Government Regulation Number 42 of 2006 concerning Implementation of Law No. 41 of 2004 concerning Waqf. In addition, the economic value of cash waqf has required the implementation of this cash waqf in order to spur economic activities of the people with religious and socio-economic dimensions for the realization of people's welfare.

Abstract

This article deals with the shadow education system of private tutoring which contributes to the reproduction of social class inequalities, focusing on the Greek public secondary education system. It presents a literature review of the issue and the findings of an empirical qualitative and quantitative research that aimed at examining the causes of the students’ massive resort to private supplementary tutoring for learning the English language, despite the fact that English is taught at school. The study also set out to examine the relationship between students’ socioeconomic background and resort to private supplementary tutoring and the relationship between socioeconomic background and knowledge of the English language as attested by official certifications. Research findings indicate that the widely spread resort to private supplementary tutoring has a negative impact on the teaching of English in Greek public lower secondary education. Using Bourdieu’s cultural reproduction theory, we argue that private supplementary tutoring makes closer the relationship between social class, familial cultural and economic capital and educational outcomes. Thus, upper and middle-class students are at an advantage, since they can move to the labour market with valued educational qualifications that enhance their occupational prospects. Finally, we discuss educational measures to address the problem.

Abstract

The economic context may have modified the relationship between higher education and the labour market. The rise in university fees, the labour market situation and the behaviour of employers, families and students could activate social background as a differentiating factor in post-higher education occupational status. The objective of the present study is to analyze if the social origin affects the labor insertion of the graduates, measured through their income. The labor insertion of graduates is analyzed in 2011 (crisis period) and compared with 2005 (period of economic expansion). Two Spanish databases are used in this analysis: the 2005 and 2011 Living Conditions Survey. The results presented show no income inequality related to social class of graduates. Between 2005 and 2011 most unskilled occupations suffered job destruction, thus homogenizing to some extent the graduates who were working in 2011 and reducing the internal differences.

Abstract

This paper discusses Emile Durkheim's thoughts as a figure in early legal sociology studies, and their contextualization in Indonesian reality. Durkheim in his theory divides society into two types, simple and modern. Simple society is characterized by streamlined work differentiation, mechanical social solidarity, and repressive types of laws. Meanwhile, modern society is characterized by an increasingly diverse and specific division of labor, organic solidarity and restitutive legal types. In the Indonesian context, the New Order era was an era of economic development that was full of issues of industrialization, law was used as a tool of social engineering and served for practical purposes, the volume of regulations increased until there was what Susskind called hyperregulation. Another issue is the legal unification project, this project is powerless because it has to deal with local legal forces inherent in society. This kind of legal condition shows the social condition of a society that still upholds collective spirit or awareness, a characteristic of a simple society in Durkheim's perspective of thought. but on the other hand, the need for and the applicability of positive law nationally along with the development of society as well as the development of legal institutions and professions, can be used as a reflection of the characteristics of modern society in the perspective of Durkheim's thought. The two categories of law and society that Durkheim theorized were in one container, namely Indonesian law and society, a uniqueness as well as a criticism of Durkheim's theory.
